4 Minnesota Rules: Amendments and Additions NOTICE: How to Follow State Agency Rulemaking in the State Register The State Register is the official source, and only complete listing, for all state agency rulemaking in its various stages. State agencies are required to publish notice of their rulemaking action in the State Register. Published every Monday, the State Register makes it easy to follow and participate in the important rulemaking process. Approximately 80 state agencies have the authority to issue rules. Each agency is assigned specific Minnesota Rule chapter numbers. Every odd-numbered year the Minnesota Rules are published. Supplements are published to update this set of rules. Generally speaking, proposed and adopted exempt rules do not appear in this set because of their short-term nature, but are published in the State Register. An agency must first solicit Comments on Planned Rules or Comments on Planned Rule Amendments from the public on the subject matter of a possible rulemaking proposal under active consideration within the agency (Minnesota Statutes ). It does this by publishing a notice in the State Register at least 60 days before publication of a notice to adopt or a notice of hearing, or within 60 days of the effective date of any new statutory grant of required rulemaking. When rules are first drafted, state agencies publish them as Proposed Rules, along with a notice of hearing, or a notice of intent to adopt rules without a hearing in the case of noncontroversial rules. This notice asks for comment on the rules as proposed. Proposed emergency rules, and withdrawn proposed rules, are also published in the State Register. After proposed rules have gone through the comment period, and have been rewritten into their final form, they again appear in the State Register as Adopted Rules. These final adopted rules are not printed in their entirety, but only the changes made since their publication as Proposed Rules. To see the full rule, as adopted and in effect, a person simply needs two issues of the State Register, the issue the rule appeared in as proposed, and later as adopted. The State Register features partial and cumulative listings of rules in this section on the following schedule: issues #1-13 inclusive; issues #14-25 inclusive (issue #26 cumulative for issues #1-26); issues #27-38 inclusive (issue #39, cumulative for issues #1-39); issues #40-52 inclusive, with final index (#1-52, or 53 in some years). 5 Executive Orders The governor has the authority to issue written statements or orders, called Executive Orders. as well as Emergency Executive Orders. The governor's authority is specified in the Constitution of the State of Minnesota, Article V, and in Minnesota Statutes Emergency Executive Orders, for protection from an imminent threat to health and safety, become effective immediately, are filed with the secretary of state, and published in the State Register as soon as possible after they are issued. Other Executive Orders become effective 15 days after publication in the State Register and filing with the secretary of state. Unless otherwise specified, an executive order expires 90 days after the date the governor who issued the order vacates office. Office of the Governor Emergency Executive Order 11-16: Providing Assistance for Displaced Citizens I, MARK DAYTON, GOVERNOR OF THE STATE OF MINNESOTA, by virtue of the authority vested in me by the Constitution and applicable statutes, do hereby issue this Executive Order: WHEREAS, on Sunday, May 22, 2011, severe weather caused death, multiple injuries, and major damage in the city of Minneapolis in the county of Hennepin; and WHEREAS, damage to public infrastructure and homes, downed trees and power lines, power outages, and natural gas leaks have created an imminent danger to persons and property resulting in the displacement of over 250 citizens presenting an immediate need to activate emergency resources to assist with the shelter and staging of displaced citizens; and WHEREAS, the resources of the affected local and county governments have been fully utilized to meet the demands generated by this storm; and WHEREAS, the city of Minneapolis has requested the use of the National Guard Armory to support the shelter and staging of displaced civilians; NOW, THEREFORE, I hereby order that: 1. The Adjutant General of Minnesota shall order to state active duty on and after May 22, 2011, in the service of the State, any personnel and equipment of the military forces of the State that are required to provide assistance in responding to the emergency and in providing emergency relief services. 2. The Adjutant General may purchase, lease or contract for goods and services necessary to accomplish the mission. 3. The cost of subsistence, transportation, fuel, pay, and allowances of these individuals shall be defrayed from the general fund of the State, as provided for in Minnesota Statutes, sections , , and Under Minnesota Statutes, section 4.035, subdivision 2, this Emergency Executive Order is effective immediately and will remain in effect until the conclusion of the emergency. 