CARRIED 5. Business Arising from Minutes None. 6. Delegations None 7. Reports 7.1 OPP Monthly Statistics Detachment Commander R. Scott presented the March 2016 monthly statistics to the Board. Key points of the presentation were: The format of the report includes new statistics appended to the end of the traditional report. Commander Scott advised the Board that the statistics are for information only, and are not to be confused with the billing statistics. There is an ongoing SIU investigations as a result of a minor injury during an arrest. Bike and foot patrol frequencies will be increased in the coming months as a result of the warmer weather. In addition, the detachment will become more proactive with tactics to prevent youth mischief. The school hours reported in the monthly report indicate a low number of hours, however this will be reviewed as it is likely a reporting error. The Perth County Detachment was the top detachment for enforcement statistics during the recent distracted driving campaign over the Easter weekend. Page 2 of 57 Page 2 of 5

5 The detachment is averaging one stunt driving charge per week recently where drivers are pulled over in excess of 50 km/h over the limit. The monthly report showed a marked increase in property crime billable hours. This does not necessarily indicate that there is an increase in crime, but that victims are now reporting crime. This is an improvement attributed to increased education efforts put forward by the OPP. The detachment is contemplating hiring an officer to specialize in mental health interventions because this type of call has steadily increased. 7.2 OPP Concerns with Minor Sports Firetruck Celebrations 8. Correspondence B. Kittmer advised the Board that he had been called by his counterpart in West Perth to discuss the matter of allowing minor sports teams to ride firetrucks after winning championships as the OPP had pulled over a ride in West Perth. After discussion at Council, it was agreed to raise this matter at the Police Services Board first to hear from the OPP. Commander Scott provided an overview of the incident in West Perth, and explained some of the concerns. These include: a parade occurring in an uncontrolled environment and the risk of personal injury to the children; noise by-law concerns for the use of emergency sirens when it is not an emergency; Highway Traffic Act related violations and the potential for charges (careless driving, seatbelt violations); the potential for the Town to be exposed to civil liability; and the potential for orders and under the Occupational Health and Safety Act and charges for criminal negligence if there ever was an injury. It was discussed that in an ideal situation, the fire struck rides would be formalized as part of a parade to celebrate the championship. If the Town were to choose this option, Commander Scott offered the assistance of the OPP in closing the road. 8.1 Ministry of Community Safety and Correctional Services re: Extension for Written Submissions on the Strategy for a Safer Ontario Page 3 of 57 Page 3 of 5

Board Member de Young asked for clarification on the use of the term bylaw for the meeting procedures document, and if the document should be more appropriately titled as a protocol of the Board. B. Kittmer to bring back an explanation for the Board. The original motion was withdrawn. CARRIED 9.2 Community Concerns Mayor Strathdee asked the Board for leave to raise two community items. It was agreed to allow Mayor Strathdee to speak. 38 2016/05/12 Ontario Provincial Police Lisa IRWIN, Provincial Constable #13563 Crime Analyst, Perth County Detachment Focused Patrols CRIME - OPEN PERTH COUNTY Title: Break and Enter Address: Perth County Pharmacies Duration: 14 April 2016 until notified otherwise. Focused Patrol Efforts/Result: There has been a rash of pharmacy Break and Enters in West Region. This focused patrol will act as a proactive measure as well as education to potential victims. Update: 12 May 2016 Although Perth County did not have any incidents, as a proactive measure, officers contributed hours to this focus patrol. Pharmacies within Perth County were visited to provide information and education with respect to this issue. CRIME - OPEN SOUTH PERTH Title: Mischief Address: South Perth County Mink Farms Duration: 1 May 30 June 2016 Focused Patrol Efforts/Result: Intelligence Alert received with reference to The Animal Liberation Front (ALF) and their history of releasing Mink from cages. In 2015, Perth County had 2 occurrences where Mink were released and Wellington County had 1. ALF's theory is that the "raiding season" occurs after the Mink have been weaned and can therefore survive in the wild. This occurs in late May and early June. Update: 12 May 2016 To date, officers contributed hours to this focus patrol. There has been no incidents or suspicious activity observed in the area. Staff has advised that they have been conducting their own nighttime security checks but are appreciative of police presence and patrols. TRAFFIC - OPEN PERTH EAST Title: TRAFFIC - Speeding Page 36 of 57

