A resolution authorizing the Parish President to execute an application form to the Louisiana Commission on Law Enforcement and the Administration of Criminal Justice CVA Grant for the Houma Police Department of the Terrebonne Parish Consolidated Government; and to address other matters relative thereto. WHEREAS, the Houma Police Department of the Terrebonne Parish Consolidated Government has been approved to implement an application for a grant from the Louisiana Commission on Law Enforcement and the Administration of Criminal Justice Fiscal Year CVA Fund (2877) in the amount of Forty three Thousand Two Hundred and forty four dollars ($43,244.00) for the Terrebonne Parish Consolidated Government. The Fiscal Year CVA Fund will provide grant funding to improve the effectiveness of our Police Officers by providing them with overtime to outreach towards victims, WHEREAS, the Parish Administrative staff and the Parish Finance Department will oversee the application process in the implementation and meeting all the requirements set forth by the Louisiana Commission on Law Enforcement and the Administration of Criminal Justice and, NOW, THEREFORE BE IT RESOLVED, that the Terrebonne Parish Council on behalf of the Terrebonne Parish Consolidated Government, authorizes the Parish President to execute any and all necessary documents to implement the grant from the Louisiana Commission on Law Enforcement and the Administration of Criminal Justice and to address other matters relative thereto.

10 5 Program Description a. Project Summary and Strategy: (Briefly describe the project - how does the project addresses the objectives of the NOFO and how will the project be implemented.) This program is designed to assist victims of crimes from any suffering both emotionally and physically, by the police agencies responding quickly and efficiently, then taking necessary action to ensure the safety of the victim. b. Goals: (Briefly describe the proposed goals for this project.) Goal 1: The evaluation committee will meet once a month to review victims of violent crimes Goal 2: The advocates will make face to face contact with 250 victims of violent crimes and provide the necessary referrals for services c. Objectives: (Briefly describe two measurable objectives per goal, of which one must be outcome-based, for this project. Please use numbers rather than percentages. ) The committee will review 250 victims of violent crimes to evaluate their progress. 2. The members will make an outreach to 3 outside agencies in the hopes to provide improved services to the victims of violent crimes. The committee will make face to face contact with 250 victims to offer victim services such as restraining orders, educational tapes, and information on programs that might be able to assist them. With the list of face to face followup contact on 250 victims of violent crimes, our department will monitor their utilization of referral source and collecting evaluations forms provided to victims at the conclusion of their case. d Organizational Capacity and Capabilities: (Briefly describe organization, partnerships, and ability to perform the project. ) The Houma Police Department's victim advocates will work after their regular working hours to contact victims of crime. 17 POLICY, PROCEDURE, & LEGAL COMMITTEE JANUARY 25, 2016 The Chairman, Darrin Guidry, Sr., called the Policy, Procedure, & Legal Committee meeting to order at 7:15 p. m. in the Terrebonne Parish Council Meeting Room with an Invocation offered by Committee member A. Marmande and the Pledge of Allegiance led by Committee member G. Michel. Upon roll call, Committee Members recorded as present were: A. Williams, G. Michel, S. Dryden, C. Duplantis-Prather, D. W. Guidry, Sr., A. Marmande, D. J. Guidry, S. Trosclair and J. Navy. A quorum was declared present. Ms. A. Williams moved, seconded by Mr. D. J. Guidry and Ms. C. Duplantis-Prather, THAT, the Policy, Procedure, & Legal Committee approve the annual fire dispatch agreement the Terrebonne Parish Communications District and TPCG City of Houma Fire Department for the fire department cost of fire dispatching services. Navy explained that the he would like to move forward amending the Nuisance Abatement ordinance relating to slum, crime, dogs, juvenile delinquency etc.; noting that the legal department would also like to incorporate the new state redemption legislation period for blighted housing (18 month period), to help enforce these changes. Parish Attorney C. Alcock explained that they are in the process of expanding the parish code s definition of blighted housing to include delinquency and crime; noting that in 2015, the State of Louisiana adopted legislation that states if you have a piece of property that has been declared blighted or abandoned, it can go up for tax sale and only have an 18 month redemptive period as opposed to the previous three year redemptive period. Ms. Alcock stated that the property than can become a part of the parish s adjudicated property. She stated that an enforcement procedure needs to be addressed and suggested that it comes back to the Committee with an expansion of the abandoned or blighted property definition to include juvenile delinquency and crime as well as an enforcement procedure. 