1 Massachusetts Chapter National Association of Housing & Redevelopment Officials March 2017 NEWS Published by Massachusetts NAHRO Boston, MA Vol. XLI No. 3 Public Housing Commission Proposed Real Cost Funding at $116 Million For those who may not remember, the Commission for Public Housing Sustainability and Reform identified five key recommendations relative to the preservation and improvement of state-aided local public housing. Most of these recommendations, except for elimination of local housing authorities, were contained in Chapter 235, the Local Housing Authority Act of The one other recommendation, totally ignored by the Legislature and the administration, was intended to address the chronic underfunding of the public housing program. Commission Recommendation 3 appears below and is as valid today as when offered: Funding for Long Term Preservation and Sustainability: Despite efforts to provide additional resources, state public housing has chronically had inadequate capital and operating funding, resulting in deferred maintenance and an estimated statewide capital need of approximately $1.6 billion. Recommendations: The Commission recommends that funders strive to increase operating resources to levels identified in the 2008 study, The Real Cost of Operating Massachusetts Public Housing, and strive to increase and leverage capital funds to restore all units to occupancy and stabilize the state public housing portfolio. The DHCD Real Cost Study concluded that state-aided public housing had an operating budget 30% lower than other housing 2017 Legislative Day April Legislative Information Day this year is later than usual - Thursday, April 13, at the State House. The funding recommendations of the Commission on Public Housing and DHCD Real Cost Study will be highlighted. Using the amended Harvard Methodology on State Public Housing Operating Subsidy Needs, the estimated real need was set at $116.4 million, an increase of $51.9 million over today s funding level. DHCD states in the 2014 Training Manual for LHA Board Members that from FY 2010 to FY 2014 the operating subsidy appropriated remained at $64.5 million annually. The same was true in 2015, 2016 and 2017, and the same $64.5 million is once again requested by the Baker Administration for FY 2018, eight years and state budgets later. The Legislature has reneged on the promise to provide LHAs with the resources to preserve public housing and to cover the real cost of operations. The Commission reforms in Ch. 235 are being implemented, however none of the new resources recommended by the Commission and the DHCD study are forthcoming. MassNAHRO and the Mass. Union of Public Housing Tenants are seeking a modest increase in subsidy to $72 million, way short of the $116 million recommended by DHCD in Performance Management Reviews are beginning this year at LHAs that have not seen any new subsidy from the Massachusetts Legislature in almost a decade. Any realistic evaluation should take this fact into consideration. LHAs have done remarkably well managing and maintaining their properties with no new resources but many new regulatory requirements. Dr. Ben Carson was confirmed by the Senate Committee on Banking, Housing and Urban Affairs. The full Senate has yet to confirm his appointment. However, confirmation is expected, according to most news sources. Dr. Ben Carson has been invited to speak at the National NAHRO Washington Conference scheduled for March 26, 27 and 28 in Washington, DC. Massachusetts own Steve Merritt, National NAHRO President, will host the Washington Conference. This is a great opportunity to meet with members of Congress and to educate them on the importance of public housing and the need to maintain this resource. On to communicating with our local Legislators. The biggest Annual Legislative Day for MassNAHRO is scheduled for Thursday, April 13th. If you haven t had an opportunity to attend a past MassNAHRO Legislative Day, you are missing out on a great day on the hill. The Massachusetts State Capitol building is absolutely beautiful, and I get a feeling of such pride within its walls. On this day, MassNAHRO will present a Public Briefing at the foot of the Grand Staircase. We will have an opportunity to visit our Legislators in their offices and have a nice lunch with our Senators and/or Representatives in the beautiful Great Hall. This is the 35th Annual Legislative Information Day MassNAHRO has hosted. I promise, you will not be disappointed. This is also an occasion to demonstrate the united force of the MassNAHRO membership. This time of year is always uplifting to me. Saying goodbye to winter makes me happy. I welcome Spring along with daylight savings. I look forward to my residents - seniors, non-elderly and families alike, - getting out of the winter hide away mode and into the fresh air. A season of change is before us. This is my time to get out and walk the properties, evaluate the winter s mayhem and activate the formula funding spending approach. 