4 Proclamation September 2018 LIVE UNITED MONTH WHEREAS, United Way of Denton County empowers donors, volunteers, businesses, governments, nonprofits, and community groups to invest in neighbors for a better Denton County community; and WHEREAS, United Way of Denton County lives UNITED 4 Denton County to help children and families succeed, to guide and serve Veterans and their families, to advocate for overall mental health, and to make homelessness rare, brief and nonrecurring; and WHEREAS, United Way of Denton County helps 80,000 people each year across Denton County; and WHEREAS, United Way of Denton County seeks to increase efficiencies and eliminate redundancies to better meet people s needs through collaborative programs to solve complex socioeconomic problems; and WHEREAS, United Way of Denton County celebrates 65 years of improving lives across Denton County. NOW, THEREFORE, be it resolved that I, Shea Dane-Patterson, Mayor of the City of Pilot Point declare September 2018 LIVE UNITED Month and ask you to join United Way of Denton County board, donors, volunteers and partners in calling on all residents to LIVE UNITED. 5 City of Pilot Point, Texas Minutes of the July 30, 2018 City Council Meeting The City Council of the City of Pilot Point, Texas met on this date at 6:30 p.m. for a Special City Council meeting. City Council members present were Mayor Pro-Tem Jim Porter, Whitney Delcourt, Dean Cordell, and Ronald Petty. City Staff members present were City Manager Alan Guard, EDC Executive Director Denise Morris, and City Secretary Alice Holloway. AGENDA A. ROLL CALL/CALL TO ORDER Mayor Pro-Tem Porter announced a quorum at 6:44 pm and called the meeting to order. B. Discuss and consider authorizing the City Manager to negotiate and execute on behalf of the City of Pilot Point, Texas, contracts for the sale of real property located at 115 East Liberty, Pilot Point, Texas, to the Pilot Point Economic Development Foundation. Councilmember Cordell moved to authorize the City Manager to negotiate and execute on behalf of the City of Pilot Point, Texas, contracts for the sale of real property located at 115 East Liberty, Pilot Point, Texas, to the Pilot Point Economic Development Foundation. Councilmember Petty seconded the motion. The motion passed unanimously. C. Discuss, consider, and possible action on the approval of an ordinance authorizing the sale of 0.21+/-acres of real property legally described as Tract 2, Block 13, in the Texas Pacific Railroad Addition, and commonly known as 459 W. Copenhavr Street, Pilot Point, Texas, Denton County, Texas; and authorizing the Mayor to execute any and all documents. Councilmember Cordell moved to approve ordinance authorizing the sale of 0.21+/-acres of real property legally described as Tract 2, Block 13, in the Texas Pacific Railroad Addition, and commonly known as 459 W. Councilmember Petty seconded the motion. The motion passed unanimously. D. 6 City of Pilot Point, Texas Minutes of the July 23, 2018 City Council Meeting The City Council of the City of Pilot Point, Texas met on this date at 6:30 p.m. for a Regular City Council meeting. City Council members present were Mayor Shea Dane-Patterson, Jim Porter, Whitney Delcourt, Andy Singleton, Dean Cordell, Ronald Petty, and Casie CJ Hilliard. City Staff members present were City Manager Alan Guard, Police Chief Tim Conner, Development Services Director Kelly Carpenter, Public Works Director Jim Proce, Finance Supervisor Lana Ensminger, Asst. Public Forum: (Citizens are allowed 3 minutes to speak. If the issue is on the agenda, the City Council may choose to discuss and consider the item. If the issue is not on the agenda, the Council is not permitted by state law to respond to or discuss the item other than to make statements of specific factual information in response to a citizen s inquiry or to recite existing policy in response to the inquiry. The Council may request the issue to be placed on a future agenda for action in accordance with state law. This forum is not the appropriate place to address complaints against Public Officials and/or Staff. Complaints of this nature should be made in writing and filed with the City Manager.) GFOA Distinguished Budget Presentation Award Janina Jewell, Director of Finance, City of Euless City Manager Alan Guard asked that the award not be presented since Janina Jewell was not present. The presentation will be presented at a later date. F. CONSENT AGENDA 1. Discuss, consider, and possible action on approval of the City Council minutes of July 9, Discuss, consider, and possible action on the 3 rd Qtr. FY 2018 Investment Report. 