EXPLANATORY NOTES This enactment consolidates Canada's drug control policy to fulfil Canada's international obligations under the Single Convention on Narcotic Drugs, the Convention on Psychotropic Substances and the relevant portions of the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances. This enactment repeals the Narcotic Control Act and Parts III and IV of the Food and Drugs Act. The major elements of the enactment are as follows: 1. The provision of a framework for the control of import, production, e~port, distribution and use of substances that can alter mental processes and that may produce harm to health and to society when distributed ar used without supervision. Apart from controlling scheduled substances, the enactment provides far the control of non-scheduled substances if they fall within the parameters of the enactment; 2. The provision of mechanisms to ensure that the export, import, production, distribution and use of internationally regulated substances are confined to medical, scientific and industrial purposes. 3. The provision of enforcement measures available to police and to the courts for the interdiction and suppression of unlawful import, export, production or distribution of controlled substances and for forfeiture of any property used or intended to be used in the commission of such offences. NOTES EXPLICATIVES Le texte a pour objet d'unificr la politique canadicnne de reglementation des drogues ufin de pcrmettrc au Canada de remplir les obligations intcrnationales qui lui incombent dans Ie cadre de la Convention unique sur les stupejiants et de la Convention slir les substances psychotropes ainsi que celles qui decoulent de la Convention des Nations Unies contre Ie trajic illicite des stupejiants et des substances psychotropes. Sa mise en vigucur a pour effet d'abroger la Loi sur les stupefiants ainsi que les parties III et IV de la Loi sur les aliments et droglles. Ses principaux elements sont les suivants : I. instaurer un cadre souple permettant de reglementer I'importation, la production, I'exportation, la distribution et I'utilisation des substances qui peuvent alterer les processus mentaux et Clvoir des effets nuisibles sur la sante et la societe lorsqu'elles sont distribuees ou utilisees sans surveillance: c'est ainsi que Ie texte permet de reglementer non seulement les substances cnumen:es aux differentcs annexes mais aussi cclles qui correspondent aux criteres qu'il fixe: 2. prevoir des mecanismes Iimitant Ii des applications medicales, scientifiques et industriellcs I'exportation, I'importation, la production, la distribution et I'utilisation des substances soumises Ii la reglementatian internationale; 3. fournir les moyens aux services de police et aux tribunaux pour reprimer et supprimer I'importation, l'exportation et Ie trafic illicites des substances designees et pour confisquer tout bien ayant servi ou donne lieu a la perpetration de telles infractions ou qui est destine a servir a une telle fin.
