1 MUNICIPALITY OF MONROEVILLE REGULAR COUNCIL MEETING AUGUST 11, 2015 MINUTES The meeting was called to order at 7 p.m. by Mayor Gregory Erosenko. LORDS S PRAYER AND PLEDGE OF ALLEGIANCE The Lord s Prayer and Pledge of Allegiance were recited at this time. ROLL CALL The Recording Secretary, Sharon McIndoe, called roll and the following were present: Mayor Erosenko, Linda Gaydos, Nick Gresock, Ron Harvey, Jim Johns, Paul Caliari, Steve Duncan, Tom Wilson, Tim Little, Bruce Dice, Sean Lally, Paul Hugus and Joe Sedlak. PUBLIC COMMENT ON PROPOSED AGENDA ITEMS ONLY No one came forward at this time. EXECUTIVE SESSION ANNOUNCEMENT Council conducted an executive session for personnel and litigation reasons prior to Citizen s Night on August 6, 2015 beginning at 6:45 p.m. and ending at 7 p.m. and before the Council Meeting beginning at 6:45 p.m. Council legislative action was taken at the August 11, 2015 Council Meeting. APPROVAL OF MINUTES There being no corrections, additions or deletions to the Minutes of the Citizen s Night Meeting of July 9, 2015, Council Work Session of July 9, 2015 and the Regular Council Meeting of July 14, 2015, Dr. Gresock duly made a motion to approve them, as submitted, and Mrs. Gaydos and Mr. Duncan seconded it. Upon a roll call vote, the motion carried with six affirmative votes and one abstention by Mr. Wilson. APPROVAL OF REPORTS OF TAX COLLECTIONS Council then considered approval of the Reports of Tax Collections. Whereupon, Mr. Johns duly made a motion to approve them, as submitted, and Mrs. Gaydos seconded it. Upon a roll call vote, the motion carried unanimously.

2 Regular Meeting 2 August 11, 2015 LIST OF BILLS, BUDGET TRANSFERS AND PAYROLL Council then considered approval of the List of Bills in the amount of $514,998.73, Budget Transfers and Payroll in the amount of $1,327, for the month of July. Whereupon, Mrs. Gaydos duly made a motion to approve the payroll and Mr. Johns seconded it. Upon a roll call vote, the motion carried unanimously. Further, Mrs. Gaydos duly made a motion to approve the list of bills and budget transfers and Dr. Gresock seconded it. Upon a roll call vote, the motion carried unanimously. VACANCIES ON BOARDS, COMMISSIONS AND AUTHORITIES PARKS AND RECREATION ADVISORY BOARD There being no discussion, Mrs. Gaydos duly made a motion to appoint Mr. Jason Hitchman from Ward One to the Parks and Recreation Advisory Board and Dr. Gresock seconded it. Upon a voice vote, the motion carried unanimously. CONSENT AGENDA RESOLUTION SITE PLAN 14-8-ST IMAMIA ORGANIZATION OF PITTSBURGH The applicant is requesting site plan approval to construct an 8,094 square foot church and associated site amenities. The property is located at 351 Old Haymaker Road in the M-1 Planned Industrial and R-2, Single-Family Residential Zoning District. RESOLUTION CONDITIONAL USE 14-5-C IMAMIA ORGANIZATION OF PITTSBURGH The applicant is requesting conditional use approval to construct an 8,094 square foot church and associated site amenity. The property is located at 351 Old Haymaker Road in the R-2, Single-Family Residential Zoning District.

