1 JANUARY 14, THE REGULAR MEETING OF THE BRISTOL VIRGINIA CITY COUNCIL WAS HELD ON JANUARY 14, 2014, AT 7:00 P.M. IN COUNCIL CHAMBERS WITH MAYOR GUY ODUM PRESIDING. COUNCIL MEMBERS PRESENT WERE VICE MAYOR CATHERINE BRILLHART, DON ASHLEY, EDWARD HARLOW, AND JIM STEELE. INTERIM CITY MANAGER, TABITHA CROWDER AND CITY ATTORNEY PETE CURCIO WERE ALSO PRESENT. Invocation was given by Council Member Harlow followed by the Pledge of Allegiance to the flag. 1. Matters to be Presented by Members of the Public There were no matters to be presented by members of the public. 2. Mayor s Minute and Council Comments Mayor Odum announced that the full agenda was now available on the City s website. Council Member Harlow gave an update on the status of the Birthplace of Country Music Museum. 3. Consider Proclamation to Recognize Congenital Heart Defect Awareness Week Ms. Agnes Rhodes, Coordinator of Mended Little Hearts, Johnson City, Tennessee, Chapter 259, spoke on behalf of Mended Little Hearts. She advised that Mended Little Hearts provides support to families of children who were born with heart defects. She pointed out that one (1) out of every one hundred (100) babies was born with a heart defect. She explained that because they were a non-profit organization they had to obtain their own funding through private donations, fund raising, and through community help. She advised that their goal was to raise awareness of congenital heart defects. She asked that City Council adopt a Proclamation recognizing congenital heart defect awareness week. Mayor Odum read the following Proclamation:
2 100 JANUARY 14, 2014 A PROCLAMATION TO RECOGNIZE CONGENITAL HEART DEFECT AWARENESS WEEK WHEREAS, the health and well-being of all children throughout our City of Bristol, Virginia, are of paramount importance to Virginia families and communities; and WHEREAS, thousands of children are born with birth defects every year, including approximately 40,000 children in the United States who begin life with one of more than thirty-five identified forms of congenital heart defects; and WHEREAS, congenital heart defects are among Virginia s most common birth defects, and they are often fatal due to their seriousness, a lack of effective medical intervention options, and the limited availability of infant donor hearts; and WHEREAS, the origins and symptoms of congenital heart defects are becoming more readily identifiable, and the range of surgical options are expanding continuously thanks to doctors and scientists diligent research efforts and field experiences that extend our body of knowledge every day; and WHEREAS, there is much to learn about the causes of and effective treatments for congenital heart defects, and it is important for parents, pediatricians, and nurses to recognize the warning signs associated with congenital heart defects among newborns so they may provide proper treatment as early as possible; and WHEREAS, many of Virginia families and communities are directly or indirectly affected by infant illness and death caused by congenital heart defects, and we applaud the efforts of doctors and scientists everywhere who work diligently to solve life s medical mysteries and to improve the quality of life for us all; NOW, THEREFORE, I, Mayor Guy Odum, do hereby now and forever recognize February 7, 2014, through February 14, 2014, as CONGENITAL HEART DEFECT AWARENESS WEEK In Bristol Virginia, and I call this observance to the attention of all our citizens. Mayor Odum entertained a motion to approve the Proclamation to Recognize Congenital Heart Defect Awareness Week. Joint Public Hearing with the Planning Commission to Consider Granting a Special Exception (SE # ) to Real Estate Parcel TBD and More Commonly Known as 337 Island Road to Allow the Construction of a Medical Office Building in the R-2 (Single and Two Family Residence) Zoning District Chairman, Guy Odum, of the Planning Commission, declared the Joint Public Hearing open for comments. Assistant City Manager, Andrew Trivette, stated the purpose of the joint public hearing with the Planning Commission and City Council was to consider granting Special Exception # for 337 Island Road which would allow the construction of a medical office building in the R-2 zone. He pointed out that a R-2 zone does not allow this type of use. He continued by stating that this Special Exception would be the vehicle that would allow this use. He pointed out that this was not a zoning change, but that it was a specific exception for this particular use.