19 OFFERED BY: SECONDED BY: ORDINANCE NO. AN ORDINANCE TO AMEND CHAPTER 14. NUISANCE ABATEMENT TO PROVIDE FOR THE DEFINITION, DECLARATION AND ABATEMENT OF BLIGHTED PROPERTY; AND TO PROVIDE FOR RELATED MATTERS WHEREAS, the Terrebonne Parish Council, on behalf of the Terrebonne Parish Consolidated Government, desires to address the health, safety and welfare issues created by blighted property in Terrebonne Parish; and, WHEREAS, pursuant to statewide election on November 4, 2014, made effective on January 1, 2015, the Constitution of the State of Louisiana established at Article VII, 25(B) that vacant, residential or commercial property sold at tax sale which has been declared blighted, as defined by R.S. 33:1374 (B) (1) shall be redeemable for eighteen months after the date of recordation of the tax sale by payment rather than the customary three year redemption period; and, WHEREAS, the Terrebonne Parish Council, on behalf of Terrebonne Parish Consolidated Government, desires to create a procedure to declare property blighted within in its nuisance abatement chapter; and NOW, THEREFORE, BE IT ORDAINED by the Terrebonne Parish Council on behalf of Terrebonne Parish Consolidated Government, that Chapter 14, Nuisance Abatement of the Terrebonne Parish Code, be amended to read as follows: SECTION I Using strikethrough to indicate deletions and underling to indicate additions, Chapter 14 shall be and is hereby amended as follows: Section of the Terrebonne Parish Code shall be amended as follows: For the purposes of this chapter, the following terms, phrases, words and derivations shall have the meaning given herein, unless it is apparent from the context that a different meaning is intended: Abandoned/junked vehicle. Any motor vehicle which is intended to be selfpropelled and designed to travel along the ground the condition of which is as follows: (1) Wrecked, dismantled, partially dismantled, inoperative, abandoned, or discarded, the condition of the vehicle being such that it is considered to be a total loss. The term "total loss" shall mean (1) that the cost to repair a damaged or dismantled vehicle exceeds the junk or salvage value of the said vehicle, as determined by any recognized national appraisal book and/or a qualified appraiser of motor vehicles; and (2) the vehicle has been left unattended for at least forty-eight (48) consecutive hours on public property or at least seven (7) days on private property in such condition by reason of deterioration of the manner in which it is maintained that it is so damaged or dismantled as to be unusable as a self-propelled vehicle capable of traveling along the ground.
20 (2) The definition of abandoned/junked vehicle does not include any antique vehicle as defined in this section provided that the antique vehicle and its storage area are maintained in such a manner that they do not constitute a health, safety or fire hazard. Abandoned Property. The term abandoned property means property that is vacant or not lawfully occupied. The terms vacant or not lawfully occupied shall include but shall not be limited to any premises which are not actually occupied by its owner, lessee, or other invitee or if occupied, without utilities, and which has been left unsecured or inadequately secured from unauthorized entry to the extent that the premises could be entered and utilized by vagrants or other uninvited persons as a place of harborage or any premises which by reason of dilapidation, deterioration, state of disrepair, or other such status is otherwise detrimental to or endangers the public safety, health, or welfare and is hereby declared to be abandoned and to be a nuisance. Antique vehicle. The term "antique vehicle" means any motor vehicle which is twentyfive (25) years old or older, has not been materially modified or altered from the original manufacturer's specifications, is being collected, preserved, restored, operated, or maintained by a hobbyist because of its historic interest, and is registered with the Louisiana Office of Motor Vehicles as an antique motor vehicle. Blighted Property and/or area means commercial or residential property or areas, including lots, which are vacant, uninhabitable, and hazardous and because of their physical condition are considered hazardous to persons or property and as further identified and defined in Section XII of this Chapter are hereby declared blighted and declared to be a nuisance. Blighted area means An area which by reason of the presence of a substantial number of slum, deteriorated or deteriorating structures, predominance of defective or inadequate street layout, faulty lot layout in relation to size, adequacy, accessibility, or usefulness, abandoned or sunken vessels or other marine debris in any waterway, submergence of lots by water or other insanitary or unsafe conditions, wind damage, deterioration of site or other improvements, diversity of ownership, tax or special assessment delinquency exceeding the fair value of the land, defective or unusual conditions of title, or the existence of conditions which endanger life or property by fire and other causes, any combination of such factors, substantially impairs or arrests the sound growth of the parish, retards the provision of housing accommodations or constitutes an economic or social liability and is a menace to the public health, safety, morals, or welfare in its present condition and use. SECTION II Section XII of Chapter 14 Nuisance Abatement of the Terrebonne Parish Code Shall be enacted to read as follows: ARTICLE XII. BLIGHTED PROPERTY AND AREAS Section Blighted Property and/or Areas identified and prohibited as a nuisance a. Blighted Property and/or areas shall be defined as set out in Section and shall be further identified by any of the following non-exclusive conditions:
