NOTE ON MOTION CALENDAR: NOVEM- Defendants BER, 0 ORAL ARGUMENTS REQUESTED Motion is respectfully made to this court for the issuance of a Writ of Execution against defendants in favor of Plaintiff in the amount of $. By withholding official action mandated by Article V of the Constitution, namely calling a convention, defendants have committed numerous illegal acts. 1 Such refusal has resulted in the collection of income tax against the Plaintiff where, had defendants obeyed the Constitution, such income tax would not exist. Under these circumstances, defendants have committed extortion against Plaintiff. 1 See Brief, generally, Motions B-J. See Evidence Appendix, p.. Case No. C0-RSM 1 () -0

2 1 1 Plaintiff in other motions has requested referral to the United States Attorney General regarding the criminal actions of extortion by the defendants. He now seeks civil reparation from the defendants under the terms of U.S.C. (a)() which states (in part): The court also shall render judgment against the said officer or employee for the amount of damage sustained in favor the party injured, to be collected by execution. As vetoing the Constitution can in no way be considered the official duties of the defendants, it is clear that the terms of U.S.C. 0 can not be applied by the court. The statute states: Execution shall not issue against a collector or other revenue officer on a final judgment in any proceeding against him for any of his acts, or for the recovery of any money exacted by or paid to him and subsequently paid into the Treasury, in performing his official duties, if the court certifies that: (1) probable cause existed; or () the officer acted under the directions of the Secretary of the Treasury or other proper Government officer. When such certificate has been issued, the amount of the judgment shall be paid out of the proper appropriation by the Treasury. As admitted by the IRS, the Secretary of the Treasury is under the direction of the defendants. Thus U.S.C. 0() cannot be applied favorably to the defendants as they were not act[ing] under the direction of the Secretary of Treasury or other proper Government officer. As noted in other motions and Plaintiff s brief, defendants vetoing a clause of the Constitution is not part of their official duties as such act violates federal criminal laws. Therefore there is no basis whatsoever to support probable cause exception of U.S.C. 0(1) as such probable cause must be ultimately based on defendants performing [their] official duties which they have not. Therefore there is no basis for the court to issue a certificate which assigns appropriation to the Treasury. The defendants are therefore liable for the entire amount to reparation owed the Plaintiff and such debt may not be transferred to the United States.
