CONSENT The minutes of the June 27, 2011 and September 26, 2011 meeting Commissioner Carmelita Garcia, abstained comment on the 6/27/2011 minutes. F. PROJECT REVIEW Note: Action listed for each item represents staff recommendation. The Commission may, at its discretion, take any action on the items listed on the Agenda. 1. The Fresh and Easy neighborhood Market, On October 18, 2011 the Monterey City Planning Commission approved the demolition of an existing 17,100 square-foot roller skating rink building and the construction of a new 10,581 square-foot grocery store on the 49,162 square-foot (1.30 acre) site at 2020 Del Monte Avenue. The project is on appeal to the City Council of the City of Monterey. The Commissioned reviewed the application, discussed the project, and took the following action: Chair revised condition # 4 The project lighting will remain downcast The Commission added a condition #5, language provided by Count Counsel Upon close of the discussion, Commissioner Albright motioned to recommend the approval with conditions, seconded by Jim Chappell; The chair called for the vote at 4:05 the Commission voted in favor 5-0. G. ADMINISTRATION 1. Reviewed revised ALUC roster County Counsel discussed terms of appointed commissioners Indicated that letters were needed from Airport managers and Mayors selection committee to the county introducing there appointees 2. Tasked staff to create a thank you" resolution for Ernesto Franco

4 3. Future meeting schedule 4. Staff introduced new 2011 Cal Trans California Airport Land Use Planning Handbook. This update will be the fourth edition of the Handbook. 5. Set Items for Future Agendas Finalize standard conditions Finalize bylaws The commission tasked staff to send copies of the CLUP and CALTRANS Planners Guidelines for Airport Land Use each commissioner s proxy Prepare a summary demonstrating the revision made to the revised guidelines H. CALL TO ORDER Pledge of Allegiance The meeting was called to order at 3:00 pm by William Sabo, Chair. B. ROLL CALL Commissioners Present: Robert McGregor, William Sabo, Norman Albright, Jim Chappell, Theodore Larson, Carmelita Garcia (arrived at 3:30pm; departed at 4:50pm) (A quorum) Commissioners Not Present: John Huerta Proxies Present: Mark Zanko (Proxy for Commissioner McGregor) and Christine di Iorio (Proxy for Commissioner Albright) Staff Present: Wendy Strimling, Joe Sidor, and Dan Lister C. APPROVAL OF MINUTES The Minutes of the November meeting were not complete and will be added to the next meeting s agenda for approval.

6 F. PROJECT REVIEW Note: Action listed for each item represents staff recommendation. The Commission may, at its discretion, take any action on the items listed on the Agenda. No items were scheduled for this meeting. G. ADMINISTRATION 1. Introduction of new County staff Joe Sidor, Dan Lister, and Luis Osorio were introduced as the new County staff for the ALUC. 2. Discussion of Commission work goals and objectives for 2012 The following items were discussed: a) Role of County staff in support of the ALUC; b) Development of an Application Form, and clarification of the submittal process and requirement for projects; c) Revision of ALUC Standard Terms and Conditions; d) Conformity of General Plans with CLUP. Recommendation to form an Ad Hoc Committee to search for CLUP funding. Members will be Commissioners Garcia, Sabo, and Albright; e) Staff to canvas jurisdictions for General Plan amendments; f) Forwarding of project proposals to applicable airport managers and districts; g) Development of a new fee schedule; h) County staff to meet with airport jurisdiction staff; i) Conflict of Interest Form Review and consider adoption of draft Rules of Procedure (Bylaws) After an overview presentation by Wendy Strimling and discussion, the Commission voted unanimously to adopt the draft Rules of Procedure as amended. Amendments include the correction of typographical errors, the keeping of consent items on the Order of Business (agenda) during ALUC meetings, and the keeping of the legal section. Motion to adopt made by Commissioner Garcia and seconded by Commissioner Chappell. Adopted January 23, Review and consider adoption of a Meeting Calendar for 2012 The Commission voted unanimously to adopt the Meeting Calendar as amended. The following changes were made: May 21 st and December 10 th, and remove the language stating that meetings are on the 4 th Monday of the month. Motion to adopt made by Commissioner Albright and seconded by Commissioner Chappell. Adopted January 23, Discussion regarding information packets for Commissioners Packets should include: - CLUPs - Caltrans Handbook - Rule of Procedure - Conflict of Interest Code / Form 700

7 - Meeting Calendar CD and/or paper copies will be made available based on the preference of the Commission member. 6. Review of Commission Roster Discussion of assignment and confirmation of proxies, term expirations, and Commissioner contact information. The terms of three Commissioners (Albright, Larson, and Sabo) will expire in May, Commissioner Sabo requested staff research the reappointment process and inform the Commissioners at the next meeting. 7. Set items for Future Agenda ALUC staff identified several potential items: Yanks Airport (County), Trinity School, and Fresh & Easy (City of Monterey). More information will be provided to the Commission as the projects move forward. H. ADJOURNMENT Meeting adjourned at 5:10 pm.