3 March 2017 Sen. Boncore and Rep. Honan Named Housing Chairs The co-chairs of the Joint Committee on Housing of the Massachusetts Legislature were announced recently. Named as Senate Chair of the Committee by Senate President Rosenberg is Senator Joseph Boncore of Winthrop, is serves also as a member of the Winthrop Housing Authority. Other Senate appointees to the Housing Committee include Senator Forry of Boston as Vice Chair, and Senators Barrett of Lexington, Cyr of the Cape and Islands, and Senator Hinds of Pittsfield. Named by House Speaker DeLeo to again serve as the House Chair of the Joint Committee is long time supporter Representative Kevin Honan of Brighton/ Allston in Boston. Also appointed by the Speaker to serve on the Housing Committee were Representative Holmes of Boston as Vice Chair, and Representatives Koczera of New Bedford, Collins of Boston, Barber of Somerville, Gentile of Sudbury, Connolly of Cambridge, Goldstein-Rose of Amherst and Tyler of Boston. MassNAHRO looks forward to working with the chairs and the Committee in furthering the preservation of local public housing. Priorities include additional operating and capital resources, aid in implementing Chapter 235, homeless prevention funds and support for mixed population resident Bills Impacting LHA Benefits and Contract Reviews Filed at State House The local option legislation that would allow local housing authorities to elect to join the state s Group Insurance Program for dental and vision coverage has been refiled as Senate The bill titled An Act relative to local public housing authorities access to the dental and vision insurance plan managed by the Group Insurance Commission was filed by Senator Michael Brady of Brockton. Senate 1385 states, Notwithstanding Chapter 32A of the General Laws, the Group Insurance Commission shall provide dental and vision insurance benefits to employees of a housing or redevelopment authority upon a vote by its governing body. The Legislature has a legal obligation to fund the gap between the cap imposed on rental income and the real costs of operating and modernization public housing. The full list of fiscal 2018 budget priorities includes: Operating Subsidy ( ): $72 million. The approximate $64.5 million provided by the Legislature over the last eight years represents an average operating subsidy of only $116 a month for 46,000 apartments. The true need, according to the DHCD Real Cost Study, is $116 million. The Legislature provides for only 27% of LHA operating expenses while the residents (70% of whom are seniors), provide the other 73%. Ch. 235 reform costs should not draw vital resources away from vital maintenance and management activities, thus adversely impacting the tenants they were intended to assist. $72 million is supported by the Mass. Union of Public Housing Tenants, CHAPA and the Building Blocks Coalition. Ch. 174 LHA Mixed Population Service Coordinator Program: $1 million. Part of the solution to the intergenerational issues associated with the mixing of young disabled persons with seniors in senior developments, was the funding of service coordinators. The program is a great success at LHA session the bill was given a favorable recommendation as ought to pass by the Joint Committee on Public Service, but got hung up in the Senate Ways and Means Committee as the session expired last year. Another important bill is the corrective legislation, House 674, An Act relative to housing authority executive director contracts. House 674 was filed by Housing Committee Chair Representative Kevin Honan and 19 other legislative cosponsors. The bill amends section 7A of Chapter 121B by repeating the earlier phrase relevant to state payments for contracts over $100,000 as it applies now for contracts under $100,000. Section 7A currently states that the 3 developments for the elderly. Originally funded at $450,000 in 1995, this line item is now down to $350,000. Our request is for $1 million for 16 new sites. Tenancy Preservation Program: $975,000. Counseling and supportive assistance in conjunction with the Housing Courts prevents homelessness and the cost of emergency assistance in hotels/motels or shelters. This program is proven to be hugely cost-effective and keeps families in their homes. Our request is for a modest $475,000 increase to $975,000. Senior Supportive Housing: $7 million. Administered through Elder Affairs, this program provides 40 senior housing sites with support services to maintain independent living. It is highly cost effective. We request $7 million with directed LHA program management in certain circumstances. Alternative Housing Voucher Program: $7.1 million. Another of the programs authorized in Ch. 179, the Mixed Population Law of 1995, was a special rental assistance program intended to provide mainstream housing to low income persons with disabilities, as an alternative to senior public housing developments. An expansion is desperately needed. The request is to increase the current $4.6 million to $7.1M for 800 households. department may review all contracts between housing authorities and executive directors and all terms for payments or monetary remuneration relevant to state payments, but is silent on contracts over $100,000. contracts over $100,000 are funded in most cases from resources other than state payments. Members will be notified by Legislative Alert when hearing dates are established. In the meantime, make plans to attend the MassNAHRO Annual Legislative Day at the State House on Thursday, April 13. These two important bills will be included on the MassNAHRO Legislative agenda as part of Legislative Day packets for attendees to share with Legislators.

