1 SAFETY SERVICES & LICENSES COMMITTEE Regular meeting of the Safety Services and Licenses Committee was held on Monday, November 10, 2008 in the Council Chambers, City Hall, Cranston, Rhode Island. I. CALL MEETING TO ORDER: The meeting was called to order at 7:05 P.M. by the Chair. Present: Also Present: Councilman John E. Lanni, Jr., Chair Councilman Terence Livingston Councilman Emilio L. MINUTES OF THE LAST MEETING: On motion by Councilman Barone, seconded by Councilman Livingston, it was voted to dispense with the reading of the minutes of the last meeting and they stand approved as recorded. Motion passed unanimously. III. CORRESPONDENCE: Letter from J&W University new d/b/a Harbor View IV. OLD BUSINESS: CLASS B VICTUALLING LICENSE RENEWALS (Cont d From 10/6/08) Park Theatre 848 Park Avenue No one appeared to speak. OLD BUSINESS: CLASS B VICTUALLING LICENSE RENEWALS (Contd) El Tapatio- cont d for applicant to apply for entertainment Richard Lope appeared to speak and stated that he has applied for this license. Discussion and vote on the application for Entertainment License held later on on the agenda under New License Applications. Basta cont d from October due to show cause Joanne Micheletti appeared to speak. Mr. Sylvia stated that the reason this is before this Committee is due to long standing non-compliance of grease traps needed to be installed and the owner has been notified for a number of years and to date, this still has not been done. Ms. Micheletti stated that she was just notified of this in May. If notification was made in the past, it must have been made to the previous owner. Mr. Sylvia stated that notices were sent to an Anthony Micheletti going back to Councilman Livingston asked what address the notices were sent to to Mr. Micheletti and the landlord. Mr. Sylvia stated that he believes they were sent to 2195 Broad St. He recommended that the Committee table this matter of the Alcoholic Beverage license for one month in order to give the owner time to implement these changes. Chair stated that the Committee needs to act on the renewal of the liquor license since it expires December 1. On motion by Councilman Barone, seconded by Councilman Navarro, it was voted to approve the renewal of the liquor license subject to proper grease traps being installed and applicant is to appear before this Committee in 30 days for an update. Motion passed unanimously. Emilia s Cuisine to submit plans for fire alarm 280 Atwood Avenue Michael Cerillo, owner of the property, appeared to speak. He turned in the liquor license, which was issued to Emilia s Cuisine, to the City Clerk. He stated that his tenant abandoned the restaurant and shut off the utilities. He stated that he has been working with Fire Prevention to comply with Fire Code violations, which should be completed by December 1, U/Rosalba/ Safety Services Minutes/Nov10,

3 IV. OLD BUSINESS: (Cont.) Emilia s Cuisine (Cont.) On motion by Councilman Livingston, seconded by Councilman Navarro, it was voted to continue this item. Under Discussion: Sydney Hall, Esq., appeared to represent the lien holder and stated that Mr. Cerillo has no ownership to turn in the liquor license. The lien is recorded in Land Evidence and the liquor license belongs to the lien holder. Mr. Garganese stated that what Attorney Hall is referring to is a UCC and the license is not advertised for transfer at this time. City Clerk stated that this matter is before this Committee for Fire Code violations. Emilia s Cuisine was operating with this liquor license. When she was made aware that Emilia s Cuisine was no longer in business, she contacted the property owner and asked that the liquor license be returned into the City. On motion by Councilman Barone, seconded by Councilman Navarro, it was voted to continue this hearing for Fire Code violations hearing next month. Motion passed unanimously. LaCascade Restaurant to submit plans Owner requested to appear Gansett Avenue Rayna Teixeira, owner of business, appeared to speak. Luigi Frabizi, owner of property, appeared to speak and stated that he would need a few months to correct the Fire Code violations. He has a contractor and an electrician ready to do the work. Chief Gumbley stated that the fire alarm system is not up to date and is not up to Code. He recommended that Fire detail be discontinued, since there has been no problem at this establishment since the last meeting. Rayna Teixeira stated she would be applying for a transfer to 280 Atwood Avenue. PUBLIC HEARING ORDINANCES: Ordinance in amendment of Chapter 12 of Title 12 of the Code of the City of Cranston, 2005, entitled Street and Sidewalk Use Regulations (Obstruction of Public Ways Prohibited). Councilman Lupino, sponsor of this Ordinance, appeared to speak in favor. Councilman Barone asked who would monitor this. Councilman Lupino stated that the Police Department, Public Works Director or their designee. Councilman Barone asked if there would be fines imposed, since the Ordinance does not state that. Councilman Lupino stated that he would hope so. Councilman Barone stated that the would like to see what the fines would be and would like the Ordinance to specify the types of signs. Councilman Livingston