1 Cielo Fernandez Ortega Chief Program Officer OUR HISTORY El Centro was established in 1976 with receipt of a $10,000 grant from the Archdioceses of Kansas City, Kansas, along with the hard work of Father Ramon Gaitan and the commitment of the Cordi Marian Sisters. They saw a need for an organization to address the needs and concerns of Kansas City, Kansas Latino population. With that monetary and compassionate commitment, El Centro de Servicios para Hispanos was born. OUR MISSION Strengthening communities and improving lives of Latinos and others through educational, social, and economic opportunities. 1

3 LARGEST METRO AREAS HISPANIC POPULATION The Greater Kansas City Metro area is 45th among the 60 largest metro areas in the United States. Total Hispanic Population in the Greater Kansas City Metro is 168,000, representing 9% of the total population Median age is 25 38% are Foreign-Born 69% are Citizens 50% Own Homes PEW Hispanic Center "Characteristics of the 60 Largest Metro Areas by Hispanic Population 9/19/2012 ECI1 Hispanic v Latino Even though both are used interchangeably, there is a distinct difference between Hispanic and Latino. Hispanic is a term originally denoting a relationship to ancient Hispania (Iberian Peninsula). Now it relates to the contemporary nation of Spain and its history and culture. A native of Spain residing in the United States is a Hispanic. Latino refers more exclusively to persons or communities of Latin American origin. While there is a significant overlap between the groups, Brazilians are a good examples of Latinos who are not Hispanic (they speak Portuguese). Who speaks Spanish? By 2015, 437 million people speak Spanish as a native language And approx. 517 millions total Spanish speakers 3
4 LATINO AMERICA Collecting Race/Ethnicity Data Federal Requirements for Schools Since 2008 School Districts must collect data via a two-part question format (respondents answer BOTH parts): PART A: Are you Hispanic/Latino or of Spanish origin? PART B: Select one or more races from the following racial groups: American Indian or Alaska Native Asian Black or African American Native Hawaiian or Other Pacific Islander White Examples Added to Part B to Help Respondents: Part B: What is the student s race? (Choose one or more) American Indian or Alaska Native A person having origins in any of the original peoples of North America, including Mexico, South America, and Central America, and who maintains tribal affiliation or community attachment. Examples: Azteca, Zapotec, Maya, Nahua, Aymara, Kichwa, Lakota, Navajo, Guarani. Asian A person having origins in any of the original peoples of the Far East, Southeast Asia, or the Indian subcontinent including the peoples of Cambodia, China, India, Japan, Korea, Malaysia, Pakistan, the Philippine Islands, Thailand, and Vietnam. 8 LA NUEVA ESPAÑA 1800 ESTADOS UNIDOS MEXICANOS 1820S MANIFEST DESTINY Is a term for the prevalent attitude during the 19th century period of American expansion that the United States was destined to stretch from coast-to-coast, as those in Congress and the White House believed it was our Divine Right. As the United States was only as far west as the Mississippi River, this necessitated the push westward including Native American removal from ancient lands to resettlement in lands that were unwanted by the contemporary settlers, along with war with Mexico in the 1840s. The phrase was first employed by John L. O Sullivan in an article on the annexation of Texas published in the July-August 1845 edition of the United States Magazine and Democratic Review, which he edited.
9 It was, O Sullivan claimed, our manifest destiny to overspread the continent allotted by Providence for the free development of our yearly multiplying millions. The term and the concept were taken up by those desiring to secure Oregon Territory, California, Mexican land in the Southwest, and, in the 1850s, Cuba. By the end of the century, expansionists were employing quasi-darwinist reasoning to argue that because its Anglo-Saxon heritage made America supremely fit, it had become the nation s manifest destiny to extend its influence beyond its continental boundaries into the Pacific and Caribbean basins NATIONAL LANDSCAPE: Immigration Policy in Trump era LOCAL/STATE ENFORCEMENT INTERFERENCE Federal funding tied to banning of Sanctuary Cities. (Congressional Authority needed) Increased cooperation between Local & State law enforcement and ICE 287g/Secure Communities on steroids (No congressional authority needed to enter into MOUs with cities/counties and law enforcement entities). Forcing State/Local Police to ask for immigration status during all lawful stops (Congressional Authority Needed) Or implement reasonable suspicion standard Trump has supported Stop and Frisk
10 BORDER ENFORCEMENT Increased surveillance & Militarized border Border wall, drones, cameras, sensors, more CBP officers, expedited removals Any increased funding would need congressional approval, but many of these things could be increased in scale without congressional approval. Entry-Exit Tracking of Visa Holders To track the entry and exit of visa holders and find those who overstay. Previous Congressional actions have approved such a system to track visa entries and exits. Visa waiver program changes DHS & DOS Secretaries may be able to change without additional congressional authority Kate s Law CRIMINALIZATION OF OUR COMMUNITY Mandatory five year prison sentence for reentry to the US after a deportation (Congressional authority needed) The Office for Victims of Crimes Committed by Removable Aliens, now called Victims of Immigration Crime Engagement (VOICE), was created by an executive order on immigration enforcement on January 25 Expanding ICE priorities for enforcement (No congressional authority needed) Arrests for certain crimes sufficient Expanding crimes sufficient for priority enforcement Expanding of Jails and Probation officers to check immigration status Anyone perceived as a threat without having a criminal record The Pew Research Center released a report yesterday (April 10) showing that, in 2014, federal law enforcement made more arrests for immigration-related offenses than it had for drugs, property or gun crimes EkosVoice 10
11 LEGAL IMMIGRATION IMPACT Registry of Muslims legally present in the U.S. (May attempt to revive without congressional authority) National Security Entry/Exit Registration System Legal immigrants from Arab nations must re-register yearly or be placed in deportation system Restrictions on legal immigration to the U.S. Provisional waiver program (No Congressional authority needed) Temporary Protected Status (Congressional authority needed) Asylum/Refugee Laws & Detention Policies Ban on Syrian Refugees (Congressional authority needed) SELF-DEPORTATION POLICIES Attrition Through Enforcement Make life so miserable for undocumented immigrants living in the U.S., that undocumented immigrants will leave on their own. Systemic plan that includes more interior enforcement, cutting what few benefits exist for immigrants (tuition, benefits to children of undocumented immigrants, state programs, etc.) (Many aspects may not need congressional approval) Target cities, organizations, religious establishments, and universities that wish to serve immigrant population (May try to utilize current law on assisting undocumented immigrants) Reporting Requirements at schools, hospitals, etc. OTHER POTENTIAL THREATS Birthright Citizenship (Constitutional amendment) Re-opening cases that have been closed through prior Prosecutorial Discretion memos (No congressional authority needed) Policies for increased detention of immigrants (may try to do without congressional authority) In-state tuition Fix (Congressional authority needed) 11
12 Sessions outlined a series of changes that he said mark a concerted effort to rid USA cities and the border of what he described as "filth" brought on by drug cartels. "But it is also here, along this border, that transnational gangs like MS-13 and global cartels flood our country with drugs and leave death and violence in their wake". "especially where indicators of gang affiliation, a risk to public safety, or criminal history are present", 12