3. Discuss, consider, and possible action on easement agreements with the following property owners: Tyrga Realty LLC, Bert Fields Jr, Freeman Developers Inc., Pilot Point Independent School District, Peter C. Kern Family Holdings LLC, Clarence R. Chandler and David A. Dejernett, USA Corp of Engineers, Pilot Point Livestock Auction Ltd, 375 Oak Ridge LLC, Craig Liggett and Lisa Liggett, for the purpose of installing public utility lines and infrastructure, and authorize the Mayor to execute the same. 4. Discuss, consider, and possible action on a resolution designating the Mayor as the authorized official to apply for, accept, reject, alter, or terminate the NIBRS grant on behalf of the City. Councilmember Porter requested that item F3 be pulled from the Consent Agenda so it can be discussed. Councilmember Porter moved to approve the Consent Agenda (item F3 excluded). Councilmember Hilliard seconded the motion. The motion passed unanimously. 1

7 Item F3-This item was discussed after item G3. Councilmember Porter asked City Manager Guard to explain to everyone why the proposed easements are needed. City Manager Guard stated that the easements are necessary for installation of sewer lines in several areas, including Yarbrough Farm. Councilmember Cordell moved to approve easement agreements with the following property owners: Tyrga Realty LLC, Bert Fields Jr, Freeman Developers Inc., Pilot Point Independent School District, Peter C. The City Council interviewed the following applicants: Curtis Wilson Gary Speer Ronald Petty Each applicant was asked to sit in the conference room until it was their time. Each applicant was interviewed in open session one at a time. Each applicant was asked the similar questions. 2. Discuss, consider, and possible action on a resolution making an appointment to fill the remaining term of City Council Place Four. Councilmember Porter moved to approve a resolution appointing Ronald Petty to fill the remaining term of City Council Place Four. Councilmember Hilliard seconded the motion. The motion passed unanimously. 3. City Secretary to administer the Oath of Office to the newly appointed councilmember of Place Four. City Secretary Alice Holloway administered the Oath of Office to Councilmember Ronald Petty. Councilmember Petty took his seat on the dais immediately. 4. Second public hearing on the proposed annexation of certain property by the City of Pilot Point, Texas: being Denton CAD Property ID Numbers 41421, approximately acres generally located on the northwest corner of Massey Road and Aubrey Street, approximately 1,400 feet west of South Morrison Street, also described as Tract 38, S. Flint Survey, Abstract Number 418. Mayor Dane-Patterson opened the second public hearing on the proposed annexation of certain property by the City of Pilot Point, Texas: being Denton CAD Property ID Numbers 41421, approximately acres generally located on the northwest corner of Massey Road and Aubrey Street, approximately 1,400 feet west of South Morrison Street, also described as Tract 38, S. Flint Survey, Abstract Number 418 at 7:57 p.m. No public comments made. Mayor Dane-Patterson closed the public hearing at 7:58 p.m. 5. Discuss, consider, and possible action on an ordinance of the City Council of the City of Pilot Point, Texas, annexing the hereinafter described territory known as being Denton CAD Property ID Number 41421, approximately acres in the S. Flint Survey, Abstract Number 418, generally located on the northwest corner of Massey Road and Aubrey Street, approximately 1,400 feet west of South Morrison Street, into the City of Pilot Point, Denton County, Texas, and extending the boundary limits of said City so as to include the described property within the city limits, and granting to all the inhabitants of the property all the rights and privileges of other citizens and binding the inhabitants by all of the ordinances, resolutions, acts, and regulations of the city; adopting a service plan; finding and determining that all requirements for annexation including public hearings, notices and open meetings have been met according to law; providing instructions for filing this ordinance and for correcting the official map and boundaries of said city; providing severability and cumulative clauses; and providing an effective date. Mayor Dane-Patterson opened the public hearing on an ordinance of the City of Pilot Point, Texas, amending Chapter 14, Zoning of the Code of Ordinances to change the zoning classification of plus or minus acre parcel(s), located on the northwest corner of Massey Road and Aubrey Street, approximately 1,200 feet west of South Morrison