3 Regular Meeting 3 August 11, 2015 RESOLUTION FINAL SUBDIVISION 14-5-SUB IMAMIA ORGANIZATION OF PITTSBURGH The applicant is requesting final subdivision approval of Parcel No. 855-K-201 and Parcel No. 855-K-381 to create Lot 1-R totaling 1.11 acres and Lot 2-R totaling 0.24 acres. The property is located at 351 Old Haymaker Road in the R-2, Single-Family Residential Zoning District. There being no discussion, a motion was duly made by Mr. Caliari to approve Site Plan Application No ST and Mr. Wilson seconded it. Dr. Gresock presented a map of Monroeville reflecting the location of R-2 Zoning Districts and he explained churches are permitted in those districts. He reviewed golf courses, public schools, recreational centers and timbering operations are also permitted. He indicated he had questioned at the work session whether there were churches located in R-2 Districts and found that there are at least 23 throughout Monroeville. He wanted to show the map of all the churches located within those R-2 Zoning Districts. Mr. Hugus reported there are 31 facilities and 23 of them are located in the R-2 Zoning Districts. Upon a roll call vote, the motion carried unanimously. Whereupon, Mr. Caliari duly made a motion to approve Conditional Use Application No C and Mr. Johns seconded it. Upon a roll call vote, the motion carried unanimously. Furthermore, Mr. Caliari duly made a motion to approve Final Subdivision Application No SUB and Mr. Wilson seconded it. Mrs. Gaydos inquired whether the.24 is where the current home is located and Mr. Hugus answered affirmatively. Mrs. Gaydos asserted the balance of the property would be combined to build and Mr. Hugus answered affirmatively. He added they are rearranging the lot line between the parcels to create a bigger lot for the place of worship versus the single-family home. Mrs. Gaydos questioned whether the applicant must come back for approval to change the single-family home to a different use and Mr. Hugus answered affirmatively. Mr. Harvey questioned whether the home is tax exempt and Mayor Erosenko answered negatively. Upon a roll call vote, the motion carried unanimously. MOTIONS MOTION A motion to appoint a non-uniformed employee to the OPEB Trust Committee. Mr. Little explained council received the names of three candidates interested in the appointment. Mr. Duncan inquired about the list and Mr. Little reported the three candidates were Darlene Cole, Liz Summers and Paul Estok. Whereupon, Mr. Wilson duly made a motion to appoint Darlene Cole and Mr. Harvey seconded it. Upon a roll call vote, the motion carried unanimously.

4 Regular Meeting 4 August 11, 2015 MOTION A motion to accept the terms and conditions of the agreement with First National Bank (FNB) for a lease purchase agreement for three (3) 2016 Ford Utility Interceptors with up-fitting kits for a three-year term at a 1.52 percent rate for an annual payment of $38, for a total of $113,626.59; and two (2) 2016 Mark GU712 Dump Trucks and Hoppers at a 1.81 percent rate for an annual payment of $74, for a total of $357, The Grand Total is $471, Mr. Little reported these payments will be taken out of the capital improvements fund. Whereupon, Dr. Gresock duly made a motion to approve and Mrs. Gaydos seconded it. Mr. Harvey inquired why there are two different interest rates and Mr. Little answered because there are two different terms. Mr. Caliari questioned why there are two different terms and Mr. Little answered all three lending institutes provided the information that way. He added the vehicles are for a three-year term and the trucks are for a five-year term. Further discussion ensued. Upon a roll call vote, the motion carried unanimously. RESOLUTIONS RESOLUTION A resolution amending the fund balance policy. There being no discussion, Mrs. Gaydos duly made a motion to approve and Mr. Wilson seconded it. Upon a roll call vote, the motion carried unanimously. ORDINANCES An ordinance of the Municipality of Monroeville electing to amend its Municipal Pension Plan administered by the Pennsylvania Municipal Retirement System pursuant to Article IV of the Pennsylvania Municipal Retirement Law; agreeing to be bound by all provisions of the Pennsylvania Municipal Retirement Law, as amended, and as applicable to member municipalities. (Recommended to continue tabling.) Whereupon, Mrs. Gaydos duly made a motion to table and Mr. Caliari seconded it. Upon a roll call vote, the motion carried unanimously. REPORTS OF MUNICIPAL STAFF MUNICIPAL MANAGER Mr. Little reported the Monroeville Jazz Festival will be held on August 22, 2015 and the Gateway Gallop 5K Race and 1 Mile Family Fun Walk will be held on October 4, 2015.

