5 REPORT SUMMARY Louisiana Revised Statute (R.S.) 24:513.2(E) requires the legislative auditor to submit annually to the legislature a report including summary financial and personnel information on all boards, commissions, and like entities created by law or executive order and to report findings and recommendations resulting from any analysis of the information. Based on our analysis, we submit the following information and recommendations: As of June 30, 2013, we identified 485 boards, commissions, and like entities created by law or executive order. Since our last report, 12 entities were created and 19 were repealed, terminated, or otherwise removed. Of the 448 active entities that responded to our request, 257 pay per diem, salaries, and/or travel of the board members. The 2013 and 2012 actual amounts totaled $1,163,133 and $1,199,247 for per diem payments; $3,316,107 and $2,008,844 for board member salaries; and $2,489,761 and $2,204,437 for board member travel, respectively. Twenty-seven boards, commissions, and like entities that were created during 2011 or earlier have never been fully organized, have disbanded, or are currently inactive. The legislature and/or governor should consider abolishing these entities. Ten boards, commissions, and like entities did not provide the requested information. Louisiana law requires these entities to provide requested information. Act 184 of 2013, effective August 1, 2013, now requires the commissioner of administration to notify the Senate Committee on Senate and Governmental Affairs, the House Committee on House and Governmental Affairs, and the oversight committees for boards, commissions, or like entities of their failure to comply with the request for information. 2

6 REPORT TO THE LEGISLATURE Legislative Mandate R.S. 24:513.2(E) requires the legislative auditor to submit annually to the legislature a report containing summary financial information and personnel data on (1) boards, commissions, and like entities created by law or executive order that are made part of, or are placed in, the executive branch of state government and (2) local boards, commissions, and like entities that are specifically created by law. The statute provides for the legislative auditor to report findings and recommendations resulting from any analysis performed of the information. R.S. 49:1301 requires the commissioner of administration to establish and maintain a website containing information on boards, commissions, and like entities. Act 184 of 2013, effective August 1, 2013, now requires the commissioner of administration to send boards, commissions, and like entities that fail to submit the required information a notice of noncompliance by certified mail; to send a notice detailing the failure to comply by certified mail to the chief administrative officer of the department of which the board, commission, or like entity is a part, if applicable; and to send a notice detailing the failure to comply to the Senate Committee on Senate and Governmental Affairs, the House Committee on House and Governmental Affairs, and the oversight committees for the board, commission, or like entity. R.S. 49:1307 also requires the legislative auditor to work with the commissioner of administration to ensure that each board, commission, or like entity complies with submitting information to the website. 7 Report to the Legislature Trend This report identifies 485 boards, commissions, and like entities, as of June 30, Our current and previous reports include the following number of entities: Growth of Entities Year Number of Entities Since 1992, these comparisons reflect an increase in the growth of boards, commissions, and like entities. The 1997 and 2005 decreases in the number of such entities are primarily attributable to the termination, in accordance with R.S. 49:215(C), of entities that were created by executive order. Since our last report, 12 entities were created and 19 entities were either repealed by law, terminated in accordance with law or executive order, or otherwise removed. The recommendations included in this report are intended to control the growth of boards, commissions, and like entities. Information Requested R.S. 24:513.2(F) directs all agencies, boards, commissions, and departments of the state and its political subdivisions to furnish information and reports as requested by the legislative auditor to fulfill his responsibilities. All boards, commissions, and like entities were requested to provide contact information, membership information, and statutory or legal authority relative to the entity. 4

8 Report to the Legislature R.S. 39:1335 and 1336 require licensing agencies to provide summary and detailed information pertaining to actual and budgeted revenues by source, expenditures by category, and fund balances; the number of classified and unclassified personnel; performance indicators; and certain general information pertaining to the board and its authority and functions. All other boards, commissions, and like entities were requested to provide similar information, except that the financial and budget information was requested in summary form only and information pertaining to performance indicators was not requested. No Response Received Some boards, commissions, and like entities did not respond to our request for information. A list of those boards, commissions, and like entities that did not respond to our request can be found on page 7. Information Unaudited Information included in this report and on the website was provided by the boards, commissions, and like entities; it has not been audited by the legislative auditor, and, accordingly, we express no opinion on the information. Inactive Entities The following 27 boards, commissions, and like entities were never fully organized; were disbanded with no plans to reorganize; were inactive; or had no funding prospects to undertake the functions for which they were established, even though the board members may continue to meet. Because these entities are not fulfilling their established functions, the legislature or governor as deemed appropriate should consider their abolishment. 5

