3 Arkansas State University Staff Senate Meeting March 27, 2013 The Arkansas State University Staff Senate met on Wednesday, March 27, 2013, in the Delta Center for Economic Development Executive Board Room, on the ASU-Jonesboro campus. Vice President Angela Daniels called the meeting to order at 2:00 p.m. In attendance: Tabitha Foreman as proxy for Karen Barker, Esther Boyd, Jeannie Cossey, Tonya Crittenden, Angela Daniels, Debbie Davis, Emily Devereux, Kasey Eakins, Traci Ellington, Talvickeo Banks as proxy for Darla Fletcher, Hester Hall, Lola Langley, Joyce Mann, David McKinney, Janet Moore, Carlos Larry as proxy for Kimla Parker, Sheryl Puckett, Jacob Robbins, Connie Scott, Cassey Tune, Haley Rogers as proxy for Elizabeth Wakefield, and Deanna Warren. February Minutes: No changes or corrections to the February Minutes. February minutes were approved. March Treasury: Reported by Janet Moore. Approved. New Business: a. Human Resources Update Lori Winn updated the senators and staff present regarding the status of the IRS Fraud affecting ASU faculty and staff. As of 3/26/13 afternoon, there have been 209 ASU faculty/staff affected. ASU has a bid process in place for an outside vendor to test the ASU systems. Best practices with personal information will be sent to employees later this week. There is limited information in what can be shared due to the federal ongoing investigation. ASU is looking to implement an identify protection employee benefit. Lori encouraged senators and staff to use the ASU webpage s tax fraud link as a communication tool with the campus community for updates. She also announced that all employees, even if have not yet been impacted, need to file the IRS Potentially Impacted Form with the IRS (do not put your social security number on it and can use your driver s license picture). Those who have been individually impacted will receive a letter this week on how to file taxes. Also for note, Lori mentioned that if you call the IRS and they give instructions other than what is on the HR website, then confirm your instructions with HR. The IRS Investigative Office has requested the steps be followed that have been posted on the HR website. IRS representatives are across offices and may have different advice than what ASU s case requires. Lori also updated the senate and staff present on the non-classified evaluations. The process is formally at the Executive Team level. It has not yet been approved and the merit program is not available right now. Non-classified employees and their supervisors need to go ahead and form goals and objectives to work on to be evaluated this next year. Employees need to speak with supervisors if they have not yet been communicated with regarding evaluations.
4 Lori gave an update on the diabetes management program for employees. Health Connect Blue is an online resource for wellness management programs from BCBS. If you get any communication requesting information from ASU s benefit vendors, you can call HR and they can update your information for you to the vendor. b. SP Concealed Handguns on Campus Randy Martin, University Police Chief, stated that the Act s language allows full-time faculty and staff at state universities to carry weapons on campus if in possession of a concealed permit. The Board of Trustees have an option to opt out each year. The Shared Governance proposal is to get campus feedback. Staff Senate is currently working on an anonymous survey to send out for feedback and poll of the staff community to share with Administration. Need legal interpretation for questions: (1.0) can opt out be designated at different campuses and buildings? (2) Can faculty/staff leave the weapon in the vehicle while at work, or will it be an all or nothing? (3) when Board of Trustees either opts out or not opts out, will the concealed laws take over? Old Business: a. Holiday Calendar Approved 2013 Holiday Option 1 was approved. The holiday break will be 2 full weeks (12/23-1/3). Vacation days will be assessed on December 13, January 2 & 3 (One in 2013 & two in 2014). Communication will need to go out to announce the 12/31 hours adjusted. It was suggested that communication be sent in September for vacation day planning to employees at their 240 hour max. Staff Senate s website will provide an update and then carry out constituent s. b. SGOC Update There will be one proposal expected at next month s meeting. c. Distinguished Performance Awards Update The nomination deadline of March 27 was announced at the meeting. d. Staff Senate Picnic Update The picnic committee had a meeting on Tuesday, 3/26, and the next communication piece will be a flyer. Subway will be donating a veggie tray for the picnic. Goody bags will be handed out this year instead of door prizes. A volunteer schedule is fixing to be distributed. e. University Procedures Website The website page is published with the exception of the University Advancement for Creative Services (Mark Reeves has sent information for approval). Cassey Tune asked senators to look for an from her with a link that connects to the procedures on the web and send any corrections to Cassey that you know of.
