1 Southern Tasmanian League Clearance and Permit Policy AIM: To strengthen Inter (Southern Region only) Clearance Transfer requirements. Background: The Southern Tasmanian League (STBL) has been involved in discussions with all stakeholders. This included consulting interested parties in order to develop a Strategic Plan which provides direction and a clearer vision for the South. As a result of the various discussions, it became clear that the STBL needed to provide a stronger framework surrounding the current clearance transfer requirements. Structure: There are twelve s affiliated with the Southern Tasmanian League. Of these, eleven s administer rosters for their members. These s are: AYC Mens Business Houses City of Clarence Greater Hobart Hobart Chargers (incorporating the Senior League) Kingborough Moonah New Norfolk District South East Southern Tasmanian Womens Wellington The Southern Tasmanian Officials is responsible for the training and support of the various officials involved with the game in Southern Tasmania. There are two s in Southern Tasmania which have under pinning s. City of Clarence has three s: Cavaliers Dominoes Lauderdale

2 Greater Hobart has four s: Breakers Grenadiers Kingston Kings Phoenix It is important to note that currently the Kingston Kings are a which under pins the Greater Hobart and not the Kingborough. The Senior League sits as a separate committee under the Hobart Chargers Board. The Senior League currently has both and based teams entered into their roster and does not have its own clubs under pinning this League. A visual representation of the current structure can be found at Appendix C. Framework: The STBL is responsible for the approval of all Inter Clearances and Permits. To support this, an individual who wishes to permit or clear from their first registered to another, regardless if the relevant teams are participating in the same roster, is required to submit the relevant documentation, outlined below, to the STBL for approval. Where the request is for clearance, in addition to the Tasmania Clearance / Permit Form, an Exit Interview Questionnaire has been developed to support this process and is found at Appendix B. This Questionnaire has been designed to capture the reasons for player movement and assist the STBL to identify any issues which may be present. This information will be utilised by the STBL to support and assist s and their s to appropriately address concerns in a timely manner. The STBL will consider each application for transfer on a case by case basis and may, on occasions, seek more information in order to arrive at suitable and sensible outcomes that ensure Transfers are in accordance with suitable etiquette standards and are in accordance with Tasmania s By-Laws and Constitution. Note also that the STBL will not approve Player Transfers mid season, except for exceptional circumstances and that the STBL will approve of only one Transfer per player per calendar year.

3 Requirements: The STBL requires the documentation listed below, before it will consider the application for transfer for any individuals from one to another within the Southern Tasmanian Region. 1. A properly completed Request for Transfer from the individual on the Tasmania s Official Clearance / Permit Form. (Appendix A) This is also available under the resource library at 2. A copy of the written request from the individuals new to the current seeking the transfer of the individual. The request should state the reasons for seeking the possible services of the transferring individual and must be made using the s official letter head and signed by the President and Secretary of the. Under no circumstances will the STBL tolerate any contact what so ever until a formal written request has been completed. 3. Where a clearance is requested, a copy of the STBL approved Exit Interview Questionnaire. This is to be completed by the individual, or in the case of a junior, their parent and submitted directly to the STBL. (Appendix B) 4. s and s may add their own comments which should be attached to the Tasmania Clearance / Permit Form and then submitted to the STBL. 5. s and s should not unreasonably delay responding to requests. 6. s should note that if the correct documentation is not in order then the STBL will not process the application for transfer. 7. s and s need to support the individual making the request by providing information in order for them to access the required forms. This can be in the form of directing the individual to a web address. Timeframe: 1. The STBL will approve requests for Clearance / Permit on a monthly basis. 2. During times of heavier workloads, usually January and February, the STBL may meet more often to approve these requests. 3. s need to consider and make allowance for these timeframes in order to not unduly disadvantage the individuals making the requests. Approval or Rejection of Requests: 1. If the request is approved, the STBL will provide the Secretary of the previous and new a copy of the Tasmania Clearance / Permit Form with the Regional Endorsement section completed. This may be delivered in electronic format.

