4 Titusville Environmental Commission Regular Meeting May 13, 2015 The Titusville Environmental Commission (TEC) of the City of Titusville, Florida, met in regular session in the Council Chamber at City Hall, located at 555 South Washington Avenue on Wednesday, May 13, 2015 at 5:30pm. Chairman Yount called the meeting to order at 5:30 p.m. Present were Vice Chairman Conklin, Member Chavier, Member Pettit, Member Myjak and Member Tucker. Secretary Lackey, Member Chamberlain and Member Laurencio were absent. Staff present was Natural Resources Planner Eddy Galindo and Recording Secretary Laurie Dargie. Member Pettit moved for approval of the April 15, 2015 minutes with corrections. Vice Chairman Conklin seconded the motion; there was a unanimous voice vote in favor. Old Business Septic Tanks The Titusville Environmental Commission discussed using the following points as the preliminary recommendations to City Council for possible solutions to the septic tank concerns: Promote public awareness for the use of the Aerobic Treatment Unit Systems Encourage hook up to city sewer when repairs need to take place on septic systems and sewer hookup is available Research possible incentives or grants that would help assist with sewer connections Centralized above ground Aerobic Treatment Unit Systems for areas where applicable Draft ordinance that align with other counties or cities ordinances that deal with septic tanks Use gray water systems Make efforts to run sewer lines down roads that do not currently have available sewer line hookups Continue mapping efforts to identify where septic tanks are located Obtain more data regarding elevations of drain fields during rainy season Obtain information as to if there are known problems with sewer lines that contribute to the pollution of the ground water and Indian River Lagoon Alternatives to above ground water treatment Testing to be done on drainage areas and outfalls Member Pettit advised the Titusville Environmental Commission that he will do more research on the Aerobic Treatment Unit Systems and bring back a report to the Commission. Member Chavier asked Mr. Galindo to research and find out what other cities are doing to get Page 4 of 17

5 Titusville Environmental Commission Meeting May 13, 2015 property owners off of septic tanks and onto city sewer. Vice Chairman Conklin asked Mr. Galindo if the City of Titusville installs liners inside the sewer pipe lines because he believes that the City does maintenance on the lines to ensure that there are no leaks. Mr. Galindo said he is not sure but if Member Conklin had seen it being done in the city then it must obviously be something the city does. Mr. Galindo advised the Titusville Environmental Commission that City Council just approved Ordinance which addresses pet waste management. Mr. Galindo advised the Titusville Environmental Commission that City Council just approved for Public Works to have funding in the amount of approximately $80, to start testing the outfalls. Mr. Galindo said this project is to install four new baffle boxes. The testing will be done on outfalls before the baffle boxes are installed and testing will be done after the baffle boxes installed. Chairman Yount said he will draft up the points that were discussed and bring them to the June 10, 2015 Titusville Environmental Commission meeting. Titusville Environmental Commission By-Laws Mr. Galindo advised the Titusville Environmental Commission that the By-Laws that were sent to the Commission in the agenda packet needs to be adopted. It is currently unclear as to which By- Laws are the most recently approved. The Titusville Environmental Commission discussed Article II. Membership. Chairman Yount said the area of the Article that addresses missing 3 or more consecutive regular meetings shall automatically forfeit membership is contradictive to the area of the Article that says City Council may authorize a member to miss more than three consecutive meetings. Chairman Yount suggested that this language be changed to say City Council may authorize a member to miss 3 or more consecutive meetings. Member Chavier suggested using the word excused in the language to allow for members to make contact and let Staff know that the member will be unable to attend the meeting. Vice Chairman Conklin said that the By-Laws have worked thus far with the language as is and he does not see a problem with leaving the language as it already is. Vice Chairman Yount said that the Titusville Environmental Commission does not have anyone who abuses there responsibility. Chairman Yount agreed that the language has worked thus far and should maybe remain as is. Mr. Galindo said that Article XV allows for the Commission to amend the adopted By-Laws and if the Commission chooses to adopt the By-Laws that are presented tonight, amendments can be made in the future. Member Myjak said that this document is a modification and is not the current By-Laws. Member Myjak said that when reviewing the By-Laws that Mr. Galindo ed to the Titusville Environmental Commission members he noticed that some areas were taken out of the adopted version that currently exist and do not show in the modified version as being changed or removed (red-lined). Member Myjak said he has a problem with this document because things are missing. Vice Chairman Conklin made a motion to accept the Titusville Environmental By-Laws as presented. Page 5 of 17 2