5 Report from the President/Open Discussion: a. Elections Nomination forms, notifications of acceptance and the voting process timeline to go out next week. b. Carter Ford Carter Ford, Red Wolves Foundation, introduced himself and reminded senators and staff of the 20% employee discount on season tickets and encouraged everyone to start purchasing for football season. Announcement and Reminders a. Next meeting is April 17, 2013, 2p, Delta Center for Economic Development Executive Board Room. b. Staff Senate Picnic is on May 15 this year. Need to discuss and vote at next meeting to move May s meeting to May 22. A motion to adjourn was made by Deanna Warren and seconded by Sheryl Puckett. Woods For An Act To Be Entitled AN ACT TO ALLOW TRAINED AND LICENSED STAFF AND FACULTY TO CARRY A CONCEALED HANDGUN ON A UNIVERSITY, COLLEGE, OR COMMUNITY COLLEGE CAMPUS UNDER CERTAIN CIRCUMSTANCES; AND FOR OTHER PURPOSES. Subtitle TO ALLOW TRAINED AND LICENSED STAFF AND FACULTY TO CARRY A CONCEALED HANDGUN ON A UNIVERSITY, COLLEGE, OR COMMUNITY COLLEGE CAMPUS UNDER CERTAIN CIRCUMSTANCES. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: SECTION 1. Arkansas Code (c)(1), regarding possession of a handgun by a minor on school property, is amended to read as follows: (c)(1) No Except as provided in , no a person in this state shall not possess a handgun upon the property of any private institution of higher education or a publicly supported institution of higher education in this state on or about his or her person, in a vehicle occupied by him or her, or otherwise readily available for use with a purpose to employ the handgun as a weapon against a person. SECTION 2. Arkansas Code (a)(1), regarding the carrying of a firearm in publicly owned buildings or facilities, is amended to read as *BPG121* :47:42 BPG121
8 As Engrossed: H2/13/13 HB follows: (a)(1) It Except as provided in , it is unlawful for any person other than a law enforcement officer or a security guard in the employ of the state or an agency of the state, or any city or county, or any state or federal military personnel, to knowingly carry or possess a loaded firearm or other deadly weapon in any publicly owned building or facility or on the State Capitol grounds. SECTION 3. Arkansas Code (14), regarding the carrying of concealed weapons in certain places, is amended to read as follows: (14) Any A school, college, community college, or university campus building or event, unless: (A) for For the purpose of participating in an authorized firearms-related activity; or (B) Otherwise provided for in ; SECTION 4. Arkansas Code (19), regarding the carrying of concealed weapons in certain places, is amended to read as follows: (19)(A)(i) Any place at the discretion of the person or entity exercising control over the physical location of the place by placing at each entrance to the place a written notice clearly readable at a distance of not less than ten feet (10') that carrying a handgun is prohibited. (B)(i)(ii)(a) If the place does not have a roadway entrance, there shall be a written notice placed anywhere upon the premises of the place. (ii)(b) In addition to the requirement of subdivision (19)(B)(i)(19)(A)ii)(a) of this section, there shall be at least one (1) written notice posted within every three (3) acres of a place with no roadway entrance. (C)(iii) A written notice as described in subdivision (19)(A) of this section is not required for a private home. (D)(iv) Any licensee entering a private home shall notify the occupant that the licensee is carrying a concealed handgun. (B) Subdivision (19)(A) of this section does not apply if the physical location is a public university, public college, or community college, as defined in , and the licensee is carrying a concealed :47:42 BPG121
9 As Engrossed: H2/13/13 HB handgun as provided under SECTION 5. Arkansas Code Title 5, Chapter 73, Subchapter 3, is amended to add a new section to read as follows: Concealed handguns in a university, college, or community college building. (a) As used in this section: (1)(A) "Public university, public college, or community college" means an institution that: (i) Regularly receives budgetary support from the state government; (ii) Is part of the University of Arkansas or Arkansas State University systems; or (iii) Is required to report to the Arkansas Higher Education Coordinating Board. (B) "Public university, public college, or community college" does not include a private university or private college solely because: (i) Students attending the private university or private college receive state-supported scholarships; or (ii) The private university or private college voluntarily reports to the Arkansas Higher Education Coordinating Board; and (2) "Staff member" means a person who is not enrolled as a fulltime student at the university, college, or community college and is either employed by the university, college, or community college full time or is on a nine-month or twelve-month appointment at the university, college, or community college as a faculty member. (b) A licensee may possess a concealed handgun in the buildings and on the grounds, whether owned or leased by the public university, public college, or public community college, of the public university, public college, or public community college where he or she is employed unless otherwise prohibited by if: (1) He or she is a staff member; and (2)(A) The governing board of the public university, public college, or public community college does not adopt a policy expressly disallowing the carrying of a concealed handgun by staff members in the :47:42 BPG121
10 As Engrossed: H2/13/13 HB buildings or on the grounds of the public university, public college, or public community college and posts notices as described in (19). (B) A governing board of the public university, public college, or public community college may adopt differing policies for the carrying of a concealed handgun by staff members for different campuses, areas of a campus, or individual buildings of the public university, public college, or public community college for which the governing board is responsible. (C) A policy disallowing the carrying of a concealed handgun by staff members into the public university, public college, or public community college expires one (1) year after the date of adoption and must be readopted each year by the governing board of the public university, public college, or public community college to remain in effect. (c) A licensee may possess a concealed handgun in the buildings and on the grounds of the private university or private college where he or she is employed unless otherwise prohibited by if: (1) He or she is a staff member; and (2) The private university or private college does not adopt a policy expressly disallowing the carrying of a concealed handgun in the buildings and on the grounds of the private university or private college and posts notices as described in (19).
