1 TWENTY-FOURTH DAY WEDNESDAY, FEBRUARY 26, 2003 PROCEEDINGS The Senate met at 11:00 a.m. pursuant to adjournment and was called to order by the President. The President announced that a quorum of the Senate was present. The Reverend Scott W. Fisher, Metroplex Chapel, Euless, offered the invocation as follows: Almighty God, we join our hearts this day with the words of the psalmist as he proclaimed, "This is the day the Lord has made. We will rejoice and be glad in it." We rejoice in the gift of life and the blessings that come from Your hands. Today, we ask that You would bless the Members of this body. Give them wisdom as they grapple with the difficult issues facing our state. May our Lieutenant Governor, each Senator, and every staff member experience and know Your great love for them. May they ever be mindful of what You require from every man, as the prophet Micah so beautifully stated, that we do justice, love mercy, and walk humbly with our God. (Senator Ogden in Chair) SENATE RESOLUTION 240 Senator Shapiro offered the following resolution: WHEREAS, The Senate of the State of Texas is pleased to pay tribute to the Texas Transportation industry; and WHEREAS, Transportation investment to ensure mobility throughout Texas is essential to the economic vitality of Texas and the quality of life of Texans; and WHEREAS, The Texas Department of Transportation and committees of the Texas Legislature have reported that current level funding supports only about one third of the identified transportation project needs in Texas; and WHEREAS, The Texas Transportation Institute s 2002 Urban Mobility Report cites data illustrating alarming increases in congestion, delay, and cost pertinent to travel in Texas major urban areas; and WHEREAS, Highway safety, connectivity, and system reliability are issues important to citizens throughout Texas; and WHEREAS, Texans interested in transportation and mobility have expressed a desire to designate a single day during the 78th Session of the Texas Legislature for focus on the importance of transportation and mobility in Texas; now, therefore, be it RESOLVED, That the Senate of the State of Texas, 78th Legislature, hereby declare February 26, 2003, Texas Transportation Day at the State Capitol. (President in Chair) HOUSE CONCURRENT RESOLUTION 63 The President laid before the Senate the following resolution: HCR 63, Honoring the Texas Historical Commission on the occasion of its 50th anniversary. FRASER The resolution was read. On motion of Senator Fraser and by unanimous consent, the resolution was considered immediately and was adopted without objection. Senator Fraser, joined by Senator Whitmire, was recognized and introduced to the Senate members of the Texas Historical Commission: former Chair Clifton Caldwell of Albany, Chair JohniL. Nau III of Houston, and Commissioners Jane Cook Barnhill of Brenham, J. P. Bryan of Houston, Shirley Caldwell of Albany, Linda Valdez of San Antonio, and Frank Gorman of El Paso. SENATE RESOLUTION 211 Senator Harris offered the following resolution: WHEREAS, The Senate of the State of Texas is pleased to join the residents of Tarrant County and the Coalition of Tarrant County Chambers of Commerce in celebrating Tarrant County Day at the State Capitol on February 26, 2003; and WHEREAS, Tarrant County was created in 1849 and named for General EdwardiH. Tarrant; the fourth most populous county in Texas, it is home to the international headquarters of such corporate giants as American Airlines, Burlington Northern Santa Fe, Pier 1, and Radio Shack; and WHEREAS, Opportunities for educational growth and job skills training are provided by such outstanding Tarrant County institutions of higher education as Tarrant County College, Texas Christian University, Texas Wesleyan University, the University of North Texas Health Science Center, The University of Texas at Arlington, and The University of Texas at Arlington, Fort Worth, also home to the Automation and Robotics Research Institute; and WHEREAS, Located in North Central Texas on the Grand Prairie and Blackland Prairies, Tarrant County is a popular area for vacationing, and today, the flavor of the Old West is still inspiring in the county s ranch lands, museums, art, and recreational centers; and

Carter Museum, the Museum of Modern Art, the Kimbell Art Museum, and the Fort Worth Museum of Science and History; and WHEREAS, Located in Fort Worth, the county seat, the Amon G. Carter Museum contains a fabulous collection of American art, featuring permanent collections of Frederic Remington and Charles M. Russell; and WHEREAS, Famous for its nationally known tourism centers, such as the Fort Worth Stockyards, Six Flags Over Texas, and Grapevine Mills Mall, Tarrant County is often referred to as "Where the West Begins"; and WHEREAS, Tarrant County is an important national and international transportation crossroads at the geographic center of the hemisphere, featuring the intersection of major highway and rail corridors and the outstanding air transportation facilities, Alliance Airport, Dallas-Fort Worth International Airport, and Meacham International Airport; and WHEREAS, The county owes much of its economic stability and diversity to the leadership provided by the Coalition of Tarrant County Chambers of Commerce; the coalition represents more than 10,000 business organizations; and WHEREAS, The