6 Titusville Environmental Commission Meeting May 13, 2015 Member Pettit seconded the motion; there was a 5 yes, 1 no voice vote. Memorial for Tony Koromilas Mr. Galindo advised the Titusville Environmental Commission that Member Lackey attended the April 28, 2015 City Council meeting to present the proposal letter for the Tony Koromilas Memorial Park that the Commission drafted. Mr. Galindo said that City Council supported a permanent recognition for Tony Koromilas however the location will have to be determined. Mr. Galindo said the proposed location that the Commission suggested for the Memorial is already a part of the U.S. Highway 1 Corridor Plan. Mr. Galindo said that in order for the park to be planned and constructed the funding of $1.5 million dollars would have to be raised. Member Pettit asked for the Titusville Environmental Commission s approval to have a meeting with the Titusville Men s Garden Club to discuss partnering and coming up with ideas for the Tony Koromilas Memorial. Chairman Yount said he would support Member Pettit s request to have the meeting with the Titusville Men s Garden Club to discuss Tony s Memorial. Chairman Yount, Vice Chairman Conklin and Member Chavier asked Mr. Galindo if City Council suggested that the Titusville Environmental Commission come up with a way to raise the $1.5 million dollars in order to have the park be a Memorial to Tony Koromilas. Mr. Galindo said that as of right now the location is designated to be a park, however the funds are not available right now therefore if the Commission is able to raise the funds the planning of the park can be started. Chairman Yount said he thought the Developer of the new mall was going to help develop the riverfront property across the street. Member Chavier said there has been discussion about the Developer participating in the development of the riverfront property but no definite plans were made. Member Tucker asked Mr. Galindo if City Council said no to the idea of using the proposed riverfront property as the park for Tony Koromilas. Mr. Galindo said that City Council did not approve or deny the request to name the park after Tony. Vice Chairman Conklin said that City Manager Scott Larese is in the process of doing a public/private partnership with the Kiwanis Club and Rotary Club to have two separate splash parks. Vice Chairman Conklin asked if the City Manager would address the Titusville Environmental Commission and the Titusville Men s Garden Club regarding the possibility of getting a third park and naming it after Tony Koromilas. Vice Chairman Conklin said why not have a public/private partnership with long range funding goals to make the park for Tony and a sign can be installed that says future site of Tony Koromilas Park. Mr. Galindo said he will speak to the City Manager in regards to talking to the TEC and the Titusville Men s Garden Club about the park for Tony. Member Chamberlain made a motion to table the new business agenda item TEC webpage until the June 10, 2015 meeting. Vice Chairman Conklin seconded the motion; there was a unanimous voice vote in favor. Page 6 of 17 3

7 Titusville Environmental Commission Meeting May 13, 2015 New Business Titusville Environmental Commission Semi Annual Report Chairman Yount said the Semi Annual report is very good and he likes how it gives the breakdown of what the Commission is doing each month. Chairman Yount said he is unable to present the report to City Council due to his teaching schedule. Vice Chairman Conklin volunteered to present the semi-annual report to City Council on June 9, Vice Chairman Conklin made a motion to approve the semi-annual report. Member Tucker seconded the motion; there was a unanimous voice vote in favor. Reports Chairman Yount said he came across an article that said that fire-proofing chemicals have been found in the Indian River Lagoon as of April 30, Member Myjak said he attended the DEP and St. Johns River out brief for the IRL BMAP technical meeting on April 21, They were reporting on two main concerns. One is the watershed model which is wrong about 50% of the time. Member Myjak said it was interesting watching the comparative analysis of the data sets that are used to train the