4 904 THE SASKATCHEWAN GAZETTE, DECEMBER 13, 2013 SASKATCHEWAN REGULATIONS 101/2013 The Alcohol and Gaming Regulation Act, 1997 Section 185 Order in Council 667/2013, dated December 4, 2013 (Filed December 5, 2013) Title 1 These regulations may be cited as The Alcohol Control Amendment Regulations, R.R.S. c.a Reg 6, new section 71 2 Section 71 of The Alcohol Control Regulations, 2013 is repealed and the following substituted: Prohibited entertainment 71 No permittee shall permit or allow on the permitted premises or premises for which a special occasion permit has been issued any activity or entertainment in which: (a) (b) female or male genitalia are exposed; or female nipples are exposed. Coming into force 3(1) Subject to subsection (2), these regulations come into force on January 1, (2) If these regulations are filed with the Registrar of Regulations after January 1, 2014, these regulations come into force on the day on which they are filed with the Registrar of Regulations.

Règl. 6 des R.R.S. ch. A , nouvel article 71 2 L article 71 du Règlement de 2013 sur la réglementation de l alcool est abrogé et remplacé par ce qui suit : «Divertissement interdit 71 Le titulaire de permis ne peut permettre ou tolérer dans le lieu visé par le permis ou un lieu visé par un permis de circonstance toute activité ou tout divertissement au cours desquels sont exposés : a) les organes génitaux féminins ou masculins; b) les mamelons d une femme». Entrée en vigueur 3(1) Sous réserve du paragraphe (2), le présent règlement entre en vigueur le 1 er janvier (2) Le présent règlement entre en vigueur le jour de son dépôt auprès du registraire des règlements, si ce dépôt intervient après le 1 er janvier 2014.

8 908 THE SASKATCHEWAN GAZETTE, DECEMBER 13, 2013 SASKATCHEWAN REGULATIONS 103/2013 The Apprenticeship and Trade Certification Act, 1999 Section 26 Commission Order dated December 9, 2013 (Filed December 10, 2013) Title 1 These regulations may be cited as The Apprenticeship and Trade Certification Commission Amendment Regulations, R.R.S. c.a-22.2 Reg 4 amended 2 The Apprenticeship and Trade Certification Commission Regulations are amended in the manner set forth in these regulations. Section 3 amended 3 Section 3 is amended: (a) in clause (u) by striking out mechanic and substituting technician ; (b) (c) by adding the following clause after clause (v): (v.1) hydraulic crane operator ; and by adding the following clause after clause (rr): (rr.1) tower crane operator. Section 6 amended 4 Subsection 6(8) is amended by adding until the commission no longer requires them after custody of the commission. Section 7 amended 5 Subsection 7(8) is amended by adding until the commission no longer requires them after custody of the commission. Section 10 amended 6 Clause 10(2)(a) is repealed and the following substituted: (a) who possesses the qualifications that may be prescribed by a trade regulation. New section 24 7 Section 24 is repealed and the following substituted: Record books 24(1) For the purposes of the Act and in this section and section 31, record book includes a book or any other type of document used to record the progress and on-the-job performance of an apprentice. (2) The commission may, on the advice of a trade board, develop a record book for a designated trade and sub-trade.

9 THE SASKATCHEWAN GAZETTE, DECEMBER 13, (3) An employer or trainer of an apprentice must provide any information required by the commission respecting the work of the apprentice in the trade or sub-trade. (4) No person shall knowingly: (a) enter false information in a record book; or (b) alter an entry in a record book with the intent of falsifying the information recorded. Section 27 amended 8 Subsection 27(5) is repealed and the following substituted: (5) For the purposes of this section, if a journeyperson trade examination consists of both a written and a practical examination, an attempt at either the written or practical examination is to be considered an attempt at the journeyperson trade examination, and no person is to have more than eight attempts to pass, of which: (a) (b) not more than four are to be attempts at the written examination; and not more than four are to be attempts at the practical examination. Section 29 amended 9 Subsections 29(3) to (5) are repealed. Section 30 amended 10 Section 30 is amended: (a) by adding and after clause (c); (b) by striking out and after clause (d); and (c) by repealing clause (e). Section 39 amended 11 Subsection 39(5) is amended by adding to a pass after increased. Section 41 amended 12 Subsection 41(3) is amended by striking out certificate and substituting letter. Section 42 amended 13 Subsection 42(3) is amended by striking out certificate and substituting letter. New section Section 46 is repealed and the following substituted: Application form 46 All applications required pursuant to these regulations must be made in the form provided by the commission or in a form acceptable to the commission.

10 910 THE SASKATCHEWAN GAZETTE, DECEMBER 13, 2013 New section Section 58 is repealed and the following substituted: Crane and hoist operator trade 58(1) In this section, trade means the trade designated in accordance with Part II as crane and hoist operator trade, and includes the operation of any mechanical device or structure: (a) that incorporates a power-driven drum and wire rope that is used primarily for raising, lowering or moving material or equipment; (b) that is equipped with a boom capable of moving in the vertical and horizontal planes; (c) that is mounted on a base or chassis intended to provide mobility; and (d) that may be crawler- or wheel-mounted. (2) In this section: (a) boom truck operator A sub-trade means the sub-trade recognized pursuant to subsection (7) as the boom truck operator A sub-trade and includes, with respect to boom trucks including boom trucks over 15.5 tons, the maintenance and operation of any device that: (i) is mounted on a turret; (ii) is supported to provide mobility; (iii) incorporates a power-driven drum and wire rope that is used primarily for raising, lowering or moving material or equipment; (iv) is equipped with: (A) a boom capable of moving in the vertical and horizontal planes; or (B) a telescoping or articulating boom; (b) boom truck operator B sub-trade means the sub-trade recognized pursuant to subsection (7) as the boom truck operator B sub-trade and includes, with respect to boom trucks up to and including 15.5 tons, the maintenance and operation of any device that: (i) is mounted on a turret; (ii) is supported to provide mobility; (iii) incorporates a power-driven drum and wire rope that is used primarily for raising, lowering or moving material or equipment; and

