Moderator Kevin Major called the 2018 Town of Sandown Deliberative Session to order at 9:00 am on Saturday, at the Sandown Town Hall, 320 Main Street, Sandown, New Hampshire. Boy Scout Galen Walton, Weblo Caleb Goldman, Arrow of Light Scouts Jacob Longchamps and Liam Cole Watkins led the body in the recitation of the Pledge of Allegiance. The Moderator gave a brief history of the Moderators in town, acknowledged those present and acknowledged Senator William Gannon and State Representatives Chris True and Jess Edwards. The Moderator read the Rules of Order and pointed out handouts were available to all on the table. He also advised those in attendance they could check-in with the Supervisors of the Checklist to obtain their voting cards. Warrant Article 1. To choose all necessary Town Officers for the ensuing year (to be voted by ballot March 13, 2018). The Moderator pointed out this article was to vote for all necessary officers and he reminded the body that the election was to take place on Tuesday, March 13, Polls will be open from 8:00 am to 8:00 pm. Special Warrant Article 2. Shall the Town purchase approximately 162 acres of property (designated as Map 17 Lot 3, Map 17 Lot 3-34 to Map 17 Lot 3-52 and Map 18 Lots 1, 1-40 and 1-41 on the Town of Sandown Tax Map) for an amount of Seven Hundred Seventy Five Thousand Dollars ($775,000) payable to the seller by a five (5) year note payable in five (5) equal installments of One Hundred Fifty Five Thousand Dollars ($155,000) and to raise and appropriate the sum of One Hundred Fifty Five Thousand Dollars ($155,000) for the first annual payment and further to authorize the Selectmen to negotiate the terms and conditions of the note and purchase, and to take any other action necessary to carry out this vote. (3/5 ballot vote required). Estimated tax impact of this article is $.30 per thousand. Page 1 of 19

2 MOTION by Jon Goldman to place Special Warrant Article 2 on the ballot Jon Goldman gave a brief explanation of the land s location, some of the positive reasons for purchasing the land including mitigating tax relief and reducing education expenses. He expressed this Board has no intention to sell but also noted this Board of Selectmen could not bind the actions of any future board. Any selling restrictions could be addressed in a future warrant. He also pointed out, however, that with the petition of 50 registered voters any intention to sell the land could be forced to be placed on a future warrant. Bruce Cleveland gave a Power Point presentation of an estimator to assist with evaluating warrant article 2. It is an interactive chart that makes some conservative assumptions regarding basic components that will affect the expenses and revenues if the approved building lots and conceptionally approved apartments are built. Chris True voiced his support as a great deal and asked if the Board could spend money to improve the land without a vote of the people Jon Goldman - explained that in some instances the Selectmen can do improvements, e.g. if there are funds that are under expended. There is no money funded for improvements at this time. Arlene Bassett - asked how much of the total acreage is usable due to the presence of power lines, easement, swamp area. She stated that 162 acres looks good on paper, but the price may not be as good if a portion of the land is unusable. Jon Goldman - stated that is not known at this time but stated the developer has interests for apartments and single-family homes so those areas would be usable. Tony Piemonte who pays for the costs of the roads Jon Goldman the Selectmen have no plans yet for the land other than maybe a baseball field and has not researched the roads Tina Owens - her house and land abut this property and when the developer built homes off Wells Village Road her well water pressure decreased and the amount of silt increased. She thinks the people should consider the input of homes, light pollution, other pollution and water issues. Lee Dube there is usable land and the developer has conceptual approval for 10 acres of land and he stated this is a great way to save for the future Doug Person asked if this was a strategy to combat school expenses and if so, is there a longterm strategy for other open spaces Page 2 of 19