6 Executive Orders Office of the Governor Emergency Executive Order 11-17: Declaring a State of Emergency in the State of Minnesota and Providing for Emergency Relief from Regulations to Motor Carriers and Drivers Operating in Minnesota I, MARK DAYTON, GOVERNOR OF THE STATE OF MINNESOTA by virtue of the authority vested in me by the Constitution and applicable statutes, including Minnesota Statutes, chapter 12 and section , do hereby issue this Executive Order: WHEREAS, on Sunday, May 22, 2011, thunderstorms generated numerous tornado and funnel clouds in and around the Twin Cities metropolitan area, resulting in personal injury and loss of life, widespread power outages, and significant damage to personal property, homes, businesses, and public infrastructure; and WHEREAS, emergency operations plans are activated and a local emergency has been declared in the city of Minneapolis, county of Hennepin, and state assistance and resources have been requested; and WHEREAS, the resources of local, county, and state governments must be fully utilized to ensure immediate response to protect the life and safety of persons in the affected areas and to protect property and infrastructure from additional damage; and WHEREAS, emergency assistance of motor carriers is needed to transport supplies and materials to affected areas of the state; NOW, THEREFORE, I hereby order that: 1. A state of peacetime emergency exists under Minnesota Statutes, section 12.31, and relief for vehicles used to provide direct assistance to the emergency is required to assist the counties of Anoka and Hennepin. 2. The Department of Public Safety Division of Homeland Security and Emergency Management will continue the activation of the Minnesota Emergency Operations Plan, continue the provision of on-site support and assistance to the affected local governments, and determine the need for supplementary disaster aid. 3. All state agencies are directed to continue to provide the assistance necessary to help the local units of government respond to and recover from this emergency. 4. Carriers or drivers of commercial motor vehicles providing direct assistance for emergency relief are exempted from the regulations incorporated in Minnesota Statutes, section , subdivision 9, pertaining to hours of service for carriers and drivers of commercial motor vehicles. 5. Nothing in this order relieves motor carriers and drivers from regulations pertaining to driver qualifications; driving of commercial motor vehicles; commercial drivers licenses; drug and alcohol testing for drivers; or equipment, parts, and accessories necessary for the safe operation of vehicles. 6. No motor carrier operating under terms of this emergency order shall require or allow an ill or fatigued driver to operate a commercial motor vehicle. Any driver who informs a carrier that he or she needs immediate rest shall be given at least ten consecutive offduty hours before the driver is required to return to service. 7. No driver operating under terms of this emergency order shall operate a commercial motor vehicle while fatigued or ill. Fatigued drivers shall take at least ten hours off-duty before returning to service. 8. Upon the expiration of this emergency order, or when a driver or carrier ceases to provide direct assistance to the emergency relief effort, a driver that has had at least thirty-four consecutive hours off-duty must be permitted to start his or her on-duty status hours and 60/70-hour clock at zero. Under Minnesota Statutes, section 4.035, subdivision 2, this emergency order is effective immediately and must be filed with the Secretary of State and published in the State Register as soon as possible after its issuance. 7 carriers and drivers remains in effect for 30 days, until the commercial motor carrier or driver ceases direct assistance in providing emergency relief, or until the emergency status no longer requires emergency response, whichever occurs first. For purposes of this order, direct assistance is defined in Minnesota Statutes, section , subdivision 3, paragraph (c). The order of relief from regulations to motor carriers and drivers may be extended in accordance with Minnesota Statutes, section , subdivision 2. The peacetime emergency may be extended by the Executive Council or the Legislature in accordance with Minnesota Statutes, section 12.31, subdivision 2. 8 Official Notices Bassett Creek Watershed Management Commission (BCWMC) Notice of Public Hearing on Proposed Major Plan Amendment to the Bassett Creek Watershed Management Commission s Watershed Management Plan NOTICE IS HEREBY GIVEN that the Bassett Creek Watershed Management Commission (BCWMC) will meet at Golden Valley City Hall, 7800 Golden Valley Road, Golden Valley, Minnesota, on Thursday, June 16, 2011, and will hold a public hearing at 11:30 a.m. Interested persons are invited to attend. The purpose of the public hearing is to explain a proposed major plan amendment to the BCWMC s Watershed Management Plan and to hear public testimony and comments of member cities regarding the proposed amendment. The proposed major plan amendment involves the following: Adding to the BCWMC s Capital Improvement Program (CIP) one project to restore 2.5 miles of the Main Stem of Bassett Creek from Irving Avenue North in Minneapolis to Golden Valley Road in Golden Valley for The estimated cost of this improvement is $600,000. Adding to the CIP a project to modify the outlet of Wirth Lake to prevent backflow from the Creek during flooding, which would reduce phosphorus loading to the lake, as recommended in the Wirth Lake TMDL Implementation Plan for The estimated cost of this improvement is $250,000. The BCWMC received a $75,000 grant for this project from the Minnesota Board of Water and Soil Resources through the 2011 Clean Water Fund Competitive Grants Program, which will be applied to the total cost of the project. Adding to the CIP a project to construct a pond at Lakeview Park within the Medicine Lake watershed that would reduce nutrient loading to this