1 Law Law is defined as the set of enforced rules under which a society is governed, and no society can exist without law. This department offers a curriculum which provides an in-depth study of general and special circumstances of everyday life which can cause conflicts among the members involved and of various ways to resolve these conflicts. During their of study, students acquire professional knowledge of the established laws and learn to apply their knowledge to actual situations. Such training helps students develop good judgment and an analytic mind, which are essential not only in the legal profession but also in many other fields. The study of existing laws enables students to resolve various legal problems in real life and provides the groundwork for inventing new laws which are necessary. In today's society, where the law defines a person's rights and obligations, and where all human conduct is governed by the law, conflicts among members in society must be resolved through the legal system. The educational goal of this department is to make students understand the principles behind the establishment and application of law. In addition to the primary goal of providing the general knowledge of law and its application through the case method, the department aims to foster professionals who will work in the field of law or other related fields. It is also one of the department's goals to produce scholars who will pursue the study of justice in a legal system and ensure the existence and establishment of just laws. The Goals of Education: 1. 3 Introduction to Law, 3-3 The purpose of this is to introduce students to law and legal studies. In this, students will outline the types of matters regulated by current law. Principles of Civil Law, 3-3 This will look at general principles commonly applicable to civil law in general, which serve as a foundation not only for civil law, but for the study of law in general. Several subjects dealt with in this are the significance of fundamental principles and rights, and the causes of changes to these rights, particularly legal conduct. Seminar in Field, 2-2 In this, those who graduated from Soongsil University College of Law and have gotten on in the world are invited. These alumni/alumnae will make a speech on how they studied law in their college years, how they prepared for getting good jobs, and how they overcame difficulties in their lives. Constitutional Law 1, 3-3 In this, student will acquire a good understanding of the Constitution. The topics will include the fundamental rights and general principles of the Constitution and governmental structure. s Principles of Criminal Law, 3-3 This will touch on the fundamental concepts of crime and its consequences. This is designed for students to understand crime and its legal consequences as constituted under criminal law. It will cover such topics as the principle of legality, the applicability of constituent requirements which are the essential elements of crime, illegality, responsibility and complicity, the theory of attempted crime, and the theory of punishment. Legal Philosophy, 3-3 This will review the fundamental issues of law, and will cover the achievements and thoughts of legal philosophers and provide the opportunity for students to think independently and to offer their own opinions on various fundamental topics of positive law. Principles of Commercial Law, 3-3 This will deal with general provisions which apply to different kinds of commercial conduct, including concepts of commercial law. In this, students will acquire an overall understanding of commercial transactions. Constitutional Law II, 3-3 This will examine topics such as the theoretical basis and system of the governmental structure, the composite principles of government organs, the form of government structure, the functions of the nation and state sovereignty, and the individual functions of state organs of a constitutional nature. Principles of Law of Obligations, 3-3 This will be a lecture on the general theory of the law of obligations including contracts and torts. This will cover the formation of contracts, the general rules governing the parties to a contract, the termination of contracts, the types of obligation, the protection of creditor's interests, duties, the assignment of claim, and the discharge of obligation. Special Part of Criminal Law, 3-3 This will analyze various forms of crime regulated under criminal law by interpreting and applying the 160 Soongsil University Catalog

4 individual constituent elements of these crimes. The crimes that will be dealt with in this will be crimes against the individual, crimes against the nation, and crimes against society such as arson. Readings in German Law, 3-3 The purpose of this is to improve the ability of students to read materials related to German law. Texts of this will be certain basic pieces chosen from German literature to be examined in this. Law and Society, 3-3 The study of law is a social phenomenon. This approaches law as the totality of norms governing our actions. It explores how social conditions influence law making and law enforcement. Special Part of Law of Obligations, 3-3 topics of this will include the general theory of the law of obligations including contracts and torts. The covers the formation of contracts, the general rules governing the parties to a contract, the termination of contract, types of obligation, the protection of creditor's interests, duties, the assignment of claims, and the discharge of obligations. Corporation Law, 3-3 This will deal with legal issues concerning corporations. topics covered will be the significance and types of corporations in existence, merger and dissolution orders applicable to all corporations, the organization and activities of merges, joint corporations, stock corporations and limited companies, and foreign corporations and penalties. International Law 1, 3-3 This will discuss the basic theory of international law by examining the role of the International Court of Justice, the relationship between international law and domestic law, the significance and rights and obligations of nations, the law of the sea, and the status of individuals. Criminal Procedure, 3-3 This aims to increase the understanding of students in relation to the rights and obligations of the subject of criminal proceedings, the constitutional and criminal proceedings, and the constitutional and criminal procedural process for the rightful exercise of the nation's right to punish. College of Law Law Readings in Anglo-American Law, 3-3 This aims at fostering the ability of the students to select materials on their own initiative and understand Anglo American law, together with an outline of background knowledge relevant to this area. Seminar on Constitutional Law, 3-3 Through this student will acquire the ability to interpret and apply the constitution on the basis of prior knowledge of constitutional interpretation and relevant theories. This will examine the texts of various constitution-related cases that reflect the vitalized trends of the Constitutional Court. Labor Law 1, 3-3 This will focus on individual labor-related laws by concentrating on the basic structure of labor law, the basic rights of laborers, and the specific contents of the Labor Standards Law. 161