3 Jon Goldman again pointed out this Board cannot bind a future board and said there was no long-term strategy at this time. The Selectmen are not in the business to be landlords. Something will happen shortly either the purchase by the town or building by the developer. Scott Bassett questioned if we are bonding the town for 5 years. Looks like the developer is running a pit out there and he thinks it s a lot of money to pay for land without a lot of open space. He also thinks the student costs may not be accurate. Attorney Gorrow the payment is not a bond, but the statues do apply since there is a note to the seller. It is treated the same way and that is why a 3/5 majority vote is required. Doug Person normally in favor of this and wondered if there are any other funds out there such as LUCT that could pay for the land Jon Goldman that was talked about but there is not enough money in those funds for the purchase and there maybe certain restrictions that would apply. A section could be considered around Hunt Pond to be conservation land. Craig Stowell asking for confirmation that only 10 acres are usable Lee Dube stated that was not an accurate number and it may be closer to 10% of the land Craig Stowell are there other available properties in town Bruce Cleveland developers can develop if they comply with the rules and that cannot be stopped. The appraisal done on this property came in at $910,000 and prior to any sale, there would be 2 public hearings. John Donahue 162 acres is not the relevant point, but the focus should be on what can be approved. Even if this developer does not seem motivated to build, he could sell to another person who is motivated to develop it soon. MOTION by Lee Dube to restrict reconsideration on Special Warrant Article 2 VOTE: MOTION to restrict reconsideration PASSED Special Warrant Article 2 will be moved to the ballot as written Warrant Article 3. Shall the Town raise and appropriate as an operating budget, not including appropriations by special warrant articles and other appropriations voted separately, the amounts set forth on the budget posted with the warrant or as amended by vote of the first session, for the purposes set forth therein, totaling $4,087,789. Should this article be defeated, the default budget shall be $4,019,521, which is the same as last year, with certain adjustments required by previous action of the Town or by law; or the governing body may hold one special meeting, in accordance with RSA 40:13, X and XVI, to take up the issue of a revised operating budget only. This operating budget warrant article does not include appropriations contained in ANY other warrant articles. Page 3 of 19

4 Estimated tax impact of this warrant article is $4.88 per thousand. MOTION by Steve Brown to place Warrant Article 3 on the ballot Fred Daley feels the tax burden in town is ridiculous and there is no level of concern to the tax payer from the school board and Superintendent and now he feels that is true at the local official level. Money is spent but it doesn t come back to the taxpayers. Salary increases were put forth and not at the 3% level but through a matrix. He doesn t think there is a problem since only 2 people have left over the last 5 years and neither left for money reasons. He is in favor of a 2-3% increase yearly for employees but in the outside world there have been no increases during some of the recessions and still the town employees received pay increases. He cited the 10% health insurance cost share by employees with 90% of that burden to the taxpayer. There is a 4-day work week. He wants to take care of the employees but also wants to take care of his taxes. This is no reflection on any employee or the work they do. He feels town employees have a good gig. MOTION by Fred Daley to reduce the Selectmen s budget by $59, and to provide these employees impacted a 3% increase SECOND by Chris True The Moderator noted the overall budget figure can be reduced, not a specific budget Mr. Daley amended his motion to modify the overall budget figure by $59, to $4,027,807. Steve Brown commented that even though there is a 4-day work week, full time employees work 40 hours in that timeframe. Fred Daley agreed Chris True under the impression the Selectmen have control over the bottom line budget and even if this motion passes, the Selectmen can do what they want. If it passes, Mr. True asked the Selectmen to keep this discussion in mind. Bruce Cleveland stated the raises went into effect 1/1/18 Tina Owens cited a vote of of the Selectmen on 8/28/17 and felt that was disconcerting. She wondered if that was a majority and wondered if someone was not present Chris True raises are already in effect and asked if the Selectmen are suggesting that those with raises will move forward with their raises Steve Brown that would be a Board decision Jon Goldman that would be a discussion for the Board and he asked if all the raises are in effect Lynne Blaisdell any based on the salary survey went into effect 1/1/18 Page 4 of 19

