3 I. DEFINITIONS A. Bail - the amount of money set by the court which is required to be obligated and secured as provided by law for the release of a person in custody in order that they will appear before the court in which their appearance may be required and that they will comply with such conditions as set forth in the bail bond (725 ILCS 5/102-6). B. Bail Bond - an undertaking secured by bail entered into by a person in custody by which they bind themselves to comply with such conditions which are set forth therein (725 ILCS 5/102-7). C. Cash or Cash Bail - United States currency; travelers checks, or a money order, for certain truck offenses, issued by major banks or express companies which, alone or in combination with currency, total the exact amount required as bail; and any other methods of payment approved by the Department for bail bond (Supreme Court Rule 501). D. Bond Certificates - bail security documents which also guarantee payment of judgments for fines, penalties, and costs, not to exceed $160 for any single offense or $500 for multiple offenses arising out of the same occurrence or not to exceed $500 for any single truck offense (truck bond), issued or guaranteed by companies or membership associations authorized by rule of the Circuit Court of Cook County (Supreme Court Rule 501). E. Conservation Offense - any case charging a violation of: 1. Fish and Aquatic Life Code, as amended, 515 ILCS 5/1-1 et seq. 2. Wildlife Code, as amended, 520 ILCS 5/1.1 et seq. 3. Boat Registration and Safety Act, as amended, 625 ILCS 45/1-1 et seq. 4. Park District Code, as amended, 70 ILCS 1205/1-1 et seq. 5. Chicago Park District Act, as amended, 70 ILCS 1505/0.01 et seq. 6. State Parks Act, as amended, 20 ILCS 835/0.01 et seq. 7. State Forest Act, as amended, 525 ILCS 40/0.01 et seq. 8. F. Felony - any offense for which a sentence to death or a term of imprisonment in a penitentiary for one year or more is provided (720 ILCS 5/2-7). G. Judge - a person who is invested by law with the power to perform judicial functions and includes a court when a particular context so requires (725 ILCS 5/102-13). H. Misdemeanor - any offense for which a sentence to a term of imprisonment in other than a penitentiary for less than one year may be imposed (720 ILCS 5/2-11). I. Ordinance Violation - violation of a municipal corporation legislative body enactment for which such violation may provide a fine of up to $750 and/or a term of imprisonment in a penal institution other than a penitentiary not to exceed 6 months (65 ILCS 5/1-2-1). II. BAILABLE OFFENSES All persons shall be bailable before conviction, except for capital offenses or offenses for which a sentence of life imprisonment may be imposed as a consequence of conviction where the proof is evident or the presumption great that the person is guilty of the offense. A person seeking release on bail who is charged with a capital offense or an offense for which a sentence of life imprisonment may be imposed has the burden of demonstrating that the proof of their guilt is not evident and the presumption is not great (725 ILCS 5/110-4). III. TAKING OF BAIL BY PEACE OFFICERS When bail has been set by a judicial officer or by rule of the court for a particular offense or offender, any sheriff or other peace officer may take bail in accordance with the provisions of 725 ILCS 5/110-7 or 725 ILCS 5/110-8 of this Code and release the offender to appear in accordance with the conditions of the bail bond. The officer shall give a receipt to the offender for the bail so taken and within a reasonable time deposit such bail with the clerk of the court having jurisdiction of the offense (725 ILCS 5/110-9). IV. PERSONS PROHIBITED FROM FURNISHING BAIL SECURITY No attorney at law practicing in this State, and no official authorized to admit another to bail or to accept bail shall furnish any part of any security for bail in any criminal action or any proceeding nor shall such person act as a surety for any accused admitted to bail (725 ILCS 5/110-13). V. MISDEMEANOR ARREST WITHOUT WARRANT When a person is arrested without a warrant and charged with a misdemeanor only, the offender may be let to bail by: A. depositing 10% of the bail bond set; in no case will less than $120 be taken ("D" Book). B. depositing with the desk sergeant the amount of the cash bail ("C" Book). C. signing an individual recognizance bond if the conditions permit ("l" Book). VI. FELONY ARREST WITHOUT WARRANT When a person is arrested without a warrant and charged with a felony, the offender may be let to bail only when a judge has set the bail. VII. ARREST ON WARRANT (ORDINANCE, MISDEMEANOR, OR FELONY) When a person is arrested on a warrant (amount of bail is listed on all warrants), the offender may be let to bail by: A. depositing 10% of the amount of bail stated on the warrant with the desk sergeant in accordance with 725 ILCS 5/110-7 ("D" Book). A minimum of $120 will be taken. Therefore, bail of $500 would require a deposit of $120. B. depositing with the desk sergeant, in cash, the full amount of the bail stated on the warrant ("C" Book). 