FACT: immigration reform would reduce the deficit. FACT: immigrants are less likely to commit crimes than native-born Americans. 14

The differences between are profound; according to Texas law the "literal translation of the phrase Notary Public into Spanish is prohibited. The intent of this legislation is to prevent Spanish speakers from confusing the roles of the Mexican Notario Publico with the limited services offered by the USA Notary Public. The Mexican Notario Publico serves not only as a lawyer but also as a judge in his role as protector of the law 20

There is one Notario appointed for every 30,000 people per populated area A Notario Publico in Mexico City may: be an arbitrator be a mediator issue judicial opinions intervene in judicial proceedings ensure that documents such as bylaws of companies, wills, deeds, powers of attorney, real state purchases and establishments of trusts do not include any legal inconsistencies ensure payment of taxes protocolize public deeds incorporation of every company, the buying and selling of all types of real estate, the establishment of deeds and wills, the creation of mortgages, among other transactions, must be protocolized by a Notario Publico. A USA Notary Public's primary duty is to verify a signer's identity and signature, and attest that the signer personally appeared before the Notary at the time the notarization was taken. The Notary is not verifying the truth of the statements in the document. The individual appearing before the Notary and signing the document is responsible for the truth of such statements. The Notary is only responsible for the truth of the statements in the notarial certificate that the Notary completes, which says the person appeared before the Notary and that such person signed or acknowledged his signature on the document on a specified date