5 Jon Goldman talked about the good meetings with the library trustees but the library budget brought an increase of $20,000 over the 2017 budget Mike Costanzo asked how many employees are affected Lynne Blaisdell 16 employees Mike Costanzo commented that everyone benefits from the library Peter Stock insulted that when the Selectmen budget is reduced the Library budget is threatened Jon Goldman no threat intended but as a Selectmen stated he was insulted that a Library Trustee and her husband would make a decision that affects these employees POINT OF CLARIFICATION Cheryl Eastman 23 employees would be affected Fred Daley also stated he takes offense with Mr. Goldman s comments The Moderator asked the body to remain focused on the amendment VOTE: MOTION to reduce the budget by $59, FAILED MOTION by Steve Brown to restrict reconsideration on Warrant Article 3 SECOND by Fran Rosenau VOTE: MOTION to restrict reconsideration on Warrant Article 3 PASSED Warrant Article 3 will be moved to the ballot as written. Warrant Article 4. Shall the Town vote to raise and appropriate and authorize the Selectmen to accept a Highway Block Grant in the sum of One Hundred Sixty Five Thousand One Hundred Thirty Six Dollars ($165,136) for the road improvement programs to be recommended by the Sandown Highway Department and approved by the Sandown Board of Selectmen, said sum to be supplied by the State of New Hampshire. Estimated tax impact of this warrant article is $0 MOTION by Cindy Buco to place Warranty Article 4 on the ballot There was no discussion on Warrant Article 4. 6 Special Warrant Article 5. Shall the Town vote to raise and appropriate the sum of Four Hundred Fifty Thousand Dollars ($450,000) to be added to the previously established Road Improvement Capital Reserve Fund. Estimated tax impact of this warrant article is $.86 per thousand. MOTION by Cindy Buco to place Special Warrant Article 5 on the ballot Lee Dube asked if there is an updated Road Improvement Plan Arthur Genualdo explained the current plan is still in place through 2018 and there will be a new one in The were some other roads that needed attention, so we are behind schedule on the current plan. This year we are scheduled to do Reed Rd, Sargent Rd and Hale True Rd. Hale True gets lots of traffic so an overlay would be done for $45,000. Lee Dube asked where is the plan that states this Arthur Genualdo it is the plan you have Doug Person has the same question and asked what has been done, what hasn t been done. What on the list has been done, what has not been done and what have been the variations Arthur Genualdo it s obvious what I have done. One year the warrant article failed. Little Mill Rd came apart and needed attention and Mr. Genualdo began to list off the roads that have been done over the years including: Hale True Rd, Lakeview, Holts Point Rd, Fremont Rd, No Danville Rd, Phillipswood, Morrison Land, Celeste Terrace and others. Wells Village Road has already been patched and to reconstruct will be over $1,000,000 to complete and will be done in phases. Many of these roads he calls farm roads and they had loam and tree stumps below grade and if we are going to repair these roads, we should do it correctly. Both Fremont Road bridge, Phillips Road bridge and the culvert on Wells Village Rd had problems that have been addressed. Only so much can be done with the funds that are available. Bruce Cleveland Hale True Road is used frequently and is coming apart and he noted a large pothole as well. We either shim and overlay or we rebuild it. Regarding Reed Road, there is much traffic on that road as well. Doug Person agrees there are many roads that are in tough shape, but he lives off Wells Village Rd and he suggests that folks drive that road. It is a safety hazard. He is asking the town to finish the plan we have and noted Wells Village Rd should have been started in Dave LaFleur questioned if the funds build over time in the Capital Reserve Fund Mike Costanzo stated the current balance of the plan is $47,000 Lynne Blaisdell explained that what is appropriated each year is expended for that year s projects. There is some retainage that remains but what is appropriated is what is needed. Page 6 of 19

7 Dave LaFleur what was appropriated last year Paula Gulla- stated the warrant article for 2017 appropriated $406,250 with an estimated tax impact of $.80 per thousand Jon Goldman explained the bid process and how the town has been later in the year for bidding which may not be an advantage for the town. This year the Selectmen decided to include the 2019 engineering costs into this year s figure with the hopes to go out to bid early in the year, allowing for more competitive bids. Arthur Genualdo added additional roads that have been completed including Woodland Rd, Rowell Rd, Chase Rd and Tenney Rd Lynne Blaisdell stated this is a 10-year plan and spans from 2008 through There is in the last paragraph of the plan a notation that the tenth year of the program (2018) was held in reserve to enable the Town to either catch up in the event full program funding were not available during each of the preceding program years, or in the event an emergency situation, resulting in the need to redirect program funds, were to be encountered during the coming decade. Special Warrant Article 5 will be moved to the ballot as written. The meeting was recessed at 10:37 am The meeting reconvened at 10:51 am Special Warrant Article 6. Shall the Town vote to raise and appropriate the sum of Seven Thousand Dollars ($7,000) to be added to the Old Home Day Celebration Expendable Trust Fund. Estimated tax impact of this warrant article is $.01 per thousand. MOTION by Steve Brown to put Special Warrant Article 6 on the ballot SECOND by Bruce Cleveland There was no discussion on Special Warrant Article 6. Special Warrant Article 6 will be moved to the ballot as written. Warrant Article 7. Shall the Town vote to approve the cost items included in the collective bargaining agreement reached between the Town of Sandown Board of Selectmen and the Union representing the Police and Animal Control Officers, the Teamster Local 633 Union, which calls for the following increases in salaries and benefits at the current staffing level: Contract Year Estimated Increase 4/1/18-3/31/19 $ 36,659 4/1/19-3/31/20 $ 19,218 Page 7 of 19