model and then apply it again using the same data to see if it actually followed what happened and it was only off by 50%. The curves, spikes and valleys matched up very well but the area under the curve was off by half which means it is only measuring or following half of the watershed. Member Myjak said they believe this is due to the amount of nutrients coming in off of the watershed are approximately in order of magnitude or more less than the problems that they have with the muck in the water as is now. Member Myjak said when things are compared such as the turbidity and the color of the water relative to its health then you begin to understand what is going on. The model was everything from basic rainfall to how that loads the watershed to the nutrients that it picks up the amount of phytoplankton growth that comes out of that and then the kind of light continuation that can occur as well as from the turbidity and how it filters down to the sea grasses. There are several things that are taken into account: atmospheric cooling and heating, trans-evaporation and evapotranspiration. Member Myjak said it is putting more water into the atmosphere than rainfall which makes no sense because how can you have negative rainfall, but we do because ground water wells up from underneath and we have dry season. This turns out to be one of the big errors that they have modeled and when they went back and did a closer look they realized that this can occur. The second report was given by Virginia Barker who is the Director of Environmental Services at the County. The analysis that Ms. Barker gave involved evapotranspiration with rainfall going back and rainfall coming down and there is a transfer of nutrients that occurs both in the Indian River Lagoon and from the land into the Indian River Lagoon. The modeling that they had prior was not properly modeling that movement of nutrients. Ms. Barker also brought up the amount of muck and messes with their models and does not allow them to get a good picture of what is actually happening because it is so overwhelming. Member Myjak said they are in the process of funding $500, to several different contracts through the State and DEP and EAP to FIT. $365, is a separate effort to look at muck removal Page 7 of 17 4

8 Titusville Environmental Commission Meeting May 13, 2015 modeling, how can the muck be removed. Member Myjak said it will probably require physical trial and error. They will be using the sheet flow model to do an analysis. $130, will be going into muck removal to determine the best way to remove muck and also another funding project that is looking at the movement and fluidity of muck within the system. The wind moves the muck depending on the direction of the wind. The biggest outcome from the meeting is areas one, two and three A have some significant recovery in the Indian River Lagoon. They are not at the level where additional removal is needed this year. All the areas to the south are having to increase the TMDL s in the water. There was a 14% recovery in sea grass measured last year. A study is taking place at FIT to find out if planting sea grass really works and will it spread. A lot of stake holders are still upset at the amount of TMDL s that have to be maintained and trying to do more. Vice Chairman Conklin said his company was turned down from a rather large Federal Project because he couldn t find the best way to go about making a green building. Vice Chairman Conklin said he is pursuing training/testing in this area and he has a lot to learn in the area of green buildings. REPORT TO COUNCIL To: From: Subject: Department/Office: Titusville Environmental Commission Members Peggy Busacca, Community Development Director Septic Tanks Recommended Action: Review the issue of septic tank replacement and propose action to Council if needed. Summary Explanation & Background: At the January 13, 2105 Regular City Council meeting (6:30 p.m.), TEC Vice-Chairman Conklin presented the TEC semi-annual report. Following discussion by Council, Vice-Chairman Conklin advised that he would request the TEC to review the issue of septic tanks. At the February 11, 2015 TEC meeting, Chairman Yount asked Staff to contact the St. Johns River Water Management District to determine if the District is monitoring water quality near City outfalls. Vice-Chairman Conklin requested a map from Staff indicating the locations of septic tanks within the City. At the March 11, 2015 TEC meeting Sean Stauffer, Water Resources Director for the City, presented a map showing which properties are on sewer and which are assumed to be on septic systems. The Commission discussed requiring sewer tie ins and the estimated costs for homeowners to connect. TEC requested Staff create two new maps for the April 15, 2015 meeting. Water quality data