stated that he feels that this Ordinance needs some work. If this is just for snow removal, then the Ordinance should state that. As drafted, this Ordinance may hurt businesses such as the restaurants in the Edgewood area who place chairs out on the sidewalk. Council Presdient Garabedian stated that though the Ordinance is well intended felt it should be narrowed to be more specific. Councilman Navarrro stated that instead of continuing this Ordinance, he would like to see this Ordinance amended in order to save time and have it advertised and passed before the winter Ordinance in amendment of Chapter 12 of Title 12 of the Code of the City of Cranston, 2005, entitled Street and Sidewalk Use Regulations (Obstruction of Public Ways Prohibited). Mr. Sylvia appeared to speak and stated that the intent of this Ordinance is to remove obstructions in the right-of-way so they won t interfere with snow removal. Major Blackmar stated that as to the businesses that have chairs on the sidewalks, when they close, they take the chairs in. The problem is with basketball nets, which are on the edge of the sidewalks in the roadway and when trucks come to plow the roads, they can t without causing damage. Chair indicated that practically every mailbox in Western Cranston is on the sidewalk. This Ordinance would require everyone to remove the mailboxes. U/Rosalba/ Safety Services Minutes/Nov10,

Ordinance in amendment of Chapter 12 of Title 12 of the Code of the City of Cranston, 2005, entitled Streets and Sidewalk Use Regulations (Obstruction of Public Ways Prohibited). (Cont.) On motion by Councilman Livingston, seconded by Council President Garabedian, it was voted to amend this Ordinance as follows and re-advertise it for the full City Council meeting: First line, after the word placed, delete in thru the words hoop or in the second line and add on any City street any basketball hoop or anything else that would obstruct or interfere with snow removal operation nor allow. Under Discussion: Councilman Santamaria asked that the City Solicitor review this Ordinance and come up with a proper amendment and the Committee continue with the agenda in the meantime. Roll call was taken on above amendment and motion passed on a vote of 5-0 with 1 abstention. The following being recorded as voting aye : Councilmen Lanni, Livingston, Barone, Santamaria and Council President Garabedian -5. Councilman Navarro abstained. On motion by Councilman Santamaria, seconded by Councilman Barone, it was voted to continue this Ordinance for one month. Motion passed unanimously Ordinance in amendment of Chapter of Title 10 of the Code of the City of Cranston, 2005, entitled Motor Vehicles and Traffic (Macklin Street). On motion by Councilman Santamaria, seconded by Councilman Barone, it was voted to continue this Ordinance for one month. No one appeared to oppose. On motion by Councilman Santamaria, seconded by Councilman Barone, it was voted to approve this license transfer application. Motion passed unanimously. CLASS B VICTUALLING LTD. ALCOHOLIC BEV. LICENSE NEW Coda LLC 192 Gansett Avenue D/B/A Boston Sub Dave Harrison appeared to speak. Chair asked how close this establishment is to the Bain School. Mr. Harrison stated that he falls within the zone radius. Councilman Navarro stated that he will be voting against this request due to the proximity to Bain School and also because this is a sub shop and he does not see the need for a liquor license for a sub shop. Mr. Harrison stated that his business is a full restaurant with seating and a full menu. No one appeared to oppose. approve this license. Motion passed on a vote of 5-1. Councilman Navarro stated that by looking at the map, this business does not meet the radius requirement. A question was asked as from what point are the measured requirements from. City Solicitor stated that State Law states that it is from the closest point of the property. Chair asked that the City Clerk notify applicant, since this has been approved and applicant has left the meeting. On motion by Councilman Barone, seconded by Councilman Livingston, it was voted to reconsider the previous motion and bring this back next month to discuss. City Clerk was able to contact Mr. Harrison by cell phone and he returned back to the meeting. Chair indicated to Mr. Harrison that according to the radius map, 200 radius does touch the Bain School property. Mr. Harrison stated that Gary in the Zoning Department, measured the property and advised him that he was well over the 200 radius and Kim in the Clerk s Office advised him that he met all requirements. Solicitor Garganese quoted the State Statute regarding serving of alcohol near a school or church. Chair stated that due to the holiday tomorrow, he will check with Gary in the Zoning Department on Wednesday to obtain clarification regarding this. Mr. Harrison stated that he would ask that he be reimbursed for all his application fees and advertising fees he paid, if he was given the wrong information, since he was given an approved Zoning Certificate. Council President Garabedian and Councilman Barone asked that the Building Official who approved this Certificate be asked to appear before this Committee to address this issue. City Clerk stated that the radius requirement is per the Department of Business Regulations and at one time, the radius did include the street and perhaps Building Inspections is not aware of this change. continue this license application in order to obtain all the correct information. 