8 /1/20-3/31/21 $ 15,291 and to further raise and appropriate the sum of Thirty-Two Thousand Seven Hundred Twenty-Five Dollars ($32,725) for the current fiscal year beginning January 1, 2018 and ending December 31, 2018, such sum representing the additional costs attributable to the increase in salaries and benefits required by the new agreement over those that would be paid at current staffing levels. Estimated tax impact of this warrant article is $.06 per thousand. MOTION by Bruce Cleveland to place Warrant Article 7 on the ballot There was no discussion on Warrant Article 7. Warrant Article 7 will be moved to the ballot as written. Warrant Article 8. Shall the Town of Sandown, if Article 7 is defeated, authorize the governing body to call one special meeting, at its option, to address Article 7 cost items only. MOTION by Bruce Cleveland to place Warrant Article 8 on the ballot There was no discussion on Warrant Article 8. Warrant Article 8 will be moved to the ballot as written. Special Warrant Article 9. Shall the Town vote to raise and appropriate the sum of Fifty Thousand Dollars ($50,000) to be added to the Fire Equipment and Apparatus Capital Reserve Fund previously established. Estimated tax impact of this warrant article is $.10 per thousand. MOTION by Tom Tombarello to put Special Warrant Article 9 on the ballot SECOND by Bruce Cleveland Fire Chief Tapley Four years ago, the fire department applied for a grant and obtained the Quint ladder truck for $750,000. Now the department is in need of replacing their Self Contained Breathing Apparatus (S.C.B.A.) units that have gone beyond their 15-year lifespan. The department has again applied for a grant for 24 units and if approved part of the $50,000 will pay for the town s portion of the grant. Any remaining balance will be put aside to replace the Page 8 of 19