3 JANUARY 14, Mr. Trivette explained that the staff analysis included a significant analysis of potential impacts of the surrounding residential property as well as level of service to the roadway and identified a number of conditions that would need to be applied to the Special Exception to help mitigate those impacts. He continued by stating that the drafted Resolution included those conditions and that City Council would be asked to include those conditions as part of their approval. Mayor Odum entertained comments from the public. Mr. Michael Pollard inquired about the location and surrounding landmarks near the property. Mayor Odum advised that the property was located between Gate City Highway and Highway 11, basically behind the Virginia Welcome Center. There being no further comments, Mayor Odum declared the public hearing closed. Mayor Odum entertained a motion to present the Special Exception request to City Council for approval. Planning Commission Member Sanslow made the motion to present the Special Exception request to City Council for approval. Motion was seconded by Planning Commission Member Steinberg and carried by the following votes: ABSTAIN: Esposito AYES: Leonard, Sanslow, Snodgrass, Steinberg, Williams, and Odum 6. Consider a Resolution Granting a Special Exception (SE # ) to Real Estate Parcel TBD and More Commonly Known as 337 Island Road to Allow the Construction of a Medical Office Building in the R-2 (Single and Two Family Residence) Zoning District Mayor Odum entertained comments and questions from City Council Members regarding a Resolution granting a Special Exception (SE # ) to real estate parcel TBD and more commonly known as 337 Island Road to allow the construction of a medical office building in the R-2 (Single and Two Family Residence) zoning district. Council Member Harlow inquired about the type of medical establishment proposed for this property. Ms. Beth Rhinehart, a representative of Wellmont Health Systems, addressed City Council Members, stating that Wellmont would be providing the healthcare services at the facility. She advised that the facility would be an infusion center that would have a minimal number of patients receiving chemotherapy, similar to the infusion center located at the hospital, but on an out-patient basis. Council Member Ashley inquired about the roadway study. Ms. Rhinehart stated that a preliminary study was done that showed minimal amounts of work that would have to be done. She advised that everyone was willing to abide by the requirements to make the roadway safe and to upgrade the roadway if necessary. Mayor Odum asked if the applicant was satisfied that they could meet the requirements of the Special Exception. Ms. Rhinehart advised that if the requirements could not be met, the project would not go through. She further advised that these were stipulations in the permit. Vice Mayor Brillhart inquired about a portion of the property being located in the flood zone, asking if this would be an insurance concern.
4 102 JANUARY 14, 2014 Assistant City Manager, Mr. Andrew Trivette, advised that this should not be a concern. He continued by stating that being a commercial use gives it certain abilities within the flood zone that residential use did not have. He further stated that based upon the preliminary site plan it appeared that the construction would be outside the flood zone. Mr. Trivette continued by stating that a revision had been made to condition number four (4) of the Resolution. He explained that the revision defined the operating hours. He advised that all parties were satisfied with the language in the revision. He pointed out that, during the Planning Commission meeting held in November, one of the things that needed to be done was the completion of a successful subdivision of the property that was intended to be utilized by this use. He advised that this did not get accomplished; therefore, a condition had been added that the execution and effective date, based upon the approval by City Council, would not go into place until that subdivision was accomplished. He pointed out that the subdivision was done administratively and would not have to be brought before the Planning Commission or City Council for approval. Vice Mayor Brillhart inquired about permission from Bristol, Tennessee, concerning the sewer service. Mr. Trivette advised that Bristol Virginia Utilities had preliminary conversations regarding the sewer service and that there was capacity in the City s area of the sewage treatment plant. Council Member Steele inquired about the flood zone. He asked if the property would be raised up at the time of construction. Mr. Trivette advised that the flood zone was located in the corner in the back, which would house parking; however, that would be determined once the site plan is submitted. Motion was seconded by Council Member Steele and carried by the following votes: City Attorney, Pete Curcio, read the following Resolution: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRISTOL, VIRGINIA GRANTING A SPECIAL EXCEPTION (SE # ) TO REAL ESTATE PARCEL AND MORE COMMONLY KNOWN AS 337 ISLAND ROAD TO ALLOW THE CONSTRUCTION OF A MEDICAL OFFICE BUILDING IN THE R-2 (SINGLE & TWO FAMILY RESIDENCE) ZONING DISTRICT SECTION 1. The City Council finds that: WHEREAS, the Planning Department received an application for a special exception from Greg Little, Covenant Commercial Group, on behalf of Don Shumaker,
