2 Historic District Commission Amanda Harrell-Seyburn James Robertson Charles Roboski, Aron Sousa, Diane Wing and Jessica Flores Pablo Majano, Secretary Historic Preservation Code The East Lansing Historic Preservation Code was adopted in The purpose of the ordinance, as noted under Section 20-2, is to: "Ensure the recognition, preservation and protection of historical and architectural sites, buildings, structures, objects, features, and open spaces;...encourage property owners and residents to participate in preservation activities; enhance, improve, and preserve neighborhoods; stabilize and improve property values...strengthen the local economy; foster civic beauty and pride; and promote the use of Historic Districts and Heritage Neighborhoods for the education, pleasure and welfare of the citizens of East Lansing... In addition, the scope of the Ordinance notes under Section 20-4: "The provisions of this Code are intended to acknowledge the eclectic nature of early 20th century architecture and are expressly intended to permit changes to buildings within Historic Districts which help them retain their historic character as established by this Chapter." Historic District Commission Review The Historic District Commission meets the second Thursday of each month. The Historic District Commission's review of proposals that require a public hearing use the following process: 1. Staff report is given which describes location, property owner, description of building and building history, current zoning, applicant's request, and the relevant sections of the Historic Preservation Code. 2. Applicant's presentation - Applicant may speak on his/her own behalf and present additional information. 3. Questions by the Commission. 4. Public Hearing Opened (pertaining to this case). 5. Rebuttal/additional comments by applicant. 6. Public Hearing Closed, followed by Commission discussion and action. The Historic District Commission will act on each request within 60 days of the filing date of the application unless an extension is agreed upon in writing by the applicant and the Commission. Guidelines for Public Comment The Commission asks that if you have written comments, please submit a copy to the Secretary for inclusion in the record and give a summary of the comments in the public comment portion of the meeting. Motion carried unanimously by a vote of 5 to 0. 2) COMMUNICATIONS Alison Lee, 942 Cresentwood Road, presented a concept design plan and said he is asking for feedback on building a sunroom. Commission asked questions regarding clarification of location, windows, doors, dormer, materials, and design. Harrell-Seyburn commented on ice build up and the possibility of a shed roof. Majano said ideas regarding contractors who have worked with historic structures can be ed. 3) COUNCIL LIAISON REPORT None 4) PUBLIC HEARINGS None 5) OLD BUSINESS A) A request from Dr. Gary Bente, for the property at 303 Chesterfield Parkway, to construct an addition of a front porch to the home. Harrell-Seyburn said this request is currently on hold. Majano said Bente is still is Germany and requested that application be considered at Historic District Commission May meeting. Motion: Sousa moved to approve consideration of request from Dr. Gary Bente for property at 303 Chesterfield Parkway, to construct an addition of a front porch to the home until Historic District Commission meeting in May. Motion was seconded by Wing. Vote: All yeas. Motion carried unanimously by a vote of 5 to 0 6) NEW BUSINESS A) City Attorney Q&A Majano said City Attorney Tom Yeadon is present this evening to answer questions regarding what Historic District Commission can prohibit/allow or what changes can be made per ordinance in City Code Chapter 20, Historic Preservation. Majano said first question involves creation of procedure to determine a complete application. Harrell-Seyburn commented on quality of applications, need to request more information rather than just denying or tabling an application, and procedure for citizens to appeal HDC decision. Yeadon discussed background, highlighted timeline in relation to completed application and HDC decision, and citizen appeal. Commission discussed timing of a completed application coming before HDC, role of staff Historic District officer in this process, and appeal options for citizens. 5 Commission discussed items which are missing from applications, and accuracy and specification of drawings which enable HDC to make a yea or nay decision. Yeadon asked regarding current list of needed items on application. Majano said every application/project is different and he cannot speak for HDC and what they might desire to see when it comes before the Commission. Commission referenced inconsistency in complying with "show in detail" requirement and responsibility in determination of completion of application. Yeadon said some clarification can be accomplished with ordinance. Commission discussed code language and current appeal options to decisions made by HDC. Commission discussed timing of current 60 day HDC decision window and clarification of when the 60 days begin, need for specific clarification for applicant to complete an application, Commission quorum, and adherence to Secretary of Interior standards. Yeadon commented on when applicant brings application to staff, determination of completeness, and HDC decision within the 60 day window. Yeadon said if HDC desires 90 day window Commission could present that to City Council which might then direct Yeadon to draft ordinance language. Commission discussed also