33 MONTEREY COUNTY AIRPORT LAND USE COMMISSION ALUC STANDARD CONDITIONS The following standard conditions may be applied to an application being considered before the ALUC. If the box next to the condition is marked, that indicates that the condition is to be applied to the project as part of the ALUC recommendation. PROJECT NAME PROJECT NO. ALUC-1 ALUC-2 ALUC-3 ALUC-4 ALUC-5 AVIGATION AND HAZARD EASEMENT Prior to the issuance of a construction permit, the developer/owner shall grant an avigation and hazard easement to the appropriate airport authority. The easement shall be recorded at the Monterey County Recorder s Office. The easement may include: Right-of-flight at any altitude above the acquired easement surfaces. Right to cause noise, vibrations, fumes, dust and fuel particle emissions. Right to prevent construction or growth of all structures, objects or natural growth above the acquired easement surfaces. Right-of-entry to remove, mark or light any structures or growth above the acquired easement surfaces, or right to require the owner to remove, mark or light. Right to prohibit creation of electrical interference, unusual light sources and other hazards to aircraft flight. Any other limitation that the ALUC may recommend to protect the public s health, safety and welfare. NOISE INSULATION STANDARDS The project shall conform to current noise insulation standards pursuant to the California Administrative Code, Title 25, Chapter 1, Subchapter 1. NOISE STANDARDS The project shall conform to noise standards pursuant to the California Administrative Code, Title 21, Subchapter 6. AIRPORT APPROACH ZONING The project shall conform with Title 20 and Title 21 of the Monterey County Code (Zoning Ordinances), Chapter and Chapter 21.86, Airport Approaches Zoning, and/or applicable zoning code relevant to airport hazards and operations. OBJECTS AFFECTING NAVIGABLE AIRSPACE The project shall conform to FAR, Part 77 Objects Affecting Navigable Airspace.

34 ALUC-6 ALUC-7 ALUC-8 ALUC-9 EXTERIOR LIGHTING Prior to the issuance of a construction permit, an Exterior Lighting Plan shall be reviewed and approved by the applicable airport manager prior to the issuance of any construction permits. All exterior lighting shall be unobtrusive, down-lit, harmonious with the local area, and constructed or located so that only the intended area is illuminated and off-site glare is fully controlled. TOWERS - MARKING AND LIGHTING When not specifically required by FAA Advisory Circular 70/7640-IF (Obstruction Marking and Lighting), the following ALUC recommendations shall be applied to towers: A flashing red beacon shall be installed at the highest point of the structure. A steady burning red obstruction light shall be installed at the highest point of the structure. A steady burning red obstruction light shall be installed at the intermediate level of the structure. Nine (9) day-glow markers (20 minimum) shall be installed on the top level of guide wires (3 to the wire). The applicant shall contact the FAA to publish a NOTAM (Notice to airmen) in Monterey County about the location of the proposed structure. Standard marking (orange and white striping) shall be installed, as defined in Chapter 3 of the FAA AC 70/7460- IF. NO CONDITION REQUIRED The project, as reviewed by the ALUC, is consistent with the CLUP for that jurisdiction and does not require any conditions. 36 AIRPORT LAND USE COMMISSION PROJECT SUBMITTAL REQUIREMENTS For ALUC Staff Use Date Stamp: The following information must be submitted prior to the subject project being placed on the agendum for review by the ALUC. Incomplete submittals will not be submitted for review by the ALUC until the submittal packet is deemed complete. NOTE: All materials, plans, multi-page plans, and other data must be legible, collated, stapled and folded (maximum size is 11x17). (*Number of plan set copy amounts is subject to change based on project.) 1) Completed Project Submittal Form. 2) Memo letter prepared by the project planner of the applicable jurisdiction stating: a) Project Description/Location b) Land Use Designation/ Zoning for the applicable jurisdiction c) CLUP Consistency 3) *10 copies of the site plan showing: a) Assessor s parcel number, subdivision name and lot number b) North arrow and scale c) Property boundaries with dimensions d) Location of all streets, roads, rights-of-way, driveways, easements, Utility and scenic easements and parking areas (Disabled accessible provisions when applicable) e) Location and dimensions of all existing and proposed buildings and structures on the site/property including fences f) Slope contours at minimum 2 foot intervals (topography) g) Location of existing trees and those proposed for removal (specify type, size, which are to remain and those to be removed) h) Location as to distance from airport i) Lot size 4) *10 copies of exterior elevation plans showing: a) All four sides of structure(s) b) Materials to be used on walls, roof, etc c) Roof appurtenances d) Elevations and finished floor elevations shall be identified 5) A CD with a PDF copy of all submitted material, including the completed application, memo from project planner and plans. 6) Fee of $ to be paid at the time of project submittal.
