Welcome Ms Hudson welcomed all the parties to the bargaining meeting and thanked them for attending, and welcomed Kobie Howe, Industrial Officer for NTEU. 2. Clauses for discussion: a. Application of the Agreement Professional - AGREED The University agrees to drop its claim to remove from and reinstate current sub clauses and remove Deputy Dean from Academic Agreement clause. However it maintains its position to remove the bracketed text in 4.2 (S) of the current professional staff agreement and provided wording in relation to equivalency for 4.2 for senior staff remuneration. The CPSU proposed grandfathering the current conditions for staff on senior contracts for the life of their current contract and subsequent contracts and the removal of the bracketed text. NTEU and Western both agreed to this proposal. The University notes 4.3 has been parked for resolution at the end of bargaining. All parties agreed to this clause.

2 b. Application of the Agreement Academic - AGREED The WSU agrees to remove Deputy Dean from the positions excluded from this agreement and proposes to insert Institute Directors and wording in relation to equivalency. The NTEU still expressed concern that senior staff contracts adequately covered redundancy provisions. The University advised senior staff are remunerated higher than HEW level staff and provisions already exist in their contract for generous redundancy provisions. The University notes sub-clause 4.3 has been parked for resolution at the end of bargaining. The NTEU agreed to the proposed clause. c. Pay and Career Equity - AGREED All parties agreed the WGEA report should go to the implementation committee and agreed to working in relation to the 1.5 The University towards achieving gender balance on University Committees established at University level and all committees All parties agreed to the clause. d. Car km Allowance - AGREED The University is confident of the current structure CEAs in providing the required information for a casual staff member to approach ATO regarding a travel claim. The decision regarding tax deductions for work related travel is one that rests solely with ATO. Information will translate through the CEPI system as well. If casuals want to claim travel, they can approach their Dean/Director to apply for reimbursement. The University agreed to amend subclause 1.1 where a casual employee s nominated work location will be record on their CEA. The Unions agreed with this inclusion. All parties agreed to the new revised clause.

3 e. Probation Professional - AGREED Without Prejudice The University proposed a number of minor changes to sub-clauses 1.3, 1.4 (d) and 1.5 based on unions feedback. The Unions agreed with these inclusions. All parties agreed to the new revised clause. f. Flexible Work Provisions The University agrees to retain this clause. The University does not agree to include a new clause as proposed Working from Home. The University believes that working from home does not belong in the agreement and is currently preparing guidelines in relation to this. The Unions suggested working from home/remotely could be articulated elsewhere in the agreement not just attached to Individual Flexibility Arrangement and Organisational Change as they believe that like academic, some professional staff could complete a substantial amount of work at home/remotely and would be a significant benefit for staff. The University did not agree with the unions claim as professional staff are in positions that require them to be service focused. Provisions available in the flexible hours of work policy to allow professional staff to request a work from home/remote opportunity, however the University is open to having reference to working in remote locations/home in other clauses in the agreement. g. Career Planning and Development - AGREED The University agreed to retain the financial target for professional development for professional staff and increased it to $4.6 million and report spending to the Implementation Committee twice yearly. The University maintains its position for HEW 6 to be the cap for internal advertisement in the first instance. The University will increase the number of centrally funded professional development opportunities provided as at the date of commencement of this Agreement. The University will undertake an annual review of University professional development programs offered and report on their uptake to the Implementation Committee. The University will take reasonable steps to widely advertise all centrally funded professional development opportunities to Employees. The Unions agreed to these inclusions.

4 All parties agreed to the revised clause. Without Prejudice h. Professional Workloads The University agrees to reinstate the introductory aspirational statement in sub-clause 1.1. The University does not agree with the proposed changes in put forward by the Unions. The University will review the wording in sub-clauses 1.2 and 2.1. i. WHS and First Aid In relation to 1.1, the University does not agree with the proposed new wording legislation refers to safe work place not safe work. Therefore the University proposes to leave the current wording as is, as this aligns to the Act. The University does not need to reinstate the WHS Act in the Agreement and therefore does not agree to the proposed inclusions by NTEU. The University does not agree to the NTEU s sub-clause in relation to a warden allowance. Schedule 3 provides for First Aid Allowance which is paid upon completion of an accredited course and First Aid Officer approval by a unit manager. First Aid and Warden responsibilities are not comparable in that an Allowance should be paid for both. j. Higher Duties AGREED All parties agreed to this clause. k. Flex Time Scheme - NOT AGREED The University invites the unions to identify where they feel entitlements have been removed from the clause and believe absolutely no entitlement coming out of the clause. The Unions both reiterated their position that no changes be made to the clause or that any aspects of the clause be moved to policy. l. Dignity and respect at work
