The bill requires a public school that hires a retired member of the Teachers' Retirement System on or after its effective date to make a contribution to the system equal to 11 percent of the regular annual compensation of the member. The bill permits a retired member of the system who is employed by a public school or or after its effective date but before the expiration of 36 months from the member's retirement date to receive earnings up to $18,000 without any reduction in their retirement benefit. It provides if the earnings exceed $18,000 that the member's benefit will be reduced by $1 for each $1 over the limit, as provided in existing statute. The bill provides there will be no limit on allowed earnings or reduction of the retirement benefit of the member for the period of time the member is employed by a public school after the expiration of the 36-month period if the member is employed by a public school for a period in excess of 36 months after the member retires. The bill requires any individual in training approved by the Oklahoma Employment Security Commission that fails to adequately attend classes or training sessions be disqualified from receiving benefits for each week the individual was scheduled to be in training. The bill requires eligibility for unemployment benefits applied for in any week following the weeks that are disqualified be determined by the application of provisions of law relating to availability for work, active work search, failure to apply for or a refusal to accept suitable work, and all other eligibility requirements. 3 tax rate computed for or assigned to an employer be reduced by 2 percent for the time period beginning Jan. 1, 2017, and ending Dec. 31, 2026, except for employers assigned a tax rate pursuant to Title 40, Section which cannot be reduced to less than 1 percent. The bill provides employers that qualify for an earned tax rate calculated pursuant to Title 40, Section and are given the highest tax rate in the rate table for the given year cannot be eligible for the rate reduction. The bill clarifies language related to the unemployment tax rate and defines the term "at risk rule." The bill modifies language related to an employer's transfer of its trade or business and provides that the employer transferring its trade or business will be the predecessor employer and the employer or entity acquiring the transferred trade or business will be the successor employer. The bill modifies language related to Professional Employer Organization filings. The bill requires if a Professional Employer Organization chooses to file quarterly tax returns under the account assigned to its client and if the client has an experience history from a previous account assigned to that client that can be used in calculating an earned rate, then that experience history shall be transferred to the account assigned to that client as a co-employer of that PEO. The bill creates the OESC Technology Fund for the purpose of modernizing the business processes and technology of the Oklahoma Employment Security Commission. The bill requires that any money that remains in the fund after the new technology system has been brought online and made fully operational be transferred to the Unemployment Compensation Fund. The bill provides that employees subject to Title 40, Sections 3-109, and will be required to pay an OESC Technology Reinvestment Apportionment equal to 2 percent (2%) of the unemployment taxes that would be owed to the Oklahoma Employment Security Commission before any rate reduction is made pursuant to the terms of the bill. It provides that the apportionment is in addition to any contribution which that employer is required to make pursuant to the provisions of the Employment Security Act of 1980 and that it will not be considered part of any unemployment taxes required of an individual employer or be considered for purposes of determining the individual employer's tax rate. It requires employers assigned a tax rate pursuant to Title 40, Section of Title 40 pay an OESC Technology Reinvestment Apportionment equal to the rate reduction granted them by the bill. It exempts employers who qualify for an earned tax rate and are given the highest tax rate in the rate table for the given year from the apportionment. It provides that employers making payments in lieu of contributions will be exempt from the apportionment. It establishes procedures for collection of the apportionment. It requires the OESC to promulgate necessary rules. It requires the OESC to create an annual report detailing the collection of the apportionment funds and the expenditures from the OESC Technology Fund to be filed on or before March 31 of each year and to continue until all money in the OESC Technology Fund is expended. The bill requires the report be filed with the Governor, the Senate President Pro Tempore of the Senate, the House Speaker, the State Treasurer, the State Auditor and Inspector, and the Director of the Office of Management and Enterprise Services. The bill modifies statutory references and removes other outdated language. It adds that failure of the governor to approve a rule within the specified period shall constitute disapproval of the rule. The bill states that a transmission of a rule for legislative review on or before April 1 of each year will result in the approval of such rule by the Legislature if it is in regular session and it has failed to disapprove such rule before the last day of session unless such rule establishes or increases a fee or fees or is a rule by an agency, board of commission created by or receives its authority from Title 59 of the Oklahoma Statutes. It requires those agencies or rules imposing a fee increase or establishing a new fee to be approved by the Legislature by joint resolution but if the Legislature fails to approve the rule on or before the last day of the legislative session, the rule will be deemed disapproved. The bill allows the Office of the Secretary of State to promulgate rules to establish separate filing deadlines and review periods for finally adopted rules and to