impaired water for The estimated cost of this improvement is $196,000. The proposed method by which the costs of the improvements are to be paid is a levy of an ad valorem property tax by Hennepin County on property within the Bassett Creek Watershed. Bassett Creek Watershed Management Commission Linda Loomis, Chair Minnesota State Agricultural Society - Minnesota State Fair Notice of Business Meeting of the Board of Managers June 3, 2011 MINNESOTA STATE FAIRGROUNDS The Minnesota State Agricultural Society board of managers will hold a general business meeting Friday, June 3. The Society is the governing body of the Minnesota State Fair. NPDES/SDS General Permit for Small Municipal Separate Storm Sewer Systems (or MS4s) NOTICE: The MPCA proposes to reissue NPDES/SDS General Permit (MNR040000), with several modifications. This general permit regulates the discharge of stormwater from small MS4s to waters of the State. This general permit covers categories with operations, emissions, activities, discharges, or facilities that are the same or similar in context. The duration of this permit is five years. Potential Applicants Any small MS4 in the State of Minnesota that is located within the boundaries of a Federal Bureau of Census-delineated urbanized area based on the latest decennial census pursuant to 40 Code of Federal Regulations or an MS4 designated by the MPCA for permit coverage under Minnesota Rules Chapter Background The authority to develop and issue a general permit is based on the 1979 United States Environmental Protection Agency (EPA) revisions to the NPDES Program regulations 40 Code of Federal Regulations which created a class of permits called general permits. General permits are issued by the MPCA in the State of Minnesota under Minnesota Statutes 115 and Minnesota Rules General permits can be issued in states with NPDES authority if the state program includes general permit authority from the EPA. MPCA s general permit program was approved by the EPA on December 15, This general permit is based in part on federal requirements in 40 Code of Federal Regulations , and state requirements in Minnesota Rules and Minnesota Rules Chapter The NPDES/SDS General Permit for small MS4s was first issued June 2002, appealed, and then reissued in 2006 for the period June 1, 2006, to May 31, This general permit is proposed to replace the existing NPDES/SDS General Permit (MN040000) and provides a mechanism to regulate discharges of stormwater from small MS4s. Like the previous permit, this general permit will require the permittee to develop and implement a Stormwater Management Program or SWMP (formerly called Stormwater Pollution Prevention Program or SWPPP) that, if properly designed, reduces the discharge of pollutants to the maximum extent practicable, protects water quality, and satisfies the appropriate water quality requirements of the Clean Water Act. This general permit will provide coverage for approximately 235 small MS4s in the State, and additional MS4s if designated by the MPCA under Minnesota Rules Chapter To obtain coverage under the proposed permit all current small MS4s are required to submit a complete application in accordance with the schedule identified in the reissued NPDES/SDS General Permit (MN040000). New MS4s, which may be designated in the future by the MPCA, will be required to submit an application by the date specified in the MPCA Commissioner s designation determination. All small MS4s are required to submit an annual report on the implementation of their Stormwater Management Program by June 30th of each year, or on another date if established for a MS4 by the MPCA Commissioner. For those MS4s designated in the future by the MPCA the submittal date of their Stormwater Management Program will be specified in the MPCA Commissioner s designation determination. Subject of Permit Revisions The MPCA has modified the existing NPDES/SDS General Permit (MN040000), to meet federal and state requirements for impaired waters and to address several main issues the MPCA identified as needing revision and/or clarification in this permit reissuance. The draft permit includes revised requirements for MS4 mapping, illicit discharge detection and elimination, construction stormwater erosion and sediment control, and post-construction stormwater management. The draft permit also includes new requirements for impaired waters covered by an EPA approved Total Maximum Daily Load (TMDL). Stakeholder input and participation in a large group meeting and five small work group meetings on the main issues held by the MPCA, as well as numerous meetings with stakeholders on the approach to TMDLs in the permit, provided valuable input into this permit revision process. 17 There are four formal procedures for public participation in the MPCA s consideration of the permit reissuance. Interested persons may (1) submit written comments on the draft permit; (2) request that the MPCA hold a public informational meeting; (3) request that the MPCA hold a contested case hearing; and (4) submit a petition to the Commissioner requesting that the MPCA Citizens Board consider the permit matter. The public comment period begins: May 31, 2011 The public comment period ends: July 15, 2011 Official Notices (1) Interested persons are invited to submit written comments on the draft permit. A contested case hearing is a formal evidentiary hearing before an administrative law judge. In accordance with Minnesota Rules , the MPCA will grant a petition to hold a contested case hearing if it finds that: (1) there is a material issue