4 2. The request has not been approved until the endorsed Tasmanian Clearance / Permit Form has been received by the new. 3. If a request is not approved, the STBL will write to the individual to advise the reasons why. A copy of this will be provided to the relevant s. 4. If the request is not approved, the individual may contact the STBL, in writing, in order to request a review of the decision. This request must state the reasons why you feel the decision should be overturned. These requests will be treated with priority. 5. There are further appeal avenues available once step 4 has occurred. This will be communicated to you should your request for review not be successful. 6. The STBL written response includes electronic correspondence. Implementation: This policy takes effect once it has been ratified by the STBL Board of Management. This is expected to occur on the 22 nd of December Once ratified, all existing Inter Clearances and Permits which have been held over due to the moratorium, will be assessed according to this policy. In practical terms, these members will need to be contacted by the they wish to clear to and provided with a copy of the Exit Interview Questionnaire. Members should be advised to complete this questionnaire as soon as possible and submit this directly to the STBL. s will need to provide written requests to the clearing along with a completed Tasmania Clearance / Transfer Form as per this policy. Review: This policy will be reviewed in November / December The STBL may review this policy earlier if it deems it necessary. The review will be conducted with a view to improve and refine the process and policy.

5 Appendix A This form is to be used for all clearances and permits within Tasmania and for clearances from Tasmania. The following procedure must be followed: 1) Clearance/permit applications must, in the first place, be submitted to the club. Such clearances/permits must be signed by the applicant, by the applicant s parent or guardian (if under 18) and endorsed by the club president and secretary and forwarded to the association. 2) clearances/permits must be signed by the association president and secretary and forwarded to the region. 3) Intra-state clearances/permits and interstate clearances must be endorsed by the regional secretary/general manager and forwarded to Tasmania. Interstate clearances will then be endorsed by Tasmania and forwarded to the state to which the clearance is granted. Please refer to detailed instructions on reverse side. 6 BASKETBALL TASMANIA CLEARANCE AND PERMIT REGULATIONS The following are extractions from By-law No. 11. Full details are contained in Clause 49 of the Constitution and in By-law No Where the clearance or permit is from one club to another within the same association, the signature of both the club President and Secretary shall be evidence of its approval by the club. It shall then be submitted to the association for acceptance or otherwise Where the clearance or permit is from one association to another within the same region, the signature of both the association President and Secretary shall be evidence of its approval by the association. Where the person seeking the clearance or permit is a member of a club within the association, the club President or Secretary shall approve it prior to its submission to the association. Following its endorsement by the association, it shall be submitted to the region for acceptance or otherwise Where the clearance or permit is from one region to another within Tasmania, the signature of the Regional Secretary/General Manager shall be evidence of its approval by the region which shall only be given following approval by the club (if appropriate) and association. Following its endorsement by the region, it shall be submitted to the region to which the person wishes to be cleared or permitted and a copy shall be submitted to Tasmania Persons wishing to play in another state or overseas shall only be granted a clearance. Interstate or international permits will not be issued Where the clearance is to another state or overseas, it shall be dealt with in accordance with Australia and FIBA regulations. The signature of the Regional Secretary/General Manager shall be evidence of its approval by the region which shall only be given following approval by the club (if appropriate) and association. Following its endorsement by the region, it shall be submitted to Tasmania for approval and subsequent action. Appendix A WHAT DOES THIS REALLY MEAN? Essentially, it means that a clearance for someone moving from one country to another requires the approval of the country from which the person is moving. A clearance issued by the person s club is not sufficient. Similarly, a person moving from one state to another within Australia requires state approval and from one region (South, North or North West) to another within Tasmania, requires regional approval (with a copy being forwarded to the state). In each of these cases, a club or association clearance is not enough. Permits from region to region are treated in exactly the same way except that permits will have conditions attached and may be withdrawn by the issuer at any time. Australia regulations do not allow a player to be registered in two states concurrently and thus, interstate permits are not a consideration. Note that although region-to-region clearances and permits are approved at regional level, a copy is to be forwarded for the record to Tasmania as in section 11.4 of By-law 11. Finally, please note section 11.7: A person who has been cleared from one club or association to another within Tasmania may not be cleared again within three months of the date of the original clearance unless the express approval of Tasmania is first obtained. And section 11.9: Clause 49.7 of the constitution allows for a person who has been unregistered for one year or more, to transfer without a clearance. Unless a player formally cancels their registration in writing to Tasmania, their registration is deemed to have lapsed on 31 st December in the year in which they last registered or at the conclusion of the last competition in which they played, whichever is the later. However, a player who owes money or property, or is contracted may have their registration refused, despite having been unregistered for one year or more.