9 current ambulance. If the grant is not approved, then the $50,000 will be put towards the purchase of the S.C.B.A. units. Special Warrant Article 9 will be moved to the ballot as written. Special Warrant Article 10. Shall the Town vote to raise and appropriate the sum of Thirty Three Thousand Two Hundred Eighty Dollars ($33,280) for the purchase of 2 new refuse compactors for the Sandown Transfer Station to replace the existing 2 refuse compactors. This is a special warrant article. Estimated tax impact of this warrant article is $.06 per thousand. MOTION by Steve Brown to place Special Warrant Article 10 on the ballot Steve Brown explained the existing compactors are over 30 years old and break down regularly. It is difficult to find parts and the decision to purchase 2 new compactors would trade the existing compactors that hold 7-8 tons and replace them with new compactors that hold tons. We pay to haul the trash away and the new compactors should reduce the number of hauls. Tom Tombarello - pointed out that if this article fails, then no means no and we could not bring in new compactors and we would be forced to put the trash in open top containers, increasing costs. Chris True asked about retaining the old compactors to compact plastic and cardboard rather than get a trade in. Tom Tombarello that would just be a band aid and would ultimately cost the taxpayers more money. Bruce Cleveland new ones would be more efficient and better on electric costs. Again, if this fails, the use of open top containers would not save the town any money. Special Warrant Article 10 will be moved to the ballot as written. Warrant Article 11. Shall the Town vote to authorize the Selectmen to enter into a longterm lease/purchase agreement in the amount of Thirty Eight Thousand Three Hundred Seventy Nine Dollars ($38,379) payable over a term of sixty (60) months for 2 new refuse compactors to replace the existing 2 refuse compactors at the Sandown Transfer Station and to raise and appropriate the sum of Seven Thousand Six Hundred Seventy Six Dollars ($7,676) for the first year s payment for that purpose. This lease/purchase agreement contains an escape clause. Should Article 10 pass, this Article becomes null and void. Estimated tax impact of this warrant article is $.02 per thousand. 10 MOTION by Steve Brown to place Warrant Article 11 on the ballot Steve Brown this is a lease/purchase option that costs the town $5,000 more but the Selectmen wanted the voters to decide. The purchase of 2 new compactors is more cost effective. Matt Russell asked about the warranty on purchase and the maintenance costs. Arthur Genualdo on the purchase, there is a 2-year warranty. On the lease there is a maintenance contract and we pay for any additional costs. Warrant Article 11 will be moved to the ballot as written. Special Warrant Article 12. Shall the Town vote to raise and appropriate the sum of Ninety Thousand Dollars ($90,000) to be added to the Bridge Capital Reserve Fund previously established. Estimated tax impact of this warrant article is $.17 per thousand. MOTION by Bruce Cleveland to place Special Warrant Article 12 on the ballot SECOND by Cindy Buco Bruce Cleveland read the following statement: As we reported in 2015, the State of New Hampshire forced the closure of the bridge located on Phillips Road. This bridge was on the State s Red List for a number of years and suffered too much deterioration to remain open. We are happy to report, temporary repairs were made and the road was reopened. This bridge will eventually need full replacement. The cost of this replacement is estimated to be just under $1 million. The long-term plan is to continue to put money away in a capital reserve fund to save for this project. We are hoping to receive 80% of the cost back from the State of New Hampshire State Bridge Aid program but funds will not be available until 2024 and that is contingent on the program still being in place. Bruce Cleveland also stated the purpose is to save $1,000,000 for the eventual replacement of the Phillips Road Bridge Special Warrant Article 12 will be moved to the ballot as written Special Warrant Article 13. Shall the Town vote to raise and appropriate the sum of Five Thousand Dollars ($5,000) to be added to the Revaluation Capital Reserve Fund previously established. Estimated tax impact of this warrant article is $.01 per thousand. MOTION by Jon Goldman to place Special Warrant Article 13 on the ballot Page 10 of 19

11 There was no discussion on Special Warrant Article 13 Special Warrant Article 13 will be moved to the ballot as written Special Warrant Article 14. Shall the Town vote to raise and appropriate the sum of Forty Three Thousand Nine Hundred Ninety Eight Dollars ($43,998) for treatment to control exotic aquatic species including invasive variable milfoil and fanwort in Phillips Pond. Costs may be offset by grants. This is a special warrant article. Estimated tax impact of this warrant article is $.08 per thousand. (Recommended by the Budget Committee: 6-0-1) MOTION by Steve Brown to place Special Warrant Article 14 on the ballot SECOND by Bruce Cleveland Steve Brown explained the condition of Phillips Pond and noted that the exotic weeds are choking out the pond. The pond needs treatment and areas are overgrown with the weeds including the town beach area. Paula Gulla explained that the town has applied and has been awarded $10,999 towards treatment of the pond. This is a reimbursement grant, so the town will still have to appropriate the full amount but will receive reimbursement when the treatment is completed. MOTION by Paula Gulla to replace the line Costs may be offset by grants to Costs will be offset by $10,999 in grant funds. SECOND by Bruce Cleveland VOTE: MOTION to replace line in the article PASSED Special Warrant Article 14 will now read as follows: Special Warrant Article 14. (Recommended by the Budget Committee: 6-0-1) Matt Russell asked if any other grants were applied for Paula Gulla Moose Plate grant but we were denied Matt Russell if other grants were received what would happen to the balance of this warrant article Paula Gulla assume the balance would go back to the general fund Page 11 of 19