21 i. A property or area with zoning violations, multiple adjudicated properties, slum, deteriorated or deteriorating structures. ii. A property or area with structures which are to dilapidated, aged or obsolete; iii. A property or area with inadequate provision for ventilation, light, sanitation; iv. A property or area with inadequate open spaces, high density of population and overcrowding; v. A property or area with stray animal, rodent, insect and vermin infestation issues; vi. A property or area with a predominance of defective or inadequate street layout, faulty lot layout in relation to size, adequacy, accessibility, or usefulness; vii. A property or area conducive to juvenile delinquency, vagrancy, loitering and crime which include locations upon which drug selling, prostitution, crimes of violence and other offenses which may constitute a public nuisance or may affect the quality of life are ongoing; viii. A property or area with abandoned or sunken vessels or other marine debris in any waterway or submergence of lots by water; ix. A property or area with other unsanitary or unsafe conditions, or wind damage, deterioration of site or other improvements; x. A property or area with such diversity of ownership, tax or special assessment delinquency exceeding the fair value of the land including defective or unusual conditions of title; and xi. A property or area with the existence of conditions which endanger life or property by fire and other causes, are conducive to ill health, transmission of disease, infant mortality, or, any combination of such herein factors which substantially impairs or arrests the sound growth of the parish, retards the provision of housing accommodations or constitutes an economic or social liability and is a menace to the public health, safety, morals, or welfare in its present condition and use. b. Property and/or areas as identified herein and defined in Section are hereby declared to be blighted and a nuisance. It is the purpose of this article to provide for the safety, health, protection and general welfare of persons and property in the parish by requiring the blighted conditions to be addressed, removed and the property or area made safe, healthy and secure Abatement of blight (a) Inspection. Upon its own consideration or upon the complaint of any person, the department shall make an on-site inspection of the property or area and compile a written report citing the specific findings and recommendations in regard to abating blight conditions. The written report shall be accompanied by a photograph(s) of the property or area taken on or near in time to the day and the time of the initial on-site inspection, the department shall issue the nuisance warning to the owner in the manner provided for this this article. (b) Nuisance warning. The nuisance warning for the existence of a blighted property or area shall contain all applicable information, as specified in article X, as well as the following: (1) A description of the property or area
22 (2) A statement/listing of the particulars found in substantiation of the conditions which warrant the property or area to be classified as a blighted property or area; and (3) An order outlining the specific manner in which the property or area can be brought into compliance with the provisions of this chapter. (c ) Failure to comply with the nuisance warning shall result in any or all of the following: (1) Further abatement of the violation in the manner specified in article X of this chapter; (2) Referral of the violation to the proper law enforcement authorities for criminal investigation and prosecution. SECTION III Chapter 14. Nuisance Abatement, Article X. Administration and Enforcement, Section , Nuisance warnings (c) shall be amended as follows: (c) The warning shall contain information concerning the nature, date, time, and location of the alleged violation; the corrective action to be taken to abate the nuisance; and, with the following exceptions, the time period not to exceed five (5) days in which the corrective action is to be completed. The warning shall also contain the telephone number and the address of the department. Exceptions as to content and time for compliance: (1) In the case of nuisance warnings issued for the abatement of dilapidated and dangerous structures and the abatement of blighted property or areas the time period for compliance shall be a minimum of fifteen (15) days. (2) In the case of a nuisance warning issued for the abatement of a junked, abandoned, and inoperative vehicle located on public or private property, the warning shall contain the state vehicle license number, and the make of the vehicle. In those cases where the license plate is not visible or legible, the vehicle identification number, color, or any other identifying characteristics shall be so noted. The notice shall also note the total number of vehicles in violation. The time period for compliance of nuisance warnings issued for the abatement of a junked, abandoned, or inoperative vehicle located on public property shall be a minimum of ten (10) days. The time period for compliance of nuisance warnings issued for the abatement of a junked, abandoned, or inoperative vehicle located on private property shall be a minimum of ten (10) days. (3) In the case of nuisance warnings issued for the abatement of any sunken vessel, the registered owner or last known owner of any sunken vessel shall be notified in accordance with R.S. 34:843, as may be amended, such notice to contain a description of the sunken vessel, the location of the sunken vessel, a statement that the sunken vessel has been deemed either dangerous or abandoned, a list of criteria the owner must meet in order to comply with this chapter, and a deadline for compliance in accordance with R.S. 34:843. SECTION IV Any and all sections and subsections of Chapter 14, Nuisance Abatement not amended herein shall remain the same and in full force and effect.
23 SECTION V If any word, clause, phrase, section or other portion of this ordinance shall be declared null, void, invalid, illegal or unconstitutional, the remaining words, clauses, phrases, sections and other portions of this ordinance shall remain in full force and effect, the provisions of this ordinance being hereby declared to be severable. SECTION VI This ordinance shall become effective upon approval by the Parish President or as otherwise provided in Section of the Nuisance Abatement for a Consolidated Government for Terrebonne Parish, whichever occurs sooner.
