4 [Liquor License Pine Street - 7-Eleven] Hearing to consider that the transfer of a Type-20 off-sale beer and wine liquor license to 7-Eleven, Inc., doing business as 7-Eleven, located at 195 Pine Street (District 3), will serve the public convenience or necessity of the City and County of San Francisco. (Public Safety and Neighborhood Services Committee) 08/29/18; REFERRED TO DEPARTMENT. Referred to the Planning and Police Departments for comment and recommendation. 08/31/18; RECEIVED AND ASSIGNED to Public Safety and Neighborhood Services Committee. 09/14/18; RESPONSE RECEIVED. The Planning Department submitted their approval; ABC Type-20 license is principally permitted with retail sales and service use in the C-3-O Zoning District per Planning Code, Section /17/18; RESPONSE RECEIVED. The Police Department submitted a response recommending approval with the following conditions: 1) sales of alcoholic beverages shall be permitted only between the hours of 7:00 a.m. to 12:00 a.m. daily; 2) no more than 5% of the square footage of the premise will be used for the display of alcoholic beverages; 3) sales of beer or malt beverages in 40 ounce containers or larger is prohibited; 4) containers of beer or malt beverages in pre-packaged, multi-unit quantities shall not be sold as a single container; 5) wine shall not be sold in bottles or containers smaller than 750 milliliters; 6) beer, malt beverages and wine coolers in containers of 16 ounces or less cannot be sold by single containers, but must be sold in manufacturer pre-packaged multi-unit quantities; and 6) loitering (loitering is defined as to stand idly about; linger aimlessly without lawful business ) is prohibited on any sidewalks or property adjacent to the licensed premises under the control of the licensee as depicted on the ABC-257 dated December 1, Heard in Committee. Member Peskin moved that a determination be PREPARED IN COMMITTEE AS A RESOLUTION, that the public convenience or necessity would be served by the transfer of a Type-20 off-sale beer and wine liquor license to the applicant. The motion carried by the following vote: Resolution determining that the transfer of a Type-20 off-sale beer and wine liquor license to 7-Eleven, Inc., doing business as 7-Eleven, located at 195 Pine Street (District 3), will serve the public convenience or necessity of the City and County of San Francisco, in accordance with California Business and Professions Code, Section ; and requesting that the California Department of Alcoholic Beverage Control impose conditions on the issuance of the license.