4 4 Board Certification Sessions Offered in Falmouth MassNAHRO Board Member Training and Certification trainings have been scheduled in conjunction with the Annual Conference. The MassNAHRO Board of Directors voted to waive the fees for the MassNAHRO Board Member Training and Certification program for tenant members serving on local housing authorities. The waiver is limited to one tenant member per housing authority. The Certification Program has successfully trained hundreds of Board Members over the past 15 years. The program includes five half-day seminars - Legal Issues, Finance, Personnel, Ethics and Professional Relationships. Those who have completed the program consider it excellent and a great learning experience for all housing authority members, including tenant members. Seminars are scheduled monthly on Saturdays on a regional basis. All five are offered in conjunction with the Annual Conference. This is the perfect opportunity to complete the entire certification all at once, or take the one or two courses you need to be certified. Procurement and Contracts Management April 10, 11, 12 Hilton Garden Inn, Worcester, MA March 2017 Tenant Election Procedures Impact Town Elections It took a memo on February 15 from the Elections Division of the Office of the Secretary of State to clear up the confusion relative to the ability of local candidates to run for their local housing authority in towns. Because the regulations prescribing the tenant Board Member election procedures required by law have not yet been issued by DHCD, candidates and town clerks alike were unsure on how to proceed in filling seats in the town spring elections. The issue was raised when it was noted that Chapter 235 prohibits more than three LHA members from being elected town wide in town housing authorities. That prohibition was effective on November of Two town elections in 2015 and 2016 have already gone by where the lack of DHCD regulations was deemed not a problem and elections went forward. The Elections Division has ruled that if election are more than 64 days away that the seat on the LHA cannot be on the ballot. The new law requires that when issued, the new DHCD regulations shall provide for a waiver of the tenant member election requirement if federal law requires the town to maintain a tenant member as one of the five members, or if a tenant has been elected by the town under the provisions of section 5. The problem will be further exacerbated if no tenant seeks election in small, all senior LHAs in towns, and the selectmen are unable to draft a tenant to serve. Given the increased responsibilities of all board members under the law, such seems likely but the current law requires that one member of the housing authority board shall be a tenant. These issues have been brought to the attention of those who drafted this well intended tenant member legislation. 5 March Nominating Committee Offers Slate The 2017 MassNAHRO Nominating Committee met on February 23, 2017 in Westborough to propose a slate of candidates for consideration at the Annual Election in Falmouth in May. Those present included Chair Ray Murphy of Holyoke, Tom Wade of Watertown, Steve Merritt of Norwood, Brian Cloonan of Brookline, Julie Torres of Hudson, Brenda Peacock of Bedford, and Lisa Audette of Franklin. The process for nominations was posted in the January and February newsletters as required by the bylaws. All letters of nomination received were duly considered and several actions taken. The Committee reviewed the meeting attendance records of all incumbents. Any future vacancies will be filled in accordance with the provisions of the bylaws. Annual Conference on the Horizon May in Falmouth The Professional Development Committee has drafted an informative and timely agenda for the 2017 Annual Conference at the Sea Crest Hotel in North Falmouth. The agenda includes seminars and workshops for Board Members, administrators, staff, and residents. DHCD and HUD both will be major participants, providing the latest information on changes to rules, regulations, and guidelines. Resource Rooms will be available again for delegates to meet with federal and state public housing regulators, and to benefit from technical assistance directly from the regulatory source. The Local Housing Authority Act of 2014, better known as Chapter 235, will again be a central topic for state program administrators and local board members. A draft agenda of topics appears on the MassNAHRO website. The seminar topics are based on prior evaluation forms and on member requests. Housing Bond Bill Includes $600 Million for Housing Authority Capital Projects House 675, the Housing Bond Authorization Bill of 2017, includes $600 million in bond authorizations for capital improvements at state-aided local public housing developments. The bill titled An Act financing the production and preservation of housing for low and moderate income residents was filed by lead sponsors Representative Kevin Honan and Senator Linda Dorcena Forry, both of Boston. House 675 is co-sponsored by 60 Senate and House legislators. Historically, the bond authorizations are spread over five fiscal years by the Administration in its capital budget. An increase in the state bond cap would be necessary if $120 million in bonding was actually to be issued in each of five fiscal years. The bill expressly authorizes DHCD to continue to fund a program to provide predictable funds to be used flexibly by housing authorities for capital improvements to extend the useful life of state-assisted public housing. The bill would also provide authorizations for bonds to fund loans for development of community based housing or supportive housing for individuals with mental illness and intellectual disabilities, $400 million for capitalization of the Affordable Housing Trust Fund, $150 million for the Housing Stabilization and Investment Trust Fund, and $50 million for a DHCD five-year demonstration program to demonstrate cost effective revitalization methods for state-aided family and elderly public housing that seek to reduce the need for future state modernization funding. DHCD will establish a 7-member advisory committee to include one member selected by the Massachusetts Chapter of NAHRO, one member from CHAPA and one from the Mass. Union of Public Housing Tenants, and four members chosen by the Department (DHCD). A complete break out of the programs included in the bond authorization bill will be sent to all members shorty, and included in the delegate packet for Legislative Day on April 13 at the State House in Boston. March 2017 SMEDA to Host Local Legislators March 24 The Southeastern Massachusetts Association (SMEDA) has scheduled its Annual Legislative Briefing at the Stone Forge Tavern in Raynham on Friday, March 24. Local housing authority officials and legislators will discuss their fiscal and legislative priorities for the session of the Legislature in an interactive roundtable format. Topics to be addressed include the impact of the state budget subsidy on DHCD expense caps on LHA budgets, costs associated with implementing Ch. 235, and other legislation with potential impact on LHA operations and resident services.
