1 Statutory Instrument 86 of [CONSTITUTION Proclamation 2 of 2013 PROCLAMATION by HIS EXCELLENCY THE HONOURABLE ROBERT GABRIEL MUGABE, G.C.Z.M., President of Zimbabwe Commer-in-Chief of the Defence Forces of Zimbabwe. WHEREAS, by section 63(4) of the existing Constitution, Parliament, unless sooner dissolved, shall last for five years which period shall be deemed to commence on the day the person elected as President enters office in terms of section 28(5); AND WHEREAS the five year period ends on the 29th June, 2013, on which day Parliament shall st dissolved in terms of the said section 63(4); AND WHEREAS it is provided by section 28(3) of the existing Constitution that an election to the office of President shall take place on the day or days fixed in a proclamation in terms of section 58(1) of the Constitution as the day or days on which elections are to be held for the purpose of electing members of Parliament members of the governing bodies of local authorities; Al~D WHEREAS it is provided by section 58(1) of the existing Constitution that an election to the office of President, general election elections of members of the governing bodies oflocal authorities shall be held on a day or days, immediately following its dissolution, that the President may fix by proclamation in the Gazette; AND WHEREAS it is provided by section 38 of the Electoral Act [Chapter 2: 13] that in a proclamation fixing a day or days for the holding of an election to the office of President, a general election elections of members of the governing bodies of local authorities the President shall provide for the matters required by the said section 38; 623

2 Proclamation 2 of 2013 AND WHEREAS it is provided by section 45C of the Electoral Act [Chapter 2: 13] that the nomination of party-list cidates for the Senate, then ational Assembly provincial councils shall take place on the same day venue as the nomination for the constituency National Assembly cidates; NOW, THEREFORE, under by virtue of the powers vested in the President as aforesaid, I do, by this proclamation- ( a) in relation to the election to the office ofpresidentreferred to in section 28(3) of the Constitution, determine that a nomination court shall sit on Thursday, the 28th June, 2013, commencing at 10 o'clock in the morning. in the High Court, Court A, Mapondera Building, Samora Machel Avenue, Harare; (b) in relation to the election of the two hundred ten members of then ational Assembly referred to in section 124(1)(a) of the new Constitution determine that a nomination court shall sit on Thursday, the 28th June, 2013, commencing at 10 o'clock in the morning, at-- (i) (ii) the MagistratesCourt,Court5,Tredgold Building, Leopold Takawira Avenue, Bulawayo, for the for election as members of the Na6onal Assembly constituencies situated in the Province of Bulawayo; Magistrates Court, Rotten Row, Harare, for the for election members of the National Assembly constituencies situated in the Province of Harare; (iii) the Magistrates Court,102-4,Main Street,Mutare, cidates for election as members of the National Assembly constituencies ~ituated in the Province of Manical; (iv) the Magistrates Court, Main Street, Bindura, cidates for elections as members of then ational 624

17 S.I. 86 of 2013 (f) for the purpose of section 120(1 )(b) (c) of the new Constitution, as read with section 38(3) of the Electoral Act [Chapter 2:13] section 35 of the Traditional Leaders Act [Chapter 29:17]- ( i) determine that the Provincial Assemblies of Chiefs shall meet on Friday, the 12th July, 2013, at the following times places to elect the following number of Chiefs to the Council of Chiefs- A. the Provincial Assembly of Chiefs for Manical Province shall be convened at the Chiefs' Hall, Mutare, at 10 o'clock in the morning for the purpose of electing five Chiefs representing the said province to be members of the Council of Chiefs; B. the Provincial Assembly of Chiefs for Mashonal Central Province shall be convenedatthenewgovemmentbuildings, Bindura, at 10 o'clock in the morning for the purpose of electing four Chiefs representing the said province to be members of the Council of Chiefs; C. the Provincial Assembly of Chiefs for Mashonal East Province shall be convened at the Mbuya Neha Hall, Marondera, at 10 o'clock in the morning for the purpose of electing four Chiefs representing the said province to be members of the Council of Chiefs; D. the Provincial Assembly of Chiefs for Mashonal West Province shall be convened at the Cooksey Memorial Hall, Chinhoyi, at 10 o'clock in the morning for the purpose of electing four Chiefs representing the said province to be members of the Council of Chiefs; E. the Provincial Assembly of Chiefs for Masvingo Province shall be convened at 639

18 Proclamation 2 of2013 (il) the Chief's Hall, Masvingo, at 10 o'clock in the morning for the purpose of electing five Chiefs representing the said province to be members of the Council of Chiefs; F. the Provincial Assembly of Chiefs for Matabelel North Province shall be convened at the Chiefs' Hall, Ntabazinduna, at 10 o'clock in the morning for the purpose of electing four Chiefs representing the said province to be members of the Council of Chiefs; G. the Provincial Assembly of Chiefs for Matabelel South Province shall be convened at the Government Buildings, Gwa,at 10 o'clockin the morning for the purpose of electing four Chiefs representing the said province to be a members of the Council of Chiefs; H. the Provincial Assembly of Chiefs for Midls Province shall be convened at the Chiefs' Hall, Senga, Gweru, at 10 o'clock in the morning for the purpose of electing five Chiefs representing the said province to be members of the Council of Chiefs; determine that the Council of Chiefs elected in terms of subparagraph (i) shall be convened at Mukwati Building, Harare, on Friday, the 19th July, 2013, at 10 o'clock in the morning for the purpose of electing the President the Deputy President of the Council of Chiefs, who shall be ex officio Senators; (iii) in relation to the election of the sixteen Chiefs referred to in section 120(l)(b) of the new Constitution, determine that- A. the electoral college constituted by the Provincial Assembly of Chiefs for 640

19 S.I. 86 of 2013 Manical Province shall be convened at the Chief's Hall, Mutare, on Friday, the 2nd August, 2013, at 10 o'clock in the morning for the purpose of electing two Chiefs to be Senators representing the said province; B. the electoral college constituted by the Provincial Assembly of Chiefs for Mashonal Central Province shall be convened at New Government Buildings, Bindura, on Friday, the 2nd August, 2013, at 10 o'clock in the morning for the purpose of electing two Chiefs to be Senators representing the said province; C. the electoral college constituted by the Provincial Assembly of Chiefs for Mashonal East Province shall be convened at Mbuya Neha Hall, Marondera, on Friday, the 2nd August, 2013, at 10 o'clock in the morning for the purpose of electing two Chiefs to be Senators representing the said province; D. the electoral college constituted by the Provincial Assembly of Chiefs for Mashonal West Province shall be convene at Cooksey Memorial Hall, Chinhoyi, on Friday, the 2nd August, 2013, at 10 o'clock in the morning for the purpose of electing two Chiefs to be Senators representing the said province; E. the electoral college constituted by the Provincial Assembly of Chiefs for Masvingo Province shall be convened at the Chief's Hall, Masvingo, on Friday, the 2nd August. 2013, at 10 o'clock in the morning for the purpose of electing two Chiefs to be Senators representing the said province; F. the electoral college constituted by the Provincial Assembly of Chiefs for 641