39 Address: Road 121 in Hesson Duration: 7 May 21 May 2016 Focused Patrol Efforts/Result: Complaints from residents in Hesson of vehicles speeding. This is a 60 km/h zone. Speed Spy set up April 25-26, Speed Spy data verifies that there is an issue with speed in this area. Over a 43 hour time period, 1820 vehicles travelled through Hesson on Road 121 with 1338 of those vehicles exceeding the speed limit. The highest speed recorded was 112 km/h. Update: 12 May 2016 To date, officers contributed 3.5 hours to this focus patrol resulting in 12 HTA charges. TRAFFIC - OPEN PERTH EAST Title: TRAFFIC School Crossing Address: Mill St. E, Milverton Duration: 9 May 20 May 2016 Focused Patrol Efforts/Result: There is a crosswalk near the school in Milverton where traffic safety concerns have been observed. At the intersection of Mill St. E and St. Mary's street there is an overhead flashing crosswalk indicator as well as large yellow X's on the roadway in both directions on Mill St. E. The light flashes in the morning between approximately 0830 and 0915 and after school 1445 to 1530 hours. Incidents have been reported where motorists are ignoring the crosswalk and school children have nearly been hit. The CAO of Perth East has been spoken to by PC Wijnands with respect to the responsibility of the Township for increased safety at the crosswalk. In the meantime, police presence and enforcement are requested for the safety of the children. Update: 12 May 2016 To date, officers contributed 5.5 hours to this focus patrol. An officer observed several children riding their bicycles across the road in the identified area. The officer contacted the CSO who in turn contacted the school to advise them and have the children educated about walking their bicycles across the crosswalk. CRIME - OPEN WEST PERTH Title: Suspicious Activity Address: 223 Coulton Dr., Mitchell Duration: 1 May 31 May 2016 Focused Patrol Efforts/Result: The male residing at this addresses and has a lengthy involvement with criminal activity including CDSA and Property Crimes. Area residents have contacted police on several occasions to express their concern and frustration with the increase in suspicious persons/vehicles/activities. Update: 12 May 2016 To date, one officer has attended in the area of the residence for observations of suspicious activity. No activity noted other than the exterior of the home is well lit where the majority of the street is in darkness. Page 37 of 57

40 CRIME CLOSED WEST PERTH Title: Mischief Trespass Address: West Perth Wetlands Duration: 1 April 22 April 2016 Focused Patrol Efforts/Result: Complaint driven Focused Patrol of ongoing issue with ATV's destroying the walking trails in the West Perth Wetlands Park. Signs have been posted with respect to Motor Vehicles being prohibited on the trails. The signs are routinely removed by the offenders. The trails have been host to events in the past such as the Lantern Walk, however, due to the constant damage, the events cannot be held as there would be a liability due to the poor state of the trails. This year $ was spent to repair the damage in an attempt to have the Lantern Walk and the trails were destroyed again. Update: 12 May 2016 Officers contributed 77.5 hours of patrol both on the trails as well as local streets. Members of ERT utilized ATV s borrowed from Wellington County O.P.P. Although damage from ATV use was observed, there were no ATV s located on the trails during patrols. There has been positive feedback from community members and no further complaints have been received as of this report. CRIME - CLOSED PERTH COUNTY Title: Theft Address: Perth County Community mailboxes Duration: The month of April 2016 Focused Patrol Efforts/Result: Several surrounding jurisdictions including Wellington, Grey, South Bruce and Huron Counties have had several thefts from community mailboxes since the beginning of Update: 12 May 2016 Although Perth County did not have any incidents, as a proactive measure, officers contributed hours to this focus patrol. Numerous areas where community mailboxes exist were patrolled. As a result of patrols, officers made observations and submitted intelligence information and 2 parties were arrested and charged on unrelated matters. 45 BY-LAW NUMBER PSB POLICE SERVICES BOARD FOR THE CORPORATION OF THE TOWN OF ST. MARYS Being a By-law to establish a policy to govern the calling, place and proceedings of the Police Services Board of the Town of St. Marys and to provide Public Notice of meetings and to repeal any previous by-laws WHEREAS AND WHEREAS AND WHEREAS AND WHEREAS THEREFORE The Municipality of the Corporation of the Town of St. Marys (hereinafter called "St Marys") is required pursuant to Section 4(1) of the Police Services Act to provide adequate and effective police service in accordance with its needs; The Municipality of St. Marys has entered into a contract with the Ministry of Community Safety and Correctional Services pursuant to Section 10(1) of the Police Services Act for the provision of police services for the municipality by the Ontario Provincial Police; The municipality is required pursuant to Section 10(2) of the Police Services Act to have a Police Services Board; The Policy Services Board is required pursuant to Section 37 of the Police Services Act to establish its own rules and procedures in performing its duties under the Act; St. Marys Police Services Board enacts the following Rules and Procedures: DEFINITIONS (a) Act means the Police Services Act, R.S.O. cp.15; (b) ''Board" means the St. Marys Police Services Board; (c) "Chair" means the Chair of the Board; (d) ''Acting Chair means a member of the Board required to act from time to time in the place and stead of the Chair or Vice Chair; (e) "Detachment Commander means the member of the Ontario Provincial Police assigned as Detachment commander reporting to the St. Marys Police Services Board; (f) "Council" means the Council of the municipality of St. Marys; Page 43 of 57

