2 Extract from - Recreation and Leisure Services Committee Meeting (15th November 1990) Agenda Item The 3 local Sports Councils within the Staffordshire Moorlands at present are Biddulph, Cheadle and Leek. 2. A meeting of the Staffordshire Moorlands Sports Council, in February, identified that the 3 local Sports Councils had different Constitution and Rules. All 3 agreed that the feasibility of a Common Constitution and Rules for all local Sports Councils should be investigated. 3. The Leisure Section designed a draft Constitution and Rules for each of the local Sports Councils to consider. At a meeting of the Staffordshire Moorlands Sports Council on Wednesday 20th June each local Sports Council put forward their amendments to the draft. 4. From this meeting, several amendments were accepted and a final draft agreed on Wednesday 3rd October. A copy of the final draft Constitution and Rules can be seen in Appendix 'A' 5. Each of the 3 local Sports Councils in the proposed Constitution and Rules have four representatives on the Staffordshire Moorlands Sports Council which will operate within the following terms of reference:- a. To advise, inform and encourage the three local Sports Councils. b. To act as a collective voice for Sport and Recreation issues in the Staffordshire Moorlands. c. To act as a co-ordinating body for all the local Sports Councils' ideas and information. RECOMMENDED - That the Committee adopt the proposed Constitution and Rules. 3 APPENDIX 'A' Staffordshire Moorlands Local Sports Councils Constitution and Rules. 1. TITLE The Council shall be called the Leek and District Sports Council. (hereinafter called 'The Sports Council). 2. OBJECTS the object of the Sports Council shall be :- a. To assess the needs for Sporting Activities in the Staffordshire Moorlands District and to advise upon and help with measures to meet those needs. b. To advise the Staffordshire Moorlands District Council generally on the collective opinions of local interests and future planning of sports facilities, new forms of sport and recreation and allocation of grants. c. To consult and co-operate with the Local Education Authority and Local Teachers to encourage school leavers to take an active part in sport. d. To disseminate information, especially to newcomers in the area, concerning available sports facilities and to maintain an up to date record of all local sporting organisations. e. To advise upon and help with the organisation of personal needs in sport with :- i) Beginners, (introductory courses) ii) iii) iv) Personal performance, (coaching centres) Training Coaches. First Aid courses, for Sports Clubs. f. To consider reports and recommendations from organisations on matters concerning sport.

4 g. To co-ordinate the promotion of sport and leisure activities in order to ovoid overlapping and waste of effort in planning for the future development of sport. h. To maximise the use of all existing sports facilities in the area. i. To organise and promote the organisation of social events, competitions and championships in the interest of sport. Such as :- 1. Staffordshire Games. 2. Staffordshire Moorlands Sports festival. 3 Sports Personality Awards. 3. MEMBERSHIP OF THE SPORTS COUNCIL All Sports organisations / Clubs actively operating within the District may apply or re-apply for membership, subject to the organisation agreeing to abide by any regulations which may be made by the Sports Council with regard to membership. The Sports Council retain the right to reject membership, if, in the opinion of the Sports Council, there are reasonable grounds for doing so. The Sports Council shall review at the Annual General Meeting the list of member organisations and make such alterations as may be necessary. The Sports Council may cancel membership of any organisation at any time for conduct which, in their opinion, is unbefitting a sport organisation. 4. REPRESENTATION ON THE SPORTS COUNCIL. a. All member clubs may send one voting member to meetings. b. Four representatives from the School Sports Association. If no such organisation exists, then these representatives to be appointed in consultation with teachers. c. Five representatives from the Staffordshire Moorlands District Council's Recreational and Leisure Services Committee. d. The youth and community officer (or representative), for the district. e. Persons representing County or National sporting organisations, by invitation.

5 5. OFFICERS APPOINTED TO THE SPORTS COUNCIL. The officers of the Sports Council shall be elected for a period of one year at the Annual General Meeting and shall consist of :- a. Chairman b. Vice-Chairman c. Secretary d. Treasurer e. Auditor The Sports Council may from time to time appoint other officers. Officers are eligible for re-election and at the discretion of the Sports Council, continue to represent their particular sport, if their sport is agreeable. 6. NOMINATION. a. Each affiliated organisation or club may nominate one candidate for each office, provided such nomination together with the candidates written consent be sent to the Sports Councils Secretary. b. In the absence of sufficient nominations being made in accordance with Rule 6a, the AGM shall at the meeting, make additional nominations for office, each affiliated organisation or club having one vote. 7. REPRESENTATION ON THE STAFFORDSHIRE MOORLANDS SPORTS COUNCIL. The Chairman, Vice-Chairman, Secretary and Treasurer as elected at the A.G.M., will be the Sports Councils representatives on the Staffordshire Moorlands Sports Council for the ensuing year. 8. MEETINGS. a. The Sports Council will meet at least once ever quarter of the year, one of which will be the Annual General Meeting. Meetings may also be called by at least 10 members of the Sports Council, by giving the Secretary fourteen days notice in writing, requesting that a meeting be convened of the Sports Council for the purpose of discussing matter or matters in the notice, whereupon the Secretary shall call such a meeting within one month of the notice.

6 b. The Secretary shall give members at least 7 clear days notice of the meeting of the Sports Council. Minutes of these meetings shall be circulated to all organisations. c. A copy of all minutes will be sent to the Leisure Section of Staffordshire Moorlands District Council. d. The Sports Council shall have the power to appoint committees or subcommittees as required from time to time. e. Affiliated Clubs are requested to be represented at all meetings for at least 70% of the year, in order to be eligible for any grant aid. f. A quorum for a general Sports Council meeting will be one third of the members. g. The Chairman of the meeting shall have the casting vote to all meetings including the A.G.M. 10. FINANCES The Sports Council's year shall run from 1st April to the 31st March each year. a. All affiliated organisations and clubs shall be required to pay membership fees as the Sports Council may decide. b. For the furtherance of the objects of the Sports Council, an elected committee or sub-committee may authorise expenditure out of the Sports Councils funds. c. The Treasurer shall keep proper books of accounts and shall advise and report to the Sports Council on all financial matters. 11. DISTRIBUTION OF GRANT AID From the monies provided from the Staffordshire Moorlands District Council, Grant Aid will only be distributed to clubs affiliated to the Sports Council, subject to the stated conditions and for the following purposes:- a. The purchase of new or replacement equipment relevant to the particular sporting interest pursued by the club making the grant aid application. Such grant aid received shall not be used in payment of insurance, fees or rent for accommodation or use of facilities. b. The Sports Councils balance sheet shall define for what purpose the Grant Aid was provided.

7 c. In making an application for Grant Aid to the Sports Council, all grants or monies received during the previous 12 months, shall be declared and likewise such other Grant Aid applications which at the time of making the application to the Sports Council, may be in hand, shall similarly be made known. d. Every application for Grant Aid shall be shall be accompanied by a copy of the club's accounts and receipts of purchase are to be supplied before the grant is issued. e. No personal grants shall be made by the Sports Council, personal applications should be directed to the Staffordshire Moorlands Sports Council for consideration prior to submission to the Chairman of the Staffordshire Moorland District Council's Recreation and Leisure Services Committee for financial support. 12 SPECIAL POWERS An elected committee or Sub-committee shall be empowered to take such action as that Committee may consider desirable in any circumstances not covered by this Constitution, such action to be reported to the next meeting of the Sports Council for ratification. 13 AMENDMENTS TO THE CONSTITUTION Amendments to this constitution may not be made without prior consultation with the Staffordshire Moorlands Sports Council Committee, any alterations to the constitution to become effective at the succeeding Annual General Meeting.