5 JANUARY 14, the property owner, for approval of a non-residential use at 337 Island Road, Bristol, Virginia; and WHEREAS, the applicant/agent submitted the required application to the Director of Community Development in accordance with City Code; and WHEREAS, the Planning Commission of Bristol, Virginia recommended forwarding special exception # for a joint public hearing with City Council; and WHEREAS, the joint public hearing has been properly advertised in accordance with Virginia Code , as amended; and WHEREAS, property owners adjoining 337 Island Road have been properly notified pursuant to Virginia Code , as amended; and WHEREAS, the City Council of Bristol, Virginia reserves unto itself the right to grant special exception permits; and WHEREAS, the City Council considered the circumstances of Bristol, Virginia City Code 50-39(g) prior to approval of the special exception request. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF BRISTOL, VIRGINIA: SECTION 2. Special Exception # is hereby granted with the following conditions: 1. Prior to the approval of a site plan for any project on this property, the applicant shall arrange and fund the completion of a traffic study, completed by a qualified consultant, which will identify if any, and what improvements may be required for Island Road to maintain an acceptable level of service (LOS) post development. The applicant shall be responsible for the cost of this study. The City Engineer or Director of Public Works shall be satisfied with the methods utilized to complete the study and with the findings. 2. Prior to the issuance of certificate of occupancy the applicant shall voluntarily proffer, pursuant to City Code and Virginia Code , as amended, that they will be responsible for causing the completion of any recommended traffic improvements which the above study finds warranted and shall be responsible for funding such improvements. 3. The applicant shall, prior to the issuance of a certificate of occupancy, install a screen of hardscape or softscape to the satisfaction of the Planning Director between any non-residential use and surrounding residential uses. Existing natural screening may be used to satisfy this requirement. 4. Standard operating hours for any non-residential use on the property shall be limited to 7am through 7pm Monday through Friday Eastern Standard Time. However, occasionally operating hours may be extended to weekends and additional nighttime hours to allow for completion of atypical work schedules. 5. Prior to the issuance of a certificate of occupancy the applicant shall provide for sanitary sewer service in a manner acceptable to the City Manager or Designee and the BVU Board or designee. 6. Prior to execution and effective date of this resolution the applicant shall complete subdivision of the property intended for a non-residential use pursuant to City Code and to the satisfaction of the Planning Director. Ordinance 1 st Reading 1) Consider First Reading of an Ordinance to Repeal and Reenact Sections 66-45, Same-Eligibility; 66-46, Annual Leave; 66-48, Sick Leave; of the City Code Interim City Manager, Tabitha Crowder, explained that this Ordinance was being presented because the Virginia Retirement System had mandated a third retirement plan effective January 1, The mandated change created the hybrid employee plan. She advised that under the hybrid plan, the employees would be eligible for short term and long term disability. As a result of this change, the City is decreasing the amount of sick leave that the hybrid employees would receive compared to the Plan One and Plan Two employees. Council Member Ashley asked if the employees got to choose this plan upon being hired. Ms. Crowder advised that the new employees hired on or after January 1, 2014, were automatically placed in the hybrid plan. Council Member Ashley then asked if the current employees were allowed to choose the hybrid plan. Human Resource Director, Trish Henderson, explained that the employees in Plan One and Plan Two under the Virginia Retirement System may opt in during the period of January 1, 2014, through April 30, She pointed out that if an employee opted in, it would be effective July 1, 2014, and that it was irrevocable. Following a brief discussion, Mayor Odum entertained a motion for the first