46 (g) "Days" means calendar days exclusive of Saturdays, Sundays, and Statutory holidays; (h) "Member" means a member of the St. Marys Police Services Board; (i) "Police Service" means policing provided under contract by the Ontario Provincial Police to the municipality of St. Marys; (j) "Quorum'' means a majority of the Members of Board in accordance with section 35(2) of the Act; (k) "Secretary" means the secretary of the St. Marys Police Services Board; (l) "Local policies" means written policies established for police services in accordance with section 10(9)(c) of the Act (m) ''Provincial policies" means the written policies contained with OPP Police Orders or directives established by the Ontario Provincial Police for the delivery of police services; 2. APPLICATION 2.1 The rules and procedures contained herein shall be observed in all proceedings of the Board and shall be the rules for the order and dispatch of business before the Board and with necessary modifications in a committee of the Board. The Chair shall decide all points of order or procedure for which rules have not been provided for. 3. BOARD COMPOSITION 3.1 In accordance with Section 27(6) of the Act shall consist of: a) the head of the municipal council or, if the head chooses not to be a member of the board, another member of the council appointed by resolution of the council; b) one further member of the council appointed by resolution of the council; c) one person appointed by resolution of the council, who is neither a member of the council nor an employee of the municipality; and d) two persons appointed by the Lieutenant Governor in Council. DUTIES AND RESPONSIBILITES OF THE BOARD The Board shall be responsible for those duties as set out in Section 10 of the Act and Section 30 and 32 of the Adequacy and Effectiveness of Police Services Regulation. 5. DUTIES AND RESPONSIBILITES OF THE CHAIR 5.1 It shall be the duty and responsibility of the Chair to: a) Report on the activities of the Board and of the OPP to Council as required; b) Act as the spokesperson for the policy decisions of the Board; c) Set the agenda for all Board meetings; d) Open meetings of the Board by taking the Chair and calling the Members to order; e) Receive and submit all motions presented by the Members; f) Put to vote all resolutions presented by the Members and announce the results; g) Decline to put to vote all motions, which infringe upon the rules and procedures or are beyond the jurisdiction of the Board; h) Enforce the observance of order and decorum at all meetings; i) Adjourn the meeting upon motion duly moved; j) If deemed necessary adjourn, suspend, or recess the meeting; k) Sign all documents for and on behalf of the Board including but not limited to: Policies; Resolutions; Agreements; and protocols, which the Board has approved. l) Perform any other additional duties when directed to do so by motion of the Board. DUTIES OF THE VICE CHAIR 6.1 In the event that the Chair is absent or vacant, the Vice Chair shall act in place of the Chair and shall have the same authority, rights, and powers of the Chair. 7. APPOINTMENT AND DUTIES OF BOARD SECRETARY 7.1 The Secretary of the Board shall be such person as is appointed by the Board from time to time. 7.2 It is the duty of the Secretary to attend all Board meetings, and: a) to prepare and distribute agendas for all meetings of the Board in accordance with this by-law; b) to record, without note or comment, all resolutions, decisions and other proceedings of the Board; c) if required by any member present at a vote, to record the name and vote of every member voting on any matter or question; d) to keep the originals or copies of all by-laws and of all minutes of the proceedings of the Board; e) to make such minor clerical, typographical or grammatical corrections in form to any by-law, motion, resolution and/or minutes as may be required for the purpose of ensuring correct and complete implementation of the actions of Board; f) to perform the other duties required under the Police Services Act under any other Act; g) to advise the Board on procedure; and h) to perform such other duties as are assigned by the Board. 8. SELECTION OF CHAIR AND VICE-CHAIR 8.1 In accordance with Section 28(1) and (2) of the Act, the members of the Board shall, at the first meeting held in January of each year, select from amongst its members, a Chair and Vice-Chair for a term of one year. 8.2 The election of the Chair shall be conducted by the Secretary; 8.3 The election of the Vice-Chair shall be conducted by the Chair; Page 46 of 57

