Announcements (Boddy) The agenda contains the following correspondence from President Day: (4/8/94) re Senate actions of March 22-24, 1994; (3/21/94) to Gordon Thompson re AR&P response to March 4 Cabinet Budget Committee recommendations; (3/25/94) to Rolf Schulze, President, CFA, thanking CFA for their statement regarding the Hayden report; (4/1/94) to Chancellor Munitz, re the Hayden report, Ghosts in the Classroom; and (3/24/94) to Lou Rea re Faculty Honors and Awards recommendations for Alumni Awards for Outstanding Faculty Contributions to the University. Other correspondence attached to the agenda includes: (3/30/94) a letter from the SDSU Alumni Association Executive Committee expressing concern about the vote on the referendum; (4/7/94) my response to the president of the SDSU Alumni Association Executive Committee; and

3 (3/25/94) a letter from Mary Jane Whitelaw, Director of Data Management, The Carnegie Foundation for the Advancement of Teaching, announcing the change in classification of SDSU to Doctoral University II. * The handouts on the table include excerpts of Principles and Policies of the Academic Senate CSU related to the definition, roles, and responsibilities of academic senates and the interpretation of the Academic Senate and implications of HEERA to the functions of senates. I urge colleagues to read these materials carefully, as they relate to joint decision-making aspects of the University. The complete HEERA document and Title 5 of the California Code of Regulations are in the Senate office (information attached). The Alumni Awards Gala will be on Saturday, May 7, at the Sheraton Grande Torrey Pines in La Jolla. Proceeds will go to provide scholarships and help our students. Committee chairs are reminded that annual reports need to be forwarded to the Senate office. They will be attached to the Senate minutes of the May meeting. There will be a special meeting of the Senate Executive Committee on Thursday at 2:45 in this room. It will be a one-item agenda, and will be in Executive Session to consider material from the Campus Development Committee. DuFault: Senator Stites is in the hospital after a second angioplastic procedure. He is in good spirits and would welcome hearing from his friends. 4. University Administration (Hopkins) Outstanding teacher award. This morning's newspaper identified Sandra Macbrayer, one of our former students, as the nation's outstanding teacher. It is interesting that the nation's outstanding teacher about four years ago was also an alumna of San Diego State University. Administrator recruitment. Interviews for Dean of Health and Human Services have been completed, and the committee has given me its recommendations. They are under study, and will be completed very soon. Interviews for Vice President for Business Affairs are in progress. RTP. I have completed my part of the process regarding RTP reviews, and am again astounded at the accomplishments of our faculty. Classification change. SDSU has been reclassified by the Carnegie Foundation as a Doctoral University II, a significant accomplishment of which we can be proud. Industrial Technology. In the agenda you will find President Day's response to the actions of the Senate at its last meeting. His view is that the issues of the program and personnel need to be divided, and I agree. I believe it is possible to reach a mutually satisfactory agreement, but we must separate the issues.

4 5. Academic Senate -- No report. 6. Associated Students (T. Tatum) Last year the Senate passed a resolution strongly recommending that the IRA monies be redistributed, with only 10 percent to go to athletics, and the rest to go to academically related activities. The four students on the IRA committee comprise only half of the IRA Committee. This year, after making several proposals that were not accepted by the IRA Committee, the students developed a proposal that would limit the athletics funding to 70 percent of the IRA fees, with the rest to go to activities more instructionally related. I regret to inform the Senate that your representative essentially blocked this modest proposal. At least on this issue, the A.S. and the Senate seemed to be in full agreement. Perhaps we should work harder to make our representatives accurately reflect the positions of their constituencies. Boddy: There are issues that come before this body, but representatives on committees have the right and obligation to judge the evidence presented to them and vote accordingly. If the A.S. would like further clarification, or to bring up other issues, the Senate Executive Committee would welcome such a discussion. Barnett: Part of what was approved by the IRA Committee was that there be a reduction of 2 percent per annum, on a base of 77 percent, with the goal of reducing athletics funding to 67 percent over five years. 7. California Faculty Association (Schulze) The CFA Assembly met this past week in Los Angeles. Interest-based bargaining will start on May 3. The CFA endorsed Kathleen Brown for governor, and the Katz bill on domestic partners. We will have our usual party at the end of the year. 8. Committee Reports a. Senate Executive Committee (1) Resolution in Support of Equitable Treatment for Domestic Partners MS H. Anderson for Committee: Approve the resolution in support of equitable treatment for domestic partners, per agenda attachments 8a(1), with the editorial correction read by Senator DuFault. P. Andersen: I would prefer a more sweeping resolution that would solve the problem for single people or for people with aging parents. DuFault: The pertinent bills now before the state legislature would define domestic partnerships, and also set up the machinery for legitimizing them. Hopkins: I want to alert you that the president is likely to disagree with this resolution on the grounds that it is a public policy issue, and the Senate ought to complete its work before getting into the fray.

