MINUTES OF THE TANGIPAHOA PARISH COUNCIL January 26, 2015 The met on the 26 th day of January, 2015 in Regular Session and was called to order by Mr. David Vial, immediately following the public hearing held at 5:30 P.M. The Invocation was given by Mr. Jeff McKneely and the Pledge of Allegiance by Mr. Greg Varnado The following members were present: Trent Forrest, Greg Varnado, Louis Joseph, Carlo Bruno, Nicky Muscarello, Ronnie Bankston, Lionel Wells, David Vial, and Harry Lavine. Roll call vote was as follows: Yeas: 9 (Forrest, Varnado, Joseph, Muscarello, Bankston, Wells, Vial, Lavine, Cortez) Nays: 1 (Bruno) 2) Director of Personnel- A motion was made by Mr. Wells and seconded by Mr. Lavine to approve a 3% raise for Mrs. Virginia Baker, Director of Personnel, effective immediately, Roll call vote was as follows: 3) Director of Finance- There was a lengthy discussion brought up by Mr. Muscarello regarding whether or not Mr. McKneely was in fact ever properly brought up to the Council and approved/voted on as Director of Finance. Mr. Vial requested that Mr. Burgess resolve the issue by properly bringing the position up to the Council up to the Council as he has done with the other Directors. The December 12, 2011 Minutes show: Item No Approval of 2012 Salaries Mr. Burgess requested approval the salaries of Director of Finance, Jeff McKneely - $96,000; Personnel Director, Virginia Baker -$65,500; and Public Works Director, Nace Garafola - $74,000. Mr. Bruno asked that Council Clerk, Carla Tate also be approved for a 3% pay increase. A motion was made by Mr. Cortez and seconded by Mr. Muscarello approving the salaries and 3% pay increase as presented and recommended by the Administration. Roll-call vote was as follows: Yeas: 6 (Petitto, Bruno, Muscarello, Bankston, Wells, Cortez) Absent: 3 (Tolar, Rick, Edwards) A motion was made by Mr. Cortez and seconded by Mr. Lavine to approve a 3% raise for Mr. Jeff McKneely. A substitute motion was made by Mr. Muscarello and seconded by Mr. Varnado to table the foregoing item. Ordinance No An ordinance to grant a variance to ordinance adoption of state sanitary code for Mary Bordelon at Weinberger Road, Ponchatoula, La A motion was made by Mr. Lavine and seconded by Mr. Forrest to adopt T.P. Ordinance No Roll call vote was as follows: T.P. Ordinance No AN DINANCE TO GRANT A VARIANCE TO DINANCE ADOPTION OF STATE SANITARY CODE F MARY BDELON AT WEINBERGER ROAD, PONCHATOULA, LOUISIANA WHEREAS, Mary Bordelon has an existing structure on this.823 acre of property; WHEREAS, Ordinance requires one acre for two residences; WHEREAS, the Bordelon property is just.177 short of requirement and will not be in violation of the State

8 Sanitary Code; THEREFE BE IT DAINED by the -President Government, governing authority of, State of Louisiana, that a variance to the Code of Ordinances, Parish of Tangipahoa, State of Louisiana, be granted to Mary Bordelon to obtain approval to place a second residence and to install an individual sewer system on this property. BE IT FURTHER DAINED that this ordinance shall become effective immediately upon signature of the Parish President. This ordinance having been submitted in writing, having been introduced at a public meeting of the Tangipahoa Parish Council, discussed at a public hearing of said Council and was submitted to an official vote of the TPC. Resolution No. R Roll call vote was as follows: T.P. RESOLUTION NO. R15-01 A Resolution granting approval to Recreation District No. 39A of, Louisiana (the District ), to call and hold an election on May 2, 2015, to authorize the renewal of a 10-year, 15 mills property tax for the purpose of purchasing and acquiring lands, buildings, equipment and other facilities in the District for recreation to promote the well-being of youths and the general public and to pay the cost of maintaining said facilities with not less than six percent (6%) of the avails of said tax dedicated to the maintenance of existing parks (Velma, Frazier, Autin) and playgrounds in the District; and further making application to the State Bond Commission for consent and authorization to hold the aforesaid election; and further providing for other matters in connection therewith. WHEREAS, Recreation District No. 39A of, Louisiana (the District ) adopted a Resolution on November 24, 2014 ordering and calling a special election to be held in the District on May 2, 2015, to authorize the renewal of the levy and collection of a fifteen (15) mills ad valorem tax for a period of ten (10) years, beginning in the year 2016 and ending in the year 2025, for the purpose of purchasing and acquiring lands, buildings, equipment and other facilities in the District for recreation to promote the well-being of youths and the general public and to pay the cost of maintaining said facilities with not less than six percent (6%) of the avails of said tax dedicated to the maintenance of existing parks (Velma, Frazier, Autin) and playgrounds in the District (the Tax ), all in the manner conferred by La. R.S. 33:4566, Article VI, Sections 30 and 32 of the Louisiana Constitution of 1974, as amended, and the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority (the District Resolution ), a copy of which is on file with the Parish Council of the Parish of Tangipahoa, State