4 SAIPAN AND NORTHERN ISLANDS LEGISLATIVE DELEGATION Third Senatorial District Nineteenth Northern Marianas Commonwealth Legislature THIRD REGULAR SESSION, 2016 HOUSE LOCAL BILL NO , D2 A LOCAL APPROPRIA non BILL FOR AN ACT FOR THE THIRD SENATORIAL DISTRICT To appropriate up to $2,596, from the Third Senatorial District Developers Infrastructure Tax Fund under Business Unit 3730; and for other purposes. BE IT ENACTED BY THE THIRD SENATORIAL DISTRICT DELEGATION PURSUANT TO CHAPTER 4, DIVISION 1, TITLE 1 OF THE COMMONWEALTH CODE: I SECTION 1. PURPOSE. 2 The purpose of this Act is to appropriate up to $2,596, of the funds collected 3 under the Developers Infrastructure Tax from the Third Senatorial District under 4 Business Unit SECTION 2. APPROPRIATION. 6 Notwithstanding any provisions, statutes, laws or regulations to the contrary, the Saipan 7 and Northern Islands Legislative Delegation hereby appropriates up to $2,596, collected 8 under the Developers Infrastructure Tax from the Third Senatorial District under 9 Business Unit 3730 as follows: 10 (a) $150, for the paving of Maguro Drive in As Perdido; and 11 (b) $150, for the paving of Toson Drive in Afetnas; and 12 (c) $150, for the construction ofa water distribution line in the Obyan area; and

5 HOUSE LOCAL BILL No , D2 (d) $40, for the repair and paving of a section of San Vicente Loop m 2 San Vicente; and 3 (e) $446, for flooding and drainage control projects, electrical wiring for the 4 Municipal Council's Office, and road improvement projects in Precinct II; and 5 (f) $296, for drainage, ponding basin, and road improvement projects m 6 As Falapi Road in Precinct III; and 7 (g) $377, as follows: 8 (I) $60, for power distribution system upgrades in San Ignacio Drive; 9 and 10 (2) $317, for Road improvement on Wireless Road, Egigi Drive, and 11 Radar Road and for speed bumps on Santa Remedio Road and Chamolinian Drive in 12 Precinct IV; and 13 (h) $377, as follows: 14 (I) $15, for construction of speed bumps in Kagman II and III; and 15 (2) $210, for the road pavement of Pine Drive from Pepega Ave to 16 Ironwood St. to Chopak St. in Kagman III, Phase II; and 17 (3) $80, for the road pavement of Puteng Drive from Half Flower St. to 18 Ironwood St. to Chopak St. in Kagman III, Phase I and II; and 19 (4) $72,116 for the road pavement of Tangantangan Road in Papago Area in 20 Precinct V; and 21 (i) $115, for the paving of the road to Obyan Beach; and 22 CD $88, for the Northern Marianas Trades Institute (NMTI) for the electrical and 23 plumbing repair and upgrade; and 24 (k) $74, for paving oftasi Lane in Dan Dan. 25 (I) $60, for the anti-skid pavement on As Perdido Road. 26 (m) $100, for the anti-skid pavement on Cha Cha Road. 27 (n) $173, as follows: 28 (I) $73, for the construction of a water distribution line m 29 Kalarnendok Lane, Kagman IV and; 30 (2) $100, for a Mt. Tapochao booster pump. 2

6 HOUSE LOCAL BILL No ,02 SECTION 3. EXPENDITURE AUTHORITY. 2 The expenditure authority for Section 2 other than subsections 2 (g) (1), 2 (j) and 2 (n) 3 shall be the Secretary of the Department of Public Works. The expenditure authority for 4 2 (g) (I) and 2(n) shall be the CUC Executive Director. The expenditure authority for 5 Subsection 2 (j) shall be the Chief Executive Officer ofnmti. 6 SECTION 4. REPROGRAMING. 7 Notwithstanding any laws, provisions or regulations to the contrary, funds appropriated 8 under this Act shall not be reprogrammed for any other purpose. 9 SECTION 5. SEVERABILITY. 10 If any provision of this Act or the application of any such provision to any person or 11 circumstance should be held invalid by a court of competent jurisdiction, the remainder of this 12 Act or the application of its provisions to persons or circumstances other than those to which it 13 is held invalid shall not be affected thereby. 14 SECTION 6. SAVINGS CLAUSE. 15 This Act and any repealer contained herein shall not be construed as affecting any 16 existing right acquired under contract or acquired under statutes repealed or under any rule, 17 regulation or order adopted under the statutes. Repealers contained in this Act shall not affect 18 any proceeding instituted under or pursuant to prior law. The enactment of the Act shall not 19 have the effect of terminating, or in any way modifying, any liability, civil or criminal, which 20 shall already be in existence on the date this Act becomes effective. 3
