It directs them to evaluate how to improve the overall level of sports safety in the school district. The bill requires each school district to utilize guidelines and resource information from a statewide organization of athletic trainers in an effort to achieve a Safe Sports School Award. The bill also directs the State Department of Education to provide a one-time grant award of $,7,500 to each public school district that achieves a Safe Sports School Award to be given over a five-year period to no more than 15 school districts per year if funds are available. A J Griffin, R-Guthrie, specifies definitions for purposes of the bill. The bill specifies which relatives may be notified for the removal of a child from the custody of his or her parents. This bill allows for the inclusion of planning for the child's transition into adulthood in his or her permanency plan upon reaching the age of 14 or older. The bill states what a court should consider when it makes its findings on a review hearing for the child and specifies the conditions of permanency plans they can order. It states the person or institution that gains custody of the child is permitted to provide encouragement of the emotional and developmental growth of the child by allowing the child to participate in age-appropriate and developmentally appropriate activities. The bill requires at least one person in the child's facility be authorized to apply "prudent parental standard" in decisions for the child. This bill establishes the Successful Adulthood Act. The act requires a child's permanency plan be developed in consultation with the child and the conditions of that plan. Frank Simpson, R-Ardmore, allows the foster parents of a child to submit a report to the court for presentation at a review hearing to assist the court in reviewing the placement or status of a child ecapitol, LLC. David Holt, R-Oklahoma City, eliminates the use of the steno-mask altogether. It stipulates that the fee for an original court transcript shall be $3.50 per page, or a cost as prescribed by the Supreme Court. The amendment states that any court where the use of electronic transcripts and exhibits has been implemented by the Supreme Court, the court reporter is required to deliver the electronic copy of the transcript directly to the person ordering said transcript and in cases involving a defendant, the court reporter will be required to deliver an electronic copy of the transcript directly to the district attorney and the defendant, or the defendant's attorney. The court reporter will also be required to file or maintain the electronic transcripts and exhibits as prescribed by the Supreme Court. The bill would authorize the court reporter or the court clerk to destroy all exhibits in all domestic relations cases in which there has been no activity for more than 20 years and exhibits in all other civil cases with no activity for more than 10 years if there is no objection by the chief judge of the district court. The bill would allow all of a deceased court reporter's notes to be destroyed immediately upon the completion of a transcription of a proceeding and after the expiration of 10 years from the date said proceeding. The bill additional requires the chief judge or designee of the chief judge to obtain one copy of all electronic exhibits and notes taken by the deceased court reporter in any court where the use of electronic transcripts and exhibits has been implemented by the Supreme Court. It also stipulates that the trial court administrator or court clerk will be authorized to destroy the materials in accordance with the time periods provided in this title and Title 22 of the Oklahoma Statutes. The bill would have the same process applied upon the termination from employment of a court reporter. It prohibits the application of any court reporter's notes or exhibits which have been transcribed or filed in a case. The bill would require the rules of the Supreme Court to govern the possession, retention, and filing of exhibits offered in a case in any court where the use of electronic exhibits has been implemented by the Supreme Court ecapitol, LLC. David Holt, R-Oklahoma City, requires an interpreter to meet the needs deemed necessary by the State Board of Examiners of Certified Courtroom Interpreters and receive the approval of the Supreme Court. The bill adds new conduct proceedings, on reasonable notice, the object of which are to recommend to the Supreme Court the suspension, cancellation, revocation, or reinstatement of a certified courtroom interpreter including: misrepresentation in obtaining certification or credential, any violation of any rule or directive of the Code of Professional Responsibility for Interpreters in the Oklahoma Courts, misrepresentation of certification level or states while engaging in the practice of courtroom interpreting or translating in an Oklahoma court, and engaging in the practice of courtroom interpreting or translating in an Oklahoma court while certification is suspended. The bill would require the Administrative Office of the Courts to provide administrative support and assistance to the State Board of Examiners of Certified Courtroom Interpreters. The bill would permit the Supreme Court to promulgate rules authorizing the use of oral and written interpreter examinations and establishing credentialing standards consistent with recognized state court interpreter certification standards, including but not limited to the standards of the National Center for State Courts. After promulgated by the Supreme Court, the requirements may be used by the State Board of Examiners of Certified Courtroom Interpreters in lieu of prescribed examinations. The bill authorizes State Board of Examiners of Certified Courtroom Interpreters to conduct a criminal history record check and requires applicants to furnish all releases, authorizations, fingerprints, or other items necessary to conduct the criminal history record check in addition to a Supreme Court-approved fee for the check. It allows a person holding a state, certification from an equivalent national entity, or equivalent federal certification to apply to be enrolled without examination as Oklahoma certified courtroom interpreter upon the payment of set fees, approval of the Supreme Court, and the satisfaction of the State Board of Examiners of Certified Courtroom Interpreters. The bill allows the Supreme Court to promulgate rules in: authorizing the courts to utilize interpreters listed on a nationally recognized database of certified courtroom interpreters, and authorizing the recognition of different levels of courtroom interpreter certifications in the Oklahoma courts. It requires every person enrolled as a registered courtroom interpreter be entitled to use the abbreviation R.C.I. after his or her name. It also requires the State Board of Examiners of Certified Courtroom Interpreters to periodically set and publish a fee schedule with the approval of the Supreme Court. The bill prohibits courtroom interpreters without official certification from using the abbreviation. It authorizes certified and registered courtroom interpreters to interpret spoken words and translate written texts in all assigned proceedings. 