reading of an Ordinance to repeal and reenact Sections 66-45, Same-Eligibility; Annual Leave; 66-48, Sick Leave; of the City Code. He requested that the motion be by caption only due to the length of the Ordinance. Motion was seconded by Council Member Steele and carried by the following votes: City Attorney, Pete Curcio, read the following Ordinance by caption only: AN ORDINANCE TO REPEAL AND REENACT SAME ELIGIBILITY, ANNUAL LEAVE, AND SICK LEAVE OF THE CITY CODE BE IT ORDAINED by the City Council for the City of Bristol Virginia that Same - Eligibility, Annual Leave, and Sick Leave of the City Code should be and hereby are repealed and reenacted to read as follows: Same Eligibility (a) Regular employees, full-time and part-time. The appointment of regular full-time and part-time employees is subject to three months' probationary service before permanent status is acquired. After the termination of such probationary period, annual leave and sick leave credit shall be given for the period of probationary service. The maximum
7 JANUARY 14, credits for annual and sick leave are for regular full-time employees. Regular employees on a part-time basis hired before January 1, 2014 shall receive sick leave and annual leave credits, and charges for authorized absences shall be made against these credits in proportion to their actual hours of duty. Regular employees on a part-time basis hired on or after January 1, 2014 shall not receive sick leave and annual leave credits. (b) Temporary employees. No credits for leave with pay shall be made for an employee holding a temporary appointment. If the status of any employee is changed from temporary to permanent, leave credits shall be given for a period of temporary service not to exceed three months; in addition that period shall also be considered part of the total service in determining the date at which the credit for leaves of absence with pay shall accrue. (c) Intermittent or occasional employees. No credits for leaves with pay shall be granted to intermittent or occasional employees. (d) Reinstated employees. A person who is reinstated as provided in section shall be credited with all unused balances of leave (except annual and compensatory leave) held at the date of previous separation, and shall have all creditable service before that date considered in determining the date of accrual; a person who is reinstated on return from military leave shall receive, also, full benefits of his period of military service in determining the date of accrual. (e) Reemployed employees. A person who is reemployed will accrue leave for continuous service only, beginning with the latest date of reemployment Annual Leave (a) Provision of credits. (1) Annual leave credits for regular, full-time employees, hired before January 1, 2014 who have not opted to participate in the hybrid retirement plan, and all employees eligible to receive enhanced retirement benefits in hazardous duty positions, and all employees hired on or after January 1, 2014 with Virginia Retirement System creditable services, shall be provided for each completed calendar month of service at the rate of one work day for employees with less than five full years of continuous service, 1¼ work days for employees with five or more full years of continuous service, and 1½ work days for employees with ten or more full years of continuous service. Annual leave credits may be accumulated not to exceed, at the date of separation or at the end of any fiscal year, 24 work days for employees with less than five full years of service, 30 work days for employees with five or more full years of service and 36 work days for employees with ten or more full years of service. (2) All full-time employees hired on or after January 1, 2014, and employees hired before January 1, 2014 who have opted to participate in the hybrid retirement plan, with the exception of employees eligible for enhanced retirement benefits in hazardous duty positions and employees hired with Virginia Retirement Service creditable service, shall receive annual leave as set forth in the applicable City of Bristol Human Resources policy. Any and all future changes to paid time off shall be subject to City Council approval. (b) Use of credits. The annual leave credits provided may be used, at the option of the employee, to provide paid absences for vacation and other personal purposes (including sickness) or for absences in excess of credits available for other kinds of leave. However, as a matter of policy, a major portion of annual leave should be used at one time in a course of a 12-month period. (1) No annual leave credit shall be provided for service less than a full semimonthly pay period or 15 calendar days, whichever is the lesser; the credit for a full semimonthly pay period or more than 15 calendar days but less than one calendar month shall be one-half a work day.