maintained by SJRWMD was discussed. At the April 11, 2015 TEC meeting Melissa Brock, Environmental Health Director of the Florida Department of Health, was present to discuss State requirements for permitting and the status of the Florida Water Management Inventory. Chuck Jacoby and Ann Benedetti, representatives for the St. Johns River Water Management District, were also present and discussed water quality monitoring efforts by the District. The connection between septic tanks and water quality in the Indian River Lagoon is unclear and requires further research according to Mr. Jacoby. Chairman Yount would like to draft a preliminary list of inexpensive recommendations relating to septic tanks in the City. At the May 13, 2015 TEC meeting the Commission created a preliminary list of recommendations to City Council for possible solutions to septic tank concerns. The Commission asked Staff to provide any information, at the next meeting, on the methods used by similar cities which have transitioned from septic to sewer. Chairman Yount will draft the list of recommendations and present them at the following meeting. Alternatives: 1. Do not review the issue of septic tanks further. Page 9 of 17

Summary Explanation & Background: At the February 11, 2015 TEC meeting the Commission requested Staff provide information specific to a particular site for a prospective memorial park. At the March 11, 2015 TEC meeting Staff recommended the TEC finalize a written proposal for City Council to consider naming the prospective site for former Member Koromilas. The TEC requested Mr. Bill Klein's proposal be included in the April 15, 2015 agenda. At the April 11, 2015 TEC meeting the Commission unanimously passed a motion to approve the proposal letter to City Council. At the April 28, :30pm City Council meeting Member Lackey presented the proposal letter to City Council. At the May 13, 2015 TEC meeting the Commission reviewed City Council's recommendations following the reading of the TEC proposal letter and requested a meeting with the City Manager and the Titusville Men's Garden Club. 13 By-Laws Of The Titusville Environmental Commission Article I. Duties and Powers The duties and powers of the Titusville Environmental Commission shall be those set forth in Section , Land Development Regulations, of the City of Titusville, as amended February 3, Article II. Membership Any member of the Commission who fails to attend three or more consecutive regular meetings (not including special or workshop meetings) shall automatically forfeit membership in the Commission and the Chairman shall so inform the City Council. Any member of the Commission who fails to attend more than fifty percent (50%) of the regular, special or workshop meetings of the Commission within a six (6) month period shall automatically forfeit membership on the Commission and the Chairman shall so inform the City Council. Upon the approval of the City Council, the Council may authorize a member to miss more than three (3) consecutive meetings or more than fifty percent (50%) of the regular, special or workshop meetings during a six (6) month period. All members shall abide by the Standards of Conduct set forth in Article III, Sections 2-51 and 2-55 of the Code of Ordinances. Membership shall be in accord with the provisions of Section , Land Development Regulations, City of Titusville. Article III. Membership A Chairman, who shall preside at all meetings and public hearings and shall have other duties as further prescribed in these By-laws. A Vice-Chairman, who shall, in the absence of the Chairman or his inability to act, have the powers to function in the same capacity as the Chairman. Article IV. Election of Officers and Vacancies In accordance with Section , Land Development Regulations of the City of Titusville, the Chairman, Vice-Chairman, and Secretary shall be elected by the Commission from its membership. Terms of office shall be for one (1) year. Elections shall be held annually at the second meeting in November. The Commission shall, from its membership, fill any vacancy in these offices by election. Page 13 of 17