clarifying other unclear language in the code. Wing referenced timing extension language in Chapter 20-63(a), how that is affected by meeting dates of HDC, approval by timing, need for action by HDC, and need for clearer language. Commission discussed definition and clearer language of completed application. Flores asked Majano regarding first review of an application. Majano said he makes sure the bare minimum is included. Commission discussed process to clarify ordinance language, suggested language of 90 day window, and process and standards of public notice for special meetings. Majano highlighted process of making periodic suggested changes to City Council. He said he will draft a memorandum for City Council with suggested areas HDC would like to address with changes and bring it next HDC meeting for review before it is sent on to City Council. Commission asked Yeadon regarding legislation and historic district green space, open areas, change which impacts a park, change in visibility, landscape, or shadows, and how that complies with Secretary of Interior standards. Yeadon said City standards are drawn farther than Secretary of Interior standards and referenced decision concerns. He also referenced other conflicting standards in zoning codes, tree ordinances, historic district standards, and zoning vs property rights. Sousa asked regarding mature trees in historic neighborhoods which are dying and not being replaced, cited examples, and said over time that will change the nature of those historic neighborhoods. Flores commented regarding guidelines which describe trees and landscape as contributing factors to historic neighborhoods. Commission discussed trees and tree trimming in historic districts and City-wide, and commented on utility companies' easement/property rights and trimming standards. Harrell-Seyburn said Commission will continue to brain-storm on tree topic in historic districts. Commission discussed public benefit. 6 B) House of the Month Award Majano brought forward three nominations to the Commission for house of the month: 518 M.A.C. Avenue 225 Chesterfield Parkway 1140 Michigan Avenue Harrell-Seyburn discussed house on 518 M.A.C. Avenue. Wing discussed 225 Chesterfield Parkway. Flores discussed 1140 Michigan Avenue. Motion: Sousa moved to approve 518 M.A.C. Avenue as House of the Month for the month of March. Motion was seconded by Roboski. Vote: All yeas. Motion carried unanimously by a vote of 5 to 0. Majano said winner receives a signed certificate and photo of winning home is posted on social media. 7) COMMISSIONER REPORTS Majano reported he has an intern who works with him once a week and is mapping a report to be sent to Board of Water and Light for any repairs/paint for historic street lights. Commission discussed style of historic lights, light pollution, and lid for historic lamp posts. Majano shared his HDC tracker which keeps a list of what has been approved by him, by Commission, compliance, and inspection timelines. 8) STAFF REPORTS 9) ASSIGNMENTS Majano reminded Commissioners to come up with nominations for house of the month award. 10) ADJOURNMENT Motion: Sousa moved to adjourn. 8 Majano said this property has come before the Commission previously with a request for vinyl siding and windows. He said this request is for aluminum clad windows in six locations and an aluminum-type siding with a different, more ridged, profile. He said the applicant and contractor as both here tonight and provided samples of proposed siding and windows. Alison Lee, the applicant and contractor, Taylor Teachout, outlined rationale for siding and windows and answered questions from Commission. Harrell-Seyburn asked regarding muntins and configuration of windows. Teachout said windows will have same colonial style as existing and aluminum storms. Harrell-Seyburn asked regarding interior muntins. Teachout said they can either be snap-in or between panes of glass. Flores asked regarding images of existing windows and siding to show level of deterioration. Teachout said current eight inch siding shows imperfections more than new four inch. Flores asked regarding removing siding to original wood. Lee referenced aluminum corners and unknown damage to wood beneath siding. Teachout said once aluminum siding is removed, a moisture barrier can be installed and damaged boards can be replaced. Flores said once aluminum siding is removed, original wood might be a more advantageous route to take. Harrell-Seyburn suggested original siding be investigated once aluminum siding is removed as sometimes siding was added in 1980's for the look, rather than to cover damaged boards. She said it might be a four inch profile and Commission is in favor of supporting original materials. Harrell- Seyburn commented on desire for windows to have muntins on both inside and outside with pane between. Flores said existing windows from 1952 can be rehabilitated with new storms. Flores suggested applicant review existing conditions of windows and siding and come back to the Commission with level of deterioration to determine warranting removal and replacement. Wing asked Majano if he has been inside to see the windows. Majano said no. Lee highlighted cracked and drafty windows. Flores said they may just need to be rehabilitated with new caulking and glazing. Harrell-Seyburn said even new windows need to be rehabilitated in years. She said wood used 50 years ago was a higher quality wood than what is currently used and said new products are not as substantial long-term. Teachout said from his inspection some windows may be beyond the point of repair. Flores said the opportunity is here to re-examine siding and windows. She requested photos of level of deterioration. Wing asked regarding work to strip and remove existing siding. Teachout said they will remove all of eight inch aluminum siding down to the wood, inspect, repair, and prep surface for new siding. 