The President and Secretary have spent countless hours over the past six years with the help and support of the Officers, Directors and Membership to achieve this goal. However, all is not over and more needs to be done as the legislature will be recessing by mid- July. The Bill is now headed to the Senate Ethics and Rules Committee. We need each and every member to contact the various members of the Committee and their own State Senators and State Representatives requesting a quick release of the bill for voting. Box 35155, Brighton, MA EDUCATIONAL INFORMATION: (Taken from some of the questions we have received) When serving Summary Process Summons and Complaints, never serve the original since it must be returned to court with your Return of Service. Make three copies of the original, keep the original in the envelope received from Attorney or Plaintiff. You can identify the original because it has the Court s seal impressed on it. Serve a copy with your attestation (i.e. a true copy, attest, and sign your name below it), and if it was left at Last and Usual place of abode, be sure to forthwith mail a copy to the tenant first class postage paid. You can charge the Attorney or Plaintiff for the postage. You should make your Return of Service on the back of the Summary Process Summons and Complaint. Most of your Returns of Service are similar. Returns should contain the names of documents, the name and address of Defendant/Debtor, the date it was served, to whom it was served, where it was served, the time, and if served in hand and if left at the Last and Usual place of abode, that you forthwith mailed a copy first class postage paid to said address of Defendant/Debtor: PROOF OF SERVICE I, (your name) hereby certify and return that on (date served) I served the within (names of documents) to the within named (name of person you are to serve) at (address, street, city/town/zip code) by delivering copies of the same in hand, or by leaving said documents at his/her last and usual place of abode. Copies of the same were mailed to the defendant/debtor first class postage paid on (date). CORRECTION: In last months Newsletter it was stated that Paternity documents must be served in hand. That has been changed and they can be left at the Last and Usual place of abode as well. CONSTABLE REQUESTING BOP INFORMATION FROM POLICE DEPTS. Member Alan Jeskey a police department dispatcher (Thank You Alan) has sent us the Massachusetts Criminal History System Board (CHSB) latest policy concerning BOP requests also known as CORI records requests by Massachusetts constables executing a valid arrest warrant. Please note that it is left up to the individual police department as to whether or not it will honor the CORI request. We feel that all Massachusetts police departments should honor such requests to protect the personal safety of the constable charged with executing a valid arrest warrant. The complete text of the CHSB policy is as follows: Criminal History Systems Board (CHSB) Policy on Constable Access to Criminal Offender Record Information (CORI)
4 The CHSB has implemented the following policy with regard to Constable access to CORI: Local police departments may conduct Criminal Justice Information System (CNS) Board of Probation (BOP) inquiries for duly licensed Constables solely for the purpose of Constable safety. BOP inquiries for a Constable can only be performed by a police department when all of the following conditions are met: The Constable is serving a warrant within the jurisdiction of the police department performing the BOP inquiry; The Constable must present the original warrant at the time of inquiry; and The Constable must show proper credentials identifying himself, herself as a bonded Constable. If all of the above conditions are met, the police department may conduct a BOP inquiry on the subject of the warrant only. If a police department chooses to conduct a BOP inquiry for a Constable, the following additional constraints apply: The Constable may not retain the hard-copy printout of the subject's BOP record; The police department shall not photocopy or otherwise reproduce the subject's BOP record; and The police department will record the dissemination of the BOP information in its Secondary Dissemination Log. Any questions concerning this policy should be directed to the CHSB's Office of the General Counsel at We hope the foregoing information will be helpful to you if called upon to execute a valid arrest warrant in the course of your duties.