Street, Pilot Point, Texas from A, Agriculture and SF-2, Single Family Residential to PD, Planned Development at 8:01 p.m. Development Services Director Carpenter stated that the proposal is to rezone acres from Agriculture/SF-2, Single Family Residential to Planned Development. The maximum number of single family lots permitted in the development will be 35 lots, which must be a minimum size of one acre. In addition, a minimum of 10 ft. wide trail that stretches from the State Park to the main entry at the northwest corner of Massey Road and Aubrey Street. The trail will be used for Equestrian/pedestrian access to the US Army Corps of Engineers property. Mr. Ocie Vest, Vice President of Stratford Land Corporation was present. Mr. Vest stated that the trail will be open to the public. This development leans more to the rural lifestyle and encourages participation in equestrian activities in related to the Corp of Engineers property. Mayor Dane-Patterson closed the public hearing at 8:22 p.m. 7. Discuss, consider and possible action on an ordinance of the City of Pilot Point, Texas, amending Chapter 14, Zoning of the Code of Ordinances to change the zoning classification of plus or minus acre parcel(s), located on the northwest corner of Massey Road and Aubrey Street, approximately 1,200 feet west of South Morrison Street, Pilot Point, Texas from A, Agriculture and SF-2, Single Family Residential to PD, Planned Development, amending the original zoning map to reflect such changes, providing a savings clause, providing a severability clause, providing a penalty clause, providing for engrossment and enrollment, and providing an effective date. City Secretary Alice Holloway stated that a correction is needed for Exhibit C-Planned Development Standards: City Administrator needs to be changed to City Manager. Councilmember Hilliard moved to approve an ordinance of the City of Pilot Point, Texas, amending Chapter 14, Zoning of the Code of Ordinances to change the zoning classification of plus or minus acre parcel(s), located on the northwest corner of Massey Road and Aubrey Street, approximately 1,200 feet west of South Morrison Street, Pilot Point, Texas from A, Agriculture and SF-2, Single Family Residential to PD, Planned Development, amending the original zoning map to reflect such changes, providing a savings clause, providing a severability clause, providing a penalty clause, providing for engrossment and enrollment, and providing an effective date with correction. Councilmember Cordell seconded the motion. The motion passed unanimously. 8. Discuss, consider, and possible action on an amendment to Chapter 14 Zoning of the Code of Ordinances of the City of Pilot Point relating to allowed uses set forth in the Schedule of Land Uses to remove the land use meat processing plant as an allowed use in C-1 and C-2 with a special use permit. Development Services Director Carpenter stated that the Planning & Zoning Commission recommended approval of the request. In addition, she stated that conditions have changed such that a meat processing plant, an industrial use, next door to the historical museum and with a block of retail 3

9 shops and eateries on the square is no longer acceptable. There is no room to store or load animals on the square. Mayor Dane-Patterson stated that she wants to preserve the history and heritage of the City. She stated that the meat processing plant has been operating for many years. Joe David started the meat market in the late 30 s and early 40 s and then B.C. Cheatham in the 50 s who named it the Golden Triangle Meat Market. Ralph Boerner owned the business for 18 years and Kevin Pelzel operated the business for 25 years after that. The last person to operate the business took over in Mr. Kevin Pelzel, current owner of the building stated that he currently works as a state inspector for slaughter houses. Mr. Pelzel stated that several other cities have meat processing plants in their downtown area. Texas Department of State Health Services Inspector Gary Balthrop, stated that he got involved when he received a complaint of bad odor. He stated that he worked with code enforcement and the exowner to review the inside of the building. Mr. Balthrop stated that the whole plant would need to be gutted and rebuilt. If this is done, he can and will come back and re-inspect. Councilmember Cordell moved to not approve the proposed amendment to Chapter 14 Zoning of the Code of Ordinances of the City of Pilot Point relating to the meat processing plant. Councilmember Petty seconded the motion. The motion passed unanimously. 