4 TERMS & CONDITONS 1. The bidder must have have experience in similar nature of work during last 02 years and must submit Experience Certificate as well as satisfactory completion/ performance certificate issued by authorized officials of any Govt./ PSU/ Generating units. The bidder shall have to produce registration certificate, Trade License, Enlistment,,duly attested The Bidder must submit Tax Clearance Certificate of current validity issued by the competent Authority The Bidder must submit Xerox copy of PAN Card.The bidder must submit their ADDRESS 2. Period of completion: - 30(Thirty) days from the date of issue of LOA. Failing to complete the supply in the stipulated period, for each extra weeks deduction will be 0.5 % subject to maximum of 10 % of the Contract Value. 3. The rate should be quoted both in words and figures The rate must be quoted with detail Breakup of all taxes & duties F.O.R. Rokhia. 4. The quoted rate shall be valid for period of 90(ninety) days from the date of opening of the bid. 5. The bidder must quote their rates inclusive of all charges,. 6. The rate quoted shall be firm. 7. The bidder shall have to submit the amount of Earnest Money as stipulated in the shape of Demand draft from any Nationalised Bank in favour of Deputy General Manager, Gas Thermal Electrical Division, Rokhia, payable at SBI, Bishalgarh, along with the bid. 10 Payment will be made by the Deputy General Manager, GTED, Rokhia after successful completion of the work. No advance payment will be made in any circumstances. NO PART PAYMENT WILL BE MADE FOR PART SUPPLY. Taxes as applicable, shall be deducted at source. 11. LOA may be issued to one or more bidders as per item wise LI rate basis instead of gross items, if necessary. Further, quantity may vary +/- as per requirement at time. Further, LOA will be issued to qualified bidders in phase manner to ensure quality of the items. Quality will be judged by the span of respective items in compare to the exhaust items average life. If it is satisfactory, 2 nd phase of LOA will be issued. In this regard, DGM will be the sole Power to decide the matter. 12. The Tender shall be submitted in sealed envelope properly superscribing NIT No. Name of work, and due date of opening. 13. The successful bidder shall have to sign a formal agreement and be required to furnish a contract performance 10 % of the total contract price in the shape of demand draft in favour of Deputy General Manager, Gas Thermal Electrical Division, Rokhia, payable at SBI, Bishalgarh, within 07 (Seven) days from the date of issue of LOA 14. The successful bidder shall have to submit an INDEMNITY BOND as per TSECL format on a Non-Judicial Stamp Paper value of Rs.30/- only. 3.

The Earnest Money may be forfeited a. if a bidder withdraws the bid during the period of validity specified b. if the bidder fails to Submit the contract performance Guarantee and to sign the formal Agreement. 16. The contract performance guarantee shall be forfeited if the bidder fails to execute the work successfully in scheduled period of completion 17 The Bid shall be submitted in 2 (Two) parts in separate sealed envelopes properly super scribing NIT No., name of work, and bid opening date containing in 1(One) as follows: Part-I: Pre Qualification Bid Containing Bid earnest money as per the stipulations of the Bid Documents in a separate sealed envelope, and cost of Tender Documents separately, if downloaded, in the shape of Demand Draft from any Nationalised Bank, in favour of Deputy General Manager, Gas thermal Electrical Division, Rokhia, payable at State Bank Of India, Bishalgarh Branch. The Bid will be rejected without cost of Tender Documents, if downloaded. Containing Documentary Evidence of the Bidder fulfilling the Qualifying Requirements stipulated in the NIT. The document to be submitted shall include copies of the relevant work order / Award letters / Agreements etc. and corresponding completion certificates issued by the concerned clients. The bidder shall also submit professional tax clearance certificate and all such other documents deemed necessary in support of their meeting the stipulated qualifying requirements and its credentials without which the quotation will be rejected. Part-II: Price Bid 1. The Price should be quoted based on F.O.R. Rokhia basis. 2. The price Bid should be quoted both in words and figures in the schedule of work of the Bidding Document. T.VAT, as applicable shall be deducted at source as per norms. 18. The quoted rate would be fixed during the period of contract. 19. In case of any dispute, the decision of the Tripura State Electricity Corporation Authority shall be final and binding ARBITRATION 1. All disputes or differences in respect of which the decision, if any, of the Engineer has not become final or binding as aforesaid shall be settled by arbitration in the manner hereinafter provided. 2. The arbitration shall be conducted by an arbitrator, to be nominated by TSECL and he will be the sole arbitrator to conduct the arbitration. 3. The arbitration shall be conducted in accordance with the provisions of Arbitration & Reconciliation Act, 1996 or any statutory modification thereof. The venue of Arbitration shall be at Agartala. 4. The arbitrators may, from time to time with the consent of all the parties enlarge the time for making the award. 4.

The arbitrator shall have full powers to review and/or revise any, decision, opinion, direction, certification or valuation of the Engineer in accordance with the Contract, and neither party shall be limited in the proceedings before such arbitrators to the condense or arguments out before the Engineer for the purpose of obtaining the said decision. 6. During settlement of disputes and arbitration proceedings, both parties shall be obliged to carry out their respective obligations under the Contract 21.. Tender will be received at the office of the Addl. General Manager, Generation Circle Bidyut Bhavan, TSECL, Agartala and at Gas Thermal Electrical Division, Rokhia, Sepahijala, Tripura upto 3.00 PM on the day fixed for receiving. The bid will be opened on the next working day at 3.00 PM, if possible, in presence of the intending Tenderers. If the date fixed for opening will be declared holiday or remain closed, the bid will be opened on the next working day with same terms and conditions. 22. The bidding documents are not transferable and cost of bidding documents is not refundable under any circumstances The Tender Form shall be signed by the tenderer/ bidder on al pages. All Corrections to rates and items in the bid should be initialed by the bidder Any bid received after the time and date fixed for submission of bid shall be rejected.
