11 State Legislative Update The legislature adjourned on March 8 th first on time adjournment (no special sessions) since day session 317 bills made it through the legislative process Budget Received full funding for our decision packages Received state funding to implement bills with Exchange impact Bills Passed: Housekeeping (2516); Automatic Voter Registration (2595); Health Care for COFA Islanders (5683); Preserving Access to Ind. Market Coverage (2408) Did Not Pass: Reinsurance(2355/6062) Individual Mandate (6084) 3

12 Governance Housekeeping Bill (2516) Clarifies the Board appointment process Operations Solidifies the Exchange s position as the state s eligibility and enrollment portal for insurance and state and federal health care programs Provides explicit state authority for the Exchange to determine eligibility for tax-credits, CSRs, and other available subsidies Defines Navigator in state law Permits the sponsorship program to include both premium and cost-sharing assistance Eliminates outdated language related to start-up activities, verification, and grace period reporting and related activities Fiscal Allows the exchange to establish a three month operating reserve Streamlines and consolidates multiple financial legislative reports into one annual report 3

13 Automatic Voter Registration (2595) Maintains current, successful, Healthplanfinder opt-in voter registration process Requires starting July 1, 2019 that the Exchange provide name, address, and DOB information to SOS (back-end data transfer), only for applicants who affirmatively indicate they are interested in registering to vote, reside in WA, are 18 or older, and are verified citizens Requires that SOS procedures are compliant with applicable federal and state voter registration and privacy laws and rules If HBE determines that implementation requires CMS approval, implementation is contingent on receiving that approval Requested amount of state funds received for implementation 13

14 Preserving Access to Ind. Market Coverage (2408) 2019: Allows residents in bare counties to purchase coverage through the Washington State Health Insurance Pool (WSHIP) at a reduced rate (sliding scale based on FPL level). Reductions funded through the current WSHIP financing mechanism 2020: Leverages the networks used by private insurers offering coverage to state and school employees to ensure private insurance coverage is available in all counties where those insurers offer coverage to state and school employees Beginning January 1, 2020, at least one health carrier in an insurance holding company system must offer at least one silver and one gold QHP in the Exchange, in any county in which any health carrier in that insurance holding company system offers a fully insured health plan for the school employees benefits board (SEBB) or the public employees benefits board (PEBB) 14

15 Health Care for COFA Islanders (5683) COFA islands include: Republic of Palau, the Republic of the Marshall Islands, and the Federated States of Micronesia Requires that HCA provide premium and cost-sharing assistance to COFA citizens residing in WA, with incomes under 133% FPL, who are ineligible for other coverage, and enroll in a silver QHP through the Exchange The program must begin by Nov. 1, HCA must conduct a community education and outreach campaign, beginning not later than Sept. 1, 2018, and appoint an advisory committee to help develop the program Implementation will include updates to Healthplanfinder to capture COFA status Requested amount of state funds received for implementation 15
