Mayor, Kevin J. Dumas of Attleboro attended our meeting and presented MBCA with a Citation honoring the office of Constable in the Commonwealth. His complimentary remarks will forever be remembered as a Mayor who understands and appreciates the role of constables in Massachusetts cities and towns. Attleboro Police Chief, Kyle P. Heagney welcomed MBCA members and made a similar presentation as the Mayor of the City of Attleboro. It was evident that the City of Attleboro favors the role of Constables. Again, our sincere thanks and appreciation to Walter Chicoine for hosting the April Membership Meeting. MBCA MEMBERSHIP DRIVE: The Executive Board led by President Ramponi recently sent out 1300 pieces of mail state-wide to prospective MBCA members. We are hopeful that a number of those contacted about the benefits of MBCA membership will consider joining our association. A cover letter from President Ramponi outlining the benefits of MBCA membership, a membership application, and a registration form for the forthcoming Constable Training Seminars were included in the mailing. CONSTABLE TRAINING SEMINARS: If you missed our recent Cobstable Training Seminars, we encourage you to sign up immediately prior to the class now populating for May 19, 2012 at West Cummings Park, Washington St., Woburn, Bldg. 800, 4th Floor Conference Room #4750. M.B.C.A. LEGISLATION TO INCREASE THE AD DAMNUM (DAMAGES) LIMIT FOR CONSTABLE SERVICE TO $25,000. The Senate Bill was refiled by Senator Katherine M. Clark of Melrose, the Bill number is SENATE 680, and was assigned to the Joint Judiciary Committee. The House Bill was refiled by Representative James J. Dwyer of Woburn, the number is HOUSE 433 and was also assigned to the Joint Judiciary Committee. As mentioned in the past It is tremendously important that we work diligently to reach every member of the Legislature to gain their support for our House and Senate Bills. Please contact your individual legislators to get the support needed for favorable release and passage. Last year we gained sufficient support to release our bills favorably from Joint Judiciary. We need your help to do it again this year. PLEASE ACT NOW! RECENT MBCA QUESTIONS: HOW DO I RECEIVE A COPY OF THE MBCA DIRECTORY? ANSWER: The complete MBCA DIRECTORY OF BONDED CONSTABLES is on line at and can be easily downloaded. Printed and placed in a binder to create a hard copy of the Directory. Simply go to the MBCA homepage at click on Constable Directory pdf to access the Directory.

3 WHERE DO I OBTAIN A CONSTABLE S BADGE/ID? ANSWER: MBCA Badge and ID Program. MBCA orders its Constables Badges from Blackinton Badge Co. MBCA is an authorized dealer in the northeast area. All badges made up by Blackinton Badge must be ordered by Mass. Bay I.D. & Badge Co. Attn: Sally M. Hoyt. The badges are made up personally with your name on it, and a badge/id number is assigned just to you forever. The Badge format was authorized/approved many years ago by then Secretary of State, John F.X. Davoren. MBCA will mail you a Badge/ID application upon request. The badge and ID Program is available to any constable in Massachusetts DO I SERVE THE ORIGINAL PROCESS GIVEN TO ME? ANSWER: No, unless you are specifically asked to serve the original, such as a Letteror Notice to someone, etc. Attested copies of Court documents are normally served. The original Court document with the State Seal is generally returned to Court by the attorney/plaintiff, or you, with the Officer s Return of Service endorsed thereon. WHERE CAN I OBTAIN A CONSTABLES BOND FOR A REASONABLE COST? I PAID $350 FOR MY CURRENT BOND. ANSWER: If you are unable to purchase a 3-year $5,000.bond for $50.00 You can contact David Smith, Bond Manager at the Burgin,Platner & Hurley Agency, LLC at 14 Franklin St., Quincy, MA 02169, Tel The have been writing constable bonds for a long time and charge $ You should not have to pay $350. for a three-year bond. CAN I LEAVE CIVIL PROCESS AT LAST AND USUAL IF NO ONE COMES TO THE DOOR? ANSWER: Usually Yes. However, there are certain documents that must be served In Hand, such as Divorces, Guardianships, Conservatorships, Change of Name, etc. Check with the attorney who sent the documents to you to be certain. WHAT HAPPENS IF I FORGET TO LEAVE A WITNESS FEE FOR A SUBPOENA? ANSWER: Return to the address where you left the Subpoena and present the Witness Fee in an envelope addressed to the person being subpoenaed. Unless you leave a Witness Fee, the person summoned does not have to appear. IF I SERVE A DOCUMENT IN HAND TO SOMEONE ELSE AT A RESIDENCE WHERE I WAS INSTRUCTED TO SERVE IT, WOULD IT BE LEGAL TO SAY I SERVED IT IN HAND TO THE PERSON NAMED? ANSWER: No, Unless you served the document in hand to the person named in the document, it was not served in hand. Please join us on Sunday, May 20th and bring your questions with you.
