15 PERMISSION TO ENTER MALAYSIA Every person entering Malaysia from any place beyond Malaysia shall produce to an immigration officer a passport; and that passport shall, in case of non-citizen, have a valid visa for Malaysia issued on the authority of and by or on behalf of the Government of Malaysia.

16 Any Foreign National who wishes to study in Malaysia is required to obtain a Student Pass. Application has to be made through the respective Educational Institution prior entry. A VISA is prior approval endorsed in the Passport or Travel Document (presently in the form of sticker) of any foreigner permitting the holder to enter Malaysia.

17 Types of Visa The Malaysian Government issues Three (3) types of visas to foreign nationals: 1. Single Entry Visa This is issued to foreign nationals who require a visa to enter Malaysia mainly for a social visit. It is normally valid for a single entry and for a period of three (3) months from the date of issue. 2. Multiple Entry Visa This is issued to foreign nationals who require a visa to enter Malaysia mainly for business or government-to-government matters. It is normally valid for a period within three (3) months to twelve (12) months from the date of issue. Citizens of India and the People's Republic of China who wish to enter Malaysia for the purpose of a Social Visit are eligible to apply for the Multiple Entry Visa. The validity of the Multiple Entry Visa is one (1) year. Each entry is for 30 days only and the extension of stay is not allowed. Conditions for the Multiple Entry Visa are: The applicant must show proof of sufficient funds for staying in Malaysia The applicant must possess a valid and confirmed return ticket Tour groups are not eligible to apply for Multiple Entry Visa. The Multiple Entry Visa costs RM for Indian Citizens and RM30.00 for citizens of the People's Republic of China. 3. Transit Visa This is issued to foreign nationals who require a visa to enter Malaysia on transit to other countries. Foreign nationals on transit without leaving the airport premises and who continue their journey to the next destination with the same flight do not require a transit visa.

21 Permission to work part-time A student is permitted to do part-time work for 20 hours per week during semester breaks or any holiday exceeding 7 days. A student is permitted to work part-time in Restaurants, Petrol Kiosks, Mini Markets and Hotels only (excluding singer, masseur, musician, GRO and other activities deemed immoral) as long as the student pass remains valid. Students are not permitted to work as cashier. Permission to work part-time is extendable by the Immigration Department depending on the student s attendance and academic reports. Application from students studying in Private Higher Educational Institutions must be submitted by the respective institutions to the Immigration headquarters in Putrajaya; while or students from Public Higher Educational Institutions to the nearest Immigration Office.

24 LOSS OF PASSPORT/TRAVEL DOCUMENTS 1. Necessary Steps to take : i. Surrender immediately to the Enforcement Division, Immigration Department of Malaysia; ii. Bring along items as per checklist iii. Do not use the service of middlemen or agents; iv. Give full cooperation during the investigation and recording of statements by an Immigration Officer. 2. Requirements Checklist When dealing with the Malaysian Immigration Enforcement Division, please bring along the original documents and copies of the following: i. Passport number / copy of the lost passport / travel document; ii. New Passport / Travel Document; iii.police report; iv.plane / bus / ferry ticket (depart within 7 days) 3. Additional Requirements: i. Any evidence of entry (land passes/tickets/list of passengers); ii. Certificate from the Embassy; iii.copy of pass / previous document (if any); iv.memo reference from the BPA/BPP/VPP/MIDA (if applicable). 4. 26 VIOLATION OF CONDITIONS STIPULATED IN THE PASS/PERMIT 1. Working or Undertaking Activities That Are Contrary To the Conditions of the Issuance of a Pass or Permit Rule 39(b) Immigration Regulations Offence: Breach of the pass, permit or border passes conditions 3. Penalty: Upon conviction punishable by a fine not exceeding RM1, 000 or imprisonment not exceeding six months or both.

27 Staying In Malaysia Beyond The Approved Period Staying in Malaysia beyond the period allowed is a violation of section 15(1)(c) of the Immigration Act 1959/63, an offence under section 15(4) of the Act. 1. Requirements Checklist When dealing with the Malaysia Immigration Enforcement Division, please bring along the originals and copies of the following documents: i. Passport / travel document (all pages are intact); ii. Police report (in the case of lost passport); iii. Any evidence of overstaying; iv. Plane / bus / ferry ticket (depart within 7 days) 2. Offence: Section 15 (1) (c) Immigration Act 1959/63 (Act 155). Living in Malaysia after a pass / permit has expired or revoked. 3. Penalty Section 15 (4) of the Immigration Act 1959/63 (Act 155) provides a fine of not less than RM10,000 or imprisonment not exceeding 5 years or both. Compound Compounding is an alternative punishment for the offence. It is made under the Immigration Regulations (Compounding Offences) 2003 in accordance with the powers conferred by section 54 of the Immigration Act 1959/63 (Act 155).

28 YOU DO NOT HAVE A VALID PASS OR PERMIT TO STAY IN MALAYSIA Living and staying in Malaysia without a valid pass or permit is an offence under section 6(3) of the Immigration Act 1959/63 (Act 155). It is a violation of section 6(1)(c) of the Act. Necessary Steps to take: i. Surrender immediately to the Enforcement Division, Immigration Department of Malaysia; ii. Do not use the service of middlemen or agents; iii. Give full cooperation during the investigation and recording of statements by an Immigration Officer. Offence: Section 6(3) Immigration Act 1959/63 (Act 155). Living in Malaysia (for non- Malaysian citizens) without a valid pass or permit is a criminal offence. Penalty Upon conviction, punishable by a fine of not more than RM10,000 or imprisonment not exceeding five years or both and shall also be liable to whipping of not more than 6 strokes.

29 Offences Frequently Committed by Foreigners 1. Illegal Entry Section 6(3) Immigration Act 1959/63 a. A foreigner whose presence in Malaysia can be interpreted as illegal entry if : Fails to produce a genuine passport/travel document/entry permit upon request. Passport/travel document does not have a valid endorsement/pass b. The penalty for an offence on illegal entry: A fine not exceeding RM10,000 or to imprisonment for a term not exceeding 5 years or both and shall also liable to whipping of not more than six strokes. A compound of RM3, c. As such foreign visitors are reminded :- To take precaution on the safety of their passport/travel document and must carry with them during their stay in Malaysia. Must ascertain that they produced their passport/travel document to an Immigration officer at the point of entry and has been issued with the relevant pass. To report immediately to the Immigration Department for the lost of their passport/travel document. 2. Overstaying Section 15(4) Immigration Act 1959/63 a. Stay exceeding the expiry date/cancellation of visit pass. b. The penalty for an offence on overstaying :- A fine not exceeding RM10,000 or to imprisonment for a term not exceeding 5 years or both A compound of RM3, As such foreign visitors are reminded to leave Malaysia before their pass expired.

30 3. Make, Falsify Or Amend A Document Or Endorsement Penalties A. Section 55D of the Immigration Act 1959/63 (Act 155) 1. A fine of not less than RM30, 000 and imprisonment of not less than 5 years but not more than 10 years and shall also be liable to whipping of not more than 6 strokes. 2. Any person who makes any false documents: i. intends to avail itself or by any person; ii. used by itself or by any other person; as a passport for the purposes of this Act (Passports Act 1966 Act 150) is a violation of section 12B of the Passports Act 1966 (Act 150). Penalties B. Section 12B of the Passports Act 1966 (Act 150) A fine of not less than RM15, 000 but not more than RM100, 000 and imprisonment of not less than 2 years but not more than 10 years and with whipping of not more than 6 strokes of rattan.
