4 SAIPAN AND NORTHERN ISLANDS LEGISLATIVE DELEGATION Third Senatorial District Nineteenth Northern Marianas Commonwealth Legislature FIRST SPECIAL SESSION, 2016 HOUSE LOCAL BILL NO , Sl, D2 A LOCAL APPROPRIATION BILL FOR AN ACT FOR THE THIRD SENATORIAL DISTRICT To appropriate the associated interest collected for the Third Senatorial District of One Hundred Seventy-Six Thousand Five Hundred and Seventeen Dollars ($176, USD) in bond funds for road paving projects in Kagman III, Phase I, Phase II, and Phase III. BE IT ENACTED BY THE THIRD SENATORIAL DISTRICT DELEGATION PURSUANT TO CHAPTER 4, DIVISION 1, TITLE 1 OF THE COMMONWEALTH CODE: 1 SECTION 1. FINDINGS AND PURPOSE. 2 The purpose of this Act is to appropriate the associated interest collected for the Third 3 Senatorial District of One Hundred Seventy-Six Thousand Five Hundred and Seventeen 4 Dollars ($176, USD) in bond funds for road paving projects in Kagman III, Phase I, and 5 Phase II had been identified by the Commonwealth Development Authority as available for 6 appropriation,,_ 7 SECTION 2. APPROPRIATION. 8 Notwithstanding any provision of law to the contrary, the Saipan and Northern Islands 9 Legislative Delegation hereby appropriates the amount of One Hundred Seventy-Six Thousand

5 HOUSE LOCAL BILL NO , Sl, D2 1 Five Hundred and Seventeen Dollars ($176, USD) from CDA Bond Interests for the 2 Third Senatorial District for the road paving projects such as Hamlag AV; Silver Bush AV; 3 Dyers Fig ST; Velvet Leaf CT; Sour Plum ST; Beggar Weed CT; Indian Beech CT; Palambria 4 CT; Apilas AV; Silver Pipturus AV; and Pepega AV. in Kagman III, Phase I, and Phase II for 5 the application of Anti-Skid additives for Kagman Road; and for the paving of Gao Gao Drive 6 in Kagman III, Phase III. 7 SECTION 3. EXPENDITURE AUTHORITY. 8 The expenditure authority of the funds appropriated and earmarked under this Act shall 9 be the Secretary of the Department of Public Works. 10 SECTION 4. REPROGRAMMING. 11 Notwithstanding any laws, provisions or regulations to the contrary, funds appropriated 12 and earmarked under this Act shall not be reprogrammed for any other purpose unless through 13 legislative appropriation. 14 SECTION 5. SEVERABILITY. 15 If any provisions of this Act or the application of any such provision to any person or 16 circumstance should be held invalid by a court of competent jurisdiction, the remainder of this 17 Act or the application of its provisions to persons or circumstances other than those to which it 18 is held invalid shall not be affected thereby. 19 SECTION 8. SAVINGS CLAUSE. 20 This Act and any repealer contained herein shall not be construed as affecting any 21 existing right acquired under contract or acquired under statutes repealed or under any rule, 22 regulation, or order adopted under the statutes. Repealers contained in this Act shall not affect 23 any proceeding instituted under or pursuant to prior law. The enactment of the Act shall not 2

6 HOUSE LOCAL BILL NO , Sl, D2 1 have the effect of terminating, or in any way modifying, any liability, civil or criminal, which 2 shall already be in existence on the date this Act becomes effective. 3 SECTION 7. EFFECTIVE DATE. 4 This Act shall take effect upon its approval by the Governor, or its becoming law 5 without such approval.