12 * God Bless Corp. d/b/a Capital Liquors 811 Park Avenue Jatishkumar Patel Per Request of the Police Department Robert Jacquard, Esq., appeared to represent the applicant and stated that his client was accused of serving alcohol to a minor. This particular incident, his client does not believe the incident occurred. After viewing recording, his client believes was distracted and he appeared in Court and plead guilty and paid the fine. Major Blackmar asked that the officer who conducted the sting operation address the Committee to state what occurred. Russ Fleming of the Woonsocket Police Department, appeared to speak and stated that on September 26, 2008, he and Officer Petrella went to a number of establishments and conducted a sting operation. Attorney Jacquard stated that his client takes this matter very seriously and he has bee in business for five and a half years and has had no other incidents. Commander Lynch appeared to speak and stated that CCAP has allocated a grant to the Police Department for this sting operation. He presented two handouts of two Providence Journal articles of a Barrington teen killed due to alcohol purchased at a liquor store in Providence. He stated that we need to take this very seriously. This is not about taking business away from anyone. Courtney Odea appeared to represent the Cranston Substance Abuse Coordinator of CCAP. Councilman Barone motioned to suspend applicant s liquor license for five days. No one seconded this motion. Council President Garabedian motioned to suspend the liquor license for two days. No one seconded this motion. Councilman Livingston stated that he feels applicant has been fined enough in District Court. He stressed to the applicant that if this occurs again, he will most certainly have his liquor license suspended for a longer period with a hefty fine along with going before District Court. On motion by Councilman Livingston, seconded by Councilman Navarro, it was voted to accept the District Court s findings and if this happens again, the liquor license will be suspended for a longer period of time with a hefty fine. Motion passed on a vote of 4-2. The following being recorded as voting aye : Councilmen Lanni, Livingston, Navarro and Santamaria -4. 13 Major Blackmar stated that at the September meeting of this Committee, this applicant was before this Committee for selling tobacco to a minor. At that time, a sting operation occurred of selling tobacco to minors. At that time, this applicant stated to the Committee that he was going to come up with a plan of action so this would not occur again. Not a month later, we have a violation of selling alcohol to a minor. We really need to send a message that this is very serious. Mr. Gagnier stated that he was the one selling behind the counter. He did not card the person, it was a mistake. He thought he knew the person and this is why he did not card him. On motion by Council President Garabedian, seconded by Councilman Livingston, it was voted to suspend the liquor license for two days and fine applicant $250. Mr. Gagnier stated that due to the bad economy, he would rather agree to pay a higher fine instead of closing for two days. On motion by Council President Garabedian, seconded by Councilman Livingston, it was voted to suspend the liquor license for two days in January with a $250 fine. Motion passed unanimously. Under Discussion: Mr. Gagnier stated that he has paid $250 in District Court, similar to the previous establishment. On motion by Council President Garabedian, seconded by Councilman Livingston, it was voted to suspend the liquor license for two days in January with no fine. Under Discussion: Commander Lynch stated that he feels strongly that this Committee needs to send a clear message. This is not about promoting business or economic development, it is about protecting our residents. He does not agree to a two day suspension and a fine. Roll call was taken on motion to suspend the liquor license for two days with no fine and motion failed on a tie vote. The following being recorded as voting aye : Councilmen Livingston, Navarro and Council President Garabedian -3. The following being recorded as voting nay : Councilmen Lanni, Barone and Santamaria -3. Councilman Barone motioned to fine applicant $250 and suspend the liquor license for five days. No one seconded the motion. On motion by Councilman Santamaria, seconded by Council President Garabedian, it was voted to suspend the liquor license for two days in January and fine applicant $250. Motion passed on a vote of 5-1. The following being recorded as voting aye : Councilmen Lanni, Livingston, Navarro, Santamaria and Council President Garabedian -5. The following being recorded as voting nay : Councilman Barone -1. Chair asked that applicant notify the City Clerk of what two days in January he will be closed and she will notify the Police Department. IX. POLICE DEPARTMENT: No business.
