1 LEGISLATIVE SCORECARD EDITION AUGUST 2018 Scores hold steady over the most recent General Assembly This is the thirteenth edition of the Common Cause Rhode Island Legislative Scorecard. It is a tool we provide for our members to highlight issues of importance to our organization over the course of the most recent Rhode Island General Assembly. Scores do not represent endorsements of candidates for office. The General Assembly was a study in contrasts. In 2017, we saw a number of important reforms pass, while 2018 proved to be a graveyard for government reform, particularly in the House of Representatives. Our Legislative Scorecard cannot tell the stories of the numerous pieces of legislation that never received a vote. From early voting to the line-item veto, a variety of reforms were bottled up by legislative leadership in The issues fall into five categories: Voting Rights, Campaign Finance, and Elections This is the area where Common Cause made the greatest gains in the last two years. In 2017, the General Assembly passed automatic voter registration, a huge win for the modernization of our elections. It also passed risk-limiting post-election audits, a priority of Common Cause since In 2017 and 2018, the Assembly also made incremental improvements to our elections and campaign finance laws, as requested by the State Board of Elections and Secretary of State. Unfortunately, one of our top priorities, creating a system of in-person early voting, never received a vote. Ethics Since voters overwhelmingly supported restoring the full jurisdiction of the Rhode Island Ethics Commission over members of the General Assembly in November 2016, there has been little progress on ethics policy in Rhode Island. In 2018, the House voted unanimously to require that financial disclosure statements be posted online, but the Senate never took up the bill. The Ethics Commission has chosen to put them online administratively without waiting for legislation. Judicial Selection Common Cause has fought for years to include magistrates as part of the merit selection process in Rhode Island. Although that reform has not passed, we saw an effort to expand the ranks of magistrates in the District Court fail in Representative Jay O Grady (D-Lincoln, Pawtucket) led a fight to limit the expansion that caused one of the longest floor debates of the year, and highlighted the lack of diversity in the ranks of magistrates in Rhode Island. Open Government and Legislative Rules While major reforms to the Open Meetings Act did not pass, there were improvements made to the law that enhance transparency. We saw minor setbacks with yet another exception created in the Access to Public Records Act. Representative Jared Nunes (D-West Warwick, Coventry) led an ultimately unsuccessful fight in 2017 to make the House of Representatives more transparent through improvements to the rules of that body. On the Senate side, a process was created in the Senate rules for expelling members. This came after Senator Nicholas Kettle (R-Scituate) was charged with numerous crimes and almost expelled from that chamber. While Common Cause believes that the process could be even better, we supported the Senate in taking this step. Separation of Powers Almost 15 years after voters ratified the Separation of Powers Amendments, one of the final boards and commissions was brought into compliance with our state s constitution when the Assembly passed changes to the enabling statute of the Coastal Resources Management Council. Common Cause was an amicus in the 2018 Advisory Opinion to the Supreme Court when then-house Speaker Murphy tried to retain control over this important body. While the bill did not reflect our preferred language, it brought a chapter in the Separation of Powers saga to a close Common Cause Rhode Island Legislative Scorecard Edition

Our lobbying, testimony, printed communications, or s laid out Common Cause positions on most of the issues. In some cases, amendments proposed on the floor of the House and Senate focused the issue more clearly than final votes, or complemented votes on the entire bill. To better draw distinctions about which votes are most important to Common Cause, this scorecard utilizes a three-point scale for ranking votes: 1 Point - Routine pro-votes or anti-votes based on positions advocated by Common Cause Rhode Island; 2 Points - Votes that uphold or attack long-standing, clearly enunciated Common Cause principles; and 3 Points - Votes on legislation or resolutions initiated by Common Cause, or on issues of critical importance to government reform. It s important to note that Common Cause takes positions on issues based on concerns for process rather than issues of substantive public policy. The votes selected for this scorecard reflect that emphasis. Our State Governing Board, elected by the membership of Common Cause Rhode Island at our Annual Meeting each fall, established our positions. The votes are divided into issue areas, including: Voting Rights, Campaign Finance, and Elections; Ethics, Judicial Selection, Open Government and Rules; and Separation of Powers. Within these issue areas, the number of pro-votes is divided by the total possible in that area (e.g. 3 pro-common Cause votes out of 4 results in a 75%). On some occasions, lawmakers recuse themselves from