5 Administrative Law 1, 3-3 This will examine the basic principles of administrative law and legislation. topics are the administration itself, and basic concepts of administrative law, administrative legal relationships, the law of administrative procedures, and the effectiveness of administration. Law of Bills, Notes, and Cheques, 3-3 This will deal with legal issues on negotiable instruments and differences among the bills of exchange, promissory notes, and cheques. Law of Real Property, 3-3 This will concentrate on the fundamental principles of civil law. This will also deal with the value of the right of ownership, the right of actual possession, the transfer of the right of ownership, and security rights. International Law 2, 3-3 This will be provided as a continuance of International Law 1. This will examine topics such as the settlement of international disputes, the use of armed force in international disputes, the use of armed force in international society, and international economic law. Civil Procedure 1, 3-3 This will begin with an analysis of what is known as the essential elements of litigation. Also, this will look at actual court procedures which affect legal proceedings from the moment of the institution of the action. Seminar on Criminal Law, 3-3 With this, students will enhance their ability to interpret and apply the provisions of the Criminal Code by studying specific cases and rulings in the field of criminal law in general. Labor Law 2, 3-3 This will focus on laws regarding labor and management relationships between labor unions and management groups. The main topics will be labor unions, group negotiations, group settlements, unfair labor actions, the management of labor disputes, and labor management agreements. Administrative Law 2, 3-3 In this students will undertake a detailed examination of administrative organizations and actions. The major topics are the law of administrative organization, the law of state administrative organization and the law of local governance, as well as the law regulating the conduct of public officials. Insurance Law & Maritime Law, 3-3 This will deal with insurance in general and the Insurance Contract Law provided for in Part IV of the Commercial Code. Also, this will examine legal principles regarding maritime transport, including laws regarding the collision of vessels, sea-rescues, and limits on the liability of transporters. Family & Inheritance Law, 3-3 This will examine the meaning and constitution of the family by focusing on legal provisions relating to domestic relations. It will cover such topics as marriage, the father-son relationship, and adoption. It will also examine the system of inheritance. 162 Soongsil University Catalog

6 Civil Procedure 2, 3-3 This is provided as a continuance of Civil Procedure 1. The major topics of this will include evidence law, appeal procedures, and the termination of procedures. Criminology, 3-3 This will include the study of crimes and criminals as the object of criminal policy, by analyzing the institutions, effects, and methods of improvement of the current criminal law system as well as crimes and their causes. International Economic Law, 3-3 This will provide students with a basic understanding of the trade regulations and the legal resolution of trade disputes between nations based on international economic norms centering on the GATT/WTO system. Topics will be the basic IMF, OECD, and other international economic organizations. Additionally, it will examine issues regarding the relations between international trade laws and laws regarding investment, environment, and competition. Anglo-American Law, 3-3 This will introduce students to Anglo-American law which is, together with continental law, one of the two major streams of law in the world. Topics in this will include the historical origins, features, and basic concepts of Anglo-American law. Economic Regulation and Consumer Law, 3-3 In this students will learn about economic law which is applied in market economies created by free and fair competition among market participants. This will focus on the regulation of monopolies, fair transactions, and laws related to consumer protection. International Private Law, 3-3 This will look at the nature and scope of international private law, the structure of conflict rules, nationality and domicile, and the doctrine of renvoi. Legal History, 3-3 Legal history is the process of change in the development of law such as from primitive societies to its present-day complexity, which provides the basis of ordered social interaction. This will examine the historical development of legal thinking and legal consciousness in Korea. College of Law Law Tax Law I, 3-3 Tax law is one of the most important fields of law. This will discuss fundamental principles regarding the creation-establishment conclusion and revision-extinction of taxation liability. Civil Execution Law, 3-3 In this students will study laws concerning the enforcement of injunctions and other procedures for temporary seizures/disposals that are necessary to give effect to rights relating to financial and other debts. Seminar on International Law, 3-3 The purpose of this is to examine the judgments of the International Court of Justice regarding international incidents. 163

7 Seminar on Civil Law, 3-3 The purpose of this subject is to provide practical knowledge of civil law by reviewing various legal cases which are or will be dealt with in the courts. International Transactions Law, 3-3 This will give students a systematic understanding of private legal issues relating to international commercial transactions. This will cover international contract law, the payment system, international carriage and finance, and commercial arbitration for international dispute settlement. Environmental Law, 3-3 From both theoretical and practical perspectives, this will examine how current law deals with the issue of environmental protection, the effectiveness of legal systems for environmental protection, and ways in which to solve legal problems arising from environmental pollution. Tax Law 2, 3-3 This is as continuance of Tax Law 1. This will examine the individual items of taxation, such as income tax, corporate tax, value-added tax, taxation problems in respect to the international environment, and the objection procedure appropriate in the case of objections regarding measures of tax administration. Intellectual Property Law, 3-3 Intellectual property law consists of copyrights, patents, utility models, industrial designs, trademarks, computer program protection laws, and trade secrets laws. Through examination of the differences between industrial property law and copyright law, this will deal with the role of the patent office and the requirements of patent registration and the like. Seminar on Commercial Law, 3-3 This will concentrate on an examination of various cases which involve commercial law issues. The purpose of this is to improve the students' ability to identify and analyze contentious issues in commercial law. Seminar on Administrative Law, 3-3 This subject aims at highlighting the dynamic nature of administrative law. In this students will acquire a practical understanding of the concepts and theories of administrative law through presentations and debates by reviewing specific cases and various rulings. Seminar on Labor Law, 3-3 The will examine important legal cases. Various issues arising from actual employment disputes will be discussed in depth. Seminar on Civil Procedure, 3-3 This will look at the application of various methods of civil procedure through an examination of actual disputes, in order to promote the ability of students to solve legal problems that actually arise in civil litigation procedure. 164 Soongsil University Catalog