14 Article V. Meetings Section 1. Regular Titusville Environmental Commission meetings shall be held on the Wednesday following the second Tuesday of each month at 5:30p.m in the City Council Chambers. Any regular meeting may be adjourned to a definite date and time as established by four (4) concurring votes of Commission members. Section 2. Adjourned, called, or special meetings may be held at any time, as required, subject to the call of the Chairman, or in his absence, by the Vice- Chairman. Upon written request of four (4) members, a special called meeting shall be held by the Chairman, or in his absence, by the Vice- Chairman. The Secretary shall have the authority to call a special meeting. Section 3. Each member shall be notified of the date and time of each meeting by written notice or by telephone at least one week prior to the meeting. In cases where a meeting is cancelled, Commission members shall be notified at least 24 hours prior to the scheduled meeting. Section 4. All meetings shall be open to the public. All agendas for the present meeting shall be posted on the bulletin board in the City Hall lobby. Article Vl. Quorum As set forth in Section (b), Land Development Regulations, four (4) members shall constitute a quorum; and concurring vote of at least four (4) members shall be required to pass on any matter. Article VII. Voting Section 1. Voting on all matters of business shall be by roll call or general consent. However, if the Commission is to make a recommendation to City Council, or other boards and commissions, the vote will be by roll call with the Recording Secretary recording the vote of each member in rotating order. The first roll call vote will begin with the Chairman followed by the Vice- Chairman, followed by the Secretary, followed by the members ( in alphabetical order) and rotating the order for each roll call vote following Section 2. No member present shall abstain from voting unless it is established that such member has a conflict of interest in the matter being voted upon. Article VIII. Alternate Members The alternate members may serve on the commission in lieu of a regular member when said regular member is unable to attend an official meeting of the commission; or, when a regular member has a conflict of interest on any item, said alternate member shall serve for the entire meeting or for the particular item that is the subject matter of the said conflict. The Chairman shall designate which alternate member shall serve. Alternate members may serve on standing or special committees. Page 14 of 17

15 Article IX. Order of Business Section 1. At regular meetings, the general order of business shall be as follows: 1. Call to order; 2. Roll call; 3. determination of a quorum; 4. Review of the minutes of the last preceding meeting and action thereon; 5. Reports; 6. Old Business; 7. New Business; 8. Petitions and Requests from the public and press; and adjournment. Section 2. In order to provide an opportunity for discussion of business before the Commission, prior to the making of a motion the Chairman shall state the matter of business and then provide a period of discussion of the relevant facts. After a motion is made and seconded, the Chairman may ask for additional discussion prior to the vote. Section 3. Citizens having business before the Commission shall be invited to speak immediately prior to discussion by the Commission on the matter with which they are concerned. If in the opinion of the Chairman time limitations are necessary in order to complete the agenda, the Chairman may place time limits for each speaker. Section 4. The order of business for called or special meeting shall be as follows 1. Call to order; 2. Roll call; 3. Determination of a quorum; 4. Business that is the subject of the meeting; and 5. Adjournment; Article X. Minutes Minutes of all meetings shall be recorded by the Secretary or designated representative; certified by the Secretary after approval by the Commission; and become a public record of the proceedings of the meeting. Article XII. Committees The Chairman may appoint such committees as deemed necessary from time to time. The chairman shall be an ex-officio member on all committees but shall have no vote on the committee, unless he is an active member of that committee. Article XII. Hearings The Titusville Environmental Commission may hold public hearings when deemed expedient and necessary. Notice of such hearings shall be in accordance Page 15 of 17

16 with the provisions of the City Charter and Code of Ordinances of the City of Titusville. Article XIII. Parliamentary Authority and Organization Procedure The rules contained in the latest available edition of Roberts Rules of Order are hereby adopted by the reference and shall apply at all meetings of the Commission and its committees, to the extent that such rules are not in conflict with these By-laws. Article XIV. Correspondence and Communications Section 1. Official communications of the Commission to the City Council shall be in writing. All original records, recommendations and reports shall be kept in the Commission files in City Hall. Section 2. Any correspondence, notices (other than administrative procedures), communications, reports, studies, and plans originating from the Commission shall be authorized by the Commission members and signed by the Chairman. Article XV. Amendment Amendment to these By-laws must be presented for discussion, in writing, at one meeting and voted upon at the next meeting Page 16 of 17
