1 KANSAS CITY, KANSAS LANDMARKS COMMISSION December 3, 2018 Minutes The Kansas City, Kansas Landmarks Commission met in regular session on Monday, December 3, 2018, at 6:00 p.m., in the Commission Chamber of the Municipal Office Building, with the following members present: Mr. David Meditz, Presiding, Ms. Karen French, Vice, Mr. John Altevogt, Mr. Murrel Bland, Mr. Hank Chamberlain, Mr. Jim Schraeder, Mr. John Tiszka, (Absent: Craddock, Taylor and Van Middlesworth) Mr. Robin H. Richardson, AICP, Director of Planning, and Ms. Janet L. Parker, CSC/APC, Administrative Assistant, were also present. The minutes of the October 1, 2018 meeting were approved as distributed. Case Starts At.58: CERTIFICATE OF APPROPRIATENESS #CA MEGAN PAINTER/CHWC, INC. SYNOPSIS: Certificate of Appropriateness to remove a failed and inadequately sized chimney and rebuild brick veneer with existing and matching brick at 2429 Washington Boulevard, within the Westheight Manor Historic District, listed on the National Register of Historic Places, Kansas Register of Historic Places, and as a Kansas City, Kansas Landmarks District. Detailed Outline of Requested Action: The applicant is seeking a Certificate of Appropriateness to remove a failed chimney from this home. The chimney does not have a cricket on the roof, resulting in severe water damage and rot in the interior wall. Patches in mortar show loss of bricks from the chimney area, and significant movement. The Chimney will be completely removed, and the wall patched where it was removed. A private inspector stated that the height of the current chimney flue is not adequate for fireplace exhaust. The property is in the Westheight Manor Historic District, listed on the National Register of Historic Places, Register of Historic Kansas Places, and a local Kansas City, Kansas District. Recording Secretary Parker stated that staff received a written request from the applicant today requesting that this item be held over as they are pursuing historic tax credits and the staff is not recommending approval of the application at time. Staff Recommendation Starts At 1:54: Planning Director Richardson stated that the staff recommends holding over this application to allow the applicant to pursue a tax credit application which might eliminate the need for this application. 2 Motion/Vote Starts At 2:01: On motion by Mr. Chamberlain, seconded by Ms. French, the Landmarks Commission voted as follows to HOLD OVER #CA as per the applicant s request for one (1) month: Chamberlain Schraeder: Van Middlesworth: Motion to HOLD OVER Passed: 6 to 0 Case starts at 2:50: The applicant was not present and the application was moved to the end of the agenda. The case was recalled at 13:40 and the applicant was not present. CERTIFICATE OF APPROPRIATENESS #CA KELLY HRABE WITH BOULEVARD LOFTS LP SYNOPSIS: Certificate of Appropriateness for the demolition and construction of a multi-family residential development at 1315 North 9 th Street, within the 500-foot environs of Sumner High and athletic field, and 500-foot environs of the Dr. A. Porter Davis Residence (Castle Rock), listed on the National Register of Historic Places, Register of Historic Kansas Places, and as a Kansas City, Kansas Landmark. Detailed Outline of Requested Action: This application has been submitted to develop a multi-family residential development with two six-unit townhouse buildings and a 38-unit apartment building. It also includes surface parking and significant open space. Staff Recommendation Starts At 13:50: Planning Director Richardson stated that he would like to change his approval recommendation to a hold over recommendation as the elevations that the Landmarks Commission have are not current (he learned on Friday.) They may change significantly from what is before the Commission so he feels that the application should be held over for the Commission to have the final elevations before them. December 3,