5 Regular Meeting 5 August 11, 2015 Mr. Little requested council consider making a donation to the Gateway Football Boosters Association per the information distributed. Mr. Wilson recommended council support the team. Dr. Gresock inquired what was done in the past and Mr. Little answered a quarter page ad. Whereupon, Mr. Wilson duly made a motion to approve a quarter page ad in the amount of $65 and Mrs. Gaydos seconded it. Upon a roll call vote, the motion carried unanimously. PUBLIC COMMENTS A nonresident came forward to make comment. Mayor Erosenko indicated he could submit his concerns in writing to the mayor or manager. Mr. Robert Serafini, a resident, came forward to report the application concerning a senior citizens building being proposed on Northern Pike was tabled at the last planning commission meeting. He encouraged anyone who has any concerns to attend the meeting on August 19, 2015 at 7:30 p.m. REPORTS OF MUNICIPAL COUNCIL MEMBERS FIRST WARD COUNCILWOMAN LINDA GAYDOS Mrs. Gaydos reminded everyone of the recognition of the members of the Monroeville Senior Citizens Center. She encouraged everyone to join and reported they are having appreciation days this week for all the members. Mrs. Gaydos also reminded everyone to report any street lights that are out because they are being paid for whether they are on or not. SECOND WARD COUNCILMAN NICK GRESOCK Dr. Gresock reported Shakespeare in the Park is being presented August 14-15, 2015 from 7 to 9 p.m. with a Winter s Tail by Poor York s Players at the Tall Trees Amphitheater at the Community Park. He also reported the last Summer Concert Series is August 15, 2015 with Eighth Street Rocks from 6:30 to 8:30 a.m. at the Tall Trees Amphitheater. He expressed his appreciation to UPMC for their support of this series. He reminded everyone that Monroeville United Methodist Church will be celebrating their 60 th Birthday on Sunday from noon to 3 p.m. He announced it is free and there will be food and games. He indicated it will be held at the Community Park in Pavilion Nos. 2 and 4. Dr. Gresock briefly explained how residents should protect themselves against lime disease which is a bacterial infection that is carried by the black legged tick which is a deer tick and transmitted from animals to humans. He reported it is becoming an epidemic in Pennsylvania and Pennsylvania has had the most reported for the past five years in the United States. He indicated it is treatable and preventable. He was hopeful that he could get some information from Allegheny Health Department on the website.

6 Regular Meeting 6 August 11, 2015 Dr. Gresock also sent condolences to Tina Mular and family who recently lost her mother who was a member of the Senior Citizens Center and Senior Center Council. THIRDWARD COUNCILMAN RON HARVEY Mr. Harvey inquired whether council could send something to the departments to enforce a problem with some of the houses in the community that look like dumps. He specifically mentioned the first house on Logan s Ferry Road on the right. He reported he has had many telephone calls and he felt something should be done to make sure the residents know this cannot be allowed. He suggested they could be cited and Mr. Hugus answered they have been cited three times by the code enforcement officer. He indicated they have gone to the magistrate twice and have been found guilty but they did not show. He indicated they were fined but cannot pay it then they were put on a payment plan but they have not abated the problem. He explained the municipality has gone through the system but they cannot go on private property to correct the problem. Mrs. Gaydos suggested the resident should be fined on a daily basis and the property liened. Mr. Hugus answered the fines and penalties are set by the magistrate. Mrs. Gaydos felt if the residents are not cleaning up the problem then the municipality needs to impose something stricter. Mr. Johns explained how he had the same problem and certain residents will pay the fine but will not clean up the problem and then some will pay in increments. He stated it is a no-win situation and the municipality cannot go on private property. Mr. Hugus explained usually by the time the municipality gets to the magistrate s level the property has been cleaned up or they clean it up after they are fined but this homeowner did not show up at the hearing. Mr. Harvey reported something happened that they cleaned it up somewhat and Mr. Hugus indicated it has been an ongoing problem for over a year. Mrs. Gaydos again insisted something should be done to fine them daily. She felt the municipality has to make a statement because it is not fair to the other property owners. Again, Mr. Hugus agreed but indicated the fines are set by the magistrate not the municipality. Dr. Gresock inquired whether there is any legal action that could be taken and Mr. Dice advised the municipality could seek a court injunction to get it cleaned up. He explained how it could cost the municipality more in legal fees trying to enforce the property be cleaned up than to go clean it up. Again, Mr. Hugus was concerned with the home owner resisting the enforcement. He reported these residents have a record of not being good citizens and the police have been called numerous times. Further discussion ensued concerning maintenance of vacant homes and the land bank. Mr. Hugus mentioned this is more of a problem than with maintenance. Mr. Duncan indicated there are ordinances to enforce these issues. Further discussion ensued regarding abandoned vehicles and vehicles on blocks. Chief Cole explained the different laws. Mr. Harvey questioned what the process is when the homeowner has disregarded the magistrate s fine. Mrs. Gaydos suggested the cost of the fine be increased and Mr. Hugus again stated the fine is set by the magistrate. He indicated he felt the same frustrations but the municipality is at the end of it limitations of what can be done. Mr. Duncan felt it may be better with an abandoned home where something can be done. Dr.