12 Matt Russell any idea of the effectiveness of the treatment and how long it will remain effect Paula Gulla cannot speak to it specifically but NHDES will be performing follow up long term management plan and the health of the pond and current condition after treatment should be mentioned Deb Brown talked about the health of the pond and stated this weed growth is the worst she has ever seen. Residents have a difficult time in the beach area and she supports the article. Rich Buco agrees and puts the swim lines in each year and talked about how infested the beach area is and agrees the problem needs to be addressed Chris True remembers previous treatment and thought that treatment was effective Jon Goldman agreed that areas are being choked out and talked about the treatment and maintenance that will be needed. He suggested that next year a Capital Reserve Fund may be an option to save for further treatments and maintenance costs. Jean Tobin asked what caused the problem Lee Dube it is an exotic weed that is brought in from other boats and is very invasive. Jon Goldman agreed and stated that is spreads very easily if chopped up with a boat s propeller Jill Winmill said milfoil can grow one inch per day, there is no stopping it and it can affect the normal plant and aquatic life in the pond Fred Daley asked about an inspection of boats as an option to control it Jon Goldman agreed and said some other lakes have that program in place. There has not been talk of having monitors in place since that is a big job. Special Warrant Article 14 will be moved to the ballot as amended. Special Warrant Article 15. Shall the Town vote to establish a Capital Reserve Fund under the provisions of RSA 35:1 to be known as the Stormwater Management Capital Reserve Fund for the purpose of stormwater management and to raise and appropriate the sum of Ten Thousand Dollars ($10,000) towards this purpose, and to further appoint the Board of Selectmen as agents to expend from the fund. Estimated tax impact of this warrant article is $.02 per thousand. MOTION by Tom Tombarello to place Special Warrant Article 15 on the ballot SECOND by Cindy Buco There was no discussion on Special Warrant Article 15 Page 12 of 19

13 Special Warrant Article 15 will be moved to the ballot as written. Warrant Article 16. Shall the Town vote to allow the operation of KENO games within the town. (Not Recommended by the Board of Selectmen: 1-3-1) (Recommended by the Budget Committee: 4-0-3) MOTION by Bruce Cleveland to place Warrant Article 16 on the ballot SECOND by Steve Brown Fred Daley asked if any percentage goes back to the town Lee Dube talked about the fact that this is to help fund full day kindergarten Deb Brown asked how this article came to be did the Selectmen initiate this Bruce Cleveland explained that Charlie McIntyre, Executive Director of the NH Lottery announced that Governor Sununu signed SB 191 into law which established KENO as a revenue source to fund full day kindergarten in NH. The agency is launching a new lottery game called KENO 603 which will be played exclusively in taverns and restaurants that have an active liquor pouring license. Steve Brown stated he was the only one to vote for it and thought it would be a good idea. We are always attempting to bring new businesses into the town and if this passed, it would be another option for a local tavern or restaurant to offer. If this warrant article passes, future appropriations will be included in the operating budget. Estimated tax impact of this warrant article is $.01 per thousand. MOTION by Tom Tombarello to place Warrant Article 17 on the ballot SECOND by Bruce Cleveland Tom Tombarello asked to defer to the Isaiah 58 representative Carrie Wieland from Isaiah 58 gave a brief presentation to the body explaining that the mission of Isaiah 58 is to eradicate homelessness. She noted that it is a problem even in towns like Sandown. People may not be sleeping in the streets, but they are couch surfing, sleeping in cars and the organization has assisted 7 Sandown families over the past year. Tom Tombarello stated he was unaware of the extent of homelessness in Sandown Lynne Blaisdell explained that when a service organization requests funding, the Selectmen have chosen to put it on the warrant to get the vote of the people. If it passes, then future appropriations will be through the budgeting process. Bruce Cleveland also stated he was unaware of the amount of homelessness prior to becoming a Selectman but it exists, and he feels that partnering with Isaiah 58 would offer more support and transition to those in need. Cindy Buco stated the Selectmen review all the organizations requests for funding on a yearly basis and try and determine those that would benefit the town the best Chris True expressed his support and said it was a worthwhile organization. He suggested that for a small amount of money, thousands of expenses could be saved Warrant Article 17 will be moved to the ballot as written Petitioned Warrant Article 18. Shall the Town vote to establish a Heritage Commission in accordance with the provisions of RSA 673 and RSA 674 and to authorize the Selectmen to appoint five to seven citizens as members of the Heritage Commission pursuant to RSA 673:4-a and RSA 673:5 and to appoint up to five additional citizens as alternate members, or take any other action relating thereto. (Zero tax impact) MOTION by Cindy Buco to place Petitioned Warrant Article 18 on the ballot SECOND by Bruce Cleveland Pam Gaudreau had a Power Point presentation playing for the body regarding Heritage Commissions. She explained that last year s article failed by 55 votes. This would be no cost to the town and would defray costs to the town. The Heritage Commission would attend to the Page 14 of 19