9. Discuss, consider, and possible action of award of bids for Burks Street Sewer Improvements to Vessells Construction in the amount of $415, with approval of the Mayor to execute all Contract Documents including Notice to Proceed. Councilmember Porter moved to accept the bid and award the contract for the Burks Street Sewer Improvements to Vessells Construction in the amount of $415, with a penalty clause with approval of the Mayor to execute all Contract Documents including Notice to Proceed. Councilmember Delcourt seconded the motion. The motion carried unanimously. 10. Discussion of the Historic Downtown Design and review of the RUDAT. Mayor Dane-Patterson stated that she asked for this item to be placed on the agenda so that the new councilmembers would have a copy of the RUDAT plan and to give everyone some history on this project. Committees were started in The City hired an engineering firm named HNTB that came up with some proposals. There was a public workshop and an overview annalist was done in November In February and December of 2006 there were three different committees: Main Street Design Committee, Downtown Planning Committee and Main Street Advisory Committee. They looked at and approved a design plan in After the plan was approved, it was sent to the Community Heritage Development Division of the Main Street Program to come up with the final plan. 11. Discuss, consider and possible action on a resolution of the City Council of the City of Pilot Point, Texas, for the use of eminent domain to condemn an approximately acre tract constituting a portion of that real property located in Denton County, Texas situated in the Charles Smith Survey Abstract 139, the Henry Tierwester Survey Abstract 1242, the Peter Gass Survey Abstract 496, and the A.K. Wiley Survey Abstract 1321, Denton County, Texas, being a part of the Mrs. M. Montgomery Estate, with Denton Central Appraisal District ID # A1242A , generally located west of Pecan Creek and north of FM 455 for a wastewater treatment facility project. Councilmember Delcourt moved that the City of Pilot Point adopt a resolution to authorize the use of the power of eminent domain to acquire an approximately acre tract constituting a portion of that real property located in Denton County, Texas, situated in the Charles Smith Survey Abstract 139, the Henry Tierwester Survey Abstract 1242, the Peter Gass Survey Abstract 496, and the A.K. Wiley Survey Abstract 1321, Denton County, Texas, being a part of the Mrs. M. Montgomery Estate, with Denton Central Appraisal District ID # A1242A , and situated in Denton County, being a part of the Henry Tierwester Survey Abstract No and being a part of the acre tract conveyed to Sharon Ann Shelby by Michael Hall Shelby and ARS Ranch Holdings, Ltd. By Partition Deed dated March 20, 2007 and recorded in instrument No of Denton County Deed Records, and generally located west on Pecan Creek and north of FM 455, for the construction, establishment, maintenance, and operation of the wastewater treatment facility project. Councilmember Cordell seconded the motion. The motion passed. Councilmember Hilliard voted against. H. In accordance with the Texas Government code, Section , to discuss or deliberate regarding commercial or financial information that the governmental body has received from a business prospect that the governmental body seeks to have locate, stay, or expand in or near the territory of the governmental body and with which the governmental body is conducting economic development negotiations. 4. In accordance with Texas Government Code, Section : to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee. a. 12 CITY OF PILOT POINT RESOLUTION A RESOLUTION APPROVING THE DRAFT DENCO AREA DISTRICT FISCAL YEAR 2019 FINANCIAL PLAN, PURSUANT TO THE TEXAS HEALTH AND SAFETY CODE, CHAPTER 772, AS AMENDED; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Council of the City of Pilot Point has been presented the DRAFT Denco Area District Fiscal Year 2019 Financial Plan for consideration, in accordance with section Texas Health and Safety Code as, amended; NOW THEREFORE THE COUNCIL OF THE CITY OF PILOT POINT, TEXAS HEREBY RESOLVES: Section 1 That the City of Pilot Point hereby approves the financial plan. Section 2 That this resolution shall become effective immediately from and after its passage. 71 City Council Agenda August 13, 2018 Agenda Item: G2 Resolution (Action Item) Agenda Description: Discuss, consider, and possible action on a resolution establishing a date to adopt the 2019 Fiscal Budget; establishing the location and date for the public hearing of the 2019 Fiscal Budget; requiring publication of a notice of the public hearing in accordance with the law; and providing an effective date. Background Information: To begin the formal process of adopting the 2018/2019 Budget, the City Council needs to approve a resolution establishing the location and date for the public hearing. 