3 Agenda No. 79 A Issues on Cluster Mines and mine dump waste management. The Committee discussed on issues on cluster mines and their waste dump management plans. The Committee after detailed discussions recommended the following resolutions: A. Resolution on issues of cluster mines: Issues related to issue of individual Environmental Clearances (EC) to the Mines located in the Cluster. 1. The Committee discussed at length the methodology to be adopted in the case of issue of Environmental Clearance (EC) for the mining projects located in the cluster. In the absence of any specific guidelines from the Govt. of India, MoEF & CC,New Delhi, on the issue of Environmental Clearance to the mines falling in the clusters, and in view of the large number of pending applications over the past one year, the SEAC, AP recommends that all such mines to be individually considered for issuing of Environmental Clearance based on their merits and with a general condition that all such proponents shall mandatorily follow the conditions that may be prescribed in due course by the MoEF & CC, New Delhi with respect to cluster mines. 2. In view of the above, the following are the recommendations: a. To consider the issue of Environmental Clearance in respect of every mining project individually. b. To issue Environmental Clearance to the eligible mining projects as per the existing criteria and legal aspects. c. To advise the Project Proponent to submit an affidavit on a Non Judicial Stamp Paper with the undertaking on the following: i. That he / she / they / it will follow and abide by any conditions which may be levied in future in respect of operation of cluster of mines by MoEF & CC, Govt. of India / SEIAA, Andhra Pradesh. ii. To abide by any Rules, Regulations, Bye laws made there under from time to time in respect of operation of cluster of mines. iii. Their operational methodology adopted for the implementation of conditions of Environmental Clearance will not be contrary to the existing statutes. B. Resolution on management and supervision of waste dumps in Chimakurthy cluster & other similar operating clusters. The Committee noted that there are issues on dump areas in Chimakurthy Clusters, Prakasam District and resolved to recommend to SEIAA,A.P to issue necessary instructions to Director of Mines to take appropriate measures in identification of areas for waste dumps and to monitor proper management of dum ps. Hence, the earlier application for EC with production capacity 6174 m3/annum is recommended for issue of EC on the basis of the resolution made by the SEAC,A.P on cluster issue and also on resolution passed on management of the dump areas in the Chimakurthy Cluster area and other similar operating cluster areas. As there was no environmental clearance issued earlier and also the enhanced quantities of production for which the current environmental clearance is applied for, is not conforming with that of the mining plan, the present application filed in July, 2015 cannot be considered Ha. of M/s.