15 town s historic resources, have access to funding grants and right now there is no official town board to attend to the historic buildings. Fred Daley questioned the no cost to the town citing that he has heard that previously. He asked if the costs would be covered by grants and they would be self-sustaining. Pam Gaudreau yes, that is the intent. However, Pam stated the only cost she is aware of regarding other Heritage Commissions is the payment of a Recording Secretary. There could be costs if the Heritage Commission is assisting the town with a project, but those costs are associated with the project and not with the Commission. Cindy Buco asked if this was the only way we could obtain grants. Pam Gaudreau individuals can obtain grants, but a Heritage Commission has access to grants that individuals do not. Anthony Loconte stated that no Board other than the Board of Selectmen controls the historic buildings at this time. Pam Gaudreau stated the Commission would pair with the Selectmen and would do the research, be a resource and help find funding Petitioned Warrant Article 18 will be moved to the ballot as written Petitioned Warrant Article 19. Shall the Town vote to establish a Heritage Fund in accordance with the provisions of N.H. RSA 674:44-d. The whole or part of any gifts of money, grants, donations or appropriated funds received pursuant to RSA 674:44-b shall be placed in the Heritage Fund and allowed to accumulate from year to year. Money may be expended from such fund by the Heritage Commission for its purposes without approval of the Town Meeting. (RSA 674:44-d,1). (Zero tax impact) MOTION by Cindy Buco to place Petitioned Warrant Article 19 on the ballot SECOND by Bruce Cleveland Bruce Cleveland asked if the Heritage Commission and Heritage Commission Fund could be dissolved at town meting Pam Gaudreau stated that they separated out the fund this year separate from the establishment of the Commission and she didn t know the answer to Mr. Cleveland s question. The Moderator stated he would have to consider Mr. Cleveland s question out of order since it deals with the last article Pam Gaudreau she is interested in the stone structures around town. The Heritage Commission would have some clout with the state to protect these structures. MOTION by Scott Bassett to insert the following sentence after the words Town Meeting: Should Article 18 fail, this article becomes null and void Page 15 of 19

16 SECOND by Carroll Bassett VOTE: MOTION to insert wording to end of the article PASSED Amended Petitioned Warrant Article 19 will now read as follows: Petitioned Warrant Article 19. Shall the Town vote to establish a Heritage Fund in accordance with the provisions of N.H. RSA 674:44-d. Jon Goldman questioned if the Heritage Commission can exist without the Heritage Fund Attorney Gorrow yes Chris True Point of Inquiry are we voting on the amendment then on the article The Moderator yes, we are voting on the amendment Chris True felt there may be a problem with the Heritage Commission expending funds without the approval of town meeting. Can the body change that? Attorney Gorrow the statute is clear, and it is part of the statute that if the fund is established the Heritage Commission can expend the funds and the body is limited to changing that. Chris True could the Commission be dissolved Attorney Gorrow the article that created the Heritage Commission could be rescinded Pam Gaudreau likened it to the Conservation Commission that has funds spent from their account without town approval Anthony Loconte asked if it is possible to establish the fund without putting any money into it Attorney Gorrow stated in this case, the Heritage Fund can mix private and town funds, so yes Anthony Loconte he clarified that he was speaking of accounting purposes Attorney Gorrow it is not necessary to appropriate any funds into the Heritage Fund Diana True where would the funds go if article 18 passes but article 19 fails Page 16 of 19

