Scope All government agencies within the State of West Virginia, including all state agencies and local public bodies, cities, counties and public schools and institutions of higher education are authorized to purchase products under the terms and conditions of this agreement 2. Participation Use of specific WSCAINASPO cooperative contract by state agencies, political subdivisions and other entities (including cooperatives) authorized by an individual state's statutes to use state contracts are subject to the approval of the respective State Chief Procurement Official. Issues of interpretation and eligibility for participation are solely within the authority of the State Chief Procurement Official. 3. Changes: The following items under the Master Price Agreement (MPA) are hereby changed: A. WV-96, attached hereto as Exhibit A 8. Reporting All contractors will be required to process monthly usage reports electronically to the Purchasing Division. The monthly reports shall be submitted by the last business day of the month for the previous month's actual sales. Monthly reports are required even if no activity has occurred. The monthly report shall include, but is not limited to, the following Data Elements: 1) Agency Purchase Order Number: 2) Agency Purchase Order Date: (mm/dd/yyyy)

Continuation of Participation from WSCAINASPO PC Contracts : To the extent permitted by the laws and rules of the state in which an individual participating entity is located, valid participating addenda for the WSCAINASPO PC Contracts are hereby extended to include participation in the WSCAINASPO PC Contracts under the same terms and conditions in the current participating addendum.

Contractor will provide any required report to the ordering entity as required by law. The Contractor, as it relates to purchases under this contract, is not a subcontractor or subgrantee, but simply a provider of goods and related services. This Addendum and the Master Price Agreement together with its exhibits, set forth the entire agreement between the parties with respect to the subject matter of all previous communications, representations or agreements, whether oral or written, with respect to the subject matter hereof. Terms and conditions inconsistent with, contrary or in addition to the terms and conditions of this Addendum and the Master Price Agreement, together with its exhibits, shall not be added to or incorporated into this Addendum or the Master Price Agreement and its exhibits, by any subsequent purchase order or otherwise, and any such attempts to add or incorporate such terms and conditions are hereby rejected. The terms and conditions of this Addendum and the Master Price Agreement and its exhibits shall prevail and govern in the case of any such inconsistent or additional terms. 7 RFQ No. _ STATE OF WEST VIRGINIA Purchasing Division PURCHASING AFFIDAVIT VENDOR OWING A DEBT TO THE STATE: West Virginia Code 5A-3-10a provides that: No contract or renewal of any contract may be awarded by the state or any of its political subdivisions to any vendor or prospective vendor when the vendor or prospective vendor or a related party to the vendor or prospective vendor is a debtor and the debt owed is an amount greater than one thousand dollars in the aggregate. PUBLIC IMPROVEMENT CONTRACTS & DRUG-FREE WORKPLACE ACT: If this is a solicitation for a public improvement construction contract, the vendor, by its signature below, affirms that it has a written plan for a drug-free workplace policy in compliance with Article 1D, Chapter 21 of the West Virginia Code.