10 Report to the Legislature No Responses As of June 30, 2013, we identified 10 boards, commissions, and like entities that have not responded to our requests for personnel data and financial information. Boards, Commissions, and Like Entities No Responses Allen Parish Reservoir District Board of Commissioners Bayou Desiard Lake Restoration Commission Bi-State Corridor Commission Black Men and Boys, Council on the Social Status of Columbia Port Commission I-12 Retirement District Board of Directors Multi-Disciplinary Committee Tri-State Corridor Commission Vermilion and Iberia Railroad Development District Board of Commissioners West Ouachita Reservoir Commission A joint letter from the legislative auditor and the commissioner of administration requesting information was mailed to all 485 boards, commissions, and like entities identified in our report. Numerous attempts via telephone and to contact those boards, commissions, and like entities that did not submit the requested information were made by the legislative auditor s staff with no response from these entities. Comparison to Other Southeastern States We collected data on the number of boards, commissions, and like entities in 14 other Southeastern states to compare to the number in Louisiana. As of June 30, 2013, Louisiana had the highest number of boards, commissions, and like entities at 485. Oklahoma had the next highest number of boards, commissions, and like entities at 448, and Florida had the lowest number at 106. The graph on the following page illustrates those Southeastern states that we collected data on and how they compare to Louisiana. 7

Boards and Commissions Per Diem Freeze During fiscal year 2012, Executive Orders BJ and were issued. These executive orders directed that all expenditures for per diem to members of all boards, commissions, authorities, task forces, and committees in the executive branch of government be terminated. However, the following were exempted from the provisions of the executive order: (1) elected members of boards, commissions, authorities, task forces, and committees who are authorized by law to receive a per diem; (2) members of boards, commissions, authorities, task forces, and committees who are statutorily authorized and entitled to the payment of per diem on their own warrant; and (3) exemptions granted by the commissioner of administration as may be necessary due to extreme economic hardships which would otherwise result to a member of a board, commission, authority, task force, or committee. Because of the exemptions, the executive orders had little or no fiscal impact on the boards, commissions, and like entities listed in this report. 29 EXECUTIVE ORDER BJ Boards and Commissions per Diem Freeze WHEREAS, some boards, commissions, authorities, task forces and committees have been established by law or executive order with the provision for the payment of per diem to the members thereof; and WHEREAS, continuing to pay per diem causes a drain on the state general fund; and WHEREAS, the termination of per diem expenditures is necessary to decrease the drain on the state general funds; and WHEREAS, the purpose of this order is to withhold appropriations and limit expenditures for per diem for members of boards and commissions in the executive branch; NOW, THEREFORE I, BOBBY JINDAL, Governor of the State of Louisiana, by virtue of the authority vested by the Constitution and laws of the State of Louisiana, do hereby order and direct as follows: SECTION 1: That all expenditures for per diem to members of all boards, commissions, authorities, task forces or committees in the executive branch of government which are made by the General Appropriation Act be, and the same are hereby, terminated. SECTION 2: The commissioner of administration is hereby empowered to withhold all appropriations for the per diem expenditures subject to this order and is directed to develop procedures to terminate all such payments. SECTION 3: The following categories of members of boards, commissions, authorities, task forces and committees are herby exempted from the provisions of this executive order: 1. Elected members of boards, commissions, authorities, task forces and committees who are authorized by law to receive a per diem. 2. Members of boards, commissions, authorities, task forces and committees who are statutorily authorized and entitled to the payment of per diem on their own warrant. 3. The commissioner of administration is hereby authorized to grant such further exemptions as may be necessary due to extreme economic hardships which would otherwise result to a member of a board, commission, authority, task force or committee under Section 1 and 2 of this executive order. SECTION 4: This order shall supersede and rescind all prior executive orders not consistent herewith. SECTION 5: This order is effective upon signature of the Governor. 31 EXECUTIVE ORDER BJ Moratorium on Boards and Commissions Authority to Pay per Diems and Elimination of Certain Board WHEREAS, Executive Order BJ froze payment of a per diem to members of boards, commissions, and like entities funded by the General Appropriation Act. However, over the years, many boards, commissions and like entities that have been statutorily created in the executive branch of state government with budget authority do not receive annual appropriation approval via the General Appropriation Act; WHEREAS, more than 80 boards, commissions, authorities, task forces, advisory councils, committees, and like entities have been established with a statutory mandate requiring payment of a per diem; WHEREAS, approximately 300 additional boards, commissions, authorities, task forces, advisory councils, committees or like entities have been established that permit discretionary payment of per diems, are silent as to such payments but may grant implied budgetary authority to authorize such payments, or provide that no compensation shall be paid to members of such entities; WHEREAS, continuing to pay a per diem is a drain on state funds and places a fiscal burden upon individuals, businesses, or other entities that fund the operations of boards, commissions, or like entities; WHEREAS, a moratorium on the payment of a per diem is necessary to decrease this fiscal burden and is proper to ensure boards, commissions, authorities, task forces, advisory councils, committees, and like entities are functioning in a fiscally prudent manner consistent with those that are included in the General Appropriations Act; and WHEREAS, the purpose of this Order is to freeze per diem payments, withhold appropriations for per diem payments, and limit expenditures for a per diem in the executive branch of state government, which will result in approximately $275,000 savings this fiscal year; NOW THEREFORE I, BOBBY JINDAL, Governor of the State of Louisiana, by virtue of the authority vested by the Constitution and laws of the State of Louisiana, do hereby order and direct as follows: SECTION 1: Expenditures for per diem payments by members of all boards, commissions, authorities, task forces, advisory councils, or committees in the executive branch of state government are hereby suspended, including any that may hold funds in accounts other than the State Treasury, except as otherwise provided in this Order.