49 8.4 Any votes required under this section shall be taken as described by the provision of Section 61(1) and (2) of the Municipal Act, R.S.O. which requires that each member of the Board present shall indicate his or her vote openly, and that no vote be taken by ballot or any other method of secret balloting. 9. COMMITTEES OF THE BOARD 9.1 The Board may at any time appoint one or more Members to a Committee of the Board to inquire into any matter within the jurisdiction of the Board. 9.2 The Committee shall report upon its work to the Board at the meeting of the board immediately following the date of the Committee meeting or at a specified time agreed to by the Board. 10. REGULAR MEETINGS OF THE BOARD 10.1 The Board shall hold at least four regular meetings each year at such place and time as may be determined by the Board The Chair shall preside at all meetings or in the absence of the Chair, The Vice-Chair; 10.3 The Chair or in the absence of the Chair, The Vice-Chair may cancel a regular meeting of the Board where the Chair or Vice-Chair deems such meeting not warranted however such cancellation shall not permit the Board to hold less than four regular meetings each year The agenda shall be considered as notice of regular meetings. Lack of receipt of a Notice or an Agenda by the members of Board shall not affect the validity of the meeting or any action lawfully taken thereat Agendas for meetings shall be made available to the public and media as soon as possible after they have been delivered to Members of Council. This provision does not apply to Agendas of In-Camera meetings/sessions. 11. SPECIAL MEETINGS OF THE BOARD 11.1 The Chair, or in the absence of the Chair, the Vice Chair, may at any time summon a special meeting of the Board and shall do so whenever requested by the majority of the board The Secretary shall give notice to all Members of such special meetings by whatever means deemed expedient by the Secretary No special meeting of the board shall be held with less than 24 hours notice to the Page 47 of 57

50 Members Notification to the public of a special meeting will be deemed complete with notification to the print media (or other means as determined by the Board) 24 hours in advance of the meeting The Secretary may provide the Agenda of the Special Meeting at the meeting where time constraints do not allow the Agenda to be provided to the Members of Board at least 24 hours before the hour appointed for the holding of the Special meeting No business may be transacted at a special meeting other than that specified in the notice or agenda. 12. THE CALLING OF THE MEETING TO ORDER 12.1 Quorum at a Board meeting shall be a majority of the voting members of the Board The Chair, or in absence of the Chair the Vice-Chair, shall call the meeting to order as soon as possible after the time announced for the commencement of the meeting and a quorum is present If a quorum for either a regular or special meeting of the board is not present with 30 minutes of the time fixed for the commencement of the meeting, the secretary shall indicate that no quorum was present and the meeting shall stand adjourned until the next regular meeting or such time as determined by the Chair If during the course of a meeting, quorum is lost, then the meeting shall stand adjourned to reconvene as determined by the Chair. If in the opinion of the Chair, it is not essential that the balance of the agenda be dealt with before the next regularly scheduled meeting, then the Chair shall announce that the unfinished business will be considered at that time In the absence of the Chair and Vice Chair, or in the case where a quorum is present and neither the Chair nor the Vice Chair have attended within thirty (30) minutes after the time appointed, the Secretary shall call the members to order. The members of Board present shall appoint during the meeting an Acting Vice Chair and he/she shall preside during the meeting until the Chair or Vice Chair arrives. 13. An item that is not included in the agenda may not be introduced at the meeting without the consent of a majority of the Members present The Secretary shall receive every letter, petition and other communication addressed to the Board and shall: a) If in the opinion of the Secretary the subject matter is properly within the jurisdiction of the Board, place it upon the agenda to be dealt with; or b) If in the opinion of the Secretary, and confirmed by the Chair, the subject matter is properly within the jurisdiction of the OPP Detachment Commander, shall refer the matter to him or her for necessary action and subsequent report to the Board The Secretary shall provide the agenda for each regular meeting to each Member of the Board not less than two days prior to the meeting. 14. CONDUCT OF MEMBERS 14.1 Board members shall attend and actively participate in all board meetings Board members shall not interfere with the police force's operational decisions and responsibilities or with the day-to-day operation of the police force, including the recruitment and promotion of police officers Board members shall undergo any training that may be provided or required for them by the Ministry administering police services Board members shall keep confidential any information disclosed or discussed at a meeting of the board, or part of a meeting of the board, that was closed to the public No board member shall purport to speak on behalf of the board unless he or she is authorized by the board to do so A board member who expresses disagreement with a decision of the board shall make it clear that he or she is expressing a personal opinion. 52 14.7 Board members shall discharge their duties loyally, faithfully, impartially and according to the Act, any other Act and any regulation, rule or by-law, as provided in their oath or affirmation of office. 14.8Board members shall uphold the letter and spirit of this Code of Conduct and shall discharge their duties in a manner that will inspire public confidence in the abilities and integrity of the board Board members shall discharge their duties in a manner that respects the dignity of individuals and in accordance with the Human Rights Code (Ontario), Human Rights Act (Canada) and the Charter of Rights and Freedoms (Canada) In accordance with the Municipal Conflict of Interest Act, Board members shall not use their office to advance their interests or the interests of any person or organization with whom or with which they are associated Board members shall refrain from engaging in conduct that would discredit or compromise the integrity of the board or the police force A board member whose conduct or performance is being investigated or inquired into by the Ontario Civilian Commission on Police Services (OCCPS) under Section 25 of the Act or is the subject of a hearing before the Commission under that section shall decline to exercise his or her duties as a member of the board for the duration of the investigation or inquiry and hearing If the board determines that a board member has breached the Code of Conduct set out in this by-law, the board shall record that determination in its minutes and may: i. require the member to appear before the board and be reprimanded; ii. request that the Ministry of the Solicitor General conduct an investigation into the member's conduct; or iii. request that the Commission conduct an investigation into the member's conduct under Section 25 of the Act 15. CONFLICT OF INTEREST 15.1 Where a Member, either on his or her own behalf or while acting for, by, with or through another, has any pecuniary interest, either direct or indirect, in any matter and is present at a meeting of the Board at which the matter is the subject of consideration the member shall; a) prior to any consideration of the matter at the meeting, disclose the conflict of interest and general nature thereof; b) not take part in any discussion of, or vote on any question in respect of the matter; and Page 50 of 57