5 VIII. BAIL SET BY COURT, STATUTE, ORDINANCE, OR RULE A. Persons in Custody for Felony Offenses Bail in felony cases will be set by a judge in: 1. Central Bond Court. 2. Preliminary Hearing Court. 3. Weekend/Holiday Court. 4. place of detention or other place. A judge may set bail for any offense and the offender may be let to bail with a "C", "D", or "I" Bond. Regardless of the type of bond used, the judge must sign the appropriate bond on the space provided. The judge must have jurisdiction within the Circuit Court of Cook County. B. Persons in Custody for Non-Traffic Misdemeanor, Ordinance, and Petty Offense Violations 1. Unless otherwise provided by statute, ordinance, or rule, the bail for any: a. Class "A" or "B" misdemeanor shall be $1,500 (with the exception of animal abuse or animal fighting). The 10% provision applies with a minimum cash bail amount of $150. Bail Bond Manual (9/10) 3 NOTE: If an arrestee is charged with a misdemeanor offense of animal abuse or animal fighting and refuses to relinquish possession of the involved animal(s) by signing the appropriate box on the Animal Care and Control Inventory Form (ACC ), the arrestee will not be allowed to post bond nor be given an "I" Bond. The arrestee will be sent to the first court call following the arrest for the court to set bond. b. Class "C" misdemeanor shall be $1,200. The 10% provision applies with a minimum cash bail amount of $120. c. Petty offense or ordinance violation shall be $ Unless otherwise provided by Supreme Court Rule 527, the bail for conservation offenses shall be $120 cash. C. Persons in Custody for Traffic Offenses 1. Any person issued a Personal Service Citation which charges a violation of any statute or ordinance relating to the regulation of traffic will be required to post one or more of the following forms of bail, when applicable: a. a valid Illinois driver's license. (Only a valid Illinois driver's license will be accepted as bail. A judicial driving permit, restricted driving permit, probationary license, receipt for application for driver's license, instructional permit, or temporary license will not be accepted as bail.) b. a bond certificate. c. CTA Memorandum Card (CTA 3283). d. cash bond. e. a Promise to Comply [only available to residents of states other than Illinois which are members of the Nonresident Violators Compact (NRVC)]. (See the Department directive entitled "Bond Procedures - Nonresident Violator Compact.") f. Individual Bond. g. a money order for certain truck offenses. (See Appendix B, Item VI-B)

6 2. Unless otherwise provided by statute, ordinance, or rule, the bail for any traffic offense shall be $120. D. Non-Felony Arrestee Unable to Post Bail Whenever any person 17 years of age or older is unable to post bond for any non-felony offense, the watch commander at the unit of detention may authorize the release of such person by an Individual Bond ("I" Book) in accordance with the provisions of the Department directive entitled "Bond Procedures." IX. BAIL BOND BOOKS AND THEIR PREPARATION A. Using Bail Bond Books Desk personnel will use the bail bond books in consecutive numerical order with the lowest numbered series being issued first. Enter "0" and the district number as the using agency number in the "Origin of Bond" Box (e.g., 001 for 1st District, 021 for 21st District). B. Voiding a Bail Bond Whenever a bail bond is spoiled in any way, print "VOID" in large letters through the bond number and diagonally across the body of the bond. State the reason for voiding the bail bond on the body of the bond formset (i.e., wrong form used, amount of money offered not sufficient, re-written on "I" bond, etc.). Void the first copy of the formset in a manner which ensures that all copies are voided. Retain the record copy of the formset in the bond book and forward the other copies with the nonvoided bonds and funds being submitted for deposit. C. Condition of Bond Department members will not make entries in that section of bail bond forms pertaining to conditions of bond. Four conditions of bond, pre-printed on each bail bond form, are established by statute for all persons released on bail or recognizance, all other conditions will be imposed only by the court, when necessary (725 ILCS 5/110-10). D. "C" Bond Book 1. When to use the "C" Bond Book The "C" Bond Book is used only when the defendant deposits 100% cash as bail. Should bail be set by a judge or by rule at $120 or less, a cash bond for the exact amount will be written utilizing the "C" Bond Book. 2. Preparation of the Form At the top of the form in the box "Bail Set by," one of two items is to be completed. If bail is made in misdemeanor or ordinance cases prior to the defendant being taken before a judge, "Rule of the Illinois Supreme Court" will be checked. If bail is set by a judge on a complaint or on a warrant, the lower portion will be completed and the name of the judge inserted. If a judge is present at the place of detention and sets bail, the judge will sign their name on the line provided, in addition to the desk sergeant's signature. 