8 106 JANUARY 14, 2014 (2) No annual leave credit shall be provided during any period of absence immediately following an absence of 60 calendar days Sick Leave (a) Provision of credits. (1) Sick leave credits for regular full-time employees, hired before January 1, 2014 who have not opted to participate in the hybrid retirement plan, and all employees eligible to receive enhanced retirement benefits in hazardous duty positions, and all employees hired on or after January 1, 2014 with Virginia Retirement System creditable services, shall be provided at the rate of 1¼ days for each calendar month of service completed. No sick leave credit shall be provided for service less than a full semimonthly pay period or 15 calendar days, whichever is the lesser period, in a month; the credit for a full semimonthly pay period or more than 15 calendar days but less than one calendar month shall be one-half a workday. No sick leave credit shall be provided during any period of absence immediately following an absence of 60 calendar days. In case of illness or injury which is not compensable under the Virginia Workers' Compensation Act (Code of Virginia, et seq., as amended, repealed, reenacted or recodified from time to time), the city manager may grant additional credits beyond what the employee has accumulated; provided, however, that it is clearly established that the illness or injury was contracted in the course and by reason of the performance of duties assigned to the employee. (2) All full-time employees hired on or after January 1, 2014, and employees hired before January 1, 2014 who have opted to participate in the hybrid retirement plan, with the exception of employees eligible for enhanced retirement benefits in hazardous duty positions and employees hired with Virginia Retirement Service creditable service, shall receive sick leave as set forth in the applicable City of Bristol Human Resources policy. The justification for any sick leave use shall be subject to verification by the department director concerned and the city manager by requirement of a certificate of a physician, describing the disability, stating that the employee was unable by reason of his disability to be on duty during the entire period covered by the application and, where extended absence is indicated, the probable duration of the disability. For any absence in excess of 60 workdays within a 12-month period such a certificate must be provided and filed with the city manager at the end of the 60 days and monthly thereafter. (2) Justifications. Leave credit may be used for authorized absences as follows: a. Personal illness or injury incapacitating the employee from performing his duties. b. Exposure to a contagious disease which jeopardizes the health of others. c. Appointment for examination and treatment related to health when such appointment cannot reasonably be scheduled during non-work hours. d. Illness or death in the immediate family requiring the attendance of the employee. "Family of an employee" shall be regarded as parents, wife, husband, child, brother, sister or any other relatives living in the household of the employee. e. 9 JANUARY 14, Consider Accepting $27, from Insurance Recovery and Appropriating as Follows: Revenue $27, Expense $16, Expense $10, Mayor Odum entertained a motion to consider accepting twenty-seven thousand, two hundred thirty-seven dollars and forty-five cents ($27,237.45) from insurance recovery and appropriating the funds as requested. Financial Quarterly Report City Clerk, Steve Allen, gave a financial summary presentation on the first six months of the fiscal year. Following a review of the revenue and expenses, Mr. Allen pointed out that the revenue and expenses were on track based upon the budgeted amounts. He also pointed out that, with regard to the budgeted revenue for Solid Waste, the loss of a customer was not anticipated, and that caused a decrease in the revenue. Mr. Allen reminded everyone that it was nearing budget time and that several issues would be brought before Council to consider. Interim City Manager, Tabitha Crowder, advised that meetings had already begun with the Senior Management Team and the department heads of larger departments to discuss the budget in terms of looking at a service-based budget as opposed to a line item budget. Council Member Ashley inquired about the damage caused by the water line break and asked if the insurance would cover the expenses. Mr. Allen advised that he anticipated the funds would cover the expense. Ms. Crowder stated that the City was using in-house forces from Public Works and Parks and Recreation to keep the cost down. 10. Executive Session Mayor Odum entertained a motion to enter into Executive Session pursuant to A.1, Code of Virginia 1950, as amended for the discussion, consideration, or interviews of prospective candidates for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of any public body; (Appointments); and pursuant to A5, Code of Virginia, 1950, as amended for the discussion concerning a prospective business or industry or the expansion of an existing business or industry where no previous announcement has been made of the business' or industry's interest in locating or expanding its facilities in the community. (Discussion with Staff concerning unannounced business prospects); and pursuant to A7, Code of Virginia, 1950, as amended for consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the public body; and consultation with legal counsel employed or retained by a public body regarding specific legal matters requiring the provision of legal advice by such counsel.
