The purpose of this booklet is to provide an understanding of the guidelines and requirements associated with the 2010 Election. It is important to note that this guide is for general information only and does not have the force and effect of Nevada law, regulation, or rule. Interested citizens should obtain the most recent version of the Nevada Revised Statutes and Nevada Administrative Code, as Nevada s Election Laws are amended each legislative session. Interested parties should also be aware that election issues are periodically addressed by the Attorney General, the Secretary of State, or by State or Federal courts. Due to the general scope of this guide, some of these issues may not be addressed here. Interested parties should review Attorney General Opinions and court decisions, and should contact the Secretary of State or a Nevada attorney with any specific questions. 2

10 REQUIREMENTS FOR FEDERAL OFFICES UNITED STATES SENATOR Term of Office: Six-year term (U.S. Const. Art. 1, Sec. 3) Term Limits: No Residency Requirement: Individuals running for office must have been a citizen of the United States for nine years and, when elected, an inhabitant of that state in which he shall be chosen. (U.S. Const. Art. 1, Sec. 3) Age Requirement: 30 years of age (U.S. Const. Art. 1, Sec. 3) REPRESENTATIVES IN CONGRESS Term of Office: Two-year term (U.S. Const. Art. 1, Sec. 2) Term Limits: No Residency Requirement: Individuals running for office must have been a citizen of the United States for seven years, and when elected, an inhabitant of that state in which he shall be chosen. (U.S. Const. Art.1, Sec. 2) Age Requirement: 25 years of age. (U.S. Const. Art. 1, Sec. 2) 9

11 HISTORICAL OVERVIEW OF CONSTITUTIONAL REQUIREMENTS FOR STATE OFFICES Article 15, Sec. 3 of the Nevada Constitution states that No person shall be eligible to any office who is not a qualified elector under this constitution. Qualified Elector is defined as follows: All citizens of the United States (not laboring under the disabilities named in this constitution) of the age of eighteen and upward, who shall have actually, and not constructively, resided in the state six months, and in the district or county 30 days next preceding any election, shall be entitled to vote for all officers that now or hereafter may be elected by the people, and upon all questions submitted to the electors at such election: provided that no person who has been or may be convicted of treason or felony in any state or territory of the United States, unless restored to civil rights, and no person who has been adjudicated mentally incompetent, unless restored to legal capacity, shall be entitled to the privilege of an elector. Nevada Constitution, Article 2, Sec. 1 Residency. After the United States Supreme Court issued its opinion in Dunn v. Blumstein, 405 U.S. 330 (1972), the Nevada Attorney General opined that the six month residency requirement in Article 2, Sec. 1 of the Nevada Constitution was preempted by the Fourteenth Amendment to the United States Constitution. See Nevada Attorney General Opinion 85 (6/19/72). Thereafter, the Nevada Legislature enacted NRS That statute provides, in relevant part, that a person is a qualified elector upon residency in Nevada for at least 30 days prior to the election. Age. Some public offices have a minimum age requirement other than eighteen. For example, members of the Nevada Legislature must be at least 21 years old. NRS The Governor, Justices of the Nevada Supreme Court and District Judges must be at least 25 years old. Nevada Constitution, Article 5, Sec. 3; NRS 2.010; NRS Minimum age requirements are constitutional. See Mengelkamp v. List, 88 Nev. 542 (1972) (holding that NRS was constitutional). Term Limits. Term limits were proposed by initiative and were approved by Nevada voters at the general elections in 1994 and Nevada Constitution, Article 4, Sec. 3 (assembly); Article 4, Sec. 4 (senate); Article 5, Sec. 19 (constitutional offices); Article 15, Sec. 3 (public offices). There are no term limits for judges. See Nevada Judges Ass n v. Lau, 112 Nev. 51 (1996) (holding that the term limits ballot question should be presented to the voters as two questions one applicable to public officials and the second applicable to judges. The voters passed the former and rejected the latter). Term limits are not retroactive and apply only to periods of service commencing after November 27, See Nevada Attorney General Opinion (8/9/96). 10

(NRS 2.020) Qualified Elector: Nevada Constitution, Art. 2, Sec. 1. Must be an Attorney: Ineligible: Licensed and admitted to practice law in the courts in the State of Nevada, another state or District of Columbia for not less than 15 years at any time preceding his election or appointment, at least two years of which have been in Nevada. (NRS (2)) Licensed and admitted to practice law at the time of his election or appointment in the State of Nevada, another state, or the District of Columbia for not less than 5 years at anytime preceding his election or appointment.(nrs 4.010) In some lightly populated townships, a candidate for Justice of the Peace does not have to be an attorney. (NRS 4.010(2)) SHERIFF Residency Requirement: 30 days next preceding the date of the close of filing of declarations of candidacy for the office he seeks. (NRS (1)) Age Requirement: 21 years of age (NRS ) Qualified Elector: Nevada Constitution Art. 2, Sec. 1 Experience: Effective January 1, 2010, and pursuant to AB 301 of the 2007 legislative session, a sheriff or sheriff elect must meet the following criteria. In a county whose population is 100,000 or more must have at least 5 consecutive years of employment or service: (1) as a peace officer; (2) as a law enforcement officer of an agency of the United States; (3) as a law enforcement officer of another state or political subdivision thereof; or (4) in any combination of the position described above; and (a) has been certified as a category I peace officer by the Commission; (b) been certified as a category I peace officer or its equivalent by the certifying authority of another state, that, as determined by the Commission, imposed requirements for the certification as a category I peace officer in the State; or (c) successfully completed a federal law enforcement training program approved by the Commission. In a county whose population is less than 100,000, a candidate for the office of sheriff is not required to meet any of the aforementioned requirements however, such a person forfeits 16

18 his office if, within 1 year after the date on which he takes office, he fails to earn certification by the Commission as a category I, II or III peace officer. District Attorney Residency Requirement: Must be a bona fide resident of the State of Nevada. (NRS (1)) Age Requirement: 18 years of age. (Nevada Constitution, Art. 15, Sec. 3; Art. 2, Sec. 1) Qualified Elector: Nevada Constitution Art. 2, Sec. 1 Must be an Attorney: Duly licensed and admitted to practice law in all courts in the State of Nevada. (NRS (2)) BOARD OF HOSPITAL TRUSTEES Residency Requirement: Must be a resident of county or counties concerned 30 days next preceding closing date for filing as a candidate. (NRS ) Age Requirement: 18 years of age. (Nevada Constitution, Art. 15, Sec. 3; Art. 2, Sec. 1) Qualified Elector: Nevada Constitution, Art. 2, Sec. 1. Population Requirements: In Counties with a population of less than 100,000 Hospital Trustees are elected in the same manner as other county officers. In Counties with a population of 100,000 or more but less than 400,000, Hospital Trustees are elected from the county at large. In Counties with a population of 400,000 or more the members of the Board of County Commissioners are ex officio the Board of Hospital Trustees during their terms of office as county commissioners.