17 Attorney Gorrow a Town committee cannot set up an outside account to accept funds, so a donation fund could be set up. All donations would need to be approved by the Selectmen Tom Tombarello noted that the Sandown Senior Affairs Transportation Fund (SSATP) has a donation fund Petitioned Warrant Article 19 will be moved to the ballot as amended Petitioned Warrant Article 20. Shall the town vote to approve the use of a parcel of town property for the purpose of creating a dog park in Sandown. The park would be established, operated and managed by a private non profit group of volunteers and funded by grants, private fundraising and donations of money, gifts and services. (Zero tax impact). MOTION by Tom Tombarello to place Petitioned Warrant Article 20 on the ballot SECOND by Bruce Cleveland Chris Longchamps stated the purpose of this warrant article is to determine if the voters are interested in using town land for a dog park. There would be a small membership and Mr. Longchamps read the following mission statement: The mission of the Sandown Dog Park is to establish an enclosed, safe and secure, off leash park where people and their well behaved dogs can play, exercise and socialize without endangering themselves, other people or pets, property, wildlife or the environment. To develop an attractive, dog friendly and well maintained space that welcomes all dog lovers who are willing to abide by the park rules and restrictions. To promote and facilitate responsible dog ownership, well balances and behaved dogs, education, training and fun activities by sharing resources through volunteers and dog professionals. To encourage the view of the park as a community project in partnership with the town of Sandown, NH designed to meet the needs of dog owners and non-dog owners alike. To foster a sense of community be encouraging positive social interactions among citizens while minimizing negative encounters with citizens who are apprehensive of off leash dogs in other public settings. To further promote Sandown, NH as a welcoming community for residents and visitors alike. Pam Gaudreau stated this is a good example of preserving open space and article 2 may provide some land Tina Owens these are being created all over the country Chris True questioned if the town s liability would be mitigated by signage Page 17 of 19

18 Attorney Gorrow there should be insurance for the town and the dog owner would have the liability Tom Tombarello Primex, the town s insurance company quoted that the liability rests with the dog owner Chris True fencing an area like that will be expensive and who takes on the responsibility Jon Goldman reminded the body that this is a petitioned warrant article and not the Selectmen s Lee Dube is it a binding warrant article Attorney Gorrow no is it advisory only Pam Gaudreau the group is looking for interest only and needs about 2 acres of land MOTION by Kate Winter to change the word approve to the word explore Jon Goldman can you change a petitioned warrant article The Moderator yes Pam Gaudreau she would rather keep the word approve because if the town if not ready to approve it, then there is a lot of work and costs that would be avoided Terry Knuuttunen - the exploring has already been done and maybe he needs a better explanation of what is meant by exploring Kate Winter it does the same thing it gets the temperature of the voters Peter Stock the wording is misleading, it looks like the town will do the exploring Chris True explore makes it softer and gives the people a better explanation Terry Knuuttunen if we keep the word explore, is this group expected to return next year to present again Lee Dube no it s town property Terry Knuuttunen expressed that he is still not clear Jon Goldman if it is on town-owned property then the Selectmen could say yes. The Selectmen would probably hold a public hearing with the details, but they could say yes. Chris Longchamps if there is no difference, then why amend it Page 18 of 19

Shall the Town vote to rescind the medical benefits approved in Article #37 at the March 1994 Town Meeting and the vacation benefit approved in Article # 13 at the March 1996 Town Meeting for the Town Clerk/Tax Collector and establish benefits for the Town Clerk/Tax Collector position in accordance with the Town s personnel policies and procedures for full-time employees. Such benefits include but are not limited to health insurance, holidays, sick/personal days, vacation and life insurance. (No Recommendation by the Board of Selectmen: 2-2-1) MOTION by Steve Brown to place Warrant Article 21 on the ballot SECOND by Ed Mencis Steve Brown gave an explanation that back in 1994 and 1996 the voters gave the then Town Clerk/Tax Collector vacation and medical benefits due to his 20 years of service to the town. Since they made those provisions with the position and not the person, they still exist today. Since the current Town Clerk/Tax Collector is not running again, this is the time to change the vacation and benefits for this position to bring them in line with the personal policy and procedures. Cindy Buco agrees this is the right thing to do to align this position with the others. However, new employees do not receive vacation benefits during the first year, so the Selectmen will be looking at the personnel policy and discussing that at the next Selectmen meeting. Warrant Article 21 will be placed on the ballot as written Moderator Kevin Major took a moment to thank the Town Clerk/ Tax Collector Michelle Short for her 15 years of service with the town.