6 HB1117 Paraphrase: HB1117, by Rep. Bobby Cleveland, R-Slaughterville and Sen. Ron Sharp, R-Shawnee, permits offenders convicted of crimes that require that they serve 85 percent of their sentence to receive and accumulate earned credits while serving the sentence. The bill requires the Department of Corrections to apply the credits after the offender has served 85 percent of the sentence. The bill provides the offender will be eligible for immediate discharge if the sum of earned credits and service time equals the total sentence length. Dan Newberry, R-Tulsa, establishes requirements for title insurance companies to execute and record certain records. The bill states that it applies only to a mortgage on property consisting exclusively of a one-, two-, three- or four-family residence, including a residential condominium unit. The bill permits an authorized officer of a title insurance company or its duly appointed agent, on behalf of the mortgagor or a transferee of the mortgagor who acquired title to the property described in the mortgage, to execute and record an affidavit in the real property records of each county in which the mortgage was recorded if a mortgagee fails to execute and deliver a release of mortgage to the mortgagor or designated agent of the mortgagor within 60 days after the date of receipt of payment of the mortgage by the mortgagee in accordance with a payoff statement furnished by the mortgagee or its mortgage servicer. The bill requires the written approval of the title insurance company appear on the affidavit if executed by an agent. The bill creates requirements for affidavits and requires that an affidavit operate as a release of the mortgage described in the affidavit. The bill requires the county clerk to index the affidavit against the real property described in the mortgage and the affidavit. The bill establishes penalties for filing a false affidavit. The bill provides that marriages not contracted by a formal ceremony may be acknowledged by filing an affidavit of common law marriage with the court clerk and establishes requirements for the affidavit. The bill also establishes requirements for marriage certificates and their filing. The bill requires that any entity requiring proof of identity or marital status accept a certified copy of the marriage certificate or affidavit of common law marriage that has been filed with the court clerk. It provides that any reference in the Oklahoma Statutes requiring a marriage license as proof of identity or marital status be interpreted to include a marriage certificate or affidavit of common law marriage on or after November 1, The bill repeals statutory language concerning marriage ceremony fees for civil marriage ceremonies; the requirement for a marriage license; the issuance and validity of marriage licenses; the contents of marriage licenses; additional evidence to determine legal capacity before issuance of a marriage license; copies of certified records as evidence for a marriage license; unlawful solicitation of performance of a marriage ceremony; unlawful sale of papers related to marriage licenses; and the delivery of marriage licenses to clergy and other qualified persons. Anthony Sykes, R-Moore, creates the An Act to Preserve Testamentary and Marital Intent. The bill requires the burden of proof in any action or claim by a party to invalidate any instrument intended to dispose of the property of a descendent or person subsequently adjudged incompetent, such as a will or prenuptial agreement, to be on the party seeking relief and by convincing evidence of the grounds asserted for said relief. The bill states any action to contest a will require the court to apply a in terrorem clause if it contains such a clause. It states it will not be a defense that the action was brought in good faith or with probable cause. It prohibits any favor of the party seeking the relief or the burden of proof be shifted to the opposing party. It requires that no action or claim of this kind to be brought more than 5 years after the executed instrument sought to be invalidated. It also permits any such action or equitable defense, such as a waiver or estoppels, to be asserted and requires them to be subject to a preponderance of evidence. The bill requires the court to strictly apply the in terrorem clause in any action described within this bill that contains an in terrorem clause in an action that does not prevail, and prohibits a defense that states the action was brought in good faith or with probable cause. Kay Floyd, D-Oklahoma City, modifies the scope of immunity for those providing volunteer emergency architectural or engineering services to permit receipt of payment for the cost of printing a report. It permits those who provide the services to be liable for wrongful death as required by Article XXII, Section 7 of the Oklahoma Constitution. The bill provides licensed professional engineers or architects practicing within their area of expertise who agree to voluntarily produce a risk-assessment report that is provided to the Oklahoma Department of Emergency Management that includes options for hardening a school; options for installation of storm shelters or safe rooms in a school; or recommendations pertaining to the best locations for refuge areas already existing in the school will not be liable for any personal injury, property damage or other loss of any nature related to the individual's acts or omissions in the performance of such professional voluntary services for any school, but will be liable for wrongful death as required by Article XXII, Section 7 of the Oklahoma Constitution. The bill stipulates that it does not provide immunity for injury or damage resulting from gross negligence or willful or wanton misconduct in rendering the voluntary professional services. The bill requires municipalities having jurisdiction in the event of damage to or collapse of a publicly or privately owned structure, due to a declared national, state or local emergency caused by a natural disaster or catastrophic event in which a human fatality occurs to meet certain requirements. It requires TNCs to adopt a policy prohibiting solicitation or acceptance of cash payments from passengers.