of Louisiana, as governing authority of the Parish of Tangipahoa, State of Louisiana (the Parish Council ); WHEREAS, the District has made application to the Parish Council for approval to call and hold such election on May 2, 2015, as more fully set forth in the District Resolution; WHEREAS, Article VI, Section 15 of the Louisiana Constitution of 1974, as amended, and Section 1415 of Title 33 of the Louisiana Revised Statutes of 1950, as amended, grants power to the Parish Council to approve any proposal submitted by the District to levy a tax; NOW, THEREFE, BE IT RESOLVED by the Parish Council, as the governing authority of the Parish of Tangipahoa, State of Louisiana, that: SECTION 1. Pursuant to a request submitted to this Parish Council by the District, approval is hereby granted to the District to call and hold an election on May 2, 2015, to authorize the renewal of the levy and collection of a fifteen (15) mills ad valorem tax for a period of ten (10) years, beginning in the year 2016 and ending in the year 2025, for the purpose of purchasing and acquiring lands, buildings, equipment and other facilities in the District for recreation to promote the well-being of youths and the general public and to pay the cost of maintaining said facilities with not less than six percent (6%) of the avails of said tax dedicated to the maintenance of existing parks (Velma, Frazier, Autin) and playgrounds in the District (the Tax ), in the manner conferred by La. R.S. 33:4566, Article VI, Sections 30 and 32 of the Louisiana Constitution of 1974, as amended, and the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority and as more fully set forth in the District Resolution. SECTION 2. In the event the foregoing proposition passes, approval, consent and authority are hereby granted to the District to levy and collect the Tax described in Section 1 hereof. SECTION 3. This approval is granted in compliance with the provisions of Article VI, Section 15 of the Louisiana Constitution of 1974, as amended, and Section 1415 of Title 33 of the Louisiana Revised Statutes of 1950, as amended. SECTION 4. This Resolution shall take effect immediately

Resolution No. R A Resolution providing for canvassing the returns and declaring the result of the special election held in the Parish of Tangipahoa, State of Louisiana (the Parish ), on Saturday, December 6, 2014, to authorize the renewal of the levy and collection of a two (2) mill ad valorem tax on all property subject to taxation within the boundaries of the District, for a period of ten (10) years, beginning with the year 2015 and ending with the year 2024, for the purpose of providing and maintaining electric lights on the streets, roads, highways and public places in the District; and providing for other matters in connection therewith- A motion was made by Mr. Cortez and seconded by Mr. Lavine to adopt T.P. Resolution No. R Roll call vote was as follows: T.P. Resolution No A Resolution providing for canvassing the returns and declaring the result of the special election held in the Parish of Tangipahoa, State of Louisiana (the Parish ), on Saturday, December 6, 2014, to authorize the renewal of the levy and collection of a two (2) mill ad valorem tax on all property subject to taxation within the boundaries of the District, for a period of ten (10) years, beginning with the year 2015 and ending with the year 2024, for the purpose of providing and maintaining electric lights on the streets, roads, highways and public places in the District; and providing for other matters in connection therewith. BE IT RESOLVED by the Parish Council of the Parish of Tangipahoa, State of Louisiana, acting as the governing authority (the Governing Authority ), of Road Lighting District No. 1 of the Parish of Tangipahoa, Louisiana (the District ), as follows: SECTION 1. That the Governing Authority does now proceed in open and public session to examine the official certified tabulations of votes cast at the special election held in the District on December 6, 2014 (the Election ), said tabulations having been prepared and certified by the election officials serving at the designated polling places, and the Governing Authority does now further proceed to examine and canvass the returns and declare the result of the Election. SECTION 2. That a Proces Verbal of the canvass of the returns of the Election shall be made and that a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; that another certified copy thereof shall be forwarded to the Clerk of Court and ex-officio Recorder of Mortgages in and for the Parish of Tangipahoa, State of Louisiana, who shall record the same in the Mortgage Records of the Parish of Tangipahoa, State of Louisiana; and that another copy thereof shall be retained in the archives of the Parish. law. SECTION 3. That the result of the Election shall be promulgated by publication in the manner provided by SECTION 4. This Resolution shall take effect immediately upon adoption. PROCES VERBAL PROCES VERBAL OF THE CANVASS OF THE VOTES CAST AT THE ELECTION HELD IN ROAD LIGHTING DISTRICT NO. 1 OF THE PARISH OF TANGIPAHOA, LOUISIANA, ON SATURDAY, DECEMBER 6, BE IT KNOWN AND REMEMBERED that on the 12th day of January, 2015 at 5:30 p.m., at the Courthouse Annex, 206 Mulberry