72 CITY OF PILOT POINT RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PILOT POINT, TEXAS, ESTABLISHING A DATE TO ADOPT THE 2019 FISCAL BUDGET; ESTABLISHING THE LOCATION AND DATE FOR THE PUBLIC HEARING ON THE FISCAL BUDGET; REQUIRING PUBLICATION OF A NOTICE OF THE PUBLIC HEARING IN ACCORDANCE WITH THE LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council desires to adopt the Fiscal Year 2019 Fiscal Budget of the City of Pilot Point, Texas (Budget) beginning October 1, 2018 and ending September 30, 2019; and WHEREAS, in order to adopt the Budget, the City Council must first hold a public hearing on the Budget and provide notice of same in accordance with Section 7.05 of the City Charter and other applicable laws; NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PILOT POINT, TEXAS: SECTION 1. The City Council hereby approves the placement of an item on the September 24, 2018, City Council public meeting agenda to vote to adopt the proposed Fiscal Budget of the City of Pilot Point, Texas. SECTION 2. The City Council hereby calls a public hearing on the proposed 2019 Fiscal Budget of the City of Pilot Point, Texas to be held in the City Council Chambers at City Hall located at 102 E. Background Information: In order to determine future capital projects Council established the Capital Projects Advisory Committee (CPAC) which began meeting in the fall of This committee met throughout the fall to hear about the various capital needs of Pilot Point. Topics included streets, public buildings, parks, drainage, sidewalks and downtown redevelopment, as well as potential means of funding and the impact on taxpayers. This committee developed a series of bond propositions for Council consideration in January Council determined that additional public input was needed. In April, Council held a town hall meeting where all the propositions were discussed. The community provided feedback through a multi-voting exercise. Public buildings, a drainage master plan, streets and downtown redevelopment received the most support. Following the Town Hall meeting, City Council held two additional discussions for public input at the June 25 and July 9 City Council meetings. Council must call an election at this meeting for a November 6 bond election from among the following propositions: Proposition #1 $4,500,000 for Public Buildings to include a new fire station, new police station and building renovations for Public Works and Development Services. Proposition #2 $4,000,000 for street reconstruction and rehabilitation. Proposition #3 $1,000,000 for downtown redevelopment Proposition #3 $500,000 for the preparation of a drainage master plan. 87 City Council Agenda August 13, 2018 Agenda Item: G5 SRO Agreement Action Item Agenda Description: Discuss, consider, and possible action on an agreement and authorize the Mayor to sign with the Pilot Point Independent School District for a School Resource Officer as part of the Annual Budget. Background Information: With the need for the safety of our school age children and youth in mind, the Pilot Point Independent School District is considering funding a School Resource Officer. The new school Superintendent Dr. Byron Terrier has been in discussion with the Chief of Police on this option, and has asked that the City consider an interlocal agreement with the school to help fund the position. The SRO would be under the direction of the City Police Department for hiring and direct administration. The officer would work at the school during the school year and then work for the city during the summer months. The SRO would not only help provide a police presence on school campuses, but the officer would also help the Police Department with the scheduling of vacation time during the summer months. Both the PPISD and the City could benefit from the agreement for an SRO officer. The City would have the SRO use an available police vehicle for police work so an additional vehicle and related equipment would not be necessary. Since the officer will spend most of the time on school campuses, there will be little wear and tear on the vehicles. Having both a police officer and a police car presence on school campuses can help with school safety. Financial Information: PPISD will compensate the City by October 15 th of each year in the amount of $55, approximately 75% of the estimated cost of the officer.