53 c) not attempt in any way to influence the voting on any such matter either before, during or after the meeting. d) forthwith leave the meeting for that part of the meeting during which the matter is under consideration Where the conflict of interest has not been disclosed by reason of the Member's absence from the meeting, the Member shall disclose his or her interest and otherwise comply at the first meeting of the Board immediately following the meeting in which the matter was considered Where the meeting referred to in subsection 14.1 is not open to the public, in addition to complying with the requirements of that subsection, the member shall forthwith leave the meeting or the part of the meeting during which the matter is under consideration Every declaration of interest and the general nature thereof made under section 14.1 shall, where the meeting is open to the public, be recorded in the minutes of the meeting by the Secretary. Where the meeting is not open to the public, every declaration of interest made under section 14.1, but not the general nature of that interest, shall be recorded in the minutes of the next meeting that is open to the public. 16. HEARING OF DELEGATIONS 16.1 Delegations will only be heard at regular meetings of the Board provided that the person(s) representing the delegation has provided written notice of their request, has provided their presentation to the Secretary at least 8 days in advance of the meeting, and the topic of the delegation is within the jurisdiction of the Police Services Board A request for a delegations shall include a list of the person(s) who will be appearing before the Board and information as to the content of the presentation Unless approved by the Chair delegations shall be restricted to presentations of no more than 10 minutes Upon receipt of the written notice the Secretary shall list the delegation on the appropriate meeting agenda The Chair may curtail any delegation, any questions or debate during a delegation for disorder or any other breach of this policy and, where the Chair rules that the delegation is concluded, the person(s) appearing shall immediately withdraw. 17. RULES OF DEBATE 17.1 Every Member, before speaking to a question or motion, shall first receive recognition from the Chair. Page 51 of 57

54 17.2 When a Member wishes to speak on any question, motion, or item, they shall in an orderly manner obtain the Chair's attention and the Chair shall keep a list of those Members who wish to speak. The Chair then shall recognize the Members in the order in which they came to the Chair's attention When a member is speaking, no other Member shall pass information between any Member or the Chair, or interrupt that Member except to raise a point of order No member shall speak to the same question or motion for more than 10 minutes, without leave of the Chair After a question is put by the Chair, no Member shall speak to the question nor shall any other motion be put forward until after the vote has been taken and the results declared If a Member considers that a ruling by the Chair is not in order, an appeal may be made. In the event of an appeal, the Chair may give a brief explanation of the ruling and ask the Members Is the ruling of the Chair upheld? In the event of a tie vote, the ruling is upheld. The decision of the Board under this section is final. 18. MOTIONS 18.1 All motions shall be duly moved and seconded before discussed or put to a vote The Chair shall read a motion before a vote is taken After a motion has been moved, the mover may withdraw it at any time prior to a vote being taken A motion properly before the Board for decision must receive disposition before any other motion can be received, except motions to: a) adjourn; b) amend; c) refer; d) suspend; e) vote on the question A motion to adjourn the meeting may be made at any time except when: a) A Member is speaking; b) the question has been called; c) a Member has indicated to the Chair his or her desire to speak on the question A motion to amend shall: Page 52 of 57