coalition brings together 23 chambers of commerce from throughout Tarrant County to support public policy initiatives that meet the needs of employers, employees, and all county citizens; and WHEREAS, Noted for its many contributions to the overall quality of life in Tarrant County, the coalition builds productive partnerships between the business community and local, state, and federal governments to provide for positive growth in business and workforce development; and WHEREAS, The members of the Coalition of Tarrant County Chambers of Commerce and the residents of Tarrant County deserve credit for maintaining the county s vitality and quality of life and for preserving its many amenities in the face of urban growth and industrial development; now, therefore, be it RESOLVED, That the Senate of the State of Texas, 78th Legislature, hereby commend the people of Tarrant County on their achievements and their contributions to our state and extend best wishes to them for a joyous Tarrant County Day; and, be it further RESOLVED, That a copy of this Resolution be prepared for the residents of Tarrant County and the Coalition of Tarrant County Chambers of Commerce as an expression of esteem from the Texas Senate. 7 Wednesday, February 26, 2003 SENATE JOURNAL 335 SENATE RESOLUTION 218 Senator Armbrister offered the following resolution: WHEREAS, The Senate of the State of Texas is pleased to welcome members of the Independent Electrical Contractors of Texas to the State Capitol and to pay tribute to this worthy organization for its contributions to the Lone Star State; and WHEREAS, A voluntary association of electrical contractors, their employees, and electrical industry support companies, the Independent Electrical Contractors of Texas has for more than four decades been a symbol of quality in the Texas electrical industry; the organization endeavors to ensure the success of all electrical contractors in the state through communication, guidance, training, and leadership; and WHEREAS, The association actively supports the education of apprentices, journeymen, and master electricians, and it eagerly promotes the practice of apprenticeship, a longtime practice of on-the-job education; and WHEREAS, The state coalition coordinates the efforts of local chapters so that a unified agenda may be presented when it addresses issues affecting the entire industry; and WHEREAS, The Independent Electrical Contractors of Texas promotes the betterment of Texas businesses, and it is appropriate that the organization be honored at this time; now, therefore, be it RESOLVED, That the Senate of the State of Texas, 78th Legislature, hereby salute the Independent Electrical Contractors of Texas and declare February 26, 2003, Independent Electrical Contractors Day at the Capitol; and, be it further RESOLVED, That a copy of this Resolution be prepared for the Independent Electrical Contractors of Texas as an expression of esteem from the Texas Senate. The resolution was read and was adopted without objection. SENATE RESOLUTION 243 Senator Hinojosa offered the following resolution: WHEREAS, Proud citizens of Corpus Christi are visiting the State Capitol on February 26, 2003, to celebrate the notable history and bright future of this South Texas city; and WHEREAS, Corpus Christi traces its roots to a trading post established in 1839 on the western shore of Corpus Christi Bay; in 1846, the settlement that had grown up around the post became the county seat of the newly created Nueces County; and WHEREAS, The city s growth was propelled in the 1870s by a flourishing wool trade, a booming cattle industry, and the arrival of the railroad; by 1914 Corpus Christi had four railroads, which promoted the area extensively to farmers and tourists; and WHEREAS, Development was further boosted by the opening of a deepwater port in 1926 and by the discovery of oil in the county in 1930; the port of Corpus Christi is now the fifth largest in the nation in terms of tonnage, and the petroleum and natural gas industries remain an important pillar of the city s economy; another significant stimulus derives from the city s location within the new I-69 corridor, which links the United States with its two largest trading partners, Canada and Mexico; and

8 336 78th Legislature Regular Session 24th Day WHEREAS, The United States military maintains several nearby facilities Naval Station Ingleside and Naval Air Station Corpus Christi; in addition to serving as a training field for pilots, the latter base is also home to the Coast Guard Air Station and the Corpus Christi Army Depot; and WHEREAS, Two institutions of higher learning, Texas A&M University Corpus Christi and Del Mar College, together enroll almost 10,000 students; other outstanding cultural and educational resources include the Art Museum of South Texas, Corpus Christi Botanical Gardens, Texas State Aquarium, and Corpus Christi Museum of Science and History; visitors can also tour the USS Lexington, a record-holding World War II aircraft carrier, and replicas of the Niña, Pinta, and Santa María; and WHEREAS, A favored destination for outdoors enthusiasts, the Sparkling City by the Sea is close to Mustang Island State Park and Padre Island National Seashore, whose 68-mile beach constitutes the longest undeveloped shoreline in the country; and WHEREAS, The citizens of Corpus Christi are continuing to build a dynamic, forward-looking community, one that combines the friendliness of a small town with the amenities of a modern city, and it is indeed a pleasure to recognize their achievements and public spirit; now, therefore, be it RESOLVED, That the Senate of the 78th Texas Legislature hereby recognize February 26, 2003, as Corpus Christi Day at the State Capitol and extend to all those visiting today sincere best wishes for an enjoyable and memorable visit. The resolution was read and was adopted without objection. Senator Hinojosa was recognized and introduced to the Senate Sylvia Ford, Chair of Leadership Corpus Christi, and Arnold Gonzalez, Jr., Chair-elect, accompanied by a group of students and city officials. 