11 THE SASKATCHEWAN GAZETTE, DECEMBER 13, (iv) is equipped with: (A) a boom capable of moving in the vertical and horizontal planes; or (B) a telescoping or articulating boom; (c) lattice boom crane operator sub-trade means the sub-trade recognized pursuant to subsection (7) as the lattice boom crane operator sub-trade and includes the maintaining and operating of any mechanical device or structure incorporating a power-driven drum and wire rope used for raising, lowering or moving material, which is equipped with a boom capable of moving in the vertical and horizontal planes and either crawler- or wheel-mounted on a base or chassis to provide mobility. (3) This section applies to employers, tradespersons, journeypersons, apprentices and any other person in the trade or in one of the sub-trades defined in subsection (2). (4) No person is eligible to enter into an apprenticeship program in the trade unless that person has educational qualifications, skills and aptitude that are required to complete the apprenticeship program successfully in the opinion of the commission. (5) A term of apprenticeship in the trade consists of three apprenticeship years operating lattice boom and hydraulic cranes of which a minimum of 1.0 apprenticeship year must be operating either lattice boom or hydraulic cranes. (6) Each apprenticeship year: (a) subject to clause (b), in the trade requires 1,500 hours of training that: (i) includes on-the-job training; and (ii) may include technical training; (b) in the boom-truck operator B sub-trade requires 1,000 hours of training that: (i) includes on-the-job training; and (ii) may include technical training. (7) The following are sub-trades of the trade: (a) lattice boom crane operator; (b) boom truck operator A ; (c) boom truck operator B. (8) A term of apprenticeship in the lattice boom crane operator sub-trade consists of three apprenticeship years.

12 912 THE SASKATCHEWAN GAZETTE, DECEMBER 13, 2013 (9) The term of apprenticeship is two apprenticeship years in: (a) the boom truck operator A sub-trade; or (b) the boom truck operator B sub-trade. (10) A holder of proficiency certificates in both the lattice boom crane operator sub-trade and the hydraulic crane operator trade or a holder of a proficiency certificate in the lattice boom crane operator sub-trade and a journeyperson certificate in the hydraulic crane operator trade is eligible to write the interprovincial standards examination in the trade, if that person: (a) applies on the form provided by the commission; (b) surrenders both certificates to the commission when he or she passes the examination; and (c) pays any fee required by the commission. (11) Notwithstanding subsection 26(3), in order to be eligible to write the journeyperson trade examination in the trade, a tradesperson who does not hold proficiency certificates in the required trade and sub-trade must satisfy the commission he or she has worked in the trade for an aggregate of not less than 4.5 years, of which: (a) at least 1.5 years are in the hydraulic crane operator trade and at least 1.5 years are in the lattice boom crane operator sub-trade, and the remaining 1.5 years may be served in either the hydraulic crane operator trade or the lattice boom crane operator sub-trade; and (b) not less than two years are to be in: (i) the hydraulic crane operator trade if the tradesperson has three years or more in the lattice boom crane operator sub-trade; or (ii) the lattice boom crane operator sub-trade if the tradesperson has three years or more in the hydraulic crane operator trade. Section 68 amended 16 Subsection 68(1) is amended by striking out mechanic and substituting technician. New section The following section is added after section 69: Hydraulic crane operator trade 69.1(1) In this section, trade means the trade designated in accordance with Part II as hydraulic crane operator trade and includes the maintaining and operating of any hydraulically-driven hoisting device or structure incorporating a power-driven drum and wire rope used for raising, lowering or moving material, that is equipped with a boom capable of moving in the vertical and horizontal planes and either crawler- or wheel-mounted on a base or chassis to provide mobility.

13 THE SASKATCHEWAN GAZETTE, DECEMBER 13, (2) This section applies to employers, tradespersons, journeypersons, apprentices and any other person in the trade. (3) No person is eligible to enter into an apprenticeship program in the trade unless that person has educational qualifications, skills and aptitude that are required to complete the apprenticeship program successfully in the opinion of the commission. (4) The term of apprenticeship in the trade consists of 2.5 apprenticeship years. (5) Each apprenticeship year in the trade requires a total of 1,500 hours of training that: (a) (b) includes on-the-job training; and may include technical training. Section 73 amended 18(1) Subsection 73(4) is amended by striking out three and substituting two. (2) Subsection 73(5) is amended in the portion preceding clause (a) by striking out 1,800 and substituting 1,500. New section The following section is added after section 91: Tower crane operator trade 91.1(1) In this section, trade means the trade designated in accordance with Part II as tower crane operator trade and includes the maintaining and operating of any mechanical device or structure incorporating a power-driven drum, boom and wire rope used for raising, lowering and moving material, and utilizing a vertical mast or tower and jib, which may be of the travelling, fixed or climbing type. (2) This section applies to employers, tradespersons, journeypersons, apprentices and any other person in the trade. (3) No person is eligible to enter into an apprenticeship program in the trade unless that person has educational qualifications, skills and aptitude that are required to complete the apprenticeship program successfully in the opinion of the commission. (4) The term of apprenticeship in the trade consists of 2.5 apprenticeship years. (5) Each apprenticeship year in the trade requires a total of 1,500 hours of training that: (a) (b) includes on-the-job training; and may include technical training.