voting because of potential conflicts of interest. In instances of recusal legislators are required by law to note the reason for the recusal in the House and Senate Journals. The formula used to calculate the final score is: (Pro-votes)/((Pro-votes + Anti-votes) + (Non-voting/2)) = Final Score Common Cause never endorses candidates for any public office. This scorecard reports only how members of the General Assembly vote on particular bills and resolutions of concern to Common Cause. Scoring does not constitute opposition or endorsement. In the following section, we provide brief descriptions of the votes we scored along with the Common Cause position on the vote. For example: Year - Chamber Bill Number (Primary sponsor) Final disposition of legislation Plain language description of the vote. 3 Voting Rights, Campaign Finance, and Elections [House: 9 votes for 14 points /Senate: 11 votes for 17 points] Common Cause has been involved in the modernization of Rhode Island elections. After years of stagnation, we are making great gains in modernizing and securing our elections more, with policies like automatic voter registration and post-election audits passing H 5448 (Jay Edwards) Changes the maximum age of a minor who may accompany a parent into a voting booth from 13 to 18 years old. Common Cause supports efforts to teach civic participation. (1 point) H 5699 Sub A (Grace Diaz)/S 792 Sub A (Erin Lynch Prata) Clarifies that the law allows more than one vote tabulator in a precinct. Rhode Island s new vote tabulators are slower and precincts with high turnout may need more than one to avoid lines. Common Cause supports efforts to reduce lines at polling places. (1 point) H 5701 (Joseph Solomon)/S 794 (Erin Lynch Prata) Removes the requirement that each city and town have a vote tabulator as a demonstration unit, freeing up 39 machines for use on election day. (1 point) H 5702 Sub A (David Coughlin)/S 770 Sub A (Gayle Goldin) Automatic voter registration registers eligible voters, or updates their address information, unless they expressly decline to do so. Allows for automatic voter registration at the DMV and other state agencies that qualify. Common Cause supports efforts to increase access to the ballot for eligible voters and keep the voter rolls clean. (3 points) H 5702 Sub A (Patricia Morgan) - Floor amendment Amendment to automatic voter registration legislation that would prohibited expansion to other state agencies. (1 point) H 5704 Sub A (Edith Ajello)/S 413 Sub A (James Sheehan) Since 1998, all Rhode Islanders have cast their votes using a voterverifiable paper ballot. However, Rhode Island is in the minority of states that do not audit ballots to determine if those ballots were read correctly. This legislation requires, starting in 2020, Rhode Island to begin auditing ballots using a statistically-based procedure that provides a degree of confidence that the voting machine yielded the correct outcome for an election. Common Cause supports voter verifiable elections. (3 points) H 5709 Sub A (Joseph Shekarchi)/S 806 Sub A (Erin Lynch Prata) Clarifies what happens to the funds remaining in a campaign account when a candidate dies. Common Cause supports making our campaign finance laws clearer. (1 point) H 5947 (Susan Donovan)/S 808 (Erin Lynch Prata) Closes a loophole in Rhode Island campaign finance laws that legalized straw donations. Common Cause supports strict enforcement of our campaign finance laws. (2 points) S 834 Sub A (Erin Lynch Prata) No vote in House Allows the Board of Elections to withhold ballot access for candidates who owe outstanding fines. Common Cause withdrew its support after amendment resulted in change that would undermine effort to strengthen auditing by the Board of Elections. Common Cause supports strict enforcement of our campaign finance laws, but only if they are effective. (1 point) H 7522 (Arthur Corvese)/S 2440 (Stephen Archambault) Codifies existing practice of notifying the prior jurisdiction of a voter when they register in Rhode Island. Common Cause supports keeping the voting rolls clean. (1 point) S 2446 Sub A (Frank Lombardi) No House vote Changes the deadline for disaffiliation from a political party from 90 to 30 days, effective immediately (effectively reopening the disaffiliation period in 2018). Common Cause opposes last-minute changes to the rules that affect voters in an election year. (1 point) 2018 S 2612 Sub A (Gayle Goldin) No House vote Requires that candidates for U.S. President and Vice President share copies of their tax returns for the prior five years in order to gain ballot access in Rhode Island. Common Cause supports financial disclosure for candidates for office. (1 point) 2018 S 2973 (Sandra Cano) No House vote Create a special commission known as a statewide complete count committee, to encourage participation in the 2020 Census. Common Cause supports a successful Census. (2 points) Ethics [House: 1 vote for 2 points/senate: 0 votes for 0 points] After a huge victory in restoring the full jurisdiction of the state Ethics Commission over members of the General Assembly - we saw no progress on ethics by the General Assembly H 8042 (Daniel McKiernan) No Senate vote Requires that the Ethics Commission post financial disclosure filings online. 