7 3. Distribution E. "D" Bond Book The distribution of copies is as stated at the bottom of the bond formset. 1. When to use the "D" Bond Book The "D" Bond Book is used when the amount of bail has been established by rule, or fixed by a judge and when the defendant deposits 10% in cash. Only the defendant himself can take advantage of the 10% provision and no other person can act as surety by depositing 10% of the bail amount for the defendant. The 10% bond must be written only in the defendant's name. 2. Preparation of the Form The preparation of this form is self-explanatory. If a judge is present at the place of detention and sets bail, the judge will sign their name on the line provided in addition to the desk sergeant's signature. 3. Distribution of Copies F. "I" Bond Book The distribution of copies is as stated at the bottom of the bond formset. 1. When to use the "I" Bond Book a. Watch commanders may authorize the use of the "I" Bond for any nonfelony offense in accordance with the Department directive entitled "Bond Procedures." b. When the arrestee is under 17 years of age, the arrestee will be released by executing the "I" Bond in the arrestee's name without surety. The amount of the "I" Bond will be set for the exact amount of the cash bail requirement. c. The only other time the "I" Bond Book will be used is if a judge sets an "I" Bond. 2. Preparation of Form The preparation of this form is self-explanatory. 3. Distribution of Copies The distribution of copies is as stated at the bottom of the formset, except that the first formset page (pink copy) will be forwarded to the Bond Court in a separate pink envelope. X. AVAILABILITY OF BAIL BOND BOOKS A. All districts and units which let arrestees to bail will keep on hand at least three unused "C", "D", and "I" Bond Books in addition to the books of each series actually in use. The watch commander on the 2nd watch will ensure that there is an adequate supply of Bail Bond Books on hand to meet the normal anticipated needs of the district or unit concerned, based on previous experience. However, the minimum of each series of books as stated above will be maintained. C. Bail Bond Books are available at the Circuit Court Supply Room, 2323 South Rockwell, Room 111 ( ), Monday through Friday from 0700 to 1500 hours, excluding those days when the court and the Daley Center are officially closed. XI. TRANSFER OF BAIL BOND BOOKS A. Under no circumstances will Bail Bond Books be transferred from one district or unit to another district or unit. B. Should an unforeseen emergency present itself where a district or unit does not have an adequate supply of bond forms available during those hours or on those days when the Bond Department at the Richard J. Daley Center is closed, the Assistant Superintendent, Operations, will be contacted and the district or unit will send a messenger to this office to obtain a Bail Bond Book for the emergency. Since Bail Bond Books of the different types and series maintained in this office will be limited, it is imperative that districts and units foresee their actual needs and maintain an adequate supply. XII. OBTAINING BAIL BOND BOOKS Officers who have been authorized to obtain Bail Bond Books from the Deputy Clerk at the Office of the Clerk of the Circuit Court of Cook County are to: A. sign the "Receipt for Bail Bonds" after inspecting the "C", "D", and "I" Bond number series on the receipt to ensure that they correspond to the numbers on the book received. B. inspect the receipt and book covers to ensure that the Deputy Clerk has entered the Municipal District number ("1" which represents the First Municipal District) succeeded by the three-digit unit number (001 for the 1st District, 023 for the 23rd District, etc.). C. accept a copy of the "Receipt for Bail Bonds" and a copy of the City of Chicago Material Requisition form (CP-GS-6) and return both along with the Bail Bond Books, to the district or unit secretary. 9 APPENDIX A BAIL BOND SCHEDULE FOR CRIMINAL OFFENSES (Supreme Court Rule 528) I. Persons in Custody for Felony Offenses Bail in felony cases will be set by a judge in: A. Central Bond Court. B. Domestic Violence offense (Domestic Battery, Violation of Order of Protection, and any similar violation of a local ordinance) is not established under the Supreme Court Rules. Bail for these offenses shall be set by the court pursuant to statute. III. IV. A judge may require bail, for any offense, equal to 10% of the bond, but in no event shall such sum deposited as bail be less than $25.