5 MS: DuFault, Harris: Amend the fourth whereas to read "Faculty, staff, and administrator benefits in The California State University have not recognized the domestic partnership of faculty, staff, and administrators." DuFault: I don't think the Senate should always act on the basis of what we think the president will approve. Last week the PERS Board approved a resolution to grant benefits to domestic partners. That action signals that if the proposed legislation passes the legislature, it will not be objected to by PERS. We ought not put this issue in the same arena as the non-smoking policy, which was passed by the Senate many times before the president approved a policy. Rosenstein: I would like to thank the vice president for informing us of the president's position. MSP Kornfeld, Rosenstein: Close debate on this and all matters before the house. Passed. MSP Amendment passed. MSP * Motion passed as amended (attached). (2) Statement on Diversity MS H. Anderson for Committee: Approve the statement on diversity, per agenda attachment 8a(2). Verity: How does this statement differ from what we are doing that is required by state law? Boddy: There is no statement on diversity in state law. There are laws regarding affirmative action, but this is not a legal statement. It is an affirmation of principles that will guide us at this university. MS Rosenstein, Schulze: Move to amend by deleting the last statement in paragraph six, and substituting the following: "While freedom of speech will be protected, the campus community has the obligation to speak out against acts of intolerance and abusive behaviors." Rosenstein: It is often difficult to draw a clear separation between an act or behavior on the one hand, and speech on the other. The term "unchallenged" in the present document is exceedingly vague. In order that this policy not have a chilling effect upon academic freedom and free speech, it is necessary to be clear as to the nature of campus response, so as to protect individuals from punitive actions by the administration for the simple expression of unpopular opinions. MSP Amendment passed. MS P. Andersen, Kornfeld: Amend the first paragraph to read "San Diego State University is a community of men and women people who are diverse racially, ethnically, linguistically, culturally, in class background, national origin, religious and political belief, age, physical ability, gender, and sexual orientation.

6 Andersen: Further along in the document, we mention that we want to heal the wounds of separation. I would like us to be united in gender as one of those ways in which we are diverse. Kornfeld: It does seem to me that stating "men and women" poses an "essentialist" view that we would like to avoid. For many readers it implies that men and women are necessarily different. The proposed language provides a way to recognize that society constructs different roles for the two sexes. Emerich for Nowak: I would like to provide the committee's rationale. I don't think the committee meant gender as related to social orientation. The university has been recognized historically as a male-dominated community. This language was chosen to identify those who may have felt discriminated against in the past by including them specifically. Cobble: I thought men and women sounded like a good phrase. Coffey: When I first read this, the phrase "men and women" jumped right out at me, and I thought, why not just say "women and men?" Kornfeld: I agree with Senator Coffey. Vice President Emerich's explanation was clear, but I disagree with his formulation. To use the term "gender" opens up the social issue. Whitney: To describe us as a community of men and women unites the community rather than dividing it. We want to use ordinary language in a meaningful way to communicate that diversity exists on this campus. Edson: I too support the language as originally proposed. The word "gender" refers to socially constructed entities. When you use the word "sex," you are referring to what a person is at birth. The phrase "men and women" makes women, the group that is historically less powerful, feel included because they are named. I don't know if that is true for men. MSF Genovese, Lamke: Close debate on this and all matters before the house. Failed. Strom: I support the opening statement with the reordering of "women and men," and adding the word "gender" before "and sexual orientation." DuFault: Yielded to Maria Nieto Senour: Everything at SDSU needs to be done with these concerns in place. We need to make this place hospitable to all staff, faculty, and students. As our population continues to change, we need to make it a community. H. Feldbaum: I would like to suggest a "friendly" amendment, to use the phrase "men and women", but leave in the word "gender." There was objection, and the amendment was not accepted as friendly. MSF Andersen amendment failed. MS Coffey, DuFault: Amend to read "women and men" and add the word "gender." P. Andersen: To do that makes this a sexist statement; phrases of that type should be alphabetical. Kornfeld: The purpose of the first amendment will be somewhat mitigated by this one. I think that this language asks us to think about the usual order of things on the campus, and for that reason is an improvement. Edson: I agree with Senator Andersen. For the purposes of what we are doing, "women and men" calls attention in a way that is not normal and usual, whereas the committee's proposal was neutral. Tatum:

7 Changing the order to "women and men" is appropriate. Genovese: I really don't care about the order of the words, but adding the word "gender" is unnecessarily redundant. This is a wonderful statement, and we ought not dilute it with such redundancy and silliness. Cobble: I agree. Why not go with what the committee wants. MSP DuFault, Kornfeld: Close debate on the amendment. Passed. MSF Coffey amendment failed. Plotkin: I am comfortable with this as a statement of values, but I am very uncomfortable with the broad policy implications of the last sentence of the document. MSP Cobble, DuFault. Close debate. Passed. MSP * Committee motion, as amended, passed (attached). (3) Information The Senate Executive Committee is euphoric about the Carnegie Foundation reclassification of San Diego Sate University to a "Doctoral University II" status. b. Academic Policy and Planning (Boddy for Hanscom) AP&P Chair Hanscom had to leave the meeting early, so his statement was read by the Senate chair: "AP&P believes that we must separate and proceed with the issues of curricular processes separately from those issues surrounding personnel in programs - but that we must proceed simultaneously." c. Academic Resources and Planning (Thompson) DuFault: Do you have any idea what might happen with the May revise? Thompson: I have no new information. Hopkins: The presidents are meeting in their Executive Council today and tomorrow, so there may be more speculation. Verity: Where is CARP in terms of prospective cuts? We agreed that the restructuring report was a fatally flawed document, but we have sent no other list of priorities to the president. The budget will come out, and we have nothing to advise the president about what we faculty identify as most important. Why hasn't anything come forward from this body? Thompson: CARP has not addressed that question nor has it been asked to bring a document of that nature to this body. It has addressed current budget revises and prospective budgets for DuFault: The questions are being addressed in various ways. The Personnel Committee is discussing a policy about personnel issues that occur when programs are dissolved. The Senate has just spoken about the diversity question that so concerned the president when the restructuring report was rescinded. So we are responding, albeit slowly. Regarding the budget, it's likely that part of this year's state debt will be rolled over to next year. The governor is still playing the game of depending

8 on the money from the federal government. So our budget problem will come in January, not in July. Hopkins: The president has asked for our recommendations about the budget without reference to student fees. So far, that is what we are thinking about. It isn't quite true that we are totally unprepared, but it is true that we don't have a set of principles that can be used as an algorithm for future budgets. Boddy: I would briefly like to address the question of leadership. The question is serious. Our direction has been to try to get a grip on very key principles we share in the university, using the Expanded Senate Executive Committee to address questions of visions and values, technology, and student initiatives. When and if we face budget problems, certain principles are needed to guide the deliberations of the bodies, whether the CBC or SEC. The alternative of doing something different at this time would be to plan for a 20 percent cut, and that might let people think we are ready to absorb something totally inappropriate. Zyskind: A letter from the president is in the agenda responding to recommendations of AR&P, but I do not see the materials to which he refers. Thompson: The materials were in the previous Senate agenda. We do everything possible to ensure that information from the committee goes to the president and to the Senate office at the same time. d. Curriculum (Papin) The University Curriculum Committee's Seventh Information Report, General Catalog, is attached to the agenda (page 13). It is a resubmission of a new course (Sociology 352) and a change in program (Sociology Major) which was withdrawn from last month's Senate agenda. e. Constitution and Bylaws -- No report. f. Committee on Committees and Elections (Edson and Lamke) (1) Committee Appointments (Edson) Action Items MSP Edson for Committee: Approve the following appointments to committees, with terms to end as noted, per agenda attachment 8f(1): Passed as follows: Graduate Council: K. (2) Instructional Development and Media Services Committee Membership MS Edson for Committee: Approve the inclusion of the Chair of the Language Acquisition Resource Center (LARC) Advisory Committee as an ex officio member of the Instructional Development and Media Services Committee.

10 Edson: Language instruction represents a significant component of SDSU curriculum. The Language Acquisition Resource Center, one of only four such centers nationwide, coordinates most of our language instruction. The LARC Advisory Board advises on application of technology for language instruction. Carmichael: Who is the chair of the LARC Advisory Committee, and how is that person chosen? Donahue: Dr. Gail Robinson was hired with a split appointment; she teaches in the Department of Linguistics and directs the Language Acquisition Resource Center. Verity: Have you met with the other units to see if they have similar technological needs and concerns? Edson: No. H. Anderson: In addition to Arts and Letters, other colleges need to be consulted. DuFault: LARC serves students across the university, not just Arts and Letters. H. Anderson: That can be said of many programs. MS Kornfeld, P. Andersen: Refer back to committee. Donahue: As the position is ex officio, there is no reason not to have others from across campus as ex officio members. Whitney: I oppose referral. This person could give valuable help to the IDMS committee, which is now trying to deal with some difficult issues. MSP Kornfeld, Nuñez: Close debate on this and all questions before the house. Contemporary Social Problems (3) Prerequisites: Sociology 101 and completion of the General Education requirements in Foundations IIB, Social and Behavioral Sciences required for nonmajors. Contemporary social problems in North America and other areas of the world. i. Undergraduate Council Amendment to Policy File IV-E, University Advising Center MS Scott for Committee: Approve the amendment to Policy File IV-E, University Advising Center, per agenda attachment 8i. Scott: Policy File IV-E refers to the University Advising Center. Much of the language is unchanged since 1976, when the University Advising Center was established. The new statement updates the policy and address the matter of advising more inclusively. The committee proposal has been developed in cooperation with several other committees, including Student Affairs. The Undergraduate Division is committed to a strong academic advising system. We provide faculty guidance and opinion to Student Affairs and Admissions and Records procedures. Throughout the university, we are examining the assessment of advising. The Referral Guide to Campus Resources was produced by the Undergraduate Division office with support from the Student Affairs Committee. MSP * Committee motion passed unanimously (attached). j.