10 338 78th Legislature Regular Session 24th Day SENATE RESOLUTION 237 Senator West offered the following resolution: WHEREAS, The Senate of the State of Texas is proud to pay tribute to Emmitt James Smith III and to recognize February 26, 2003, as Emmitt Smith Day at the State Capitol; and WHEREAS, Emmitt Smith is one of the all-time, great running backs in National Football League history; his accomplishments include four season rushing titles, three Super Bowl titles, and 1993 league and Super Bowl XXVIII Most Valuable Player awards; and WHEREAS, In the past season, he claimed the National Football League s all-time rushing record with 17,162 yards and is the first player in league history to rush for over 1,000 yards in 11 consecutive seasons; and WHEREAS, The former National Collegiate Athletic Association All-American holds 58 school records at the University of Florida, where he earned his bachelor s degree in 1996 by completing his course work during off-seasons; and WHEREAS, Emmitt is respected by citizens across our state and nation, not only for his outstanding skills as an athlete, but also for his exceptional generosity and community leadership; he devotes much of his time supporting such charitable organizations as the Open Doors Foundation, established to help motivate and empower youths, and the Make-A-Wish Foundation; he is a member of the President s Council on Physical Fitness and Sports, and he was recently bestowed the Children s Medical Center/Athlete Role Model Award; and WHEREAS, A devoted family man, Emmitt lives in Addison with his wife, Pat, their two daughters, Jasmin and Rheagen, and their son, Emmitt James Smith IV, who was born on his Dad s 33rd birthday; and WHEREAS, As an athlete, Emmitt has made a tremendous mark in the annals of professional football; as a philanthropist, he has made an even deeper impression on the lives of thousands of youths and their families through his generous contributions and the time and effort he puts into serving his community, both on the local level and the national level; and WHEREAS, On the field, he is an athletic champion, devoted to the game; off the field, he is an inspirational volunteer, dedicated to making a difference in the lives of his fellowman; now, therefore, be it RESOLVED, That the Senate of the State of Texas, 78th Legislature, hereby commend Emmitt James Smith III for his outstanding achievements and declare February 26, 2003, Emmitt Smith Day at the State Capitol; and, be it further RESOLVED, That a copy of this Resolution be prepared for Emmitt Smith as an expression of highest esteem from the Texas Senate. PHYSICIAN OF THE DAY Senator Ogden was recognized and presented Dr. Paul Berg of Georgetown as the Physician of the Day. The Senate welcomed Dr. Berg and thanked him for his participation in the Physician of the Day program sponsored by the Texas Academy of Family Physicians. COMMITTEE SUBSTITUTE SENATE BILL 191 ON SECOND READING Senator Carona moved that Senate Rule 7.13; Section 5, Article III, of the Texas Constitution; and the regular order of business be suspended and that CSSBi191 be taken up for consideration at this time: CSSB 191, Relating to the fee for reinstatement or issuance of a driver s license following a license suspension or denial for failure to pass a test for intoxication. Senator Carona offered the following amendment to the bill: Floor Amendment No. 1 Amend CSSBi191 by striking everything below the enacting clause and substituting the following therefor: SECTION 1.iiSection , Transportation Code, is amended by amending Subsections (a) and (b) and adding Subsection (c) to read as follows: (a)iia driver s license suspended under this chapter may not be reinstated or another driver s license issued to the person until the person pays the department a penalty of $140 [fee of $125] in addition to any other fee required by law. (b)iithe payment of a reinstatement penalty [fee] is not required if a suspension under this chapter is: (1)iirescinded by the department; or (2)iinot sustained by an administrative law judge, or a court. (c)iiif the person was arrested in a county that maintains a certified breath alcohol testing program but does not use the services of a certified technical supervisor employed by the department, of each penalty collected under Subsection (a), the department shall remit $15 to the treasurer of that county. Money received by a county under this subsection may be used only to defray the costs incurred by the county for the use of the services of a certified technical supervisor employed by the county in connection with the enforcement of this chapter.
