Maintenance of the Veterans Memorial Cemetery. 3 Notwithstanding any other provision of law, the sum of Two Hundred Thousand 4 Dollars ($200,000) is appropriated from the FY 2009 Guam Highway Fund 5 revenues to the Office of Veterans Affairs for the operations and maintenance of 6 the Veterans Memorial Cemetery. Chairman Calvo then recognized all those signed in to provide testimony on the bill. Although all testimonies received were in favor of the bill, many commented on their disappointment that only two Senators were present at the hearing. III. WRITTEN TESTIMONIES: The Committee received two written testimonies (attached), one in support and the other not in support of Bill 386(LS). The Committee will continue to receive written testimonies regarding Bill 386(LS) for the next ten working days. IV. 11 TESTIMONY IN SUPPORT OF BILL NO. 386 Submitted by Fred Gofigan Administrator Guam Veterans Affairs Office I am the Administrator for the Guam Veterans Affairs Office the Guam Veterans Cemetery is under my purview. P.L transferred the responsibility of the Cemetery from the Department of Parks and Recreation. The law appropriated $200,000 for the cemetery only to privatize the maintenance. The law did not take into account other functions of the Cemetery for example, Burial Services, Burial Reimbursements, Application for Head markers and Reporting Requirements to Department of Veterans Affairs National Cemetery as part of their grant requirements. The National Cemetery does not provide funding for the operations of the Cemetery. It only provides reimbursements for veterans laid to rest at the Guam Veterans Cemetery (GVC) and Federal Grants for improvements and expansions. GVC only receives $300 per veteran laid to rest; which is approximately$ 18,000 per year. GVC does not charge for Dependents to be laid to rest at GVC. The Department of Parks & Recreation and Mayor Vicente Gumataotao provide the staffs for the burials; we are operating on borrowed staff. Rules and Regulations at GVC are constantly violated due to the lack of enforcement; for example drilling the crypts to place candle holders and headstones are lifted above ground. These Rules and Regulations can only be enforced if GVC has its own staff. We spent over $50,000 to restore the GVC in preparation for Memorial Day; however, with the lack of staffing GVC is going back to its previous condition. Department of Corrections provides bi-weekly grass cutting services through our Memorandum of Understanding. But the Cemetery is in need of weekly cutting. In preparation of All Souls Days we had to request the assistance of Mayor Gumataotao, the Army Retirees Association and the ROTC students of GW. Our veterans deserve more, especially those that gave the ultimate sacrifice.

Wonpat, Ed.D and members of the 29th Guam Legislature. Bill 386 (LS) seeks to appropriate $200,000 from the FY2009 Guam Highway Fund revenues to the Office of Veterans Affairs for the operations and maintenance of the Veterans Memorial Cemetary. The passage of this Bill will deplete an already diminishing, operational Guam Highway Fund source. The current Budget Act, PL29-113, already over-extends the current GHF, and for a myriad of under-funded mandates (e.g., the DPW's Divisions of Verticals-Horizontals-Building Maintenance, the $5.3MM in invoices-actuals for streetlights v. the $3.3MM appropriationsshortfalls, the dismal Mass Transit operations-services v. the appropriations, etc.) The attached sheets show an estimated shortfall of the GHF. It outlines our analysis of this Bill's impact on the GHF and makes recommendations. It is for these reasons that the Department of Public Works is opposed to the passage of Bill 386 with the Guam Highway Fund as an appropriation source.