of fact in dispute concerning the draft permit; (2) the MPCA has the jurisdiction to make a determination on the disputed material issue of fact; and (3) there is a reasonable basis underlying the disputed material issue of fact or facts such that the holding of the contested case hearing would allow the introduction of information that would aid the MPCA in resolving the disputed facts in making a final decision on the draft permit. A material issue of fact means a fact question, as distinguished from a policy question, whose resolution could have a direct bearing on a final MPCA decision. A petition for a contested case hearing must include the following information: (1) a statement of reasons or proposed findings supporting the MPCA decision to hold a contested case hearing according to the criteria in Minnesota Rules , as discussed above; and (2) a statement of the issues proposed to be addressed by a contested case hearing and the specific relief requested or resolution of the matter. (4) In the absence of any requests for additional public information meetings or a contested case hearing, the final decision to issue the permit will be made by the MPCA Commissioner. 19 Comments on the proposed site-specific standard must be sent in writing to the MPCA contact person listed below by 4:30 P.M. on July 14, 2011 Procedural Background MPCA staff are in the process of completing a Total Maximum Daily Load (TMDL) study for nutrients in Lake Winona. As part of the TMDL development process, MPCA staff developed a site-specific phosphorus standard for the lake. This site-specific standard has been shared with a local stakeholder group that has been involved throughout the TMDL development process. This group has representatives from the city and county, state agencies, the local sanitary district and local residents from the chain of lakes linked to Lake Winona. Before the TMDL can be finalized, the site-specific standard for phosphorus must be public noticed and approved by the MPCA and the U.S. Environmental Protection Agency (EPA). Lake Winona Background Lake Winona is located in the City of Alexandria, Minn., in Douglas County. In 2002, the lake was listed as impaired for nutrients and placed on the state s impaired waters list. Waters impaired for nutrients fail to meet at least two of the state s three water quality standards related to nutrients: phosphorus, chlorophyll-a (a measure of the level of algae in the lake) and Secchi disc depth (a measure of water clarity). Working with a local stakeholder group (city, county and state agency staff, as well as local residents) and an environmental consulting firm, the MPCA coordinated a TMDL study to determine the level of phosphorus reductions needed from various sources to eventually bring the lake back into compliance with standards. The state phosphorus standard for shallow lakes in the north central hardwood forest ecoregion where Lake Winona is located is 60 ppb. Phosphorus levels in Lake Winona recorded during a study period from showed a summer average of 232 ppb. Minnesota s water quality rules allow for the adoption of a site-specific standard if there is information available that shows a modification is more appropriate than the statewide or ecoregion standard for a particular water body. Studies conducted as part of the TMDL project show that chlorophyll-a and Secchi depth standards can be met in Lake Winona if in-lake phosphorus levels can be reduced to 75 ppb, a level the MPCA is proposing to use as the site-specific phosphorus standard for Lake Winona. While higher than the 60 ppb standard for Lake Winona s ecoregion, it is lower than the 90 ppb standard for the ecoregion that begins just a few miles to the southwest of Lake Winona. The proposed 75 ppb level was discussed with the local stakeholder group that has been involved throughout the Lake Winona TMDL development process. The chlorophyll-a and Secchi disc standards for Lake Winona would remain unchanged from the existing standards for shallow lakes in the north central hardwood forest ecoregion. The primary sources of phosphorus to Lake Winona are phosphorus in lake bottom sediments, stormwater runoff from the city and other surrounding areas, and the local wastewater treatment facility, Alexandria Lakes Area Sanitary District (ALASD). A site-specific standard of 75 ppb for in-lake phosphorus would still require significant reductions from all three of these sources, on the order of up to 85 percent. Site-specific Modification of Standards Minnesota Rule Chapter 7050 provides the legal basis for consideration and adoption of site-specific standards: (see subpart 7). Official Notices Water quality standards are subject to review and modification as applied to a specific surface water body, reach, or segment. If sitespecific information is available that shows that a site-specific modification is more appropriate than the statewide or ecoregion standard for a particular water body, reach, or segment, the site-specific information shall be applied. The site-specific Standard Recommends the Following Phosphorus Values for the Lake Winona TMDL Project: TP (Total Phosphorus) = 75 ppb as a summer-mean as measured at the established South Winona sampling site. The chlorophyll-a and Secchi disc standards for Lake Winona would remain unchanged from the existing standards for shallow lakes in the NCHF ecoregion. Preliminary Determination on the Draft Site Specific Standard: The MPCA commissioner has made a preliminary determination to submit this site-specific standard to the EPA for final approval.
