1 CHAUDFONTAINE NEWSLETTER Newsletter 26 January 2017 Commission Union External Action Service Parliament Export Control Forum 2016: The Commission, in cooperation with the Slovak Presidency of the Council of the EU, held the 2016 Export Control Forum on 12 December 2016 to provide an opportunity to discuss the proposal's key changes to EU export controls presented on 28 September The Forum brought together export control officials from EU institutions and Member States with industry associations and exporters, manufacturers and other economic operators involved in production or trade of dual-use items, as well as representatives of civil society and academia. Report and documents: Commodity nomenclature dual-use (CN-DU) codes: On 16 January 2017, the EU Commission published an updated correlation table of the CN-DU codes. Available: Restrictive measures: On 10 October 2016, the Union updated restrictive measures against the Democratic Peoples Republic of Korea. Link: Statement by Federica Mogherini: The High-Representative of the Union for Foreign Affairs and Security Policy, Federica Mogherini, released a statement on 16 January 2017 on the first Anniversary of the Implementation of the JCPOA with Iran. Document: Annual report on the implementation of the Regulation: On 24 August, the Commission published its Annual Report to the Parliament and to the Council on the implementation of Regulation 428/2009. Document: Conflict minerals legislation: On 22 November, Parliament negotiators clinched the final deal with the Council and Commission on the legal framework for
2 Nuclear Suppliers Group curbing the trade in conflict minerals. The new law will clean up mineral and metal trade by enhancing due diligence obligations in sourcing tin, tungsten, tantalum and gold, essential for consumer electronics. Increased traceability in mineral-supply chains will contribute to breaking the link between trade and armed conflict. Information: Legal developments: International Updates of the guidelines: The NSG Part 1 and Part 2 Guidelines were revised and published on 8 November 2016 on the IAEA website as INFCIRC/254/Rev.13/Part 1 and INFCIRC/254/Rev.10/Part 2. Link: United Nations Security Council Resolution 2325(2016): On 15 December 2016, the UN Security Council adopted the Resolution 2325 (2016). It confirms the objectives pursued by Resolution 1540(2004), the action of the 1540 Committee and notably insist on the importance of establishing controls on technology transfers, the challenge represented by non-state actors and encourages the adoption of control lists by the Member States. Available: Wassenaar Arrangement OPCW MTCR Plenary meeting: The twenty-second Plenary meeting of the Wassenaar Arrangement was held in Vienna on 6-8 December The Participating States notably adopted new export controls in a number of areas, adopted updated Best Practices for Effective Legislation on Arms Brokering and updated Best Practices for Effective Enforcement and maintained informal contacts with the Nuclear Suppliers Group (NSG) and the Missile Technology Control Regime (MTCR) on control list issues. Updated control list: Best practices (arms brokering): Best practices (enforcement): Final statement: Conference of the States Parties: The 21 st Conference of the States Parties of the Organisation for the Prohibition of Chemical Weapons was held from 28 November to 2 December Report: Plenary meeting: The Missile Technology Control Regime (MTCR) held its 30th Plenary week in Busan from 17th to 21st October 2016 with India as a new partner. Partners notably expressed concern associated with global missile proliferation activities in particular
3 Australia regarding ongoing missile programs in the Middle East, Northeast Asia, and South Asia, which might fuel missile proliferation activities elsewhere, as well as concern associated to additive manufacturing or 3D-printing technology. Link: Members works Chaudfontaine Group: The seventh edition of the Chaudfontaine Group was held from 8 to 10 January 2017, in Chaudfontaine, with the support of DG DEVCO of the Commission and focused on Incentives of non-proliferation outreach activities: actors and rationale. The objective of the seminar was to debate WMD dual-use goods trade control outreach activities, also in the light of the Commission s proposal for a new EU dual-use legislation, which makes a clear link between the internal and external dimensions of dual-use trade controls.
