("China Airlines" in the above-captioned action and in Benchmark Export Services, et al. v. China Airlines, Ltd., et al., Civ. No (filed Feb. 12,2010, E.D.N.Y., a subsequently-filed civil action consolidated into the above-captioned action. 2. Holder, Jr. State Attorneys General May 16, Plaintiffs' Motion for Preliminary Approval of Settlement with China Airlines, Ltd., filed May 8, 2014, including the following documents: a Plaintiffs' Notice of Motion for Preliminary Approval of Settlement with China Airlines, Ltd. (Exhibit 4; b Declaration of Robert N. Kaplan in Support of Plaintiffs' Motion for Preliminary Approval of Settlement with China Airlines, Ltd., including as Exhibit A a copy of the Settlement Agreement (Exhibit 5; c Memorandum in Support of Plaintiffs' Motion for Preliminary Approval of Settlement with China Airlines, Ltd. (Exhibit 6; and d Proposed Order on Motion for Preliminary Approval of Settlement with China Airlines, Ltd., and Certificate of Service (Exhibit 7. With regard to 28 U.S.C. 1715(b(2, no hearing currently is scheduled on the motion for preliminary approval of China Airlines' proposed settlement. On April 23, 2014, before the motion for preliminary approval of the proposed settlement was filed with the court, the Magistrate Judge scheduled a general Status Conference in Air Cargo for June 26, 2014, at 2:00 pm EDT. See Exhibit 3. With regard to 28 U.S.C. 1715(b(3, no proposed or final notification to class members has been filed with the court relating to China Airlines' proposed settlement. With regard to 28 U.S.C. 1715(b(6 and (8, there has been no final judgment or notice of dismissal yet filed relating to China Airlines' proposed settlement, nor has there been any written judicial opinion relating to the settlement materials. With regard to 28 U.S.C. 1715(b(7(A, because the proposed settlement class includes purchasers of air freight services from China Airlines or from any other Defendant, and because class counsel have not provided China Airlines with a list of all class members who reside in each state, it is not feasible for China Airlines to provide the names of class members residing in each state or an estimated proportionate share of the claims of such members to the entire settlement. Similarly, with regard to 28 U.S.C. 1715(b(7(B, China Airlines also is unable to reasonably estimate the number of class members residing in each state and the estimated proportionate share of the claims of such members to the entire settlement. China Airlines notes, however, that other settlements and proposed settlements previously noticed in this case contain the same settlement class definition as China airlines' proposed settlement, and the estimated number of class members residing in each state and the estimated propmiionate share of the claims of such members to the entire settlement should be the same for China Airlines' proposed settlement as for all other settlements and proposed settlements containing the same settlement class definition. - 2-
