Dated: lstrapril 2016 Subordinate Statistical The undersigned is directed to refer to this Ministry OM of even number dated 15e January 2OL6 vide which draft seniority list of Senior Statistical Officers was issued and circulated amongst the concerned officers of SSS for objections and comments. All the objections received up to O4.O4.2OL6 from the concerned officers have been examined. List of officers, who have raised objections, may kindly be seen at Annex- A. The main objections received are as under: (il All Junior Statistical Officers (JSOs) were considered for regular promotion as Senior Statistical Officer (SSO) on the same date of DPC held on and the JSOs belonging to SC / ST categories were not promoted before JSOs belonging to General / OBC category. Therefore, SC and ST officers are not eligible for seniority over and above tjle officers of General and OBC category. (iil As per DOPT OM dated Sth February 2OO2, the DPC is to grade an officer as 'Fit' or unfit' and the feeder grade seniority of the officers assessed as "Fit" should be maintained in the promoted grade of SSOs. (iifl In ad-hoc promotion order dated , , 28.O4.2OL0 and , it is clearly stated that ad-hoc service will not be counted for the purpose of seniority in that grade (i.e. SSOs). Therefore, SC and ST category officers could not be extended benelit of ad-hoc promotion and seniority over and above the officers of General and OBC category. tiv) In MoSPI order dated L6.O4.2OL5, it is clearly stated that ad-hoc promotion of SSOs of SSS made till date would be treated as cancelled with immediate effect. Therefore, SC and ST Officers could not be extended seniority over and above the officers of General and OBC category oflicers. {vl As per the term of 'availability'as clarified in DOPT OM No. 2OOIL / OL / Estt. (D) dated it is stated that "fixation of seniority shall be the actual year of appointment after declaration of results/selection and completion of preappointment formalities as prescribed. It is further pointed out that when appointments against unfilled vacancies are made in subsequent year or years either by direct recruitment or promotion, the persons so appointed shall not get seniority of any earlier year lvrz. year of vacancy/panel or year in which recruitment process is initiated) but get the seniority of the year in which they are appointed on substantive basis. The year of availability will be the vacancy year in which a candidate of the particular batch of selected direct recruits or an officer of the particular batch of promotees joins the post/ service". 2 -2- (viif Seniority has not been fixed by taking into account "Catch-up-Rule' and the Honble Supreme Court of India judgement in Civil Appeal No. 663L-6632 of 2015 dated 27.O8.2OL The above objections have been examined and it is clarified that the general principle of seniority envisages that the candidates appointed through an earlier selection stand senior to those appointed through a subsequent selection. However, inter-se-seniority of the officers are required to be drawn amongst those officers, who were recofirmended by DPC for regular promotion as SSOs against the year-wise vacancies. In such a situation (i.e. different panels on the same date), the seniority of Senior Statistical Officers (SSOs) had to be prepared taking into account the facts of chronologr of recommendations of DPC. 03. Further, it is clarified that where regular DPC could not be convened for a number of years, due to reasons beyond administrative control, even though regular vacancies were available in relevant years, in such a situation year-wise panels are required to be prepared and officers in the feeder grade had to be considered and recommended for regular promotion to higher posts by the DPC taking into account year-wise SC and ST vacancies in the relevant rosters. In view of this, reserved candidates have been placed over and above to those OBC / General Candidates in draft seniority list of Senior Statistical Officers (SSOs) in the light of DOPT OM No. 2OOLL / Ol / 2OOt - Estt. (D) Dated 21st January 2OO2 and as per relevant calendar year-wise panel as recommended by DPC, who have been granted promotion in subsequent years of vacancies. Further, as per para of DOPT OM No. 22OL1 / Estt. (D) dated lall promotions will have only prospective effect even in cases where the vacancies relate to earlipr yearsl, all the promotions recommended by the DPC have to be effective from a prospective date. Therefore, SC & ST candidates have not been granted seniority with retrospective effect but factually, they were recommended by DPC against the vacant posts in the relevant year of roster of Senior Statistical Officers (SSOs) in the light of provision contained under sub- Para (i) of Para 6.4.L in DOPT OM dated , so thatyear-wise proper representation of SC / ST may be maintained in the higher Grade in the light of reservation policy. 04. So far as Supreme Court judgment in Civil Appeal No of 2015 dated is concerned, it is clarilied that all the relevant existing instructions, issued by DOPT relating to promotion, seniority etc. were strictly followed by the CCA of SSS and accordingly seniority of Senior Statistical Officers (SSOs) of SSS was decided vide this Ministry OM of even number dated 15o' January 2OL6. 3 t t After taking into account all the objections submitted by SSS incumbents, the seniority list of Senior Statistical Officers (SSOs) has been finalized and issued vide this Ministry's OM No12039 l03 / SSS dated 12u'April 2OL6.
