16 RULES OF SUPERINTENDENCE RULE 12 (E) (2) Rule 12 (E) (2) of the Rules of Superintendence provides as follows: Multiple defendants or charges in criminal cases, including traffic cases, all defendants shall be assigned separate case numbers. Where a defendant is charged with a misdemeanor and traffic offense, the defendant shall be assigned one case number. The category selected for the case number and its case type designator shall be that of the offense having the greatest potential penalty. 44 Painesville Municipal Court Probation Department 2016 Mission Statement To enhance community safety through enforcement of Court orders while striving to empower individuals and change lives. The Painesville Municipal Court Probation Department Employees continue to accomplish the department s mission and goals. Although every year brings about new challenges, the probation department continues to flourish and generate positive outcomes not only for the offenders, but for the community we serve. In the year 2016, the probation department received one thousand two hundred seventy-nine (1,279) new cases to supervise. One hundred forty-nine (149) cases were referred to the Pre-trial Diversion program, providing the eligible offender the opportunity to have the charge(s) dismissed after fulfilling court requirements. Thirty-two (32) written presentence investigation reports were also completed by the probation department in Per Ohio Revised Code , the Court continues to require an offender placed under the control and supervision of the probation department to pay a monthly supervision fee of twenty dollars ($20.00). In the year 2016, one hundred five thousand, seven hundred eighty-six dollars and ninety-six cents ($105, ) was collected. The supervision fees were utilized for specialized staff, purchase of equipment, treatment programs for probationers and state mandated continuing education for staff. The Court also provides house arrest, ignition interlock devices and SCRAM (Secure Continuous Remote Alcohol Monitor) as tools for the probation department to supervise offenders. In the year 2016, forty-six (46) offenders served one thousand three hundred thirty (1,330) days on house arrest. Thirty-two (32) offenders served one thousand four hundred sixty-six (1,466) days of house arrest under the Court s Jail Diversion program (state funded house arrest) and seven 37
45 (7) offenders served four hundred sixty-four (464) days of house arrest as a requirement of bond supervision. Also in the same year, thirty-two (32) offenders had the ignition interlock device installed on their vehicle in order to utilize limited driving privileges. In regards to SCRAM, in the year 2016, thirty-nine (39) offenders were monitored for a total of two thousand nine hundred twenty-seven (2,927) days (each offender served an average of seventy-five (75) days on SCRAM). It should be noted out of the two thousand nine hundred twenty-seven (2,927) days of SCRAM monitoring, there were two thousand nine hundred thirteen (2,913) sober days, a 99.5% success rate. A sanction the Court continues to aggressively use for offenders is supervised community service work. Last year three hundred seven (307) offenders completed five thousand six hundred eighteen (5,618) hours in the Court s Community Service Work program. The offenders are required to work under the authority of health districts, park districts, counties, municipal corporations, townships and charitable organizations. In October of 2016, Judge Mike Cicconetti finished his twenty-second (22 nd ) year of operating the Painesville Municipal Court Garden. Under the guidance and supervision of Walter R. Siegel, non-violent offenders sowed, tended and harvested the one (1) acre garden located at 3740 Center Road in Perry Township. The plants were again donated by numerous local nurseries (Middle Ridge Gardens, Secor Nursery, Sabo s Nursery and Gilson Gardens) and an assortment of vegetables were picked (4,608 green peppers, 66 cabbage, 13 squash, 339 cucumbers, 190 zucchini, 157 eggplant, 124 baskets of tomato s, and 411 dozen of sweet corn) and donated to the Salvation Army, Madison Food Bank, Perry Food Bank, Teen Challenge, Madison Senior Center and Perry Senior Center. Painesville Municipal Court staff continues to be active with various professional organizations such as Ohio Chief Probation Officers Association, American Probation and Parole Association, Northeast Ohio Probation Officer s Association and the Lake County Corrections Board. The probation staff attended the American Probation and Parole Association 41 st Training Institute in Cleveland, Ohio from August 29, 2016 to August 31, On December 9, 2016, Probation Officer s Ivonne Brickell and Angela Turner completed the training required and passed a written examination in the use of the Taser X26P Conducted Electrical Weapon.