3 The Commission discussed whether or not it is within the purview of the Commission to discuss the aesthetics of new construction of something that is within the 500 environs of a historic landmark or district. Director Richardson stated that the property owners within 200 have been notified of the applications on the City Planning Commission agenda but not the Landmarks Commission agenda. Those cases will not move forward this month. The Commission stated that maybe the owners should be notified of the Landmarks consideration and perhaps that can be addressed in the new zoning ordinance rewrite. Director Richardson stated that he and a member of staff had a meeting with the developer a couple of weeks ago and the applicant told them that the neighborhood was in support. They also had a meeting with the neighborhood group leaders and they were not aware of all aspects of the project. So there is some work that needs to be done. Motion/Vote Starts At 24:40: On motion by Mr. Altevogt, seconded by Mr. Schraeder, the Landmarks Commission voted as follows to HOLD OVER #CA until the January 7, 2019 meeting as per the staff s recommendation for the Commission to have complete plans to review: Chamberlain Schraeder: Van Middlesworth: Motion to HOLD OVER Passed: 6 to 0 Case starts at 3:59: CERTIFICATE OF APPROPRIATENESS #CA MATTHEW TOMASIC WITH TOMAHAWK VENTURES LLC SYNOPSIS: Certificate of Appropriateness for additions/alterations for restoration of the former St. Mary s Church, to use the building for the Kansas City, Kansas Police athletic league at 800 North 5 th Street, listed on the Kansas State Register of Historic Places (February 13, 1982.) Detailed Outline of Requested Action: This application has been submitted to create an accessible route out of the west end of the church. The church has been remodeled into a facility to provide services for the Police Athletic League. It should be noted that a single-family structure was demolished to the west of the church on what is now part of the church property. Somehow a permit was issued without the benefit of Landmarks review. December 3,
4 Matthew Tomasic, applicant, 1400 West 50 th Terrace, Kansas City, Missouri Staff Recommendation Starts At 5:16: Planning Director Richardson stated that the comments in the staff report explain the proposal. The staff sent out today (to the Commission) an elevation that shows this from 5 th Street and notes that it is some 80 behind the front elevation and it does provide an ADA access and appropriate fire access for the structure so it can be used for modern purposes. The staff recommends approval. Motion/Vote Starts At 5:50: On motion by Mr. Schraeder, seconded by Mr. Bland, the Landmarks Commission voted as follows to APPROVE #CA : Chamberlain Schraeder: Van Middlesworth: Motion to APPROVE Passed: 6 to 0 Subject to: 1. Elevation that was submitted to staff on December 3, The construction of the new ramp will not be attached to the church in any location where the previous stairs were attached. 3. The existing stairs have been removed already. At that point a stop work order was issued. 4. After review of the nomination form nothing was found that would indicate this modification would impact the architectural or cultural significance of the structure. MISCELLANEOUS Starts At 6:38: Next meeting is January 7, There is one new application and one hold over application. December 3,
5 Ethics Training/Meeting Procedures Secretary Parker thanked the Commission members for attending the training. Director Richardson stated that any member that did not attend the training needs to contact Secretary Parker so she can schedule them for the Ethics Training (mandatory training.) Federal and State Tax Credit Seminar on February 4, 2019 from 8:00 a.m. to 4:00 p.m. at Kansas Museum of History Classrooms at 6425 SW 6 th Avenue, Topeka, Kansas (information was distributed to the Commission.) The cost is $15.00 which will be paid through the department s budget. ( Meditz and Vice French stated that they would like to attend.) Wyandotte Portraits from the William E. Connelley Collection Exhibit will be on display November 2, 2018 to January 2, 2019 (information was distributed to the Commission.) UMB Building Update Starts At 8:30: Director Richardson stated that the building was involved in foreclosure proceedings and staff is waiting for the journal notes to come out to see if the property transferred hands. The staff checked last week and it had not happened; if it does change hands there is the possibility that it will have an owner that the staff can work with to get certain repairs done. T-Mobile has an interest in this as they have their antennas on the building and the city is holding up their electrical permits because there are other electrical issues in the building. T-Mobile is putting pressure on the owner and financer to get these issues resolved so they can move forward. The city is working through the Code Enforcement and Building Inspection processes as best as they can. There is a bench warrant out for the corporation that currently owns the building but a corporation obviously cannot be arrested. If there are new owners the staff will go through the code enforcement issues and it will probably be two to three months before all of the issues are resolved.