9 Flores said total wrapping of clapboard house in Tyvek will affect air movement, house will not be able to expand and contract, and other aspects of the home will expand and contract such as floorboards. She said there must be ventilation at some other location. Discussion was brought back to Commission by Majano. Majano highlighted action options Commission can take and reviewed 60 day decision window. Majano asked applicant when prior to the next HDC meeting he could visit property to examine and photograph windows to show level of deterioration. Harrell-Seyburn highlighted Secretary of Interior standards which guide HDC decisions of maintaining original materials or replacement. Wing asked regarding siding. Harrell-Seyburn said she is in favor of four inch smooth siding as a replacement as it is close to original look of the house. Wing spoke in favor of seeing photographs of home after aluminum siding has been removed. Teachout commented on maintenance costs of wood siding. Wing said photographs would be a record of what the house looks like before it is covered again. Jane Wagner, 1021 Cresenwood Road, spoke regarding cost to maintain a neighboring home on Chesterfield which removed siding and has had to repaint often due to moisture. Motion: Wing moved to approve completeness of application. Motion was seconded by Flores. Vote: All yeas. Motion carried unanimously by a vote of 4 to 0. Motion: Wing moved to approve application for 942 Cresenwood as follows: allow applicant to remove existing aluminum siding and replace it with four inch smooth aluminum siding contingent upon preservation officer viewing the house after the aluminum siding has been removed in order to assess the condition of the original siding and obtain pictures; the applicant provide access to the windows so that preservation officer can assess condition of the windows, and approval of windows will be tabled until next Historic District Commission meeting. Motion was seconded by Flores. Vote: All yeas. Motion carried unanimously by a vote of 4 to 0. Harrell-Seyburn requested contractor to specify muntins will be on both outside and inside of windows. Majano suggested times he will photograph windows and house after aluminum siding is removed. Majano commented on current fence in right-of-way and options and ramifications of replacing or moving fence. Mark Terry spoke regarding replacing wood garage doors without windows at 343 M.A.C. Majano asked to receive picture and specifications of garage door which will be used as replacement. 5) OLD BUSINESS A) A request from Dr. Gary Bente, for the property at 303 Chesterfield Parkway, to construct an addition of a front porch to the home. After discussion, Commission decided upon 325 Chesterfield Parkway as house of the month for the month of April. 7) COMMISSIONER REPORTS Commission discussed suggestions/advice which can be made to applicants, potential grant/timing for window restoration workshop, and utility substation maintenance and repair. 8) STAFF REPORTS Majano referenced draft application worksheet with check boxes indicating complete or incomplete application. Majano referenced sent to Commissioners with possible color text amendments which will then be forward on to City Council. Majano said the department intern is walking around historic districts cataloging historic lights/lamp posts for any repairs needed. 9) ASSIGNMENTS Majano reminded Commissioners to come up with nominations for house of the month award. 12 PLANNING, BUILDING & DEVELOPMENT Quality Services for a Quality Community MEMORANDUM TO: Historic District Commission FROM: Pablo Majano, Community Development Analyst DATE: May 05, 2017 SUBJECT: 942 Cresenwood City of East Lansing PLANNING, BUILDING & DEVELOPMENT 410 Abbot Road East Lansing, MI (517) The applicant for this project received partial approval at the previous meeting on April 13, The Commission approved the project to allow for a replacement aluminum siding. The commission tabled the window replacements until the May meeting. At the request of the commission staff went out to the property and took pictures of the existing windows that are being considered for replacement. Staff does not believe that the windows are severely damaged that they need to be replaced at this time. At the time of the inspection, staff recommended that the applicant seek a contractor for a repair quote and seek a wood window replacement quote. Please see the attached pictures of the windows (EXHIBIT A). ACTION NEEDED: Motion to Un-table the Certificate of Appropriateness for the replacement of the proposed windows Motion to approve or deny the Certificate of Appropriateness as submitted based on above information and the code language in Findings or as determined by the Commission. Should the Commission approve the Certificate of Appropriateness, Staff would recommend that the following conditions be included: 1) Only materials approved by the Historic District Commission shall be used. 2) Windows shall match design, size and style of previous windows. 3) New siding is substantially similar to the original protected architectural features and the substitute siding is placed over the original siding to allow for restoration in the future.