carry out the provisions of this bill. 6 The bill makes changes to the application for retirement and extends the 30 day filing period to 60 days before the date of retirement. It allows the system's executive director to waive the 60 day deadline for good cause, as defined by the board. It also authorizes individuals who are also benefirficiaries of a trust created under the Oklahoma Discretionary and Special Needs Trust Act, or comparable Trust Act in another state, to be the designated beneficiary if named by the trustee. It provides how benefits will be calculated. The bill also changes the amount related to the payment of monies without intervention of probate court from $5,000 to $25,000 in the case of a member's death, who leaves no living beneficiary. It requires those claiming to be legal heirs to provide trust documents or affidavit that a will does not exist. It allows the Board of Trustees to have more than one Medical Board and requires each board to have the same duties and authority. The bill also allows the Board to provide the Pension Commission with direct access to the same data from the custodian bank for the system in lieu of compiling and distributing a quarterly report. The bill also requires employers to make information concerning compensation and service credit to the system. The bill establishes that public colleges and universities and public technology center schools will be immune from liability for any injuries arising from any accident involving a firearm or an act of self-defense where a firearm was used except for acts of gross negligence or wanton misconduct. The bill states the persons collecting blood or saliva for DNA will be immune from civil liabilities arising from the process. The bill defines applicable terms. The bill requires a fantasy contest operator offering fantasy contests to implement procedures that are intended to: prevent employees of the fantasy contest operator and relatives living in the same household as such employees from competing in any fantasy contest offered by any fantasy contest operator in which the operator offers a cash prize that is more than $5; prevent sharing with third parties confidential information that could affect fantasy contest play until the information is made publicly available; prevent the operator from being a participant in a fantasy contest he or she operates; have a mechanism in place that is designed to verify that a fantasy contest player is 18 years of age or older; ensure that individuals who participate or officiate in a fantasy contest will be restricted from entering a fantasy contest that is determined, in whole or in part, on the accumulated statistical results of a team of individuals in the fantasy contest in which they are a player; allow individuals to restrict themselves from entering a fantasy contest upon request and take reasonable steps to prevent those individuals from entering the operator's fantasy contests; disclose the number of entries a 9 of 345 1/22/16, 11:12 AM

10 single fantasy contest player may submit to each fantasy contest and take reasonable steps to prevent players from submitting more than the allowable number; and segregate player funds from operational funds and maintain a reserve in the form of cash, cash equivalents, an irrevocable letter of credit, a bond or a combination thereof in the amount of the deposits in player accounts for the benefit and protection of authorized fantasy contest players' funds held in fantasy contest accounts. It also requires a fantasy contest operator offering fantasy contests in the state to annually contract a third party to perform an independent audit, consistent with the standards established by the Public Company Accounting Oversight Board, to ensure compliance with all of the requirements in the Oklahoma Fantasy Contests Act. The bill requires the fantasy contest operator to submit the results of the independent audit to the Department of Consumer Credit no later than Dec. 31 of each year. The bill establishes that any person, firm, corporation, association, agent or employee who violates any provision of the Oklahoma Fantasy Contests Act will be liable for a civil penalty of not more than $1,000 for each violation, which will accrue to the state and can be recovered in a civil action brought by the Department of Consumer Credit. Justin Wood, R-Shawnee, prohibits a police officer from taking a person into custody based solely on the commission of certain offenses involving a controlled dangerous substance if the peace officer, after making a reasonable determination and considering the facts and surrounding circumstances, reasonably believes that all of the following apply: the peace officer has contact with the person because the person requested emergency medical assistance for an individual who reasonably appeared to be in need of medical assistance due to the use of a controlled dangerous substance; and the person provided his or her full name and any other relevant information requested by the peace officer, remained at the scene with the individual who reasonably appeared to be in need of medical assistance due to the use of a controlled dangerous substance until emergency medical assistance arrived, and cooperated with emergency medical assistance personnel and peace officers at the scene. It provides that those individuals will be immune from criminal prosecution as long as the amount of the controlled dangerous substance does not constitute trafficking or drug paraphernalia associated with a controlled dangerous substance. The bill also provides immunity if the offense involved a state of intoxication caused by the use of a controlled dangerous substance by a person or if the offense involved the person being or becoming intoxicated as a result of the use of a controlled dangerous substance by a person. The bill provides that a person may not initiate or maintain an action against a peace officer or the employing political subdivision of the peace officer based on the compliance or failure of the peace officer to comply with the provisions the bill ecapitol, LLC.