7 Regular Meeting 7 August 11, 2015 Gresock questioned whether it is the same situation with an abandoned home and Mr. Hugus explained that is usually with a foreclosure or someone walks away or there is a death and the property can be liened. Dr. Gresock inquired what happens with a home that an owner does not live in it but it is not being maintained. Mr. Hugus explained the municipality goes through the same citation and magistrate process but he was concerned with enforcement when the homeowner is living at the home. Mr. Caliari questioned whether the magistrate would only go beyond citation and Mr. Dice indicated that is his jurisdiction. Mrs. Gaydos questioned whether the municipality could do something with the taxes. Mr. Harvey thanked Chief Cole for the break down he distributed of the police department activities for the month and Mr. Adams for answering all his calls resolving issues. He also requested the administration send an information letter to the residents of McClure Road and neighboring streets with the intentions of the municipality to improve the road next Spring. Mr. Little agreed to do so. Mr. Harvey inquired whether the council and manager were aware that snow fall insurance can be purchased. He explained it is for when large amounts of snow fall and the entity goes over budget with the costs for manpower and salt. He pointed out this past winter when a community in New England had snow fall insurance and they were reimbursed for $40,000 and the premium was $8,000 for anything over 70 inches and they had 124 inches. Further discussion ensued and Mr. Little indicated he would review it. Mr. Harvey sent his condolences to Tina Mular on the loss of her mother. FOURTH WARD COUNCILMAN JIM JOHNS Mr. Johns reviewed the calendar of events for the Monroeville Convention Center: Wine/Beer Spirits and Triple Treat Comedy Show, August 15, 2015; Mac Art Show, August 14-16, 2015; Just Between Friends, August 20-23, 2015; Show Masters Gun Show, August 21-22, 2015; CAMP Coins and More Productions, August 28-30, He reported the Monroeville Chamber of Commerce will host the 11 th Annual Celebrate Monroeville on September 2, 2015 from 4 p.m. to 8:30 p.m. He reported the fee is $5 for adults and children are free under five years old. He gave a telephone number and indicated the information is on the website. He reported on August 29, 2015 River Towne Brewery will sponsor Rhythm and Brews featuring the Rusted Root at the Tall Trees Amphitheater and he indicated the general admission tickets are $50 and the VIP tickets are $80 and are available on and also referred to for additional information. He commended Chief Cole and his staff of police officers for their work and he explained how he was allowed to sit in on a DUI checkpoint for three hours. He also sent condolences to Tina Mular and her family. FIFTH WARD COUNCILMAN PAUL CALIARI Mr. Caliari reported the Monroeville Library s Victorian Teen Fashion Show is August 30, 2015 at noon at the Pitcairn Park Building with tickets for $25 which can be purchased at the library.

8 Regular Meeting 8 August 11, 2015 SIXTH WARD COUNCILMAN STEVE DUNCAN Mr. Duncan reported the Municipal Authority has completed the installation of a 12-inch iron ductile pipe on Elliott Road and all paving and yards have been repaired but may require a second seeding. He encouraged residents to notify the authority if they see the yards not growing. He reported the work on Brookside Drive is to be completed on the 12-inch water line in approximately three weeks and there will be some minor traffic interruptions for residents during the installation period. He stated completion of the projection will result in the elimination of 4,000 feet of 12-inch cast iron pipe that has caused numerous interruptions on Route 22 Corridor in recent years. He reported residents have the option of paperless billing from the Municipal Authority by signing up for e-billing on the MMA Website at Mr. Duncan also sent his condolences to the Mular Family on their loss. SEVENTH WARD COUNCILMAN TOM WILSON Mr. Wilson sent condolences to Tina Mular and her family. He also confirmed Pitcairn Road would be opened the next day and Mr. Little concurred. MAYOR GREG EROSENKO Mayor Erosenko sent heart felt condolences to Tina Mular and her family. ADJOURNMENT There being no further business to come before council, at this time, Mr. Johns duly made a motion to adjourn the meeting at 7:46 p.m. Mrs. Gaydos and Mr. Wilson seconded it.
