4 LOCAL LAW #2 OF 2015 PARKING LAW (REVISED) TITLE This law shall be known as the Parking Law (Revised) forthe Village of Tannersville. LEGISLATIVE INTENT In consideration of public health, safety and vvelfare, it is necessary for the Village Board of the Village of Tannersville to restrict parking on certain streets in order to facilitate vehicular travel and access for emergency vehicles including fire trucks, ambulances, and police vehicles. AUTHORITY This Local Law is expressly adopted pursuant to the relevant sections of the New York State Village Law and the New York State Municipal Home Rule Law. REVOCATION OF PRIOR ORDINANCES/LAWS All prior ordinances and/or laws relating to parking in the Village of Tannersville including the ordinances/laws of 1959,1969,1971,1976,1978,1980,1984, 2001, and 2010 are hereby revoked and repealed and superseded. SEVERABILITY In the event that any section, clause or portion of this Law shall be held invalid by a court of competent jurisdiction, such holding shall not affect the validity of the remaining sections of this law. EFFECTIVE DATE This law shall take effect upon filing with the Secretary ofstate. MAIN STREET PARKING Parking is permitted on the South side of Main Street as limited and prohibited below: i. Parking is limited to two hours on the South Side of Main Street from the intersection of South Main Street West to the traffic light at the intersection of Railroad Avenue (a.k.a. Depot Sti-eet, a.k.a. the Dugway) ii. Parking is prohibited between the hours of 5:00 am to 6:00 am. iii. iv. Parking is prohibited on the bridge crossing Allen Brook. Parking is prohibited on the South Side of Main Street from South Main Street East to the Village Line. V. Parking is prohibited on the South Side of Main Street from the traffic light at the intersection of Railroad Avenue (a.k.a. Depot Street, a.k.a. the Dugway) West to the Village Line.
5 B. Parking is prohibited on the North side of Main Street along its entire length from Village Line to Village Line. 8. PARKING PROHIBITIONS - BOTH SIDES OF THE STREET Parking is prohibited on both sides ofthe street on the following streets: A. Grays Lane B. Spruce Street C. Lakeview Avenue D. Church Street E. Hill Street (county Route 23C) to Village Line F. Spring Street Extension -from Sylvanside Avenue North to Village Line G. Railroad Avenue(a.k.a. Depot Street, a.k.a. the Dugway) - from the intersection of Main Street at the traffic light to the intersection of South Main Street H. South Main Street 9. Parking Prohibitions - Intersection of Railroad Avenue (a.k.a. Depot Street, a.k.a. the Dugwav) and South Main Street Parking is prohibited on the triangle formed by the intersection of Railroad Avenue (a.k.a. Depot Street, a.k.a. the Dugway) and South Main Street. 10. PARKING PROHIBITIONS - ONE SIDE OF THE STREET Parking is prohibited on one side of the following streets as set forth herein: A. East Side of Spring Street B. West Side of Spring Street from intersection of Fromer Street to Main Street C. South Side of Sylvanside Avenue D. East Side of Park Lane E. South Side of Fromer Street F. East Side of Tomkins Street G. West Side of Renwick Street H. West Side of Raspberry Lane I. South Side of Penrose Avenue (a.k.a. South View Avenue, a.k.a. Penrose Park) J. North Side of Sunset Avenue K. North and East Side of Lake Road
6 11. PARKING PROHIBITIONS - INTERSECTIONS AND FIRE HYDRANTS A. There shall be no parking within seventy (70) feet of any intersection with in the Village of Tannersville. B. There shall be no parking within 15 feet ofa fire hydrant in the Village of Tannersville VILLAGE PARKING LOTS I A. Overnight Parking 1. Overnight parking is prohibited in the Municipal Parking lot located by. Tannersville Post Office. 2. Overnight parking is prohibited in the municipal lot located in the center ofthe Village (a.k.a. Pugliese Plaza) except where authorized by permit only, and the municipal lot located between Tompkins Street and Church Street except where authorized by permit only. Residents must apply to the Village Clerk's Office for said permit, which must be visible in their vehicle and will be valid for one year. B. Parking is prohibited in all municipal parking lots from November 1** to April 30*'' between the hours of 5:00 am to 9:00 am. ; C. Commercial vehicles are prohibited from parking in all municipal lots. 13. TOW-AWAY ZONES ; All "No Parking" areas shall be and hereby are declared Tow-Away Zones. Vehicles illegally parked may be towed. All towing charges shall be borne solely by the owner or operator of the motor vehicle, and shall be in addition to any fines orother penalties. 14. HANDICAPPED PARKING SPACES,, All vehicles parked in designated handicapped parking spaces, must have the handicapped license plates or a permit prominently displayed from their rear view mirror. THE FOLLOWING PARKING AREAS/LOTS HAVE DESIGNATED HANDICAPPED PARKING SPACES: a. Municipal Parking Lot-2 located at eastern entrance off of Tompkins Street, 1 located at ' municipal walkway to Veterans Monument b. Municipal Parking Lot (a.k.a. Pugliese Plaza)-1 at Entrance to lot I c. Main Street Parking Space in front of Kaaterskill United Methodist Church (315 feet East of Park Lane, 100 feet West of Fromer Street) d. Post Office Parking Lot.-1 Space East of Entrance 15. SNOW EMERGENCY - SNOWTIRES AND CHAINS ' I A. During the months from November 1^* to May 1^' and during any snow storm, the Village Board, may declare a snow emergency. During the Snow emergency, parking is prohibited on all streets, roads and parking lots within the Village of Tannersville. B. Any motor vehicle driven or parked in the Village of Tannersville during the period \i November l^^o May 1'* and are not equipped with snow tires, chains or their
7 16. VIOLATIONS equivalent shall be in violation of this law in the event that such vehicle becomes snowbound. A. Any persons with Violations for unpermitted parking in handicapped designated spaces shall be a minimum of one hundred dollars ($100.00) and a maximum of two hundred fifty dollars ($250.00). B. Any person violating all other sections of this Law shall be guilty of a Violation and shall be subjectto a fine not to exceed Fifty Dollars ($50.00) for the first Violation; One Hundred dollars ($100.00) for the second violation within six months; Two hundred fifty dollars ($250.00) for a third violation within six months.