4 Judicial Selection [House: 2 votes for 3 points/senate: 0 votes for 0 points] The long-time issue of magistrate selection came to the forefront in The Rhode Island District Court submitted legislation that would have allowed for unlimited expansion in the number of magistrates in that court H 7912 (Cale Keable) No Senate vote Allows for the creation of multiple magistrates in the Rhode Island District Court where there is currently only one. Common Cause opposes expansion of magistrates without their going through the Judicial Nominating Commission process. (2 points) Open Government and Rules [House: 8 votes for 12 points/senate: 7 votes for 11 points] 2018 H 7912 floor amendment (Jeremiah O Grady) Limits the expansion of magistrates in the District Court to a single additional position. Common Cause supports efforts to limit the expansion of magistrates without their going through the Judicial Nominating Commission process. (1 point) There is a growing realization that the House and Senate rules matter for how those bodies function. There was a significant effort, ultimately unsuccessful, to amend the House rules in 2017 and an effort to deal with the fallout from the resignation of Senator Nicholas Kettle (R-Scituate) by creating a process for expelling members H 5293 Sub A (Arthur Corvese) Common Cause supported several amendments to the rules of the House of Representatives proposed by Representatives Jared Nunes (D-Coventry), Blake Filippi (R-Block Island), and Justin Price (R-Richmond). Common Cause opposed the rules of the House of Representatives that continue to concentrate power. (2 points) H 5293 Sub A (Jared Nunes) Rules Amendment #2 Would require the General Assembly to create a searchable database of legislative votes. Common Cause supports making legislative information more accessible. (1 point) H 5293 Sub A (Blake Filippi) Rules Amendment #4 Would require the General Assembly to provide a redlined copy of bills when amendments are offered. Common Cause supports making legislative information more accessible. (1 point) H 5293 Sub A (Justin Price) Rules Amendment #5 Would require the General Assembly to provide members of legislative committees amendments to bills 24 hours prior to a vote on these amendments. Common Cause supports making legislative information more accessible. (1 point) H 5293 Sub A (Jared Nunes) Rules Amendment #9 Would require that the House of Representatives budget be available for three days prior to a vote by the House Finance Committee. Common Cause has long supported a more transparent state budget process. (2 points) H 5347 Sub B (Charlene Lima) Requires release of investigatory records of the state police and Attorney General related to the 38 Studios scandal, with certain exceptions. Common Cause supports increased access to documents related to the 38 Studios scandal. (2 points) H 6323 (Evan Shanley)/S 381 (Michael McCaffrey) Makes changes to the Open Meetings Act by requiring municipal bodies to post their meeting minutes online, and to exclude weekends and state Separation of Powers [House: 2 votes for 3 points/senate: 2 votes for 3 points] holidays from the calculation of forty-eight (48) hours public notice. Common Cause supports strengthening our open meetings law. (2 points) H 8341 (Gregory Amore)/S 2308 Sub A (Roger Picard) Creates a new exemption in the Access to Public Records Act for evaluations of public school administrators. Common Cause opposes further weakening of our public records law. (1 point) 2017/ Suspension of Senate Rules Each year, the House and Senate suspend certain rules in order to expedite the flow of legislation in the final days of the session. This limits the ability of the public to follow legislation at the most crucial time of year. The chambers must vote to suspend the rules unless the majority and minority leaders grant their consent to waive the vote. In 2017 and 2018, the Senate held a floor vote on suspension of the rules. The House did not hold similar votes because Majority Leader Shekarchi and Minority Leader Morgan agreed to bypass a vote. Common Cause opposes suspension of the rules that limits transparency of the legislative process. (1 point) S 469 (James Sheehan)/No House vote Requires the state budget office to produce a citizens guide to the state budget. Common Cause supports efforts to encourage civic participation. (1 point) S 2008 (Louis DiPalma)/No House vote Requires that internet service providers doing business with the state of Rhode Island abide by the principles of net neutrality. Common Cause supports an open internet. (2 points) S 2967 (Dominick Ruggerio) Creates a process in the Senate rules for expelling a member of the Rhode Island Senate. Common Cause supports creating processes and standards for expelling members of the General Assembly. (1 point) H 6258 (Gregory Amore)/No Senate vote Requires that those who serve on state boards and commissions be Rhode Island residents, or be professionally licensed in Rhode Island. Common Cause opposes putting limits on the governor s power of appointment. (1 point) H 8319 Sub A (Kenneth Marshall)/S 2955 Sub A (Susan Sosnowski) Fixes the enabling statute for the Coastal Resources Management Council to bring it into line with the Separation of Powers amendments of Common Cause supports efforts to bring the law into compliance with Separation of Powers.
