1 ORDINANCE NO An ordinance changing the zoning classification on the following property: BEING Lots 12, 13, 14, and 15 in City Block A/697 and Lot 13 in City Block B/698; fronting approximately 450 feet on the northeast line of Beacon Street; fronting approximately 100 feet on the southeast line of Columbia Avenue; fronting approximately 50 feet on the northwest line of Alton Avenue: and containing approximately acres, from a CR Community Retail District and a D(A) Duplex District to Planned Development District No. 901 with retention of Historic Overlay District No. 128 (Junius Heights): amending Chapter 51 P, Dallas Development Code: Planned Development District Regulations, of the Dallas City Code by creating a new Article 901; establishing use regulations and development standards for this planned development district: providing a penalty not to exceed S2,000; providing a saving clause: proiding a severability clause; and providing an effective date. WHEREAS. the city plan commission and the city council, in accordance with the Charter of the City of Dallas, the state law, and the ordinances of the City of Dallas, have given the required notices and have held the required public hearings regarding the rczoning of the property described in this ordinance; and WHEREAS. the city council duds that it is in the public interest to establish this planned development distn ct; sow, Therefore, BE it ORDAINED BY THE CITY COUNCIL OF THE CITY OF DALLAS:

2 SECTION 1. 92t That the toning classification is changed from a CR Community Retail District and a D() Duplex Dictrict to Planned Develorment District No. 901 with retention of Historic Oer1ay District No. 128 on the tbllowing propcity ( the Property ): BEING Lots and 15 in City Block A697 and Lot 13 in City Block 8698: fronting approximately 450 fret on the northeast line of Beacon Street: fronting approximately 100 feet on the southeast line of Columbia Avenue: fronting approcimately 50 feet on the northwest line of Alton Avenue: and containing approximately acres. SECTION 2. That Chapter SIP. Dallas Development Code: Planned Development District Regulations. of the Dallas City Code is amended by adding a new Article 901 to read as follows: ARTICLE 901. PD 901. 3 SEC. 51 P , DEFINITIONS AND INTERPRETATIONS (a Unless otherwise stated. the detinitions and interpretations in Chapter 51 A apply to this article. In this district: (1) BED AND BREAKFAST means a lodging facility containing fifteen or fewer guest rooms and one kitchen. This use may not have kitchens in the guest room. Amenities such as maids, laundry, concierge, meeting rooms. exercise rooms, pool, and business services (fax, Internet, voic , courier, etc.) and food and beverage service may only be provided to registered guests. (2) ORIGINAL STRUCTURE means a building that was constructed on the property before January 1, (b) Unless othenvise stated, all references to articles, divisions, or sections in this article are to articles, divisions, or sections in Chapter 51A. (c) This district is considered to be a residential zoning district. SEC. SIP EXHIBITS. (b) Landscaping for surface parking must be provided in accordance with the developmentlandscape plan (Exhibit 901 A). (c) Plants must be maintained in a healthy, growing condition. SEC. 51P SIGNS. Signs must comply with the provisions for non-business zoning districts in Article VII. SEC. 51P ADDITIONAL PROVISIONS. (a) In general. (1) The Property must be properly maintained in a state of good repair and neat appearance (2) De elopment and use of the Property must comply with all federal and state laws and regulations, and with all ordinances, rules, and regulations of the city. 8 (b) The building official shall not issue a building permit to authorize work, or a certificate of occupancy to authorize the operation of a use, until there has been full compliance with this article, the Dallas Development Code, the construction codes, and all other ordinances, rules, and regulations of the city. SECTION 3. That, pursuant to Section 51A of Chapter 51A of the Dallas City Code. as amended, the property description in Section 1 of this ordinance shall be construed as including the area to the centerline of all adjacent streets and alleys. SECTION 4. That development of this district must comply with the full-scale version of Exhibit 9OlA (development/landscape plan) attached to this ordinance. A reduced-sized version of this plan shall be provided in Chapter 51 P. Permits shall be issued based on information provided on the full-scale version of the plan. SECTION 5. That the city attorney is authorized to insert the enrolled number of this ordinance in the legislative history section of Article 901 in Chapter 51P. SECTION 6. That a person who vo1ates a provision of this ordinance, upon conviction. is punishable by a fine not to exceed S SECTION 7. That the zoning ordinances of the City of Dallas and Chapter 51P of the Dallas City Code, as amended, shall remain in full force and effect, save and except as amended by this ordinance. I J(I\.