Street, Amite, Louisiana, the, acting as the governing authority (the Governing Authority ), of the Parish of Tangipahoa, Louisiana (the Parish ), and being the authority ordering the election held therein on Saturday, December 6, 2014, did examine and canvass the returns of the election, there having been submitted at the election the following proposition, to-wit: PROPOSITION Shall Road Lighting District No. 1 of the Parish of Tangipahoa, Louisiana (the District ) be authorized to renew the levy and collection of a two (2) mill ad valorem tax on all property subject to taxation in the District (an estimated $2,004, reasonably expected at this time to be collected from the levy of the tax for an entire year) (the Tax ), for a period of ten (10) years, beginning with the year 2015 and ending with the year 2024, for the purpose of providing and maintaining electric lights on the streets, roads, highways and public places in the District? 12 the ad valorem tax as authorized at the election by virtue of the favorable passage of the proposition attached hereto as Schedule A setting forth the rate and duration of the tax; and WHEREAS, in compliance with the provisions of said authority and other applicable constitutional and statutory authority, an election was held in the District on Saturday, December 6, 2014, to authorize the renewal of the levy and collection of the ad valorem tax, it is now the desire of the District to renew the levy the ad valorem tax and provide for the collection thereof and other matters in connection therewith as hereinafter provided in this Resolution. NOW, THEREFE, BE IT RESOLVED by the Governing Authority of the District, that: SECTION 1. Pursuant to the authority of an election held in the District on December 6, 2014, there be and there is hereby levied within the geographic boundaries of the District for the purposes stated in the proposition attached hereto as Schedule A, an ad valorem tax of two (2) mills on the dollar of assessed valuation of all property subject to taxation in the District, beginning with the year 2015 and ending with the year 2024, to be dedicated and used for the purposes of providing and maintaining electric lights on the streets, roads, highways and public places in the District, all in the manner and subject to the provisions and terms of those portions of Chapter 7 of Title 48 of the Louisiana Revised Statutes of 1950, as amended, applicable to ad valorem taxes levied by road lighting districts. SECTION 2. That the ad valorem tax described in Section 1 above shall be levied, assessed, imposed, collected, paid and enforced according to law. SECTION 3. The obligations and rights of taxpayers in connection with the ad valorem tax levied hereby shall be as provided taxpayers by the provisions of law applicable to ad valorem taxes levied by the District. SECTION 4. If any one or more of the provisions of this Resolution shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this Resolution, but this Resolution shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provision enacted after the date of this Resolution which validates or makes legal any provision of this Resolution which would not otherwise be valid or legal, shall be deemed to apply to this Resolution. SECTION 5. Upon adoption, this Resolution shall be published in full in one (1) issue of the Daily Star and shall be recorded in the mortgage records of the Clerk of Court. SECTION 6. Resolution No. R15-04 Resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for a grant under 49 CFR 5311, Non-Urbanized Area Formula Program and/or 49 CFR 5309, Discretionary Capital Program. WHEREAS, the Secretary of Transportation and Development is authorized to make grants for mass transportation projects; WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provisions by it of the local share of project costs; WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and WHEREAS, it is the goal of the Applicant that minority business enterprise be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services:

That the Parish President is authorized to execute and file an application on behalf of the -President Government with the Louisiana Department of Transportation and Development, to aid in the financing of operating and/or capital assistance projects pursuant to the Rural Public Transit Program, 49 CFR 5311 and/or the Discretionary Capital Program, 49 CFR That the Parish President is authorized to execute and file with such applications an assurance or any other document required by the Louisiana Department of Transportation and Development effectuating the purposes of Title VI of the Civil Rights Act of 1964, as amended. 3. That the Parish President is authorized to furnish such additional information as the Louisiana Department of Transportation and Development may require in connection with the application or the project. 4. That the Parish President is authorized to set forth and execute affirmative minority business policies in connection with the project's procurement needs. 5. That the Parish President is authorized to execute grant contract agreements on behalf of the -President Government with the Louisiana Department of Transportation and Development for aid in the financing of the operating or capital assistance projects. 6.
