5 CWA LOCAL Local Officers Election Procedures It is the responsibility of the CWA Local 1033 Elections Committee to conduct all elections mandated by the CWA constitution and the Local s bylaws. All union election must be conducted in accordance with federal labor laws. In addition to federal regulations, elections in Local 1033 will be conducted in accordance with the guidelines set forth in CWA s handbook How to Conduct Local Union Elections. Federal labor law provides for the protection of Union members as they relate to the members participation in the election process. It is the responsibility of the Elections Committee to ensure that these rights are protected throughout the entire process. This includes, but is not limited to, the right to a secret ballot, access to membership lists, observing the preparation and mailing of ballots, being informed of the conduct of an election, and observing the gathering and counting of ballots. In adherence to the regulations and guidelines set forth above, the following procedures will be implemented by CWA Local 1033 s Elections Committee: TIMELINE: A time line for the election of offices shall be established by the Elections Committee. ELIGIBILITY TO RUN FOR LOCAL OFFICE In compliance with 29 CFR and 504(a), persons convicted of robbery, bribery, extortion, embezzlement, grand larceny, burglary, arson, violation of narcotics laws, murder, rape, assault which inflicts grievous bodily injury or a violation of Title II or III of the Act, and those convicted of abuse or misuse of their position or employment in a labor organization or employee benefit plan are not eligible to hold office for 13 years after conviction if there has been no imprisonment, or for 13 years after imprisonment. According to Local 1033 By-laws, only active members of the Local in good standing who have been paying full dues for at least three months prior

6 to the date of an election announcement shall be eligible to hold elective office. NOMINATION PETITIONS 1. Nominating petitions may be obtained at the Local office beginning 9 a.m. Tuesday, August 1, Potential candidates must have been a member in good standing of CWA Local 1033 since April 24, 2017 to run for or hold elective office. Nominating petitions must clearly state the candidate s name and the office being sought. Petition sheets not bearing this information will be automatically voided. 2. Nominating petitions must be returned to the Local office by 12 noon. Thursday, August 31, All petitions received will be date stamped, time of receipts noted, and initialed by an Elections Committee representative. Nominating petitions may be submitted at any time prior to August Petitions must minimally contain the specified number of applicable signatures of members in good standing of CWA Local Candidates for Local President/, Local Executive Vice President/ Delegate to CWA annual Convention, Local Secretary and Local Treasurer must have the signatures of at least 200 members; candidates for Administrative/Clerical Vice President, 60; Professional Vice President, 25; Primary Level Supervisory Vice President, 25; Higher Level Supervisory Vice President 5; candidates for Area s must secure 30 signatures of Local members within their respective jurisdictions. 4. Names and signatures must be clearly legible. Any name or signature not legible will be voided. Candidates are advised to secure more than the minimum number of signatures and to submit completed petitions as soon as practical. 5. Petitions will be certified by the Elections Committee beginning at 5:15 p.m., Friday, September 1, 2017.

7 SLATES Slates will not be permitted; however, each candidate may elect to have a campaign slogan printed beneath their name on the official ballot. POSITION ON BALLOT Position if the ballot will be determined by a lottery supervised by the Elections Committee on Friday, September 1, 2017 following the certification of nominating petitions. Drawing order for each position will be based on the date time complete nominating petitions are received. CAMPAIGNING Federal law prohibits the use of funds received from dues, assessments, or similar levies to promote any persons candidacy. 1. No union equipment may be used. (i.e. stationary, phones, Xerox, etc.) 2. No campaigning can be done on time paid for by the Union or state. Employers may not contribute funds, directly or indirectly, in support of the candidacy of any person for Union office under any conditions. This prohibition includes any costs incurred by a Union or any employer and anything of value contributed by a union or employer. MEMBERSHIP LISTS A. Lists will be prepared by the Local s Secretary in conjunction with the Election Committee chair and/or the committee liaison. B. Copies of the Local s membership lists will be available to candidates for inspection. C. Membership lists will be opened for inspection one time per candidate during the election period during regular business hours ( Friday thru Saturday, 8 a.m. 5 p.m.) beginning Friday, September 1, 2017 through Saturday, September 30, 2017.

8 D. Three (3) days minimum notice is required to schedule inspection of lists. E. Challenges to a voter s eligibility will be accepted at the time of list Inspection and will be decided by a vote of the Elections Committee prior to mailing a ballot. OBSERVERS A. Candidates and/or their designated observers who are members in good standing of CWA Local 1033 are allowed by law to attend all Elections Committee meetings. B. Observers who wish to address questions to the committee will be afforded an opportunity to speak at any meeting. DISTRIBUTION OF CAMPAIGN LITERATURE All reasonable requests to distribute literature at the candidate s expense will be honored. 1. Arrangements will be made through the Election s Committee to contact a mailing house with minimum of three (3) days notice and at the candidate s expense, payable in advance. 2. If a candidate wishes to have volunteers do a mailing, they can do so at the Local office Monday through Friday after 5:00 P.M., and under no circumstances after 9 P.M., under the supervision of the Elections Committee. Such mailings must be folded or inserted into an envelope and pre-stamped before being brought to the Local to have mailing labels affixed. A minimum of three (3) days advance notice is necessary. 3. All leafleting will be done by the candidate and his/her volunteers. MAILING BALLOTS Post-office boxes for ballots returned and returned member ballot packets will be rented. Ballots turned-in at the CWA Local 1033 office will not

9 be accepted. Mail ballots to be accepted must be received through the US Postal Service at the post office box obtained for this purpose. BALLOT COUNT The ballot count will take place at Election America, 147 E. 2 nd Street, Suite 102, Mineola, NY on Monday, November 6, 2017 immediately upon the return of the ballots. Members of the Election Committee will pick up ballots at postal box at around 10:00 a.m. APPEALS In the event the issue of appeal rises or falls upon a disputation of fact or law, a hearing will be conducted pursuant to the following procedures: A. Date of the hearing will mutually agreed upon by the parties Involved, but in all circumstances such hearings must be convened and concluded within the time limits specified. B. Reasonable requests for information may be submitted to the Elections Committee Chair at any time prior to the date of the hearing provided they include a reasonable period for compliance with the request. C. Requests for information by either party may be declined by the Committee Chair on the basis of impracticability or confidentiality. D. Information requested and rejected on the grounds of confidentiality are subject to sanitation to secure members privacy. E. Appellant will bear the burden of proof; however, Appellant may request a synopsis of the Local s positions and evidence in advance of the hearing. F. Appellant may request and shall receive a copy of the Local s official file in this matter, a copy of all documents contemplated for use in this proceeding and a list of all potential witnesses whose testimony may be entered into the record. G. The Elections Committee possesses NO power to require the production of any of the above evidence.

10 H. Appellants may be represented by themselves or a designee. I. Appellant will given a full and fair hearing to present evidence and express his/her views on an information basis. 1. General rules for hearing conduct will be adhered to. 2. Deliberations shall be conducted by the Elections Committee under total confidentiality, subject to the provisions of recording as contained in the provisions of Federal Labor Law and the CWA Constitutions. 3. All decision of the Elections Committee will be by majority vote of the members present. 4. The decision of the Elections Committee shall be rendered in writing to all parties and is subject to appeal to the Local Executive Board. Members are advised to notify the Local of any change of address before member election packets are mailed in mid-october. In the event that returned Election packets are returned due to incorrect addresses CWA Local 1033 Election Committee will review and take every reasonable effort to contact members to correct addresses and r ballots to the corrected addresses. As approved by Elections Committee I have read the above Notice of Election, and approve its dissemination to the membership.
